SAMAWA: Jurnal Hukum Keluarga Islam adalah jurnal akademik yang ditelaah sejawat (peer-reviewed) dan berfungsi sebagai wadah ilmiah untuk pengembangan kajian Hukum Keluarga Islam. Jurnal ini memuat hasil penelitian teoretis maupun empiris yang bertujuan memberikan kontribusi terhadap wacana klasik sekaligus perkembangan kontemporer di bidang Hukum Keluarga Islam. Fokus utama jurnal ini mencakup kajian Hukum Keluarga Islam dari perspektif normatif, historis, sosiologis, dan hukum perbandingan, baik di Indonesia maupun di negara-negara Muslim lainnya meliputi hal-hal berikut: Perkawinan dalam Islam Mencakup kajian tentang akad nikah beserta rukun dan syaratnya; mahar, wali, dan saksi; hukum, prosedur, serta praktik poligami; pembatalan pernikahan (fasakh nikah); serta studi perbandingan hukum perkawinan dalam berbagai sistem hukum. Perceraian Membahas kajian ilmiah mengenai talak beserta jenis, prosedur, dan akibat hukumnya; khulu’ (perceraian atas permintaan istri); fasakh (pembatalan pernikahan); ruju’ (rujuk setelah perceraian) beserta syarat dan prosedurnya; serta analisis yurisprudensi terhadap kasus-kasus perceraian dari berbagai perspektif. Nafkah, Hak Asuh Anak, dan Perwalian Mencakup kajian tentang kewajiban nafkah suami; nafkah pasca perceraian seperti nafkah iddah, mut’ah, dan nafkah anak; pengaturan hak asuh anak (hadhanah) setelah perceraian; serta perwalian terhadap anak di bawah umur, baik wali nikah maupun wali yatim. Kewarisan, Wasiat, dan Hibah Mengkaji pembagian warisan menurut hukum Islam; wasiat, termasuk ketentuan, batasan, dan pelaksanaannya; hibah (pemberian), meliputi syarat hukum, mekanisme, serta kemungkinan pembatalannya; serta analisis yurisprudensi terhadap kasus kewarisan dalam berbagai konteks. Mediasi dan Penyelesaian Sengketa Keluarga di Pengadilan Agama Berfokus pada proses dan prosedur mediasi, peran mediator dalam penyelesaian sengketa keluarga, serta strategi peningkatan keberhasilan mediasi dalam kerangka peradilan agama. Isu Gender dalam Hukum Keluarga Islam Membahas keadilan gender dalam hukum keluarga, menelaah perspektif kesetaraan antara laki-laki dan perempuan, serta menganalisis bentuk dan dampak bias gender dalam praktik dan implementasi hukum keluarga Islam. Reformasi dan Kodifikasi Hukum Keluarga di Dunia Islam Mengkaji perubahan dan reformasi hukum keluarga, menelaah proses dan model kodifikasi di Indonesia serta negara-negara Muslim lainnya, dan menganalisis peluang serta tantangan dalam pelaksanaan reformasi hukum keluarga yang efektif. Studi Perbandingan Hukum Keluarga Menganalisis persamaan dan perbedaan antar mazhab dalam hukum Islam, mengkaji perspektif perbandingan hukum keluarga lintas negara, serta menelaah hubungan dan interaksi antara hukum Islam, hukum adat, dan hukum positif dalam pengaturan masalah keluarga. Studi Empiris tentang Praktik Hukum Keluarga Islam di Masyarakat Meliputi penelitian lapangan mengenai implementasi hukum keluarga Islam dengan pendekatan sosiologis, antropologis, dan yuridis; serta mengkaji pengaruh adat lokal terhadap praktik dan penafsiran hukum keluarga dalam berbagai komunitas.

This study analyzes the judge's consideration in deciding supernatural cases in divorce lawsuits at the Metro Religious Court through Decision Number 230/Pdt.G/2023/PA.Mt. The main problem is how the judge decides the supernatural divorce case when the husband leaves his wife for less than two years, even though Article 116 letter (b) of the KHI requires a minimum of two consecutive years. Using normative legal research methods with a legislative and case approach, this study analyzes court decisions and Islamic legal literature. The results of the study show that judges use a substantive-protective approach by integrating legal-formal and philosophical aspects based on the rules of fiqhiyyah "dar'u al-mafasid muqaddamun 'ala jalb al-mashalih" and the principles of maqashid sharia. Factors that cause the request include the absence of the husband, economic neglect, the habit of drinking liquor, and the failure of peace efforts. The judge granted the lawsuit by imposing talaq satu ba'in shughra even though the duration of the separation had not reached two years, considering that maintaining the marriage caused psychological harm and legal uncertainty for the wife. This study demonstrates that judges act as justice seekers who contextualize legal norms with social realities to protect the abandoned party. This article reexamines the meaning and ethical position of polygamy through two approaches: Ma'anil al Hadith and legal sociology. The Ma'anil al Hadith approach emphasizes a meaningful, contextual reading of hadiths that is oriented toward maqāṣid al-syarī'ah, rather than merely textual. Meanwhile, legal sociology analyzes the social function of a norm in modern society. This study finds that polygamy in Islam is not a command or normative preference, but rather a conditional permissibility that arises from a specific socio-historical context. In contemporary social reality, moral conditions, especially inner, psychological, and structural justice, are almost impossible to fulfill. Therefore, polygamy is more accurately understood as a situational rukhṣah, not an ideal family model. This analysis shows that both hadith and modern legal sociology theory lean toward ethical recommendations of monogamy as a form of protection, justice, and family stability. The issuance of Supreme Court Circular Letter (SEMA) No. 2 of 2023 is a significant development regarding interfaith marriages in Indonesia. This circular letter changes judicial practice by prohibiting courts from granting applications for interfaith marriages. This study aims to analyse the position and power of SEMA as a judicial policy instrument, as well as its impact on judicial independence. A jurisdictional-normative approach is employed, incorporating legislative, conceptual and case-based methods. The findings suggest that SEMA No. 2 of 2023 does not introduce a new legal norm, but rather reaffirms the Marriage Law, with the intention of standardising judicial practices. SEMA implies a shift in the role of judges from discovering law to implementing judicial policy that emphasises uniformity. However, for effective implementation, the norms must be harmonised with the Marriage Law and the Population Administration Law.

This study examines the implementation of Tuha Peut in resolving domestic conflicts in Langsa City by analysing its institutional role, implementation challenges, and conceptual reconstruction within the framework of customary law, Islamic family law, and state law. Employing an empirical legal research approach with qualitative methods, data were collected through interviews with Tuha Peut members, keuchik, religious leaders, and families involved in domestic disputes, complemented by an analysis of Aceh qanun, national legislation, and relevant scholarly literature. The findings demonstrate that Tuha Peut functions effectively as a community-based mediator by promoting deliberation, reconciliation, and family preservation before disputes proceed to formal judicial mechanisms. Nevertheless, its effectiveness remains constrained by limited institutional authority, the absence of standardized mediation procedures, inadequate mediator capacity, potential gender bias, and challenges in addressing complex cases such as domestic violence. Unlike previous studies that primarily describe the customary functions of Tuha Peut, this research proposes a Hybrid Family Dispute Resolution Model integrating the social legitimacy of customary institutions, the normative principles of Islamic family law, and the juridical legitimacy of state law. This model contributes to the development of community-based family dispute resolution that strengthens institutional capacity while ensuring legal certainty, protection of vulnerable parties, and sustainable social harmony.

The concept of kafā'ah in Islamic law has traditionally been confined to premarital compatibility between prospective spouses, while the legality of divorce has generally been assessed through formal juridical grounds without adequately considering the continuity of substantive marital equality. This study aims to reconstruct kafā'ah into a Post-Marital Kafā'ah Theory grounded in Maqāṣid al-Sharī'ah as a framework for redefining divorce legality in Islamic family law. Using a normative-conceptual legal research design with statutory, conceptual, comparative, and Islamic legal philosophy approaches, the study argues that kafā'ah should function as a continuous principle of marital compatibility encompassing spiritual, moral, psychological, intellectual, social, and economic dimensions, together with the reciprocal fulfillment of spouses' rights and obligations. Persistent deterioration of these dimensions, resulting in the loss of maṣlaḥah and the failure to achieve the objectives of Maqāṣid al-Sharī'ah, may therefore constitute substantive grounds for divorce. The study's novelty lies in proposing the Post-Marital Kafā'ah Theory, which integrates kafā'ah, Maqāṣid al-Sharī'ah, and divorce law into a Maqāṣid-oriented paradigm for a more adaptive, progressive, and welfare-oriented Islamic family law.
