Tinjauan Yuridis Terhadap Sertifikat Hak Guna Bangunan Yang Telah Berakhir Masa Berlakunya Dalam Penjaminan Bank. Dibimbing oleh Kunti Widayati, SH., M.Hum and Mia Kusuma Fitriana, SH., M.HumPerpanjangan Hak Guna Bangunan yang telah berakhir jangka waktunya menyebabkan hak atas tanah menjadi hapus, oleh karena itu harus dilakukan Pembaruan hak dan pembebanan Hak Tanggungan baru karena Hak Guna Bangunan yang dijadikan obyek jaminan Hak Tanggungan memiliki keterbatasan waktu, maka sudah tentu akan menimbulkan masalah hukum tersendiri yang selanjutnya akan dijadikan pokok pembahasan pada penulisan skrpsi ini.Berdasarkan hal-hal tersebut maka permasalahaan yang akan diteliti dalam penelitian ini adalah Kedudukan hukum sertifikat Hak Guna Bangunan atas tanah berupa Hak Tanggungan yang jangka waktunya berakhir sebelum jatuh tempo dan proses pengajuan pembaruan sertifikat Hak Guna Bangunan yang masih dibebani Hak Tanggungan.Metode pendekatan yang digunakan adalah pendekatan metode penelitian Yuridis Normatif dimana hasil penelitian dapat disimpulkan bahwa berakhir atau habisnya HGB mengubah status tanah yang sebelumnya melekat pada pemegang HGB beralih kepada pihak yang berhak sesuai dengan status tanah awal sebelum adanya Hak Guna Bangunan tersebut baik itu kepada Negara atau kepada Pemegang Pengelolaan atau kepada pemegang Hak Milik serta pengajuan permohonan pembaruan HGB dimana dengan hasil penelitian di Kantor Notaris maka dalam proses tersebut harus ada surat persetujuan dari pihak bank dimana jika nanti penerbitan SHGB tersebut sudah selesai maka akan segera diajukan pembebanan Hak Tanggungan kembali.   Kata Kunci : Pembaruan Hak Guna Bangunan, Hak Tanggungan

Abstract

ABSTRACTHuman rights violations Genocide is an extraodinary crime that resulted in the loss of material and immaterial victims. Victims who have suffered  Genocide often do not get the protection and fulfillment of the rights held in accordance with the provisions of applicable law. Based of the results of this writing, it can be known that the victims of human rights vioations Genocide according to the provisions of legislation appicable have the right to get protection, compensation, restution, and rehabilition. Efforts should be made to address contained in the fulfillment of the rights of victims is by absorbing covenants International human rights into national law, make repairs regulations regarding the rights of victims, increased support for the house of representatives, the manufacturing bill handling of cases of human rights violatons Genocide and icreasing the presindent’s role in the formation of the court human rights Ad Hoc.Keyword : Rights, Victims, Human Rights Genocide.

Abstract

ABSTRACT Andri Suhendra, NPM: 13.11.1001.1011.086, "Legal Review of Implementation of Environmental Administrative Sanctions on Business Conduct Conducting Environmental Pollution (In Kfc Dine & Rilex of Samarinda City)". Guided by Dr. H. Abdul Rokhim, SH., M. Hum as the supervisor of I and Syamsul Bahri, SH., MH.This study aims to determine the extent to which the role of Environmental Office of Samarinda City in maximizing the implementation of environmental administrative sanctions on KFC & Rilex business activities in Samarinda City. This study also aims to find out what obstacles faced by the Environment Department of Samarinda City in administering administrative sanctions to KFC & Rilex business owners.This research was conducted in Samarinda City. The object of the research is the Environment Department of Samarinda City. This research is conducted by conducting interviews with the speakers of the Regional Environmental Supervisory Official (PPLHD) who are competent and relevant to the proposed topic. The second approach is to describe descriptively the results of interviews and then analyze the data.The results of the study indicate that the enforcement of administrative sanctions by the government consistently in accordance with existing authorities will have an impact on law enforcement, in order to preserve the function of the environment. In connection with this, enforcement of administrative sanctions is at the forefront of enforcing environmental law (primium remedium). The obstacles faced are, the Environmental Supervisory Officer in exercising his authority to supervise the enforcement of environmental law is hampered by the administrative bureaucracy problem, as in Article 71 of UUPPLH Number 32 Year 2009, In the event that the environmental supervisor has done his duty and authority in doing supervision or examination on the indication of the occurrence of pollution or destruction of the environment, then when the report of the supervisory work of the environmental supervisory official is submitted to the top officials structurally such as the Head of Technical Division, Regent / Mayor, Governor, there is an indication of business activities checked and supervised by PPLHD the head of the agency The technical officer and the authority having authority over it, which is given the environmental monitoring report, is not followed up by the Head of Institution of Technical Affairs, Regent / Mayor, Governor, is very big and may happen. Too great the potential for disruption of decision-making on the result of environmental monitoring report to be submitted to the Head of DLH of Samarinda City, PPLHD must observe the hierarchical system of organizational structure which could happen the intervention from the structural position above it to the content result and the suggestion of the action contained in the result of supervision, can the imprecise of imposition of environmental sanctions such as the example of government sanction imposition of freezing permit to sanction reprimand I, the omission in the control system of the implementation of government coercion, and others. The real obstacle faced by PPLHD in the implementation of its duties and functions concerning UUPPLH 32 year 2009 in Article 71.

Abstract

ABSTRACTDomain names even if they are similar to trademarks or services can not be equated. Both of them have substantial differences that allow both to be distinguished, especially in the registration system, their use and the way in which dispute resolution occurs. Although both are different, but the domain name can also get brand-like protection, especially in the domain name as well as the trademark of a company that has entered the category of famous brands. The absence of a domain name setting within the Indonesian national legal system, which governs the domain name itself, or concerns about brand issues. Troubleshooting that occurs in domain name conflicts over brands is done through a conventional ADR or ADRonline agency.

Abstract

ABSTRAKKendala yang dihadapi dalam kontrak pembiayaan antara lain peraturan tentang ketentuan pembiayaan di Indonesia masih terbilang disepelekan bahwa Indonesia masih belum mengatur secara khusus Undang-Undang memuat tentang pembiayaan, kendala secara teknik yaitu pihak lessor memerlukan tenaga ahli yang sesuai bidang masing-masing dan menguasai secara khusus masalah yang berkaitan dengan perjanjian pembiayaan. Setelah pihak lessor mengalami kendala yang ada di atas, maka pihak lessee sendiri biasanya juga mendapatkan kendala berupa tekanan bahwa harus disediakannya dana yang besar untuk melakukan penyediaan barang modal kepada pihak lessor. Jadi mau tidak mau, pihak lessee telah menyetujui kesepakatan yang mereka buat dan ketentuan yang telah dicantumkan oleh pihak lessor meskipun lessee berat hati untuk menyetujui ketentuan tersebut, karena dalam hal ini lessor bertanggung jawab penuh atas segala resiko dan kendala dalam perjanjian pembiayaan.Upaya hukum dan penyelesaian wanprestasi serta overmacht antara lain : Dalam hal wanprestasi yang berupa keterlambatan pembayaran uang sewa, maka pihak lessor berhak melakukan denda atas keterlambatan pembayaran tersebut dengan jumlah yang telah ditentukan dalam perjanjian. Namun dalam prakteknya, pihak lessor akan memberikan teguran baik secara lisan (melalui telepon) maupun dengan surat kepada lessee. Lessor juga masih memberikan tenggang waktu kepada lessee untuk menyelesaikan tunggakan uang sewa kepada lessor serta dalam hal terjadinya keterlambatan pembayaran yang dilakukan kurang dari tiga hari dari tanggal jatuh tempo, maka lessee tidak dikenai denda; Dalam hal wanprestasi berupa penggadaian barang modal dan pemindahtanganan hak sewa barang modal kepada pihak ketiga, maka pihak lessor segera melakukan tindakan sebagai berikut : sehari setelah diketahui bahwa barang jaminan digadaikan, pihak lessor segera mengirim tim informannya untuk menarik barang modal tersebut berdasarkan atas surat kuasa yang dibuat oleh para pihak bersamaan dengan disepakatinya perjanjian pembiayaan diantara mereka. Dalam hal lessee yang dituduh lalai dan dimintakan supaya kepadanya diberikan sanksi atas kelalaiannya tersebut, dapat membela diri dengan mengajukan alasan untuk membebaskan diri dari sanksi tersebut. Alasan lessee untuk membebaskan diri dari sanksi atas kelalaiannya tersebut, salah satunya adalah dengan mengajukan tuntutan adanya keadaan memaksa (overmacht).

Abstract

ABSTRACTNumber of drug users in Indonesia. Currently almost 5 million Indonesians are drug addicts, it makes the entry of drugs illegally into Indonesia as if never stopped, either through land border, sea or air, should the addicts be noticed by their respective families and then submitted for Immediate rehabilitation of drug users, if not rehabilitated it will never recover and escape from the influence of the drug. Punishment is not optimal for drug dealers. The punishment should be given to the perpetrators of drugs is maximum punishment in the hope that the person is sorry for his actions and carried out coaching in order to change his life with the skills given as living capital when it is free. Human rights protection should not be the burden of the state, but it is the way the government carries out its mandate as the highest authority organization. The victim's problem in Law Number 35 Year 2009 is because it uses various terms namely "addict", "patient", "abuser" "Victims of abusers". The Narcotics Correctional Institution of Samarinda City categorizes narcotic drug into several levels of narcotics users. Correctional institutions are expected to run a penitentiary system so that convicted narcotics (or known as prisoners / WBP) are aware of mistakes, improve themselves, do not repeat So that criminal acts, can be accepted back by the community environment, Can actively play a role in development, and can live as a reasonable life a good and responsible citizen, and not a recidivistKeywords  :  Human Rights, Coaching Prisoners, Narcotics

Abstract

ABSTRACT Man is a social being, always interact with each other in an effort to achieve prosperity of life. One form of interaction is Arisan. As an activity in society, Arisan is a concept that can not be separated in the territory of civil law arrangement. Implementation of  the concept of Arisan by the community not infrequently has caused various problem, thus demanding a solution that can meet the sense of society and state. The settlement has been answered by law that has divided its authority in areas differentiated by the type of problem arising. Arisan activity is a form of application of certain law (cicvil) which then raises various problem. In its journey it is often found that the solution of the problem is beyond the proper field of law. Therefore, the research conducted with normative juridical method using the approach of law and concept approach on Arisan, his position in the law of engagement, as well as the legal consequences in relation to the legal steps to be taken to resolve the problems arising. The results of the study are written in the thesis as a result of Arisan Law law in Terms of Civil Law.Keywords: Arisan, consequence, effort, solution, problem.

Abstract

ABSTRACTThe development of the technological results in the banking sector that can help facilitate the activities of banking transactions for customers is Automated Teller Machines (ATM) specifically to the ATM that became the focus of the author, in its development reap some threats and losses of the debiting of the ATM card which also serves as A Debit Card that reduces the number of accounts unwanted by the customer due to the actions and unlawful acts (PMH) of a third party by way of Skimming Card or the efforts of a person or a group of people to duplicate information contained in the magnetic tape on the ATM card. The prevention efforts contained in Law Number 10 of 1988 concerning Banking based on prudential principles as set forth in articles 29 and 47 on bank secrets and as well as prefentive action is the importance of providing legal protection for bank customers in the ATM use agreement by parties bank as an ATM card issuer that can minimize customer losses.

Abstract

ABSTRACT This thesis entitled "AUTHORITY UNIT PRICE POLICE ON REGULATION OF THE CITY OF SAMARINDA CITY" ', with 2 (two) Principal issues are: (1) How is the Authority of Satuan Pamong Praja Police Unit on Enforcement of Local Regulation in Samarinda City (2) 2. How The Law caused when the Civil Service Police Unit does not carry out its obligations to the Regional Regulations in Samarinda City? This research is a kind of normative and empirical combined research. The result of this thesis shows that; (1) All levels of local government apparatuses, offices and agencies in the area of Samarinda City Government gradually begin to feel the importance of the existence and duties of the Civil Service Police Unit in enforcing the Local Regulations of Samarinda City. The guidance and arrangement of duties, functions and roles of the Civil Service Police Unit are well conducted, besides the Samarinda City Police Service Unit, really demonstrate its ability in upholding the discipline of Regional Regulation that actually violates the regulation of regional head. However, this is not optimal due to the many constraints faced so as to have an impact on the performance of the Civil Service Police Unit itself. (2) Legal effect of Satpol PP which does not fulfill its obligation to Perda of Samarinda City based on Government Regulation Number 6 Year 2010 about Pamoing Praja Police Unit Article 18 point d, can be given sanction that is dismissal. Keywords: Authority, Civil Service Police Unit, Local Regulation.

Abstract

AbstractCivil Servants (PNS) as the state apparatus has a very strategic position and a decisive role in organizing the government and development. As a state apparatus, civil servants are obliged to carry out government and development tasks with full loyalty and adherence to Pancasila, the 1945 Constitution, the state and government. Therefore, civil servants as implementers of legislation must endeavor to adhere to any laws and regulations in carrying out official duties.The authority of the judges of the State Administrative Court in resolving the civil service dispute In accordance with Law No.51 of 2009 on the State Administrative Court, it is stated that the judge of the court is an official performing the task of the judicial authority, in which the judicial authority's duties are in order to administer the judiciary and the judiciary itself has the obligation to examine, hear and decide a case. In short, a State Administrative Judge is an official authorized to examine, hear and decide a case within the State Administrative Court.
