Abstract

Artikel ini mengekplorasi nalar eksklusif maupun inklusif dalam penafsiran al-Qur’an dipengaruhi oleh rujukan tafsir, tujuan penafsiran serta ideologi penafsir. Hal ini berangkat dari langkah Depag serta Muhammad Thalib (pengarang Tarjamah Tafsiriyah) yang sama-sama memperjuangkan deradikalisasi pemahaman al-Qur’an. Namun, relatif berbeda dalam penerapan pada karya yang dihasilkan. Di sisi lain karya Tarjamah Tafsiriyah muncul sebagai langkah reaktif serta korektif terhadap karya Depag yang dianggap membawa pesan radikal. Akan tetapi kenyataannya Depag selalu memperjuangkan toleransi dalam kehidupan beragama di Indonesia. Melalui sudut pandang hermeneutika berbasis pendekatan sosio-historis ditemukan adanya bias dalam masing-masing karya tersebut dengan fokus pada ayat-ayat al-Qur’an bertemakan jihad dan relasi muslim dan non-muslim.

Abstract

The paper studies the use of Hadith in the discourse of gender issue reflected in the issuance of MUI’s fatwa. Using descriptive analytic method, it finds that the use of hadiths about gender equality in MUI’s fatwa was based on the validity of the hadith codified by authoritative Hadith scholars. The study confirms Ibnuddin’s (2011), M. Quraish Shihab’s (2003), and Yusuf al-Qarad}a>wi’s (2011) findings, which say that understanding the Traditions about women requires metaphorical interpretation. This study differs from M. Asrorun Ni'am Saleh’s (2012) which argues that that the MUI’s fatwa on female circumcision is neutral, and from Yunahar Ilyas’s (1997) which shows discrimination.

Abstract

The interpretation of QS. 4: 34 gains a new popularity in modern era as it has been used and abused as one of the references in discussing gender discourse in Islam. The paper discusses it in relation to woman’s leadership in modern Indonesian context. Hard-liners’ perceptions such as that of Salafi’s interpretation is excluded in this discussion. It deserves another adequate discussion.  The paper also restricts its discussion to the thoughts of Hamka, M. Quraish Shihab, Husein Muhammad, and of Ministry of Religious Affairs’ interpretation and treats them as exemplary of what is going on in the field of Qur’anic interpretation in this context. Using a descriptive-analytic method, this study deploys a library review technique in answering its question of the study, “how modern Muslim Indonesian scholars interpret the QS. 4: 34 in the context of democracy of Indonesia? The study concludes that they in deciphering the verse tend to adapt the demand of democracy but with a careful maintenance of the traditional wisdom.

Abstract

This article compares Zamakhshari’s interpretation with Rāzī’s one, regarding the verses of jabr and ikhtiyār, using a thematic method. It finds that Zamakhshari’s interpretation is deterministic and sometimes indeterministic, whereas Rāzī’s one is deterministic. Both interpretations were influenced by the contexts where the authors lived. Their interpretations reflect as thoughts which perceive the human capacity in comprehending texts as well as dealing with realities.

Abstract

In its formative years, Islamic law develops gradually. Along its development as a concept of reasoning as well as judging, Islamic law is a result of mixed and blended elements: a transcendental  and  local elements are formulated to be a coherent reference of logics. The article proposes the continuation of the blended tradition. The basic assumption is as long as sharia is able to maintain its adaptability to the newest cultural innovation and create ‘creative dialectics’ as it is shown in its glorious history of human civilization, it will survive as a moral guidelines and legal frame of thought. The article tries further to offer a model of such  a creativity, especially with regard to the concept of human rights.
