Abstract

Abstract: This study aims to examine Jabariyah theology through the framework of cognitive psychology and its impact on individual decision-making processes. Jabariyah theology asserts that all events occur solely by the absolute will of God, without human intervention, which has implications for the development of an external locus of control within the cognitive structure. This research employs a library research method, utilizing secondary data drawn from classical and contemporary literature, scholarly journals, academic articles, and scientific publications discussing the concept of Jabariyah and cognitive psychological theories. The analysis is conducted using a descriptive-qualitative approach to explore the relationship between theological doctrines and cognitive mechanisms in decision-making. The findings indicate that internalization of Jabariyah theology may lead to passive attitudes and a reliance on fate, which influence individual motivation and initiative in making decisions. However, variations in interpretation exist, with some individuals managing to integrate the Jabariyah concept with the principle of human effort (ikhtiar), thereby maintaining adaptive and dynamic decision-making. This study contributes to the interdisciplinary understanding between Islamic theology and cognitive psychology and opens opportunities for the development of new theories concerning the relationship between religious beliefs and human cognitive processes.

Abstract

Abstract

: This study examines the limitations of classical ushul fiqh epistemology in responding to legal challenges in the digital era. Traditional ushul fiqh, which is grounded in a textual-formalist and analogical logic approach, is considered inadequate in addressing the complexities of modern technology and society. In this context, two contemporary Muslim thinkers—Nasr Abu Zayd and Khaled Abou El Fadl—are analyzed as representatives of a new approach to Islamic law that emphasizes contextual and ethical interpretation. Nasr Abu Zayd highlights the importance of hermeneutics in interpreting religious texts, rejecting the notion of a singular, objective meaning and emphasizing the social and historical contexts of interpretation. Meanwhile, Khaled Abou El Fadl underscores the ethical and justice-oriented dimensions of ijtihad and Islamic legal production. Both thinkers offer a critique of authoritarian interpretation and propose a more inclusive, participatory, and relevant framework for engaging with contemporary digital legal issues such as AI-generated fatwas, crypto transactions, and personal data protection. Using a qualitative approach and textual analysis, this study concludes that a reconstruction of ushul fiqh epistemology is necessary— one that is based on a contextual-ethical perspective. These findings are crucial for developing an Islamic legal framework that is more responsive to digital realities and for opening methodological reform within contemporary Islamic studies.

Abstract

: This study aims to analyze the role of the fiqh legal maxim “الضرر يُزال” (harm must be eliminated) in responding to and addressing cases of domestic violence. This maxim is one of the kulliyyah (universal) principles in Islamic jurisprudence that holds a strategic position in resolving social issues, particularly those concerning the protection of individuals from harm and injustice. The research employs a library research approach by reviewing classical and contemporary literature related to fiqh legal maxims, Islamic family law, and studies on domestic violence from both legal and social perspectives. The findings indicate that domestic violence—whether physical, psychological, verbal, or economic—constitutes a form of ḍarar (harm) that must be eliminated according to Islamic legal principles. The maxim “الضرر يُزال” provides a normative foundation for intervention in domestic settings, whether by individuals, religious institutions, or the state, to protect victims and prevent further violence. Moreover, this maxim aligns with the objectives of Islamic law (maqāṣid al-syarī‘ah), particularly the preservation of life (ḥifẓ al-nafs) and dignity (ḥifẓ al-‘irḍ). This research recommends the reconstruction of Islamic family jurisprudence to be more empathetic, just, and responsive to social realities. Additionally, there is a need for synergy between Islamic legal thought, state law, and social movements to ensure that the principle of harm elimination is effectively applied in Muslim family life. Thus, the maxim “الضرر يُزال” should not only remain a theoretical concept but also function as an ethical and practical principle to foster harmonious, safe, and just families.

Abstract

This study aims to explore how students at State Islamic Higher Education Institutions (PTKIN) in Indonesia interpret the concept of religious moderation within their academic and social lives. Religious moderation is a strategic policy discourse promoted by the Ministry of Religious Affairs to cultivate tolerant, inclusive, and balanced religious attitudes amid growing symptoms of intolerance and radicalism. However, the meaning of this concept among students has not been thoroughly investigated from the perspective of their subjective experiences. Therefore, this research adopts a phenomenological qualitative approach to capture students’ understanding, interpretations, and lived experiences in responding to the institutionalized values of moderation. Data were collected through in-depth interviews, participatory observation, and document analysis involving students from diverse backgrounds at three PTKIN campuses in Indonesia. The findings reveal that students’ understanding of religious moderation is pluralistic and shaped by their educational backgrounds, affiliations with student organizations, and exposure to social media. There exists a tension between the normative idealism promoted in academic settings and the social realities of student life, which are often characterized by ideological polarization, resistance, and communal dynamics. While some students perceive moderation as a noble value worth embodying, others view it with skepticism, seeing it as a political tool of the state that may not genuinely reflect their lived needs and experiences. The study concludes that internalizing the values of religious moderation in PTKIN environments requires a more contextual, dialogical, and experience-based approach. These findings are expected to enrich the discourse on strengthening religious moderation in Islamic higher education and to serve as a reference for future policy evaluation and value-education strategies.
