Abstract

Artikel ini membahas urgensi pesantren sebagai lembaga pendidikan Islam dalam menghadapi tantangan ideologi transnasional yang berkembang di Indonesia. Ideologi transnasional, seperti gerakan radikal dan fundamentalis, telah menimbulkan berbagai persoalan sosial, politik, dan keagamaan yang berpotensi mengancam persatuan bangsa. Melalui pendekatan kualitatif deskriptif dengan metode studi pustaka, artikel ini menelaah literatur yang relevan mengenai konsep ideologi transnasional, faktor penyebab kemunculannya, serta peran pesantren dalam merespon fenomena tersebut. Hasil kajian menunjukkan bahwa pesantren memiliki peran strategis dalam membangun karakter bangsa melalui nilai-nilai panca jiwa, seperti keikhlasan, kesederhanaan, kemandirian, ukhuwah Islamiyah, dan kebebasan. Nilai-nilai tersebut menjadi benteng ideologis yang mampu menangkal paham radikal sekaligus memperkuat moderasi beragama. Dengan mengedepankan pendidikan akhlak, wawasan keislaman yang moderat, serta dukungan terhadap prinsip kebangsaan dan demokrasi, pesantren berkontribusi signifikan dalam menjaga harmoni sosial dan keutuhan Negara Kesatuan Republik Indonesia

Abstract

Tujuan penelitian ini adalah untuk menjelaskan tentang apa itu sekularisme, sejarah lahirnya, serta pandangan Islam tentang sekularisme itu sendiri. Metode penelitian yang digunakan adalah menggunakan metode penelitian kualitatif deskriptif, dengan pendekatan libarary research. Pengumpulan data diperoleh dengan mengkaji studi-studi yang berkaitan dengan sekularisme. Selanjutnya hasil penelitian dijabarkan secara deskriptif yang mendalam. Hasil pembahasan dalam penelitian ini menjelaskan bahwa sekularisme secara umum merupakan sebuah pemikiran yang menjelaskan tentang pemisahan antara agama dan Negara. Berasal dari Negara Barat yang terjadi karena dominasi gereja dan pertentangan antara doktrin gereja dan ilmu pengetahuan pada saat itu. Dalam dunia Islam perkembangan sekularisme berbeda-beda pendapat, Zulkifli dalam tulisanya, menjelaskan sekularisme masuk ke dunia muslim didorong oleh adanya modernisasi (westernisasi) dan tekanan konservatisme, Pendapat lain mengatakan sekularisme dalam dunia islam terjadi karena adanya stagnasi keilmuan di dunia Islam. Fazlur Rahman berpendapat bahwa masuknya masuknya sekularisme terjadi karena kegagalan syari’at dan institusi agama dalam mengembangkan dan menyesuaikan kebutuhan masyarakat yang berubah. Disamping itu, Zulkifli menjelaskan bahwa tidak sepenuhnya sekularisme itu tidak relevan dengan tradisi islam, dikarenakan secara sosiologis umat muslim juga melalui perubahan sosial. Namun perlu diperhatikan bahwa makna sekularisme dan kedudukan agama di barat dengan umat Islam berbeda. Dengan demikian respon para sarjana Muslim tentang sekularisme ada yang menerima dan ada yang menolak kehadiran sekularisme tersebut teutama di Indonesia.

Abstract

The Ngupati tradition is a unique cultural practice among Javanese society, particularly in Buntet Pesantren, Cirebon, West Java. Ngupati is performed during the fourth month of pregnancy, following the Neloni ceremony in the third month and preceding the Mitonan in the seventh month. This tradition involves Quranic recitations, prayers, and communal gatherings, reflecting gratitude for God's blessings and prayers for the unborn child's safety. This study explores the history, cultural significance, and social impact of the Ngupati tradition within the Buntet Pesantren community. Using a qualitative approach, data were collected through interviews, observations, and literature reviews. Findings reveal that Ngupati serves as a medium for preserving ancestral heritage, reinforcing social cohesion, and embodying religious devotion. The practice also highlights the integration of religious and cultural values in Javanese society. Additionally, Ngupati contributes to the community's social structure by fostering mutual respect and collective responsibility. As a symbol of cultural resilience, the Ngupati tradition continues to thrive amidst modernization, reflecting the adaptability of Javanese traditions in contemporary society. This research emphasizes the importance of understanding traditional ceremonies to appreciate their role in shaping and sustaining cultural identities.

Abstract

This research aims to analyze the legal status (fiqh) of the sale, purchase, and use of pirated goods and to identify the determining factors that encourage the proliferation of this practice within society. Islam, as a comprehensive religion, regulates principles of property ownership justly and prohibits the acquisition of wealth through illicit means. The phenomenon of pirated goods, which are unauthorized replications of products without the copyright holder's permission, presents an ethical and juridical issue from an Islamic legal perspective. This study employs a qualitative method with a library research approach. Data analysis is conducted descriptively-analytically on primary sources such as the Qur'an and Hadith, as well as secondary sources including scholarly fatwas, classical fiqh books, academic journals, and intellectual property rights (IPR) legislation. The research findings indicate that the majority of scholars, including the fatwa of the Indonesian Ulema Council (MUI), prohibit the production, sale, and use of pirated goods. The basis for this prohibition stems from the fact that this practice contains elements of injustice (violation of rights), deception (tadlis), uncertainty (gharar), and usurpation of others' property rights (ghasab). Furthermore, this research identifies key contributing factors, including economic aspects (price disparity), cultural factors (consumerism and low legal awareness), technological advancements, and weak law enforcement. A holistic approach encompassing education, regulatory strengthening, and law enforcement is needed to effectively address this issue.

Abstract

This study explores the diverse landscape of Islamic thought in Indonesia through the perspectives of prominent intellectuals. Ahmad Syafi'i Ma'arif categorizes Islamic thought into four distinct paradigms: modernism (evolving into neo-modernism), neo-traditionalism, exclusive Islam, and Muslim secular-modernism. Similarly, M. Dawam Raharjo identifies four styles: Muslim nationalism, humanism, Muslim socialist-secularism, and secular-modernism. Within this discourse, Nurcholish Madjid posits that modernization is inherently synonymous with rationalization. This conceptual framework originates from the liberalization of thought, which seeks to reform traditional cognitive patterns and non-rational (non-aqliyah) procedures into rational (aqliyah) systems. Furthermore, the emergence of Liberal Islam represents a contemporary milestone in Indonesian Islamic discourse. Driven by a dynamic generation of intellectuals, this movement integrates critical modern scholarship to reshape the existing worldview. Liberal Islam proactively challenges regressive cultural and intellectual trends, offering a transformative "hue" to the development of Islamic thought in Indonesia.

Abstract

This research aims to analyze the concepts of wakalah and agency from a contemporary Fiqh perspective, focusing on their relevance in modern transactions. The research design employs a comprehensive library research method, examining various primary and secondary literature related to Fiqh muamalah, Islamic contract law, and agency practices in the contemporary era. The main findings indicate that although the concept of wakalah has strong roots in classical Fiqh, its application in the form of modern agency requires careful interpretation and adaptation to suit current economic dynamics. A fundamental distinction between wakalah as pure representation and agency as a commercial activity needs to be understood to avoid legal ambiguity. The implication of this research is the importance of developing a more adaptive Fiqh framework to accommodate complex agency practices, ensuring sharia compliance while remaining relevant to market needs. This implication encourages Islamic financial institutions and legal practitioners to draft more transparent and sharia-compliant contracts for agency transactions. The originality of this research lies in its comparative analysis between traditional wakalah and modern agency concepts from a contemporary Fiqh perspective, providing a theoretical foundation for the development of innovative sharia-compliant products and services within the realm of agency.

Abstract

The expansion of e-commerce in Indonesia has progressed rapidly in recent years; however, this growth has not been fully aligned with the values of Islamic Sharia, despite Indonesia having the world’s largest Muslim population. This study seeks to explore the legal and social consequences of implementing halal e-commerce in the Indonesian context and assess how well these practices conform to existing national regulations. Utilizing a normative legal research method, the study adopts conceptual, comparative, and content analysis approaches, drawing from Islamic legal sources and statutory law. The findings indicate that there is currently no comprehensive legal framework specifically governing halal e-commerce, leading to regulatory gaps and insufficient protection for Muslim consumers. On the social front, low levels of halal digital literacy and limited access to halal certification (particularly among micro, small, and medium enterprises (UMKM)) pose significant obstacles. The study emphasizes the need for strengthened halal digital regulations, the development of a tech-based certification infrastructure, and active collaboration between government agencies, business sectors, and religious authorities. In conclusion, the advancement of a sustainable halal e-commerce ecosystem requires an integrated strategy that encompasses legal, social, and technological elements to ensure Sharia compliance and inclusivity for Indonesia’s Muslim population.

Abstract

This research examines the protection of public rights from the perspective of Islamic law, aiming to understand the relevance of Sharia principles within modern contexts and positive legal practices in Indonesia. The study is motivated by the existing gap between Sharia theory and the implementation of public rights, alongside the demands of globalization and international human rights standards that necessitate the harmonization of Islamic norms with national law. Utilizing a qualitative approach through library research and descriptive analysis, data were gathered from scientific journals, reference books, legal documents, and contemporary articles discussing Islamic law, maqāṣid al-sharīʿah, and public rights. An inductive analysis was performed to identify patterns, Sharia principles, and the relationship between individual rights and collective interests. The results indicate that public rights in Islamic law are deeply rooted in maqāṣid al-sharīʿah, which emphasizes the preservation of religion, life, intellect, progeny, and property. The principles of justice, public interest (maslahah), and social responsibility serve as the primary foundations for formulating public policy and protecting communal rights. Furthermore, this study identifies discrepancies between Islamic law and Indonesia's positive legal practices, particularly regarding education, healthcare, minority rights, and religious freedom, highlighting the need for integration with international human rights standards. In conclusion, the protection of public rights is a collective responsibility shared between the state and society. Integrating Sharia principles into public policy can enhance social justice, legal literacy, and community welfare. This research offers both academic and practical contributions to the development of modern Islamic legal theory, policy, and practice.

Abstract

This study aims to identify and analyze product innovation in Sharia Non-Bank Financial Institutions (SNBFIs) in Indonesia, focusing on driving factors, regulatory challenges, and their implications for institutional performance and sustainability. This research employs a qualitative approach using a library research design with content analysis techniques applied to various literary sources, including scientific journals, books, financial authority reports, and fatwas from the National Sharia Council-MUI. The findings indicate that product innovation in SNBFIs is driven by increasingly diverse customer needs, advancements in digital technology, and industrial competitive pressures. A prominent form of innovation is the development of Sharia fintech-based financing services, such as Sharia peer-to-peer lending and crowdfunding, which enable faster and more inclusive access to MSME financing. However, these innovations face various challenges, particularly regarding stringent Sharia regulations that require fatwa validation processes, a shortage of human resources with dual competencies (both in fiqh muamalah and technology), and limited funding for research and development. The implications of this study affirm that product innovation serves not only as a strategy to enhance competitiveness but also as an instrument to expand financial inclusion and strengthen the Sharia economic ecosystem. Therefore, adaptive policy support is required, such as the development of more flexible regulatory sandboxes, to foster innovations that remain aligned with Sharia principles and the objectives of maqasid al-sharia, specifically the attainment of collective welfare (falah).

Abstract

This research aims to analyze the dynamics of Sharia clothing implementation within the context of the relationship between law and culture in Indonesia. The study employs a qualitative approach through a literature review of contemporary scientific sources from the 2020–2025 period. The focus of the study includes the interaction between Sharia normative provisions and social practices within the Indonesian Muslim fashion industry. The findings indicate that differing interpretations regarding the boundaries of awrah and Sharia standards have led to diverse clothing practices in society. Furthermore, a process of cultural negotiation occurs between universal Islamic values and local wisdom, giving birth to the distinct characteristics of Indonesian Muslim fashion. The Muslim fashion industry is also undergoing a transformation from a Sharia-compliance orientation toward a market-oriented approach, creating a dilemma between maintaining religious values and meeting economic demands. Additionally, digitalization and social media play a primary role in accelerating the transformation and reinterpretation of Sharia clothing, particularly among the younger generation. This research recommends the need for adaptive regulations, the development of credible Sharia certification standards, and an increase in public literacy to create a sustainable and contextual Muslim fashion ecosystem in Indonesia.
