Abstract

This study aims to examine the construction of cyber risk mitigation regulations in digital technology investment contracts, analyze the role of contracts as instruments for risk allocation and control, and identify the legal implications of the absence or ambiguity of cyber risk mitigation clauses on the parties' responsibilities. This study uses a normative legal approach, utilizing legal interpretation, legal theory, and legal principles as a framework for understanding and assessing applicable norms. The results show that, first, the construction of cyber risk mitigation in digital investment contracts is based on the principles of freedom of contract, legal certainty, obligation responsibility, and good faith, which are realized through clear, measurable, and proportional contractual clauses. Second, contracts function effectively as instruments for cyber risk allocation and control, with risks allocated to the party with the greatest control, thus ensuring legal certainty and protecting the interests of the parties. Third, the absence or ambiguity of cyber risk mitigation clauses creates legal uncertainty, complicates proving responsibility, and increases the potential for disputes. Therefore, detailed and explicit clauses are a normative necessity to strengthen the accountability and effectiveness of contracts.

Abstract

This study aims to: 1) Analyze the legal regulations for digital economic transactions in Indonesia to ensure legal certainty for businesses and consumers, 2) Identify the main legal challenges that arise in the practice of digital economic transactions, and 3) Formulate effective legal solutions to overcome challenges in digital economic transactions. This type of research is normative legal research with a statutory, conceptual, and analytical approach. The legal materials for this study consist of primary, secondary, and tertiary legal materials. The analysis of legal materials uses legal interpretation, legal theory, and legal principles. The results of the study indicate that the legal regulations for digital economic transactions in Indonesia are available, but legal certainty for businesses and consumers still needs to be strengthened. The main challenges include consumer protection, data security, and the compatibility of traditional legal principles with the fast and cross-platform nature of digital transactions. Legal solutions include regulatory harmonization, the application of adaptive legal principles, and the utilization of digital contract principles to ensure that rights, obligations, and transaction security are effectively protected.

Abstract

This study aims to: 1) analyze the problems of underage marriage from the perspective of Islamic marriage law in Indonesia, 2) understand the relevance of the regulation of the marriage age limit in national law to the principles of Islamic law. The research method used is normative legal research with a statutory approach and a conceptual approach. The legal materials for this study consist of primary legal materials, secondary legal materials, and tertiary legal materials. The legal materials were analyzed using legal interpretation methods, legal theories, and legal principles. The results of the study indicate that although Islamic law does not specify a numerical marriage age limit, the principle of maturity reflected in the concepts of baligh and rusyd emphasizes the importance of individual readiness to carry out household responsibilities. In addition, the regulation of the marriage age limit in national law aims to provide legal certainty and protect prospective couples from the risks of early marriage. Thus, this regulation is essentially in line with the principle of maqāṣid al-syarī‘ah which emphasizes the benefit and protection of individuals in family life.

Abstract

This study aims to: 1) analyze the legal protection provided to patients in health practices, 2) explain the limits of medical responsibility that are the obligations of health workers, and their implications for safe and professional health care practices. This study is a normative legal study using a statutory approach and a conceptual approach. The legal materials consist of primary legal materials, secondary legal materials, and tertiary legal materials. The legal materials are analyzed using legal interpretation, legal theories, and legal principles. The results of the study show that the legal framework for patient protection in Indonesia, which is regulated through Act No. 17 of 2023 concerning Health and Regulation of the Minister of Health No. 11 of 2017 concerning Patient Safety, guarantees patients' rights to safety, information, and professional services, and emphasizes the obligations of medical workers according to professional and ethical standards. The limits of medical responsibility are regulated through Article 57 paragraph (1) of Act No. 17 of 2023, with the application of the principles of caution, justice, and legal certainty as guidelines. These provisions ensure that healthcare practices are safe, professional, and lawful, while minimizing the risk of malpractice and comprehensively protecting patient rights.
