Abstract

ABSTRACTOrdinary people also know that when we consume alcoholic beverages without limitation, the human becomes uncontrollable and always do as they wish it. Many cases - legal cases arising from the liquor. Problem drinking in New York City is not something new for the community. The habit of drinking has been popular in the community and is something that is difficult to overcome, until-until law enforcement officers become tired or bored seeing this situation. On the other side than the influence of liquor causing many problems in social life. Various examples of cases impact pretty much liquor, ie the occurrence of various types of crimes of violence, among others, for example, assault, theft, adultery / obscene / moral, destruction, rape, pembunuhaan, make noise at night, stopping the taxi asked for money to buy liquor, ask for money to passers-by in front of them, drinking in public places and so forthThe research method used in this research is normative juridical that legal research conducted by the norms and rules and regulations, especially with regard to Regional Regulation No. 6 Year 2013 On Prohibition, Monitoring, Control and Sale of Alcoholic beverage In SamarindaResults of research conducted in the field there are still places that do not have permission Sales of alcoholic beverages in the city of Samarinda, both overt and hidden -selling alcoholic beverages. This is a violation of Implementation of Regional Regulation No. 6 Year 2013 On Prohibition, Monitoring, Control and Sale of Alcoholic beverage In Samarinda.Based on the research results and the real conditions which exist, the authors conclude Implementation Regional Regulation No. 6 Year 2013 On Prohibition, Monitoring, Control and Sale of Alcoholic beverage In Samarinda has been implemented by the government of Samarinda Cq. Abstract

ABSTRACTThe Company is one of the centers of human activity in order to meet the needs of life in addition to the company as well as a source of state revenue through taxes, therefore the existence and role of companies in society is huge. As the Company may not be able to act alone. The Company does not have the will to be run by the Company in accordance with the intent and purpose of establishment of the Company.Settings on the legal protection of the minority shareholders of the Company Limited open more emphasized in the Company Law, namely Law No. 40 of 2007 in which the Act is the bargaining position of minority shareholders in the decision making of a company in greater detail with the rights set forth in the Act No. 40 of 2007.Technique Data Collection, in this case the author divides data collection techniques in two engineering studies, namely: Research normative juridical, which methods of legal research is done by researching library materials or secondary data merely by reading, quote and make important notes relevant to writing this essay.The regulation of the rights of minority shareholders is expected to libih grants equal rights to the majority owner. The need for revision of the provisions of a Limited Liability Company regarding certain standards of responsibility of the Board of Directors, should therefore pay attention to the values and standards of other countries, especially the United States adheres to the common law system as a guide or reference for each member of the Board of Directors of the company in carrying out its duties.Keywords: Company Limited.

Abstract

ABSTRACT This study aims to determine the stages, terms and conditions that must be done in the development process of a General Fuel Filling Station (gas stations) in Samarinda and to determine what sanctions can be awarded against violations of the applicable provisions of the development and activities of Charging Stations General Fuel (gas stations) in Samarinda. This research was conducted by the sociological juridical approach that examines the legislation and the fact that there are seen from the perspective of law enforcement.Based on the research that has been done, it is known the terms, conditions and process of the establishment of a General Fuel Filling stations (gas stations) in Samarinda, namely 1) Register online on the official website of PT. Pertamina, which stages include inputting location data and account activation, employer profiles, company profiles and layouts. 2) Verify the initial form of the selection of financial preparedness and readiness of selection of land. 3) Verify field to synchronize the data that has been disikan with the fact the field. 4) Approval of the business feasibility of the PT. Pertamina then prospective partners are asked to complete the application for a new permit requirements General Fuel Filling Station (Gas Station). The four stages that must be done before building General Fuel Filling Station (Gas Station) with a construction period that has been determined by the PT. Petamina. Given legal effect when the building General Fuel Filling Station (Gas Station) is not in accordance with the provisions of Samarinda City Regional Regulation No. 34 of 2004 on Building In Samarinda City area may be liable to criminal sanctions (imprisonment or fines) and administrative sanctions, and based Samarinda City Regional Regulation No. 11 Year 2014 on the Implementation of Exertion or Oil and Gas Activities can be subject to administrative sanctions.From this conclusion, the authors suggest to the government of Samarinda to be more careful in the process of verifying the licensing General Fuel Filling Station (Gas Station) with more attention to the existing terms and conditions in accordance with the legislation in force and to maximize the application of rules and appropriate sanctions with the legislation in force. Keyword : zonation, SPBU.

Abstract

ABSTRAK         Undang-Undang No. 13 Tahun 2003 tentang ketenagaakerjaan menyatakan bahwa pembangunan Ketenagakerjaan sebagai bagian integral dari pembangunan nasional berdasarkan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, dilaksanakan dalam rangka pembangunan manusia Indonesia seutuhnya dan pembangunan masyarakat seluruhnya untuk meningkatkan harkat, martabat dan harga diri tenaga kerja serta mewujudkan masyarakat sejahtera adil, makmur dan merata baik material maupun spiritual.           Penyelesaian kasus Perselisihan Hubungan Industrial dan PHK memerlukan tata cara menurut perundang-undangan yang berlaku agar dapat menciptakan suasana kemantapan, ketertiban, sehingga terwujudlah penyelesaian yang efektif, efesien, murah, dan adil dengan dilandasi musyawarah mufakat antara para pihak yang berselisih.       Metode penelitian yang digunakan dalam penelitian ini adalah yuridisnormatif dengan spesifikasi penelitian deskriptif analitis. Sumber data yangdigunakan berupa bahan hukum primer, bahan hukum sekunder, dan bahanhukum tersier.         Bahwa pada dasarnya pelaksanaan penyelesaian hak karyawan di Dinas Tenagakerja Samarinda bisa dilakukan saat tercapainya kesepakatan bersama, apabila pengusaha telah menyiapkan kompensasi untuk pekerja berkaitan dengan adanya pemutusan hubungan kerja. Kata Kunci: Perselisihan Hubungan Industrial, PHK ,Mediasi

Abstract

Abstract

ABSTRAKBiro perjalanan umum sebagai pihak penyelenggara dari pelayanan jasa paket wisata mempunyai peran yang sangat penting, karena biro perjalanan umum adalah merupakan perusahaan yang mempunyai hubungan langsung dengan wisatawan dan yang bertanggung jawab terhadap penyelenggaraan jasa paket wisata selain itu juga ia ( Biro perjalanan Umum) mempunyai tugas dan fungsi sebagai pihak pemberi jasa yang bertujuan memberikan pelayanan yang sebaik mungkin kepada wisatawan, sehingga dari sini diharapkan akan tumbuh suatu rasa percaya diri dari wisatawan kepada biro perjalanan umum bahwa memperoleh pelayanan yang sebaik-baiknya selama ia melakukan wisata atau tour ketempat yang mereka inginkan yang tentunya telah tercantum di dalam paket wisata. Oleh karena itu biro perjalanan umum hendaknya harus selalu meningkatkan mutu pelayanan agar selalu mendapatkan kepercayaan dari para wisatawan. Akan tetapi dalam pelaksanaan tidak semua biro perjalanan umum melakukan tindakan atau usaha yang demikian ini, kadang kala ada juga sebagian yang merasa bahwa setelah mendapat kepercayaan dari para wisatawan lalu menyalahgunakan kepercayaan itu dengan berbagai macam cara yang bertujuan semata-mata hanya untuk memperoleh keuntungan yang sebanyak-banyaknya tanpa memperdulikan resiko yang akan dihadapi. Banyaknya Kasus mengenai jual beli dalam dunia pariwisata khususnya, dapat kita ketahui tentang kekurangan yang bersifat esensial bila di tinjau dari segi yuridis. Yang pada prinsipnya dapat dibagi menjadi dua yakni:Sebab dari dalam, ini meliputi hubungan di dalam Biro Perjalanan itu sendiri.Sebab dari luar, ini meliputi sebab-sebab seperti gangguan perjalanan, pelaksanaan pemotongan pembayaran, keamanan wisatawan sendiri, Overmacht ( Keadaan memaksa)

Abstrak     Penelitian ini bertujuan untuk Untuk mengetahui pelaksanaan perjanjian dan apa yang menjadi syarat-syarat carter kapal tugboat di PT. Panca Merak Samudera serta bagaimana cara penyelesaian sengketa apabila salah satu pihak melakukan wanprestasi..Penelitian ini menggunakan metode penelitian yuridis empiris, yaitu  penelitian yang dilakukan dengan mengumpulkan data langsung dari pihak yang berkompeten sehubungan dengan obyek yang diteliti, untuk itu dilakukan metode wawancara atau interview dengan pejabat, karyawan dan instansi yang terkait dengan obyek penelitian ini untuk memperoleh data primerMaka hasil penelitian yang diperoleh Sewa menyewa kapal di PT Panca Merak Samudera meliputi 3 ( tiga ) tahap yaitu,  Tahap persetujuan, tahap pembuatan kontrak perjanjian, dan tahap penataan administrasi persetujuan. Abstract

Abstract               As we all know that Law No. 1 of 1974 on Marriage is a work of great significance for the nation of Indonesia. An outcome that does not guarantee the realization of the unity of the family and household well-being eternal is based on God.Marriage law does not explain their interpretation of such property. However, according to Hilman Hadikusuma, is an innate property is a treasure waiting spouses or innate property in the true sense, because each spouse brings wealth as stock in a marital bond that is free and independent.Referred joint property (Gono-gini), according to him, are all revenue or income of husband and wife during the marriage bond apart from the origin and property or property that follows the administration of origin treasure is treasure living with a husband and wife.

Abstract

ABSTRACTThe research on withdrawal of assets such as land that has been in the endowment according to Islamic law (Case Study verdict numbers: 1 / Pdt.G / 2011 / PTA.Smd),  is motivated by legal act of someone who donating property such as land based on Islamic Law Compilation (ILC) and Law Number 41 Year 2004 about waqf which basically waqf deed is person or group of persons or legal entities to separate and/or submit most of his possessions to be used forever or for a certain periode of time in accordance with its interests for religious purposes. However the land which has been in endowment can be made possible to withdrawn by the parties especially wakif or the heirs of wakif.By this author discusses about whether the donated land may be withdrawn in accordance with Islamic law and legislation on waqf. How the Law on waqf can allow the withdrawal of donated land, How alignment of factors into consideration the judge against the Act of  waqf in dropping Decision Number 1/Pdt.G/2011/PTA.Smd.In this study the authors used a qualitative research using normative juridical approach. This is a source of research data in the form of the Decision Document Number 1/Pdt.G/2011/PTA.Smd., Literary study of books and scientific articles on waqf land, Interviews with young clerk of law, Interview with young clerk of lawsuit and Religious Court judges, Waqf deed official pledge sub-district sungai kunjang dan Registration Section of the Office of Land Rights Samarinda. The results showed that the withdrawal of assets such as land which has be donated land can be done if the implementation of waqf endowments are not eligible and pillars of endowments listed in Article 6 of Law Number 41 Year 2004 about waqf. In Decisions Number 1/Pdt.G/2011/PTA.Smd, waqf are distributed according to the value of the price. The alignment of factors into consideration judges with legislation waqf in dropping Decision Number 1/pdt.G/2011/PTA.Smd is right. Keywords: Islamic Law,Waqf land, Assets

Abstract

AbstractIn article 7, paragraph (1) of the code of criminal procedure stated that the letter j investigators as stipulated in article 6 paragraph (1) letter a because of its obligations has the authority "to conduct another action according to the law is responsible”. Listen to the duties and authorities of the police apparatus as set forth above, then the one question that arises here is inserting a perpetrator into the People Search listings is another action of investigators in solving the crime. For that I need to know how to set The search list as another action investigator responsible according to the law and how the terms to define other actions investigators in conducting The search list. In the Act No. 2 of 2002 on the State police of the Republic of Indonesia, the police authority to conduct the search list of The assignment is not set explicitly, but when looking at the provisions of article 16 paragraph (1) letter I Act No. 2 of 2002 jo article 7 paragraph (1) of the code of criminal procedure, there is a letter of authority to perform another action according to the law is responsible.
