Abstract

Human trafficking is a punishable offense involving acts of violence, intimidation, or abhorrent behavior, kidnapping, imprisonment, forgery, and other crimes such as recruitment, transportation, harboring, and shipping. This study examines the policies implemented by the North Sumatra Regional Police in eradicating human trafficking through online prostitution. The importance of this research lies in the fact that human trafficking is a serious violation of humanity. The practice of human trafficking through online prostitution is increasingly rampant in Indonesia, especially in North Sumatra. Therefore, the role of all levels of society and state institutions in the legal field is needed to take decisive action to eradicate human trafficking through online prostitution. It is hoped that this article will encourage the police, especially in the North Sumatra region, to apply these findings to formulate measures against human trafficking through online prostitution, which is a crucial aspect of investigations.

Abstract

This study examines Sofyan Syafri Harahap's thoughts on Sharia Accounting and its urgency in contemporary accounting practices. The study is based on the criticism of conventional accounting, which is considered unable to fully guarantee justice, transparency, accountability, and truthfulness in financial reporting. Conventional accounting is often viewed as being influenced by capitalist ideology, emphasizing profit maximization and material interests while neglecting ethical and spiritual dimensions. According to Sofyan Syafri Harahap, accounting should not merely function as a tool for decision-making but also as a means of accountability to stakeholders and ultimately to Allah SWT. The study reveals that the concept of Sharia Accounting is rooted in Islamic teachings, particularly in the principles of justice, honesty, transparency, and accountability as reflected in the Qur’an, especially Surah Al-Baqarah verse 282. Sharia Accounting seeks to ensure that financial information is free from fraud, manipulation, and injustice while promoting ethical economic activities. Sofyan Syafri Harahap argues that Islamic accounting existed conceptually long before the emergence of conventional accounting introduced by Luca Pacioli and that accounting practices should be aligned with Islamic values and objectives.

Abstract

The practice of interfaith marriage among Muslims in Indonesia is still prevalent in society. This phenomenon has given rise to various controversies and debates from religious, social, psychological, and legal perspectives. This paper will discuss the validity of interfaith marriage in Indonesia from the perspective of Islamic jurisprudence and positive law. The method used is normative legal research with library research as the data source. The data is then collected, processed, analyzed, and presented qualitatively. The results of the study conclude that Islamic jurisprudence scholars agree that marriage between a Muslim man and a non-Muslim polytheist woman is prohibited. This opinion refers to the verses of QS 2:221, QS 60:10, QS 5:5, and considerations of public interest. In the legal context in Indonesia, the Compilation of Islamic Law (KHI) regulates the prohibition of interfaith marriage. Meanwhile, the Marriage Law does not clearly regulate the permissibility of interfaith marriage, thus leaving room for differing legal interpretations in society. The Population Administration Law and several court rulings have opened the door to recognizing interfaith marriages, making them valid, registered, and recognized by the state. However, this development led to the birth of Supreme Court Circular Letter No. 2 of 2023, which prohibits courts from granting permits for registering interfaith marriages. Interfaith marriages not registered with an official institution have no legal status in the eyes of the state. Consequently, such marriages are not administratively recognized.

Abstract

It has become an agreement among Sunni scholars that obeying the leader of the state is an obligation. The obligation to obey this applies to every Muslim leader whether he is cautious or not while not yet falling into real kufr. No one sneaks in this principle except the Khawarij and Mu'tazilah. But there is a figure named Abu Muhammad Al-Maqdisi who in principle has the same understanding as the Sunni scholars in the matter of the obligation to obey the leader even though they are acting arbitrarily against the people. The problem is that there is a statement from al-Maqdisi that shows the fall of the obligation to obey the leaders now, as if Muslim leaders have now apostatized from Islam so that they must not be obeyed or be loyal to them and are even obliged to fight. The formulation of the problem is: (1) how al-Maqdisi's views on obedience to the leader, (2) how the ulama's response to al-Maqdisi's views, (3) What is al-Maqdisi's view according to siyasah fiqh. This study aims to describe and describe the ai-Maqdisi thinking systematically. From this study it can be concluded that al-Maqdisi saw no adherence to the leaders of the Islamic world now because they had apostatized due to abandoning Islamic laws, therefore obliged to fight them according to their respective abilities. Many scholars opposed Al-Maqdisi's ideas but many supported them. However, if viewed from the perspective of the Siyasah fiqh, al-Maqdisi's thinking is incorrect, even very dangerous because it will cause a war between the government and the people so that the country will be chaotic.

Abstract

The rapid development of the digital economy in Indonesia has given rise to a new work model through digital platforms that bases employment relationships on the concept of partnership. However, this model creates legal ambiguity due to the weak bargaining position of platform workers and the existence of elements of employment relationships that are factually fulfilled but formally omitted. This study aims to analyze legal protection for digital platform workers and review the status of partnership relationships from the perspective of labor law in Indonesia, particularly after the implementation of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into law.

Abstract

This study aims to analyze the concept of jarimah al-riddah from the perspective of Islamic criminal law and examine its relevance in the Indonesian legal system. Jarimah al-riddah is understood as an act of leaving the Islamic religion which in classical Islamic criminal law is categorized as a criminal act with certain sanction consequences. This study uses a normative legal research method with a statutory and conceptual approach, through a study of Islamic legal sources and applicable laws and regulations in Indonesia. The results of the study indicate that there are differences of opinion among scholars regarding the application of sanctions against perpetrators of riddah, especially in the context of modern society. On the other hand, the Indonesian legal system does not explicitly regulate jarimah al-riddah as a criminal offense, but rather emphasizes the protection of religious freedom as guaranteed in the constitution. Therefore, the application of the concept of jarimah al-riddah in the Indonesian context requires a contextual approach that takes into account human rights values and the principle of legal pluralism.

Abstract

This study examines the implementation of Islamic jurisprudence (qowaid) in addressing various contemporary problems emerging in modern society. As general principles in Islamic law, qowaid plays a crucial role in providing solutions to emerging issues not specifically addressed in the Qur'an and Hadith. The purpose of this study is to analyze the relevance and application of Islamic jurisprudence (qowaid) in addressing contemporary issues in the social, economic, technological, health, and modern muamalah (transactions). The research method used is qualitative research with a normative approach and library research. Data sources were obtained from fiqh books, qowaid books, scientific journals, and relevant Islamic legal literature. The analysis was conducted by examining several key principles, such as al-umuru bi maqashidiha (all matters depend on the goal), al-dhararu yuzal (harm must be eliminated), and al-masyaqqatu tajlibu al-taisir (difficulty brings about ease) in the context of contemporary issues. The research results show that the Islamic jurisprudence (qowaid) is of high quality and relevance in addressing the challenges of the times. The principles of Islamic jurisprudence can serve as the basis for ijtihad in establishing laws regarding various modern phenomena, such as digital transactions, the use of information technology, Islamic financial services, and even health and social issues. Thus, the application of Islamic jurisprudence (qowaid) not only maintains the existence of Islamic law but also demonstrates that Islamic law is dynamic, adaptive, and capable of providing benefits to human life in every era.
