Abstract

ABSTRACTThis study examines and addresses issues concerning the role of legal counsel in the investigation process; as well as the constraints faced by legal counsel in carrying out the defense in the investigation process.This study includes a descriptive type of empirical legal research. Research data using primary data and secondary data, primary data is original data obtained by researchers from the first hand from the main source in this case data obtained by the author from field research or research directly at Samarinda  Police Station and then also to the Legal Counsel who accompany suspect to know its role in process of investigation, secondary data is data obtained by researcher from library research and documentation which is result of research and processing of others who have been willing in the form of books or documentation usually provided in library. Sources of data in this study are secondary data sources consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques used are interview (interview) and literature study. Data analysis technique used is a qualitative data analysis that is a research procedure that produces analytical descriptive data that is what is expressed by respondents in writing or oral, and also the real behavior is researched and studied as something intact.The role of legal counsel in the investigation process that includes how the case of his position, because in the case of the position is threatened with the punishment of five years and above then must be accompanied by legal counsel. The legal advisor who accompanied the suspect was appointed by the investigator of the Samarinda  Police Resort through a letter of appointment which essentially contained a request to assist the suspect in the investigation process. Then on how the role of legal counsel in the investigation process that includes the rights, obligations, authority, steps, and actions in accompanying the suspect in the process of investigation. Then explained about the constraints faced by legal counsel in carrying out the defense in investigation process at Samarinda  Resort Police. Whereas the application of Article 115 of the legal advisors is only seen and heard only, and its presence only with the consent of the investigator whether allowing or not, if there is a matter that the legal advisors feel is not true then become a separate record for legal counsel to be submitted to the hearing. Investigators when using violence in obtaining information can be subject to Article 422 Penal Code and can be pre-trial.

Abstract

AbstractEnvironmental law in general to solve environmental problems especially caused by human activities. Environmental problems for humans can be seen in terms of environmental quality decline.The presence of massive coal mining activities in Tenggarong Seberang sub-district of Kutai Kartanegara Regency has caused damage to the environment in the region. Surely this is very inconvenient for the life of the surrounding community. One of the efforts to reduce the level of environmental pollution as a result of coal mining activities is through strict environmental monitoring and law enforcement against companies that pollute the environment.There are 3 (three) things studied in this research are: 1) How many cases and types of environmental imaging conducted by coal mining companies in Tenggarong Seberang Sub-district Kutai Kartanegara Regency during the last 5 years (2011-2015)? ; 2) what are the forms given to companies for environmentalists in Tenggarong Seberang sub-district of Kutai Kartanegara Regency for the last 5 years (2011-2015)? and 3) What are the procedures for monitoring and sanctioning the companies that pollute the environment? The method used in this research is the normative method and sociological method (empirical).Based on the results of research that has been done, the number of environmental dispute cases related to coal mining activities in Tenggarong Seberang District Kutai Kartanegara Regency during the period 2011-2015 as many as 52 cases and environmental components which are the activities of air (17 cases), soil (36 cases), air / vibration (3 cases) and cumulative (1 case). The number of companies reported as many as 27 companies and cases that have been completed as many as 50 cases while 2 cases are still in the process of completion. The highest number of cases in 2012 is as many as 14 cases while the number of cases occurred in the year 2013 as many as 6 cases. All cases.Implementation of sanctions to coal mining company in Tenggarong Seberang Sub-district Kutai Kartanegara Regency for 2011-2015 period as many as 8 companies with billing forms namely written warning (3 companies), government coercion (3 companies) and freezing of environmental permit (2 companies), while the word replacement termination no company got the order. The amounts divided in 2011 and 2012 are 3 companies each and in 2013 as 2 temporary companies in the last 2 years (2014-2015) there is no company. Forms of sanction given to companies that conduct the environment (pollution and / or environmental damage). Not all cases are sick or only 15.38% of cases of pollution and / or environmental damage are given sanctions.The Regional Environment Agency (BLHD) of Kutai Kartanegara Regency already has Standard Operating (SOP) related to environmental law enforcement in Kutai Kartanegara Regency, namely: 1) SOP of Administrative Sanction Implementation in the field of Environmental Protection and Management and SOP of Environmental Law Enforcement. Nevertheless BLHD Kutai Kartanegara does not yet have SOP related to law enforcement related to. The main obstacle of BLHD Kutai Kartanegara in conducting supervision and enforcement of environmental law is the number of personnel (PPNS and PPLHD) and limited operational fund.

Abstract

ABSTRAKPenelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan layanan program Jaminan Kecelakaan Kerja (JKK) pasca transformasi PT JAMSOSTEK menjadi BPJS (Badan Penyelenggara Jaminan Sosial) Ketenagakerjaan dan untuk mengetahui bagaimana akuntabilitas kinerja BPJS (Badan Penyelenggara Jaminan Sosial) Ketenagakerjaan.Penelitian ini dilakukan di Kota Samarinda, dengan mengambil data yang relevan serta melakukan wawancara dengan pihak-pihak yang terkait dalam hal ini pihak penyelenggara BPJS dan pihak-pihak yang terkait dan pihak-pihak yang terkait dalam penulisan skripsi ini.Metode penelitian skripsi ini menggunakan metode penelitian kepustakaan (LibraryResearch) dan metode penelitian lapangan (FieldResearch). Metode penelitian kepustakaan yaitu metode penelitian dengan melakukan pengumpulan data pustaka atau bahan bacaan yang relevan dengan penelitian yang dilakukan, sedangkan metode penelitian lapangan yaitu penelitian yang dilakukan dimana penulis akan terjun langsung ke lapangan.Hasil penelitian ini menunjukkan bahwa pasca transformasinya JAMSOSTEK menjadi BPJS Ketenagakerjaan, pemerintah telah memberikan dukungan penuh untuk pelaksanaan BPJS diantaranya dengan menetapkan jenis pelayanan kesehatan, menetapkan anggaran dan subsidi iuran. Adapun fokus utama dalam skripsi ini adalah program Jaminan Kecelakaan Kerja (JKK) Pasca bertransformasi dinilai telah banyak memberikan peningkatan dalam kualitas layanannya, dan juga penambahan program yang memberi manfaat lebih untuk penggunanya, baik dari segi benefit maupun tarifnya yang dinilai cukup ekonomis. Namun, penulis belum bisa mengatakan pelayanan dan akuntablitas BPJS yang telah diberikan berjalan sempurna sebagaimana mestinya, karena penulis masih menemukan ketidaksesuian didalamnya Kata Kunci: Kecelakaan Tenaga Kerja Harian Lepas , BPJS

Abstract

ABSTRACT Darma Dwi Apriana Saputri, NPM: 13.11.1001.1011.204, “Perlindungan Masyarakat Hukum Adat Kutai Terhadap Hak Ulayat Di Kutai Kartanegara (Tinjauan Hukum Perda Provinsi Kalimantan Timur Nomor 1 Tahun 2015)”. (Dibimbing oleh Kunti Widayati, SH., MH dan Isnawati, SH., MH).Penelitian ini dilakukan untuk menentukan tentang perlingungan masyarakat Hukum Adat Kutai terhadap Hak Ulayat di Kutai Kartanegara di tinjau dari Hukum Perda Provinsi Kalimantan Timur No. 1 Tahun 2015. Dalam pengumpulan data, penulis menggunakan metode Normatif/Pendekatan yang disesuaikan dengan masalah penelitian tersebut diatas dan juga didapat dari berbagai sumber literatur dari bahan pustaka dengan memeriksa bahan di perpustakaan. Dan data dianalisis dengan menggunakan deskriftif-kualitatif yang bertujuan untuk menggambarkan secara lengkap ciri-ciri dari suatu keadaan dilapangan, yang memberikan gambaran yang sangat jelas tentang perlingungan masyarakat Hukum Adat Kutai terhadap Hak Ulayat di Kutai Kartanegara.Hasil penelitian menunjukkan bahwa berdasarkan Perda Provinsi Kalimantan Timur Nomor 1 Tahun 2015, Undang-Undang Dasar 1945 telah menegaskan keberadaan masyarakat adat. Pengakuan atas eksistensi ini perlu dilengkapi dengan pengakuan dan perlindungan atas hak-hak yang menyertai keberadaan masyarakat adat yang harus sesuai dengan isi yang tercantum di dalam Konstitusi Negara yang mengakui keberadaan masyarakat hukum adat, yaitu di dalam Pasal 18B Undang-Undang Dasar 1945 yang menyatakan bahwa Negara mengakui dan menghormati kesatuan-kesatuan masyarakat hukum adat beserta hak-hak tradisionalnya sepanjang masih hidup dan sesuai dengan perkembangan bangsa, masyarakat dan prinsip-prinsip Negara Kesatuan Republik Indonesia yang diatur dalan Undang-Undang. Penghormatan dan pengakuan terhadap eksistensi hak ulayat sebagai hak asasi manusia secara implicit juga diatur dalam Pasal 28I ayat (3) Undang-Undang Dasar 1945 (hasil perubahan ke dua UUD 1945 yang ditetapkan pada tanggal 18 Agustus 2000), bahwa identitas budaya dan hak masyarakat tradisional dihormati selaras dengan perkembangan zaman dan peradaban, selanjutnya pada hasil perubahan ke empat UUD 1945, dalam Pasal 32 ayat (1) bahwa Negara memajukan kebudayaan nasional Indonesia di tengah peradaban dunia dengan menjamin kebebasan masyarakat dalam memelihara dan mengembangkan nilai-nilai budayanya dan Negara perlu mengelola kemajuan masyarakat agar menjadi potensi dalam pembangunan, bukan menjadi penyebab konflik.Kata kunci: Masyarakat Hukum Adat, Hak Ulayat, Peraturan Daerah Kaltim

Abstract

ABSTRACT Regarding the effort of implementation of preliminary agreement in PT. Morning Cloudy So far, both parties and the second party have tried to exercise their rights and obligations respectively. Concerning the preliminary agreement in the sale and purchase of this house is generally based on article 1338 Civil Code which states "All legally-made agreements act as laws for those who make them. The agreements can not be withdrawn other than by mutual agreement, or For reasons which by law are sufficient for that Agreements shall be carried out in good faith. In particular, the preliminary agreement is set forth in the Decree of the Minister of State for Public Housing No. 09 / KPTS / M / 1995 on Guidelines on the Sale and Purchase of Houses. The Ministerial Decree does not explicitly state the definition of the preliminary agreement, but it can only be concluded that the preliminary agreement is Agreement made before the house is completed.Settlement efforts taken in the event of default in the implementation of preliminary agreement between PT. Morning Creditor with buyer is as follows: If the preliminary agreement is void, for the un-built house, the second party (the consumer) is subject to a fine of 5% (five per cent) of the house price; Whereas if the house has been built, the second party is liable to a fine of 10% (ten per cent) of the total price of the house; In the event that the second party is late in performing its obligations, ie paying the mortgage, then before the first party decides that the second defaults, the first party first gives a warning letter to the second party up to 3x (three times). If 3x (three times) is given a warning but the second party does not heed it, then the first party has the right to decide and declare that the second party is defaulted and entitled to request a settlement under the agreement / law; In the event that the consumer cancels the purchase of the house, then the consumer must make a statement of cancellation of the purchase of the house.

Abstract

ABSTRACT "Implementation of Presidential Regulation Number 19 of 2016 Against Obligations of Company Employees Being Participants Social Security Administering Board (BPJS)" This study was conducted to determine the procedure Social Security Administering Agency (BPJS) to employees of the Company as a participant BPJS and Implementation where in data collection, Normative methods from various literature sources such as library materials, Laws, Presidential Regulations that provide a very clear picture of the implementation of Presidential Regulation Number 19 of 2016 on the obligations of employees of the company to be a participant of the Social Security Administering Agency (BPJS). The results of the study indicate that based on Presidential Regulation Number 19 of 2016 concerning the Second Amendment to Presidential Regulation Number 12 of 2013 on Health Insurance all must submit and comply with the provisions in question. Employers are still there who have not implemented or violated because it is in need supervision and guidance by agencies related to the existence of sanctions that have been arranged. Keywords: Presidential Regulation Number 19 of 2016, Implementation, Company     Employee, Social Security Administering Board (BPJS).

Abstract

ABSTRACTThe relationship between reconstruction with the crime scene is to justify the information of the suspect made by the investigator in the context of criminal investigation activities to be adapted to the actual scene of the scene. In practice, reconstruction is not done at the actual scene. This is solely done for the security of the suspects themselves in order to avoid the rampage of the public. In addition to that, also to minimize the cost of reconstruction may be less so if the scene where the reconstruction will be held outside the city. But if the crime scene is not located outside the city, the implementation of reconstruction will still be carried out at the actual TKP. If the crime scene is not known with certainty then the efforts undertaken are: Conduct action by means of investigation which is a technique of investigation for the criminal case was revealed, where with this investigation technique will be obtained answers to questions in the field of investigation criminal case; Conducting interrogation activities against the incident reporter and requesting information from witnesses of the witness, expert witnesses and witnesses who know the first case of this criminal case. Although there is a difference in the area between the scene of the case and the area where the victim was found or the result of the crime does not prevent the police to disclose the criminal case, because although there are differences in the area the police still can work together with each other.

Abstract

ABSTRACTBasic Law of Control of UKL and UPL License under Law No. 32 of 2009 on Environmental Protection and Management. Previously many changes. However, nowadays, the existing law is Law Number 32 Year 2009 is very detailed as follows: (a) Aspects of planning carried out through the inventory of the environment, the determination of ecoregion areas and the preparation of RPPLH (Environmental Management Plan for Protection). (B) Aspects of Natural Resources Utilization made under the RPPLH. But in this Law it is regulated that if an area has not yet developed RPPLH then the utilization of Natural Resources shall be implemented based on the carrying capacity and environmental capacity. (C) Controlling aspects of pollution and damage  to environmental functions including prevention, mitigation and recovery. (D) The incorporation of new control instruments, including: KLHS, Spatial Planning, Criteria for Environmental Damage, AMDAL, UKL-UPL, Licensing, Other Instruments in accordance with the needs and / or development of Science. (E) Conservation of the environment through conservation of Natural Resources, Natural Resources Reserve, and / or the preservation of atmospheric functions. (F) Monitoring and enforcement aspects. There is a strict regulation mandated in Law Number 32 Year 2009, namely the imposition of criminal and civil sanctions related to violations of AMDAL. The articles governing the sanctions are: (a) Sanctions against persons conducting business / activities without environmental permits; (B) Sanctions against persons preparing EIA documents without having a competency certificate; (C) Sanctions against officials granting environmental permits without the EIA or UKL-UPL document.Keywords : License Control, Amdal, UKL-UPL

Abstract

ABSTRAKApabila pihak yang dirugikan atau badan hukum tersebut dirugikan atau merasa kurang puas, maka orang atau badan hukum tersebut mengajukan tuntutan kepada Pengadilan Negeri dan setelah ditanggapi dan penerbitan pers tersebut memuat sanggahan atau penjelasan atas tulisan yang merugikan itu. Tuntutan ganti rugi oleh pihak yang dirugikan atau badan hukum yang merasa nama baiknya dicemarkan oleh media pers tersebut, agar para wartawan sebagai petugas dalam menyebarkan berita pada media pers dapat menanggapi atas kesalahannya dan dapat menerima tuntutan ganti rugi dari pihak yang dirugikan tersebut, kalau memang benar pihaknya yang terbukti bersalah.Tanggung jawab media massa terhadap berita salah yang merugikan pihak lain dituntut tersebut, apabila pihak yang dirugikan tersebut benar-benar tidak melakukan perbuatan yang telah diberitakan dalam media massa. Tanggung jawab media massa atau media pers atas perbuatan berita yang salah atau berita yang merugikan pihak lain atau badan hukum tersebut, dapat menuntut ganti kerugian atau pemulihan nama baik sesuai dengan putusan Hakim Pengadilan Negeri dan sesuai dengan pasal 1365 KUH Perdata berupa ganti rugi yang telah ditentukan tersebut.

Abstract

ABSTRACT That the factors causing the absence of official permission in the civil servant divorce case in the Religious Court of Samarinda are: the civil servant concerned does not take the procedure of granting licenses in BKPPD of Samarinda City Government; Difficult procedure of divorce permit In BKPPD Government of Samarinda City; The discontinuation of the procedure for granting a divorce permit in BKPPD of Samarinda City Government; Officials do not issue a Decision Letter in accordance with the specified time period. Based on the provisions of Article 49 of Law Number Year 2006 one of the jurisdictions of religious courts is to examine, decide and settle matters in the field of marriage in the first level between people who are Muslims. Understanding the field of marriage here are all things that are regulated in the UUP, including among others on the case of divorce. In the handling of divorce cases, religious courts are authorized to handle divorce cases at the first level among Muslims, including divorce from civil servants who are Muslims. In relation to the divorce of civil servants, in addition to heeding the general provisions contained in the UUP and Government Regulation No. 9 of 1975, religious courts must also heed the special provisions contained in Government Regulation No. 45 of 1990 on Amendment to Government Regulation No. 10 of 1983 on Marriage and Divorce of civil servants. The legislation as mentioned above, is a material law that is used as a guide by religious courts in solving the case of divorce. Although the UUP and Government Regulation No. 9 of 1975 and Law No. 3 of 2006 contain the rules of material law in settling divorce cases, but basically the things that are set in it are just the point. The rule has not yet elaborated on the overall provisions of marriage law regulated in Islam.
