Abstract

The Social Contract is away so that humans can live a better life and get out of an uncertain natural state, although there are differences of opinion between Thomas Hobbes and John Locke regarding how the social contract should be implemented, both agree that the social contract is the way to peace in which the state will guarantee justice and the welfare of the people. However, both Hobbes and Locke have different views on what the ideal state should look like. Hobbes wanted absolute power and Locke wanted a separation of powers (Trias Politica).

Abstract

A country's constitution is its most significant component. Creating a state without a constitution is a non-starter. This is due to the fact that it is the most important law at its level. As a result, understanding how a country's governing structure can be altered is critical. The author examines how the United States, France, and Indonesia have implemented a system of constitutional amendments. While France and Indonesia share a legal system, they have a separate procedure for amending their constitutions. Even though Indonesia and the United States have very different legal systems, they both use the same constitutional amendment process. Since America has the world's oldest constitution, it was chosen as the focus of the author's study. As a result, France was picked since the French Revolution had a significant impact on the legal system of several European countries, including Indonesia.

Abstract

BUMN is always in the spotlight. BUMN promotes public welfare and owns at least 51% of the state's shares. This 51 percent share creates the impression that BUMN's riches are the state's wealth, hence its loss is the state's loss. BUMN losses are linked to corruption. The legality of the loss is being disputed. There's nothing improper because of the legal position of BUMN assets. Currently, the government has changed PP No. 45 of 2005 about the Establishment, Management, Supervision, and Dissolution of SOEs to add "BUMN losses" to Article 27 paragraph (2). By adding "BUMN loss," the government aims to underline that BUMN losses are not state losses. If accurate, this statement merits praise, but it's not enough to absolve SOEs of state losses. Thus, laws and regulations pertaining to the legal position of public financing in SOEs must be harmonized at the highest legal level.

Abstract

This article examines how Indonesian diplomacy takes place in the Israeli-Palestinian conflict. Armed friction and clashes between Palestinian fighters and the Israeli military still occur and can even affect Palestinian civilians. Judging from the history of Indonesia's closeness to Palestine, Indonesia is one of the countries that actively call for the independence of Palestine with a two-state solution. This article is described using conflict resolution theory. Furthermore, the author finds the findings of Indonesian diplomacy in resolving the Israeli-Palestinian conflict, Indonesia plays an active role through its role as a non-permanent member of the UN Security Council.

Abstract

The constitution has explicitly guaranteed Indonesia to control its natural resources which are intended for the greatest prosperity of the people. considering the potential of natural resources in the marine sector is so great for the progress and welfare of the Indonesian nation in the future, so that a clear Roadmap is needed for Indonesia, both in the regulation and utilization of natural marine resources aimed at the welfare of the Indonesian people.

Abstract

This paper is to explain how the fusion of social movements and new media produces new social movements. The author himself raised how the #R4bia movement in Egypt and around the world as a form of protest and solidarity with the leader of the Egyptian state President Morsi (2012-2013) was overthrown by Abdul Fattah as-Sisi in a military coup in June 2013. The #R4bia symbol became a trending topic on various social platforms. media. technology is not historically a value-free entity. When a technology product interacts with the user community, the technology product undergoes an adjustment process, in which society gives meaning based on various values. There is a reciprocal relationship and a dialectical dynamic in the process of social construction that is built.

Abstract

Since the discovery of the fraudulent investment case carried out by Doni Salmanan, law enforcement officers then confiscated the financial assets involved in the case. In addition to the ownership of luxury homes, financial assets in banks, to gifts that were given to a number of public figures. There were also several public figures who then voluntarily returned the gifts to police investigators, but the question arose as to whether returning the items could abolish the ongoing legal process. This paper tries to examine these events from the perspective of criminal law theory, law enforcement, and jurisprudence. Then it was found that returning the goods/gifts resulting from a crime does not necessarily negate or abolish the ongoing legal process, but it can be considered by the judge in deciding the case. In addition, for gifts that are still in the possession of the recipient of the gift, it is possible that the gift will be confiscated by investigators for the sake of investigation.

Abstract

The naming of states or regions in the Russian Federation is different from other federated states, such as the United States, which uses the word State, or Province in India, Pakistan, and others. Russia has asymmetric subject nomenclature. No homogeneity. The Russian Federation has the Republic, Federally Important Cities, Krais, Oblasts, Autonomous Oblasts, and Autonomous Okrugs. Each Federal Subject has a head, legislature, and constitutional court backed by the constitution and federal law.
