Sources for this analysis will be taken from studies of inscriptions, as well  as early Malay text, religious and non-religious texts. Abstract

The contemporary scientific and technology development give impacts on the development of Islamic law. The dynamic of fiqh in handling issues especially on medicine become a momentum of the synergy of the two diciplines, science and the Islamic jurisprudence of medicine. Many medical issuess are yet to require legal completions that are contemporary ijtihad based on perubatan discipline. On the other hand, ijtihad not only as exclusively unilateral, moreover inclusive multilateral approach (ijtihad jama’i) is needed on handling fiqh issues. It is because expert opinions also important in describing about those issuess. Without those opinions, Islamic law scholar could not give appropriate legal decision. However, this study will explore about the importance of development of Fiqh of Medicine based on contemporary ijtihad. These studies will explain some contemporary Medicine issuees, which is proof the requirement of contemporary ijtihad. For example on the issues of reproduktif organ donation. Some ijtihad instruments which are compatible will be aplicated based on the issuess. Research findings about perubatan issuess gave fact that there were not exact explanations on al-Qur’an and al-Sunnah also did not directly examined on fiqh book in the past. This condition cause contemporary ijtihad on those studies as an important study to give law answer about perubatan issues appear. Generally speaking, the current studies require the sinergized between the dynamic of Islamic law and the advance of science and technology.

Abstract

This article is an ethnographic account of my research on negotiating Islam and Sunda in Islamic Sundanese music. By taking special case of Terebang Sejak, I draw my attention on the issue based on my fieldwork in Cikeusal village, TasikMalaya, West Java. Observations and interviews are the main tools I used in gathering information. By presenting particularity of Terebang Sejak, this paper aims to present complexity and negotiations that are formed from the interaction between Islam and Sunda in the music in the village. In this context, presenting the idea of the truism of marginalizing Islam on local culture is in accordance with the idea of Indonesian modernity, which has parallelism with the mission of modernist Islam. While many scholars describe Islam in Indonesia with the idea of syncretism to depict the religion as ‘not really Islam’, in this article I provide different interpretation of localizing Islam by which people produce their own interpretation and appropriation in response to social and political changes in their environs. This interpretation will contribute to new understanding in addressing the particularity of meanings based on local knowledge, among Cikeusal people that forms what coded as ‘identity’ of being Muslim-Sunda. Here, Islamic text of Kitab Mulud in the music has played an agentive role to acknowledge the music as Islamic, thus continues to be part of ritual.

Abstract

The Qur’an’s verse, Al-Baqarah: 283, explains rahn in a trip condition, however, the fact that the enforcement of rahn also occurs in muqim condition. Syar’ah fiduciary needs to be included into law as Muslims in Indonesia are the majority and based on the decision of OKI (Islamic Conference Organization), Indonesia is as an Islamic country. Therefore, by being supported by Pancasila, it generates God Sovereignty theory. The research method used is normative juridical method: that is the law research method done by researching literature. The research shows that: 1) the fiduciary truth (rahn) in Islamic law is (syara’) making a thing having value of property in the view of Syara’ as a debt guarantee, which enables to take the whole or part of the debt of the thing. Method of istinbath al-hukmi is related to the fiduciary done by the fiduciary institution using qiyas (metaphor), 2) the emergence of dualism of sharia fiduciary institution and sharia banking was caused by the existence of fatwa of National Sharia Board MUI (Indonesian Council of Religious Scholars) No: 25/DSN-MUI/lII/2002, and Fatwa of National Sharia Board MUI No: 26/DSN-MUI/II1/2002, in which sharia financial institution is allowed to produce the product which accords with syarih principles, 3) critic towards law No. 21, 2008 and governmental regulations No. 51, 2011 are not directly clarified, but has similarities and explanations concerning a product that must accord with sharia principles.

Abstract

Based on category, this program leads to three social issues. First, public awareness about the significance of the view of life that is more tolerant, open and more pluralis amid development of industrialization. Industrialization that developed in centers of growth (growth poles), which prominently still holdsrural-agrarian values, has given rise to what is called the proletarian farmers. "Proletarisation" was preceded by transition process of the function of farmland into industrial land, thus causing economic activity became more intense and integrated into industrial capitalism. This leads to the occurrence of an identity crisis that led to theopposition attitude in most communities, especially those who associated with the existence of other religions. Second, these changes have an impact on the emergence of community with radical attitude by carrying the religious themes. The construction of houses of worship, which is actually the "House of God" for any religions, considering the dangers may threaten the existence of the community and other faiths. The value system was formed, as a society oppressed became one of the motivators and catalysts for the inception of religious radicalism at the low level community. Third, the Government's policy regarding the construction of a harmony is among believers. This last part is related to the concept of good governance. As an institutional approach, the concept of good governance (good governance) is defined as the interaction between the organizers of the State (Government) and groups in the community. According to the World Bank, there are at least four important dimensions of good governance, i.e. example, effective legal framework, information that is in line with the transparency (accountability or Government) and the availability of well-educated workforce. In this context, the position of District Government of Bekasi becomes one of the institutions, which is responsible for the running of the relationship between the Government, employers or investors, religious figures, and the public as the three interest groups that cannot be separated in developing awareness of pluralism in religious life in the community.

Abstract

Buton the beginning of the country is filled with myths, which serves to form a world view of cosmocentric in determining descriptions of time, space, and society. Buton as a kingdom lasted for over two centuries (1327-1541) and then continued with a sultanate era for more than four centuries (1541-1960). During the era of the kingdom, Buton was not acquainted with script and literary tradition. Apparently, tradition of writing manuscript was firstly known in the sultanate era, when the process of Islamization began by the scholars who introduced the tradition of reading and writing the Arabic script, which was later modified into a Buton script (Buri Wolio). Sultanate built on the basis of ideology of Islam and Sufism applied teachings of “martabat tujuh” on the system and structure of government. The manuscripts tradition achieved its golden peak in the reign of the 29th Sultan, La Ode Muhammad Idrus Kaimuddin (1824-1851), which was instituted in a Zawiah school. Today, there are about 340 texts in Buton manuscripts, which are mostly found in the collections of Abdul Mulku Zahari. In addition, there are still many other texts may be found on varied other private collections, which the numbers are difficult to determine because of various reasons.
