Journal of Indonesian Islam (JIIS) publishes articles on Indonesian Islam from various perspectives, covering both literary and fieldwork studies. The journal puts emphasis on aspects related to Islamic studies in an Indonesian context, with special reference to culture, politics, law, society, eco­no­mics, history, and doctrines. Journal of Indonesian Islam always places Indonesian Islam in the central focus of academic inquiry, and invites any comprehensive observation of Islamic expressions with various dimensions in the country. The journal, serving as a forum for the study of Indonesian Islam, supports focused studies of particular themes and interdisciplinary studies in relation to the subject. It has become a medium of exchange of ideas and research findings from various traditions of learning that have interacted in the scholarly manner.

Abstract

Fatwa in the circle of Nahdlatul Ulama (NU) remains showing reminiscent of classical period of Islamic jurisprudence. It uses madhhab and taqlid with the employment of classical jurisprudence texts. Being identical in certain crucial features, the NU’s version of fatwa, however, is different from classic fatwa in various aspects. Fatwa is collegial, binding and modern. This last aspect remains debatable within the NU. While senior ulama‘ resist the reintroduction of ijtihad in the process of fatwa issuing as a tradition which should be preserved, certain younger ulama‘ in the organization urges the employment of ijtihad to keep up with the demand of modern context. Senior ulama‘ of the NU maintain that taqlid and madhhab is the very essence of their commitment to Islamic law, whereas the younger ulama‘ assert that such attachment will only result in the abandonment of Islamic law altogether by Muslims, especially the NU members. This article shows that dynamic with special reference to what is happening in East Java, the traditional stronghold of the NU.

Abstract

This paper deals with the idea of reforming an Islamic education in Indonesia through the educational system of pesantren by referring particularly to the thought of Imam Zarkasyi, the founder and leader of Pesantren Gontor. The paper argues that Gontor symbolizes not only the courage of people formerly regarded as educationally marginalized, offering what is best for their fellow country-men, but also the very quality of Islam itself as well as its ability to deal with ever-present social problems. Delving into the depth of Imam Zarkasyi’s thinking, the paper identifies that there are several areas in which he tried his utmost to renew the outlook of his pesantren: (1) the method of Arabic-teaching as a foreign language, (2) the development of pesantren curriculum which integrates both Islamic and non-Islamic sciences, (3) the integration of intra-curricular, extra-curricular, and co-curricular subject-matters, (4) the combination between moral, intellectual, spiritual-religious, and physical education and education in self-management, leadership, and life-skill, (5) managerial base for the endowment system so as to strengthen the institutional aspect of the pesantren. The paper argues that the success of the pesantren lies not only in its ability to produce men of excellence but also its systematic efforts to accumulate wealth.

Abstract

Amidst the rise of textual and literal approach of Islam, the spirit and the purpose of Islamic law are often overlooked. The application of Islamic law should be able to go hand in hand with the changing dynamics of the times. As many novel legal issues take place, Muslim jurists must respond with adequate solution bearing in mind the spirit and purposes of Islamic law for the welfare of human being. This article discusses Ibrahim Hosen, an Indonesia Muslim jurist of the 1980s who upheld this principle in his fatwas. As the chairman of fatwa issuing body of Indonesian Ulama council at the time, he was in the forefront of delicate situation of positioning Islamic law in the modern context. His idea of “mem-fiqh-kan yang qath’i” which means redefining the absolute aspect of Islamic jurisprudence created considerable impact on the application of Islamic law in Indonesia. It did make him a controversial muslim jurist, aspecially after he issued several controversial legal opinions (fatwa), namely the lawfulness of national lottery and lawfulness of beer on which the majority of Indonesian Muslim jurists considered as gambling and liquor.

Abstract

This paper deals with the problem of the visit to the sacred sites by the nominal Muslims of Java and its religious, social and cultural ramification. It argues that the dialectic expression of the visitors depends very much on the cultural setting of the sites they visit. It specifically identifies three groups of expression, abangan deles (purely nominal), putihan campuran (half-heartedly puritan) and bisnisan gak ngalor gak ngidul (inconsistent commercialists). The first group tends to be magical-emotional, the second is magical-rational, and the third is empirical-rational. Despite this difference in mythical expression, the three groups share the mythical experience. The paper goes on to say that if Islam is understood in mythical sense, it must be tolerant, adaptive, collaborative, acculturative, and transformative.

Abstract

In this article, we discuss the function and position of penghulu in Java in the second decade of the nineteenth century. The object of this study is a manuscript from the British Library collection, coded Mss Eur D/742.1, ff. 155-166, that was issued by Thomas Stamford Raffles, the Lieutenant-Governor of Java, and Its Dependencies, on 11 February 1814. The manuscript actually regulates the general justice system. However, in this article, we will only discuss a number of rules that are directly related to the function and position of penghulu in the justice system. The paper will show that penghulu, in Raffles’ regulation, was functioned as an expert to be presented to a court. He must expound about Islamic law or customary law related to cases that were being handled by the court. In fact, when it was first formed in the early days of the Demak Sultanate (1475-1554), the penghulu was a representative of the sultan and is held responsible for the implementation of the rules of Islam. Meanwhile, in the field of law, the penghulu was head of the court.

Abstract

Habermas’ idea of the public sphere as a space where members of society can develop discussions and debates on public issues has inspired some scholars to interpret the modern development of Muslim societies. The spread of communication technology that includes print and electronic media, has paved the way for the emergence of the public sphere in those societies. Several studies of Indonesian Islam by western scholars also pay attention to the public sphere. Having discussed those studies, this paper argues that, although Habermas’ very notion of the public sphere has been criticised and modified by the scholars, it can be used effectively and developed for further research on Indonesian Islam.

Abstract

This article is an initial exploration of Indonesian Sufi, developed in the Malay world of Indonesia and Malaysia. The spread of this particular tariqa (sufi’s order) relates specifically to the mandate received by Tuan Guru of TNKB, as its certified Shaykh, who then actively involved in the network acitivity by visiting the Malay Sultanate areas scattered in the Malay Peninsula. This research reveals the incorporation of some elements of different tariqas in the “form” of TNKB, such as Tariqa Shazaliyya and Tariqa Sammaniyya, as well as adaptation of local culture of Malays ethnic which become part of its unique ritual. Supported by the Sultan, TNKB has become the “official order” of Malay Sultanate, which covers area of Riau, Sumatera Utara (North Sumatera) in Indonesia as well as Johor in Malaysia—with caliph as its “agent”.

Abstract

This article deals with the transformation of conflict and the formation of identity of the Bandanese people in the Banda Islands after Maluku conflict through an analysis of kabata, folk songs that record the historical narratives of the colonial era. This research employs a grounded theory approach to collect field data from the Banda Islands and Ambon Island, as well as literature related to the Banda Eli community in Kei Island. The finding indicates that the Maluku conflict had an effect on the diversity of religion, custom and social relation among the Banda people, and led to the fragmentation of identity—the communities of Banda Neira Islands, Banda Eli in Kei and Banda Suli in Ambon—on the basis of religious aspects and their bond to Banda lands. The transformation of conflict created a consolidation of identity of Banda Islands community, which became religiously more exclusive, especially after the rise of conservative Islam in Indonesia. This article fills the gap in the study of kabata by positioning it as a key to understanding how the identity of the Bandanese people has developed and adapted within the context of the long history of colonialism and contemporary conflicts.

Abstract

In the present-day Indonesia, cases of discrimination and violence towards minorities are still prevailing. A number of Indonesian personages who play a strong role in defending minorities have been observed, most particularly Muslim minority groups such as the Shi’ism and the Ahmadiyya. One of these personages: Sinta Nuriyah Wahid (b. 1948). One may say that Sinta is a female Muslim scholar-activist who is rooted in tradition­nalist Islam, and accordingly is considered a figure of authority in speaking in the name of Islam. This article is dealing with the role and authority of this female scholar-activist in promoting the rights of the Ahmadiyya in contemporary Indonesia. The first concern of this paper is dealing with Sinta’s roles in protecting the Ahmadiyya in Indonesia. The second concern is dealing with the ways in which Sinta and her ideas on protecting the Ahmadiyya wield authority on present-day Indonesian Muslims.

Abstract

This study examines the Shia minority in Makassar, South Sulawesi, who was excluded by anti-Shia groups, and received support from the local government. The exclusion of Shia in Makassar is contrary to the constitution in Indonesia which guarantees freedom of religion for all religious people, including the Shia group. The purpose of this study is to explain that the act of exclusion against the Shia group in the public sphere is against the Constitution. From this study, there is an urgency to build religious inclusivity and equality in democratic public policies. This study uses a qualitative approach with primary data collection methods conducting in-depth interviews with several competent informants in Makassar.
