Abstract

The criminal justice system is responsible for the judicial system to gain the trust of the public and the respect of society both nationally and internationally. In fact, the performance of law and law enforcement is still considered less meeting the expectations and feelings of justice. As a result, the respect and trust towards this institution was virtually no longer so admirable behavior still common and cause harassment to the court (Contempt of Court). The purpose of this is skripisi; The first to know the contempt of court in the Indonesian criminal justice system. Second, to find out the policy of criminalization contempt of court in the Indonesian criminal justice system.This type of research can be classified into types of normative legal research, research that discusses the basics of law, the legal system, the legal status of the synchronization, in this case the author discusses the general principles of law. This research was done by researching library materials or secondary data such as legislation and books written by lawyers associated with the title of the research, articles, journals and various other sources. Source of data used is secondary data sources. Secondary data were divided into three types: primary legal materials, secondary law and tertiary legal materials, data collection techniques used in this research method literature review. From the research, there are two main problems that can be inferred. First, Contempt of court (Contempt of Court) is one of the many problems affecting society for that reason the severity of claims to establish the rule of Contempt of Court systematically and individually. Second, as for the criminalization of policy constraints in Contempt of Court (Contempt of Court) is on a different system between the State of Indonesia as a follower of Civil Law, with its criminal justice system non adversary system, while in the State which adopts the Common Law system adheres adversary. Suggestions Author, First, should be made a rule that governs the actions of contempt of court (Contempt of Court) in a separate law, to be able to benchmark what should be categorized as an act of contempt of court (Contempt of Court) because during this become an obstacle for law enforcement officers in dealing with contempt of court action (contempt of court). Second, should the public as justice seekers must have a sense of justice, must heed the order in the conference to realize peace and order and expedite the trial process and hoped to law enforcement officials to be professional in their duties in order to gain certainty, justice and expediency as a theory legal purposes.Keywords: Contempt - Court - Criminal Justice System

Abstract

Reconstruction is an examination technique in the framework of the investigation, by re-modeling the suspect's manner of committing a crime and / or knowledge of a witness, in order to obtain a clear picture of the occurrence of the offense and to test the truth of the suspect or witness so as to obtain a description of whether or not The suspect as a perpetrator of daan daituangkan in Minutes of Reconstruction. Based on this understanding, the authors formulate two problems, namely: First, how the arrangement of the reconstruction of criminal acts in an attempt to prove in the Indonesian penal system perasilan. Second, what is the urgency of a criminal reconstruction? This type of research can be classified in the research of normative law (legal research) or also called research literature by examining secondary law material or research based on standard rules that have been recorded also called library research, data type used is using secondary data consisting Of primary, secondary and tertiary legal materials. While the data collection used in this writing is the method of literature review or documentary study, the data that has been collected then processed by way of selection, clarified systematically, logically and juridically qualitatively. The author draws a deductive conclusion, drawing the conclusions of the general things to the things that are special. From the research results there are several problems that can be summarized as follows: First, provide an overview of how the arrangement of reconstruction of criminal acts in the Indonesian criminal justice system. Second, give what urgency the reconstruction of a crime is done. Third, as a contribution of thoughts and tools to encourage students to conduct research on the arrangement of the reconstruction of criminal acts in an effort to prove the Indonesian criminal justice system. Abstract

Setiap pembangunan nasional khususnya di bidang ekonomi, memerlukan perhatian yang serius dari negara melalui pemerintah untuk kepentingan rakyat Indonesia, karena itu dalam pelaksanaannya haruslah berada di jalur hukum. Dalam hal perkembangan kebutuhan dan peningkatannya, di perlukan dana yang merupakan salah satu pendukung untuk menggerakkan kegiatan masyarakat di bidang ekonomi, Setiap kegiatan pembangunan nasional, tidak akan terlepas dari aspek hukum. Salah satu sarana yang mempunyai peran penting dalam pengadaan dana tersebut adalah Bank, Bank tidak hanya berfungsi sebagai penghimpun dan penyalur dana bagi masyarakat, tetapi juga memberikan jasa kredit kepada nasabahnya yang merupakan bagian dari usaha bank. Dalam hal ini terjadi hubungan antara pelaku ekonomi dengan pihak perbankan. Pihak bank dalam memberikan kredit atau meminjamkan modal tentunya mensyaratkan adanya jaminan bagi pemberian kredit tersebut sebagai pengamanan dan kepastian akan kredit yang diberikan tersebut, karena tanpa adanya pengamanan bank akan sulit menghindari resiko yang terjadi sebagai akibat dari kreditur yang wanprestasi.Permasalahan yang penulis angkat adalah tentang proses pelaksanaan lelang eksekusi pada PT. Bank Danamon TBK DSP Cluster Pekanbaru melalui KPKNL (Kantor Pelayanan Kekayaan Negara dan Lelang). Permasalahan yang terjadi di PT. Bank Danamon Indonesia Tbk adalah tidak semua kredit yang dikeluarkan oleh PT. Bank Danamon Tbk berakhir dengan lancar. Sering timbul permasalahan bahwa debitur telat membayar angsuran kredit yang biasa disebut dengan NPL (Non Perfoming Loan). Apabila debitur cidera janji, pemegang hak tanggungan pertama mempunyai hak untuk menjual objek hak tanggungan atas kekuasaan sendiri melalui pelelangan umum dalam hal ini adalah pihak KPKNL.Penulis melakukan wawancara langsung dengan Cluster Manager PT. Bank Danamon Indonesia Tbk DSP Cluster Pekanbaru, guna untuk mendapatkan informasi yang dapat digunakan sebagai bahan penelitian penulisan ini. Jenis penelitian yang dilakukan penulis dapat diklasifikasikan sebagai penelitian kualitatif, yang dimana selain melakukan wawancara dengan pihak terkait dari PT. Bank Danamon Indonesia Tbk DSP Cluster Pekanbaru penulis juga mengunjungi langsung lokasi yang menjadi objek lelang, penulis juga melakukan beberapa studi literatur.Kata Kunci: Kredit – Jaminan – Lelang – Eksekusi

Abstract

Consumer protection against the campaign conducted in the District Sail Shop Alfamart need for supervision, it is caused because so many business do promotion on a particular item. But often once the promotion is done in a manner that is false or misleading consumers, so the promotion is done by business often result in a loss for consumers. A result of the improper promotion, businesses should be held responsible for damages suffered by consumers. Alfamart District Shop of Sail is found that many of these promotions were misleading the public, so that many consumers feel very aggrieved. So based on this it is necessary that both consumer protection and the supervision of the government campaign against improper conducted in the District Sail Alfamart store.Keywords: Accountability - Business Actors - Promotion Not True

Abstract

According to Article 54 of Law Number 35 Year 2009 on Narcotics said that drug addicts and drug abuse victims must undergo rehabilitation. However, in its implementation in Class II A Pekanbaru, rehabilitation is only carried out by inmates who undergo a judge's verdict. The aim of this thesis are: First, the implementation of rehabilitation programs for victims of abuse of narcotics in Penitentiary Class II A Pekanbaru, Second, Barriers experienced in the implementation of the rehabilitation program in Lemabaga Penitentiary Class II A Pekanbaru, Third, efforts made in overcoming obstacles in the implementation Rehabilitation program at the Class II A Penitentiary Pekanbaru.This type of research can be classified into types of empirical juridical or sociological research, because in this study the authors directly carrying out research at the site under consideration in order to provide a complete and clear picture of the issues examined. This research was conducted at the Penitentiary Class II A Pekanbaru, while the sample population is a whole with regard to the problems examined, the source of the data used primary data, secondary data and data tertiary, data collection techniques in this study with the observation interviews, questionnaire and Literature study.From the results of research problems there are three main things that can be concluded. First, the implementation of the rehabilitation program in Class II A Pekanbaru Prison has been done well and some have not been implemented. Second, barriers encountered in the implementation of rehabilitation in Penitentiary Class II A Pekanbaru, namely, human resources, facilities, time constraints, budget, and rehabilitation clients. Third, efforts made in the face of obstacles in the implementation of rehabilitation in Penitentiary Class II A Pekanbaru, namely: improving human resources, add infrastructure, maximizing time, give strict punishment. Suggestions writer, first, the Government needs to provide assistance to meet the needs of implementing rehabilitation programs so that infrastructure development is met, both, quality and quantity of personnel need to be supported in accordance with the field, third, Need special attention from the relevant agencies (NGOs, BNN, RS, etc).Keywords: Implementation-Rehabilitation-Victim of Narcotics Abuse

Abstract

Along with the times today, more and more phenomena that we face in everyday life of the community. Among these phenomena as phenomena in the economic, social and cultural sectors, politics, and law. This type of research can be classified sociological law research. This study explains that: First, the duties and functions of correctional Hall Class II A Pekanbaru in the achievement of the objective of sentencing narcotic crime. Secondly, efforts should be made by the Central Penitentiary Class II A Pekanbaru in the achievement of the objective of sentencing narcotic crime. From the research results can be concluded that the Correctional Centres Whereas Class II A Pekanbaru already perform the duties and functions optimally, but there are constraints faced by the Central Penitentiary Class II A Pekanbaru in guiding inmates. This is evident from a report in 2016 which showed that there were inmates who return to crime (recidivism), especially in narcotic crime. The efforts made by the Central Penitentiary Class II A Pekanbaru in carrying out the duties and function of conducting individual counseling and group counseling. Where in the guidance of the inmates were given skills training in order to provide supplies to inmates. So that when inmates were out of BAPAS, inmates have the ability or skill and can work according to skills possessed. Abstract

Determination of Tap MPR/S notch below the Constitution in 1945 NRI order regulations bring consequences that TAP MPR/S must be aligned with the NRI Constitution 1945. In a sense the TAP MPR/S must not be contrary to the provisions of the Constitution of the NRI, 1945. In contrary to the Constitution of 1945, NRI then TAP MPR/S will lose their validity. In the event of a charge TAP MPR material/S contrary to Constitution 1945 NRI, surely TAP MPR/S that can be tested against the UUD 1945 NRI (test of constitutionality). Otherwise TAP MPR/S became the source of law and the basis for the formation of legislation that exists underneath.From the results of the research there were two basic problems that can be inferred. First, TAP MPR became a part of the type of order and the legislation with the position is above the law and under the Constitution in accordance with the principle of perjenjangannya legal norms. TAP MPR is the country's basic rules/rules of principal State and be the source for the formation of legal norms that are pinned to the laws and regulations that are below. The legal position of the MPR's statutes, adjust by law number. Second, the institutions of the State which are entitled to perform testing against TAP MPR is regeling based on TAP MPR Number I/MPR/2003 and the enactment of Act No. 12 of 2010 is MK. Abstract

The prohibition of unfair business competition in Indonesia has been formulated in a legal codification. Law Number 5 Year 1999 Concerning Monopolistic Practices and Unfair Business Competition is a law which contains the regulation of the prohibition of unfair business competition in Indonesia. One of the prohibitions contained in the law is the prohibition on pricing. The prohibition of pricing provided for in Article 5 to Article 8 in the law prohibits price fixing by agreement. The prohibition in Law No. 5 of 1999 concerning Monopolistic Practices and Unfair Business Competition itself has two concepts of approaches in the nature of the prohibition, namely per se illegal and the rule of reason. Both of these approaches are used by the Commission for the Supervision of Business Competition in deciding the behavior that is alleged to violate Anti-Monopoly Law and Unfair Business Competition. As in the case involving 7 (seven) reported shipping companies, namely: PT. Meratus Sailing (Reported I), PT. Tempuran Emas Tbk (Reported II), PT. (Persero) Djakarta Lloyd (Reported III), PT. Jayakusuma Perdana Lines (Reported IV), PT. Samudra Indonesia Tbk (Reported V), PT. Tanto Line (Reported VI), PT. Lumintu Sinar Perkasa (Reported Party VII). The case was terminated in Decision No. 03/KPPU-I /2003 by the Business Competition Supervisory Commission. The purpose of this study is to examine how the concept of approach used by the Commission Assembly Team of Business Competition Supervisors in considering the case and decide in the decision No. 03 / KPPU-I / 2003 and how the form of pricing made by the business actors who became parties reported In the case. The independence of deliver opinion in public is a rightful authority every Indonesian citizen that written in Constitution Oof Republic Indonesian 1945 in Section 28 E Subsection 3, in addition to the independence of deliver opinion arranged further in Constitution Number 9 in 1998 about The Independence Of Deliver Opinion In Public Section 1 Subsection 1.However, not infrequently of demonstration were ended chaosly and anarchist, because of less pasification and coordination with police. The purpose of this thesis are : first, to find out the prevention of criminal act in demonstration, second,to find out police obstruct in prevention of criminal act in demonstration, the third, to find out the police efforts in content of prevention obstruct criminal act factors in demonstration.The design that used of this thesis was research sociological. In the thesis, the researcher did this research about the occur of positif law in prevention th criminal act in demonstration based on Constitution Number 9 In 1998 about The Independence Of Deliver Opinion In Public.The result of this research could conclude that prevention the criminal act not only did by police, but also the nitisen who did the demonstration to obedient the certainty of rules that obtained, the lack of awareness of nitizen who did demonstration to obedient the certainty of legislation became constant for police in did the prevention of criminal act, so the police have to do efforts of preemptive, preventive, and repressive in copewith.Keyword : demonstration - criminal act - prevention

Abstract

Konvensi mengenai status pengungsi tahun 1951 mengatakan bahwa pengungsiadalah orang-orang yang berada di luar negara kebangsaannya atau tempat tinggalnya seharihari,yang mempunyai ketakutan beralasan akan mendapat penganiayaan dikarenakan ras,agama, kebangsaan, keanggotaan didalam kelompok sosial tertentu atau memiliki pendapatpolitik tertentu. Pada umumnya, negara tidak diminta untuk mengizinkan orang asing masukke wilayahnya, namun pengungsi merupakan pengecualian dari aturan itu. Pengungsimerupakan orang yang berada dalam keadaan yang sangat rentan. Mereka tidak mendapatkanperlindungan dari negaranya sendiri, bahkan seringkali pemerintahnya sendiri yangmengancam akan menganiaya mereka. Dalam keadaan seperti itu, masyarakat internasionalmelakukan upaya-upaya yang diperlukan guna menjamin dan memastikan bahwa hak-hakdasar seseorang tetap dilindungi dan dihormati. Pada status perlindungan internasionaltersebut, seseorang yang dalam kapasitas sebagai pengungsi, wajib mendapat proteksi atashak-hak dasarnya sebagai manusia.Asas non-refoulement awalnya dikenal sebagai kerangka perlindungan pengungsiyang melarang negara penerima untuk mengusir individu yang bersangkutan ke wilayahdimana ia akan mengalami persekusi. Seiring dengan adanya perkembangan didalam hukumHak Asasi Manusia Internasional, asas non-refoulement dijadikan metode pemenuh danperlindungan hak-hak yang tidak diderogasi, salah satunya hak untuk bebas dari penyiksaan,perbuatan kejam, tidak manusiawi dan merendahkan manusia. Ini menjadikan asas nonrefoulementsering kali diaplikasikan tanpa pengecualian dan didiskusikan meraih status juscogen, norma tertinggi dalam hirarki hukum internasional.Dengan belum menjadi pihak pada Konvensi Tahun 1951 dan Protokol 1967, makaPemerintah Indonesia juga tidak mempunyai wewenang untuk memberikan penentuan statuspengungsi atau yang disebut dengan “Refugee Status Determination”(RSD), sehinggapengaturan permasalahan mengenai pengungsi ditetapkan oleh UNHCR yang merupakanbadan PBB yang mengurusi masalah pengungsi sesuai mandat yang diterima berdasarkanStatuta UNHCR Tahun 1950. Semua negara termasuk yang belum meratifikasi KonvensiTahun 1951 wajib menjunjung tinggi standar perlindungan pengungsi yang telah menjadibagian dari hukum internasional umum, karena konvensi tersebut sudah menjadi jus cogens,dan tak seorang pengungsi pun dapat dikembalikan ke wilayah di mana hidup ataukebebasannya terancam.Meningkatnya pencari suaka ini sangat mengkhawatirkan negara indonesia, karenaIndonesia bukan termasuk salah satu negara peratifikasi Konvensi 1951 Tentang Pengungsi,dan tidak mempunyai kewajiban untuk menerima para pencari suaka, apabila para pencarisuaka masuk secara ilegal ke Indonesia, dan dapat mengganggu stabilitas pertahanan dankeamanan indonesia.Kata Kunci : Konvensi 1951 – Non-Refoulement - Pengungsi - Ratifikasi
