Abstract

It is a fact that in human social life, both individuals and groups, there are often deviations from social norms, especially known as legal standards. Deviations from these legal standards are referred to as criminal acts in the general public. Crimes against human souls have increased in society in recent years. This study uses library and field research. The judge's consideration, also known as the ratio decidendi, is an argument or reason used by the judge as a basis for making a decision on a case. Before proving this legal consideration, the judge first collects the facts of the trial, which include conclusions from witnesses, defendants, and evidence.

Abstract

The development of information and communication technology (ICT) in recent decades has had a significant impact on various aspects of human life, one of which is the emergence of online gambling. The spread of online gambling advertisements through social media has become a worrying phenomenon, especially in Indonesia, where even though there are regulations governing online gambling, effective implementation of the law still faces obstacles. This study aims to analyze the effectiveness of law enforcement against online gambling advertising on social media, with a juridico-sociological approach. The results of the study indicate that the main challenges in law enforcement related to online gambling are the difficulty in identifying perpetrators, the use of fake accounts, and the limited capacity of law enforcement officers in handling technology-based cases. This study recommends increasing the capacity of officers, more massive socialization of the law to the public, and stricter supervision of social media to strengthen law enforcement and reduce the negative impacts of online gambling.

Abstract

Inti dari peradilan adalah untuk menilai apakah terdakwa benar-benar melakukan perbuatan yang memenuhi unsur-unsur pidana perjudian sebagai mana diatur dalam Pasal 303 dan 303 bis KUHP, seperti adanya unsur taruhan, keuntunan, dan perbuatan melawan hukum. Penelitian ini membahas Putusan Hakim Peradilan Pengadilan Negeri Jakarta Pusat Nomor 223/Pid.B/2024/PN-JKT yang dilaporkan oleh Aiptu ABDUL GOFAR, S.H yang sedang melakukan Operasi Tangkap Tangan di daerah Jl. Senen Jakarta Pusat. Penelitian ini akan menguraikan putusan hukum peradilan terhadapan terdakwa dan kesesuaian putusan hakim peradiklan dengan KUHP terhadap hukum pidana yang berlaku di Indonesia.Peradilan ini merupakan penelitian yuridis normatif, yang dilakukan melalui pendekatan Undang-Undang (statue approach) dan pendekatan kasus (case approach).Berdasarkan hasil penelitian dapat disimpulkan dasar pertimbangan hakim peradilan dalam Nomor Perkara 223/Pid.B/2024/PN-JKT yakni putusan hakim sebagai tesangka dengan barang bukti (1 (satu) buah papan berwarna hijau yang digunakan sebagai lapak judi pai kyu, 1 (satu) buah kotak batu domino digunakan untuk melakukan judi pai kyu, 6 (enam) buah dadu yang digunakan untuk melakukan judi pai kyu, 1 (satu) buah kotak cui yang digunakan untuk mengumpulkan uang untuk penyelenggara, dengan besaran 3?ri orang yang menang disetiap putarannya, 1 (satu) buah kotak yamca, dan 7 (tujuh) buah karet warna hitam). Dasar putusan tersebut telah sesuai dengan KUHP dan hukum acara pidana yang berlaku di Indonesia.

Abstract

Constitutional legal literacy serves as a fundamental pillar in shaping the character and civic awareness of adolescents. However, in practice, students’ understanding of constitutional values remains relatively low, especially amid increasingly complex social dynamics. This article aims to analyze the effectiveness of informational services within school-based Guidance and Counseling (GC) programs as an alternative approach to enhancing constitutional legal literacy in formal education settings. Employing a normative juridical method and qualitative analysis of relevant laws and academic literature, the study finds that informational services when delivered through communicative, contextual, and psycho-pedagogical approaches significantly improve students’ comprehension of their rights and responsibilities as citizens. The role of GC teachers as facilitators of legal literacy is crucial in bridging constitutional values with the realities of students’ everyday lives. Integrating informational services into GC programs strengthens the implementation of character education based on constitutional values in a holistic and sustainable manner. Thus, this non-instructional approach proves to be an effective strategy in fostering a legally literate, democratic, and socially responsible young generation.

Abstract

The advancement of artificial intelligence (AI) technology has posed serious challenges to the protection of human rights in Indonesia. Although Articles 28A to 28J of the 1945 Constitution guarantee constitutional rights such as privacy, justice, and non-discriminatory treatment, there is currently no specific and comprehensive regulation governing the use and governance of AI. This regulatory gap opens the door to systematic yet invisible civil rights violations, such as algorithmic discrimination, breaches of personal data, and the lack of legal accountability for decisions made by AI systems. This research employs a normative-juridical approach by examining national legal provisions and comparing them with international legal frameworks, such as the European Union’s Artificial Intelligence Act and Canada’s Artificial Intelligence and Data Act. The findings indicate that Indonesia is not yet normatively prepared to anticipate the impacts of AI on human rights. Therefore, there is an urgent need for AI regulation that is grounded in constitutional values, technological ethics, and the principle of accountability, to ensure that digital innovation does not erode citizens’ fundamental rights, but rather supports the rule of law and democracy in the era of technological transformation.

Abstract

Genocide is defined by the 1948 Genocide Convention as an attempt to destroy, in whole or in part, a group based on its national, ethnic, racial, or religious identity. The United Nations has a crucial duty and authority to address the crime of genocide. Therefore, the United Nations must conduct its operations in accordance with its charter. Conversely, preventing and addressing genocide using international legal instruments such as the Genocide Convention and the Rome Statute still faces significant challenges, such as political challenges and poor preventive measures. Genocide, defined as the systematic destruction of a particular ethnic, racial, or religious group, challenges law enforcement worldwide. According to Article 77 of the Rome Statute, those who commit genocide can be subject to imprisonment, fines, or confiscation. The enforcement of international law is considered fair because the International Court of Justice does not discriminate on the basis of the nation, ethnicity, or status of the perpetrators. It is hoped that this research will broaden our knowledge of the crime of genocide and provide policy recommendations to strengthen the enforcement of international justice and enhance protection for vulnerable groups.

Abstract

Human trafficking is a serious and complex transnational crime that requires strong international cooperation for effective prevention and eradication. Indonesia and Australia, as geographically proximate nations with close bilateral ties, have engaged in multiple forms of international legal cooperation to combat trafficking in persons (TIP). This study explores the forms of cooperation, policy implementation, and the challenges faced in practice. Employing a normative juridical approach and literature review, the study finds that while bilateral and multilateral cooperation—such as MoUs, participation in the Bali Process, and capacity-building initiatives like AIPJ—have been established, key obstacles remain, including differences in legal systems, weak coordination, and limited resources. The article concludes with strategic recommendations to enhance the effectiveness of international legal cooperation in combating TIP in the Asia-Pacific region.

Abstract

The advent of digital technology and the internet has opened up new opportunities, butalso brought serious legal challenges, particularly regarding transnational digital crime.Transnational cybercrime presents challenges for law enforcement because it involvesperpetrators located in various countries with different legal systems. This article aimsto analyze existing international regulations, focusing on the Budapest Convention, andthe challenges faced in implementing them in Indonesia. The research method used isa qualitative approach with an in-depth literature review of international and nationallegal documents and regulations related to digital crime. The results show that despitethe existence of international regulations, law enforcement against transnationalcybercrime in Indonesia still faces various obstacles. Improved cooperation betweencountries and regulatory reforms are needed to address this issue more effectively

The conflict between Palestine and Israel is a prolonged and ongoing conflict that continues to clam many lives, especially among civilians and children. This conflict has also been marked by numerous human right violations. These violations include killings, forced evictions, territorial blockades, and attacks on public facilities. Such actions have drawn international attention as they are considered violations of international law. Abstract

This article discusses the polemic of Gibran Rakabuming Raka's candidacy as Vice President of the Republic of Indonesia in the 2024 Election through an approach to constitutional law and constitutional ethics. The focus of the study is directed at Constitutional Court Decision No. 90/PUU-XXI/2023 which expands the interpretation of the age requirements for presidential/vice presidential candidates, allowing individuals under 40 years of age to run if they have previously served as regional head. Even though Gibran's candidacy is legally legal, this problem arose because of the close family relationship between the Constitutional Court Judge and the party who benefits, as well as the lack of national leadership experience of the candidate concerned. This research highlights the importance of considering the substantive appropriateness, moral integrity, and neutrality of the judiciary in maintaining the quality of democracy and the supremacy of the constitution. The results of the analysis show that the dominance of a formal legal approach without ethical considerations and leadership capacity can open up space for legal politicization and detrimental constitutional precedents.
