Abstract

This research aims to analyze the legal status (fiqh) of the sale, purchase, and use of pirated goods and to identify the determining factors that encourage the proliferation of this practice within society. Islam, as a comprehensive religion, regulates principles of property ownership justly and prohibits the acquisition of wealth through illicit means. The phenomenon of pirated goods, which are unauthorized replications of products without the copyright holder's permission, presents an ethical and juridical issue from an Islamic legal perspective. This study employs a qualitative method with a library research approach. Data analysis is conducted descriptively-analytically on primary sources such as the Qur'an and Hadith, as well as secondary sources including scholarly fatwas, classical fiqh books, academic journals, and intellectual property rights (IPR) legislation. The research findings indicate that the majority of scholars, including the fatwa of the Indonesian Ulema Council (MUI), prohibit the production, sale, and use of pirated goods. The basis for this prohibition stems from the fact that this practice contains elements of injustice (violation of rights), deception (tadlis), uncertainty (gharar), and usurpation of others' property rights (ghasab). Furthermore, this research identifies key contributing factors, including economic aspects (price disparity), cultural factors (consumerism and low legal awareness), technological advancements, and weak law enforcement. A holistic approach encompassing education, regulatory strengthening, and law enforcement is needed to effectively address this issue.

Abstract

This research focuses on how Islam compares between the time of the Prophet and today. These differences occur as a result of a shift in the understanding and practice of Islamic teachings along with developments over time. The challenges faced by the Prophet and his previous companions were physical attacks, whereas in contemporary times there is no longer any war or conflict between humans. There is a saying that Western nations advanced because they abandoned their holy book, while Muslims regressed because they also abandoned their holy book (Al-Qur’an). This expression may be true when we see how poor Muslims are in various sectors of life, from education, economics, to the development of science and technology. Meanwhile, Western countries are so advanced and powerful that they dominate the world with all their military, economic, socio-political and cultural power which influences Muslims and other parts of the world. In contemporary times, Muslims are experiencing Ghazwul Fikr, namely a war of ideas or intellectual war. Ghazwul fikr is a transformation of conventional war.

Abstract

Islam in Indonesia has developed into an integral part of the social, cultural, and political life of its people since its introduction in the 13th century. Various local traditions in Indonesia have successfully assimilated with Islamic values, creating a unique form of Islam distinct from other regions. Practices such as pengajian, Maulid Nabi, and tahlilan reflect the blend of Islamic beliefs with local customs. Moreover, Sufi orders have played a significant role in spreading Islam through spiritual and social approaches. However, in recent decades, there has been an increase in dynamics between traditional Islam and more puritanical modern Islamist movements. These dynamics affect various aspects of life, including religious education, politics, and cultural expression. Studies on Islam in Indonesia highlight the complexity of the interaction between religion, tradition, and modernity.

Abstract

This study examines social acceptance of legal processes involving public figures or state officials, focusing on the interplay between public perception, religious values, and prevailing social norms. The background problem lies in the increasing number of legal cases involving public figures in Indonesia and the diverse societal responses to these proceedings. Utilizing a qualitative approach through case studies and in-depth interviews, the research explores how public opinion is shaped by moral values and trust in legal institutions. The findings reveal that social acceptance of legal processes is significantly influenced by religious values, socio-political proximity to the figure involved, and the credibility of the legal institutions managing the case. In some instances, religious norms are used either to justify or reject ongoing legal processes. The study concludes that achieving public-perceived justice requires legal institutions to strengthen public trust and consider the sensitivity of prevailing social and religious values within the community.

Abstract

This paper aims to find out the character of Islam Nusantara, as a manifestation of the existence of moderate Islam that was taught by the Walisongo and religious figures to this day. The historical phenomenology is employed to understand Islam Nusantara. The results of this research showed that Islam in Nusantara has five special characters.
