Abstract

Sengketa laut China Selatan telah dimulai sejak tahun 1947, pada tahun tersebut Negara China membuat garis putus-putus untuk mengklaim semua kepulauan yang ada di Laut China Selatan. Permasalahan ini dilatarbelakangi oleh dua factor penting, yaitu : pertama, letak yang strategis yakni laut China Selatan merupakan jalur Pelayaran perdagangan dan jalur komunikasi internasional yang menghubungkan samudra Hindia dan samudra Fasifik, beruntung dari segi Geografi karena dikelilingi oleh sepuluh Negara pantai. Kedua, sumber daya alam yakni kekayaan alam yang terkandung di wilayah Kepulauan Spartly memiliki kandungan minyak dan gas alam yang besar. Sumber daya alam ini merupakan salah satu produk yang sangat penting bagi pembangunan ekonomi Negara. Yang menjadi objek focus utama sengketa antara Negara-negara sekawasan (China, Taiwan, Singapura, Philipina, Vietnam, Malaysia, Brunei Darrusalam) yaitu dua pulau utama yang terdapat di wilayah laut tersebut, terkhususnya Kepulauan Spartly. Tujuan penulisan skripsi ini yakni ; Pertama, Penyelesaian Sengketa Kepemilikan Kepulauan Spartly Berdasarkan UNCLOS III Tahun 1982, Kedua, Upaya-upaya yang di Lakukan Oleh Negara-negara Sengketa Dalam Menyelesaikan Sengketa Kepemilikan Kepulauan Spartly di Laut China SelatanJenis Penelitian ini dapat digolongkan dalam penellitian hukum normative, yaitu penelitian yang dilakukan dengan cara meneliti bahan sekunder atau penelitian yang berdasarkan aturan-aturan baku yang telah dibukukan atau dapat juga disebut dengan penelitian kepustakaan.Dari hasil penelitian masalah ada dua hal pokok yang dapat disimpulkan. Pertama, penyelesaian sengketa kepemilikan Kepulauan Spratly berdasarkan UNCLOS III Tahun 1982 yakni pada Pasal 279 menyebutkan penyelesaian sengketa secara damai. Pasal ini memberikan penjelasan bahwasanya penyelesaian sengketa dengan jalan damai merupakan penyelesaian sengketa yang harus lebih dahulu ditempuh dan yang sangat dianjurkan dalam Konvensi Hukum Laut Internasional dalam penyelesaian suatu konflik Hukum Laut Internasional. Kedua, Upaya penyelesaian konflik ini sudah dilakukan sejak tahun 1970an baik melalui upaya-upaya bilateral maupun multilateral. Dalam upaya-upaya tersebut telah disepakati beberapa hal seperti kerjasama pengelolaan wilayah Kepulauan Spratly, maupun pembagian sumber daya alam. Akan tetapi konflik ini belum selesai karena belum ada kesepakantan mengenai hak kepemilikan wilayah Kepulauan tersebut. ASEAN sebagai organisasi regional Asia Tenggara ikut berperan aktif dalam upaya penyelesaian konflik di wilayah tersebut.Kata Kunci : Penyelesaian Sengketa – Secara Damai – UNCLOS

Abstract

The criminal acts within the scope of household neglect criminal offense of domestic violence is classified as psychological domestic violence that can lead to mental burden for victims of perpetrators of domestic violence. Domestic violence belong to a specific criminal offense. In the High Court there are disparities Pekanbaru 3 criminal assault household negligence. First, the decision No. 219 / pid.sus / 2013 / ptr, Second, decision No. 45 / pid.sus / 2014 / ptr, Third, decision No. 150 / pid.sus / 2016 / pt.pbr.Based on the description in the background of the above problems, then formulate the problem as follows: First, Do the factors that cause the disparity perpetrators of neglect of household decision based on Law No. 23 of 2004 on the elimination of domestic violence in the city of Pekanbaru ?. Second, whether the judge has been performing its role in accordance with fairness, certainty and effectiveness in deciding criminal assault household negligence in Pekanbaru?.This type of research is classified dala kind of normative legal research. Penellitian type is descriptive analysis. The data used was obtained through three (3) legal materials is the primary legal materials, secondary, and tertiary. The data collection techniques were performed using methods, namely the study of literature.From the results of research and discussion can be concluded that the First, the main factors being 3 An appeal disparities in the criminal act of neglect of households in the High Court Pekanbaru are: problems of philosophy; sentencing guidelines; criminal benchmark issues; factor that comes from self-judge alone. Second, the judge has been carrying out its role in accordance with certainty in deciding criminal assault household negligence In the city of Pekanbaru. But viewed from the aspect of justice and expediency judges not done it, can be seen from the 3 three decision in the District Court Rengat and Pekanbaru an appeal, in because the defendant does not feel fair share of the verdict. Suggestions in this study is the first, then to minimize the negative impact of the disparity of criminal needs be a rule or rules which can be a guide judges in the administration of the criminal verdict to the defendant. Second, Providing information that is very clear to the public on the causes of the disparity criminal, the cases that concern people who are indirectly giving legal education to society should need to be improved to increase public knowledge about the judicial process and the law itself.Keywords: Disparity - Decision - Criminal Act - Domestic Neglect

Abstract

Baby disposal crimes more often happens. This happens due to peope sometimes failed to prevent himself from doing deviant tendencies because of economic interests, biological demands, status and the pride of himself. Even though this evil doings is a form of perversion of the norms and values of humanity. The Police as law enforcement agencies have to cope with this criminal act to avoid recurrence. But in the process of tackling this problem, there are some obstacles of course. Therefore, the author is interested to do research on the phenomenon in order to know the investigation process, obstacles and efforts by police investigation in Tenayan Raya sector against criminal acts of the baby disposal in jurisdiction of Tenayan Raya. To find the answers to these problems, the research done through interview and literature studies. Based on qualitative data analysis by the method of deductive reasoning obtained the answers that the investigation of baby disposal crimes in jurisdiction of Tenayan Raya is already running as it should, but not optimal. Tenayan Raya sector police’s obstacles in the investigation of criminal disposal of baby include: lack of investigators, community, lack of facilities and infrastructure, lack of information and the difficulty expressing the evidences factors. The efforts by the police in the investigation of baby disposal crimes in the Tenayan Raya’s region of law are: adding personnel, making a good relationship with the community, looking for an alternative use of facilities and infrastructure that less, published a wanted list, and disclosing effort of evidences. The author suggests that Tenayan Raya’s police are investigating quickly and thoroughly, making cooperation with other forces such as the institution for the protection of children in this investigation, and completing facilities and infrastructure that is needed.Keywords: Baby disposal, Investigation, Tenayan Raya

Abstract

Investigators conduct an investigation of the evidence carefully and thoroughly. if after investigation was the lack of evidence, no proof, no evidence, or even light not criminal cases, the police investigators may issue a Warrant Termination of Investigation (SP3). Warrant termination of investigation, in case No. 05 / Pid / Pra / 2014 / PN.Pbr which tells the story of a villager Asmi Nur, Nur Asmi reported Br. Hj. Eva Yuliana, wife of the regent of Kampar regency with his friends named Br. Very Inspire and Br. Ral Mulyadi suspected of committing criminal offenses as listed in Article 170 of the Code of Penal namely Whosoever openly and jointly use violence against people or goods.Construction law pretrial decision No. 05 / Pid / Pra / 2014 / PN.Pbr is a case against termination case investigation by the Riau Police. Applicant named Nurasmi aged 36 years, occupation housewife, located at street Pematang Kulim districts Eastern Kampar Kampar Riau. The defendant is kapolda Riau is located at Jalan Sudirman Pekanbaru. The case started around June 2014. At that time, Nur Asni and Jamal were working on the land in the village Birandang, Kampar, attended Eva, Jeffery Noer and some aides. At the site had been a debate for Eva claiming the cultivated land is hers. The result is argue with each other and allegedly led to the beating. Because of the incident, the victim was rushed to Arifin Ahmad Pekanbaru. When treated, the victim is known to experience some bruises and claimed traumatized because aide found herself at gunpoint by the regent. Nur Asmi has made a police report but then the Riau Police issuing SP3 so Nur Asmi pretrial seeked. The judges' verdict is declared cessation of pretrial investigation of the case No: S.TN/54/X/2014/Reskrimum on termination of the investigation on 10 October 2014 was unlawful, ordered the defendant to continue the process of investigation of the case No: LP / 123 / VI / 2014 / Videos / Res Kampar dated June 1, 2014.Follow-up conducted by the Riau Police on pretrial decision No. 05 / Pid / Pre / 2014 / PN.Pbr is to do with the reopening of cases of alleged maltreatment again this. Abstract

Child is someone who is not yet eighteen years old, including child who is still in the womb. In the case of children who has problems in the law is known by a way of diversion. Diversion istransfering problems of a child from the settlement of the criminal justice process to the outside of the criminal justice process. It is stipulated in Article 1 paragraph (7) of Law Number 11 Year 2012 on Child Criminal Justice System. The research objective of this minithesis, among others; First, to determine implementation of diversion Pekanbaru City Police, Second, To know the barriers that are faced Pekanbaru City Police, Third, To know the efforts of City Police Pekanbaru.This type of research can be classified in type of sociological research (empirical), because in this study the author directly conducts research on the locations or the places that are researched in order to give a complete and clear overview of the issues that areresearched. This research was conducted in the Pekanbaru City Police, while the population and the sample are all of the part that related withthis research, the data source is used, among others, the primary data, the secondary data, and the tertiary data, data collection techniques interview and literature. From the research, there are three fundamental problems that can be concluded.First, diversionary application in Pekanbaru City Police has been implemented according to procedures of an applicable law, it is just not running properly like is regulated in Law.Second, barriers which are faced Pekanbaru City Police in implementing diversion in cases of children in a conflict with the law, among others,factor of an identity, factor of a child psychology, awareness of law of citizens factor,law enforcement officials factor such as increasing knowledge and increasing thequality of investigators children.Thesuggestions, First,Enacting and implementing diversion in accordance with the Law.Second, adding children investigators especially woman investigator. Abstract

Pekanbaru as one of the developing cities has a lot of charms in the field of social, economic and cultural. Pekanbaru as a developing city can not be separated from the rampant circulation of narcotics. Provincial National Narcotics Board (BNNP) Riau has a role to overcome the narcotics circulation, but the role of BNNP is always having problems. The purpose of thesis writing to determine the role of BNNP in overcoming the narcotics circulation and to determine the factors that cause the high circulation of narcotics in the city of Pekanbaru.This type of research can be classified in the type of research Sociological Juridical, because in this study the authors directly conduct research on the location or place studied in order to provide a complete and clear picture of the problem under study. This study was conducted in the legal area of Penbaru City, whereas the population and sample are the whole parties related to the problems studied in this study, the data sources used, primary data, secondary data, and tertiary data, data collection techniques in this study by interview And literature review.From the results of research that the authors do can be concluded, the first Role of the National Narcotics Board of Riau Province in Tackling Narcotics Drugs in Pekanbaru City still not running maximally because to overcome the circulation of narcotics constrained funds for counseling or socialization conducted BNNP, and rehabilitation performed only succeed In the short term and the eradication carried out by BNNP is constrained due to lack of personnel in terms of both quality and quantity. Abstract

In the process of criminal justice, defense lawyers typically do with providing legal assistance to the accused in defending and protecting the interests of fundamental rights of freedom of justice seekers. advocates not just accompany the accused in the trial, but with all his knowledge to defend, prove the accused not guilty and uphold the interests of the defendant, both in substance law and legal procedure. Law Number 30 Year 2014 About the Administration, stating the elements of abuse of authority as stipulated in the law on Corruption Eradication must be assessed by the State Administrative Court. Here it takes the role and existence of the Advocate in defending the interests of the defendant to actively and intelligently in exploring and understanding the legislation, to ensure legal certainty on the defendant himself.As for the purpose of this thesis is how the existence of an advocate in defense of the accused in the alleged Misuse of Authority in the Corruption Court In Pekanbaru District Court and what are the obstacles encountered in the defense of the accused in the alleged abuse of authorityFrom the research problem can be concluded, first, the existence of an advocate in defense of the accused in the trial, has significant value for accused persons to prove whether he is guilty or not guilty. In the case of allegations of abuse of authority, Advocate provides legal assistance to the accused optimally including by ensuring the implementation of the testing element has been abuse of authority by the State Administrative Court before the alleged abuse of authority inspected or tried at the Corruption Court. The second, in stints profession Advocate gets constraints, namely: lack of legal awareness of the accused, not pahamnya advocate in legal developments, the stigma society has opined defendant guilty before the court decides, the difficulty of presenting defense witnesses / prove the defendant not guilty, and their menyelesaian judicial mafia is no longer a case based on facts so professional, quality, and ability to advocate no longer needed.Keywords: Advocate - Abuse of Power - Corruption Court

Abstract

Since regional outonomy era, the local boundary has meaning which is important as boundary of local government authority in implementing the government function in a certain areas which is regulated by regulations and has implication to appear the conflict of interregional about affirmation of area border because it’s related to uphold existence and the sovereignty on each local governments. But originally, the process of dispute resolution has regulated in Permendagri Nomor 76 Tahun 2016 which solves the conflict through administration route, it doesn’t solve the problems, even the parties can take legal effort in constitutional court justice in this process of dispute resolution so that changed the conflict patterns which initially among a region with another one become a region with state institutions. In this research, the writing purpose is not just to describe the conflict solution process through administration process only, but also is concerned with the solution process through judicial review against Undang-Undang Dasar Republik Indonesia Tahun 1945 by Constitutional Court.The type of this research can be classified in the type of normative law research is literature. In this normative law research, the author make the research against principles of law. Then, in this research concludes that Peraturan Menteri Dalam Negeri Nomor 76 Tahun 2012 is the true regulation which is able to solve the conflict of boundary area. Administration process which regulated in Undang-undang Nomor 23 Tahun 2014 could not solve the conflict problems of boundary area yet even though the decision was final decision but also have a legal effort as judicial review in constitutional court. The author recommends that will be formed a regulation which more have legal certainty and also engages the constitutional court in solving the conflict of boundary area, because is also about constitutionality.

Abstract

The regions that will hold the election consist of 7 Provinces, 76 Regencies, and 18 Cities. One of them is Pekanbaru City. 5 pairs of Mayor of Pekanbaru 2017, in the implementation of campaign by all Mayor and Vice Mayor Candidates there is a violation involving parties that are prohibited by legislation to assist in campaign process.The purpose of writing this thesis are: First, law enforcement in Article 70 of Law Number 10 Year 2016 on the Election of Governors, Regents and Mayors in the election of Regional Heads and Deputy Heads of Regions simultaneously in Pekanbaru City, Second, law enforcement inhibiting factors in Article 70 of Law Number 10 Year 2016 on the Election of Governors, Regents and Mayors in the election of Regional Heads and Deputy Regional Heads simultaneously in Pekanbaru City, Third, the efforts made to overcome the obstacles of law enforcement in Article 70 of Law Number 10 Year 2016 About the election of Governors, Regents and Mayors in the implementation of the election of Regional Head and Deputy Regional Heads simultaneously in Pekanbaru City. The type of research conducted in this study the author uses the type of sociological law research, research location in this study is Pekanbaru City. Population and sample are all parties related to the problem under study. Sources of data used are: primary data, secondary data, data collection techniques using unstructured interviews.From the research results there are three main issues that can be concluded. Firstly, the enforcement of the law of Article 70 is not in accordance with the rules contained in the Law on Regional Head Election, Second, the Factor inhibiting law enforcement in Article 70 of Law Number 10 Year 2016 on the Election of Governors, Regents and Mayors in the Implementation of the Election of Regional Head and Deputy Head of Serentak Region in Pekanbaru City is: there is fear of loss of position, political interest factor, political promise given to ASN, Internal Panwaslu factor, Third, Efforts made to overcome obstacles Law Enforcement Article 70 Law Number 10 Year 2016 about the election Governor, Regent, and Mayor in the implementation of elections of Regional Head and Deputy Regional Heads simultaneously in Pekanbaru City are: Providing socialization to ASN / PNS, emphasizing to ASN / Civil Servants regarding their alignment only to the people's interest, monitoring ASN / Civil Servants so as not to eat political promises . Author suggestion, Firstly, It is expected that supervision done by law enforcers in the future is better, there should be no system of tolerance to the enforcement of election rules. Law enforcers are expected to perform their duties in accordance with the prevailing regulations, The existence of transparency of law enforcement in following up reports or findings are reported. It is expected that the revision of the legislation related to the sanctions either be criminal sanctions or administrative sanctions for candidate pair and ASN / Civil Servants and it is expected that the addition of provisions concerning membership of District / Municipal Panwaslu (human resources) amounting to only 3 people related to the provisions of Article 72 paragraph 2) point c of Law Number 15 Year 2011 regarding the Implementation of General Elections.Keywords: Law Enforcement - Election Implementation – Regional Head

Abstract

Mining is a part or all phases of activities in the framework of research, management and exploitation of mineral or coal that include investigations, general, exploration, feasibility, construction, mining, processing and refining, transportation and refining, transportation and sales, and post-mining activities. Mining sand quarrying C in Kuantan Singingi an illegal mining that have negative impacts on the environment, public morality and so forth. Therefore, law enforcement agencies Regency Kuantan Singingi attempt to eradicate the illegal sand mining activities. But enforcement of the law by the Law Enforcement Institutions Regency Kuantan Singingi not run effectively and efficiently. This is evident from the data is the increasing number of illegal sand mining from 2013 to 2015. Of the many cases of illegal sand mining in Kuantan Singingi no legal proceedings. The purpose of writing the thesis as follows: first, to find out how the implementation of law enforcement against sand mining minerals C illegal in Kuantan Singingi, secondly, to determine what factors are obstacles in the implementation of law enforcement against Sand Mining Illegal District kuantan Singingi, third, to determine the extent of the role of Local Government in the discipline Regency Kuantan Singingi sand mining quarrying C in Kuantan Singingi.This type of research can be classified in this type of research Sociological, namely direct research on locations or places studied, this study conducted at the Department of Energy and Mineral Resources Regency Kuantan Singingi and police Resort Kuantan Singingi, the research wanted to see the correlation between the law society.From the research, there are three things that can be inferred. First, the implementation of the rule of law against the perpetrators of sand mining extractive C illegally in Kuantan Singingi. Second, obstacles encountered in the implementation of law enforcement against illegal sand mining in Kuantan Singingi them is the lack of public awareness, economic factors, and educational factors. Third, the role of the Regional Government of Regency Kuantan Singingi in mining curb illegal sand quarrying C in Kuantan Singingi of which is to disseminate the relevant community sanctions will be accepted perpetrators of illegal sand mining and the impact of mining on environmental sustainability. Advice writer, first, in carrying out enforcement against illegal sand mining in Kuantan Singingi should be maximized and efforts should be made to arrest the perpetrators of illegal sand mining and not only take steps to prevent it. Second, law enforcement authorities and agencies, Regional Goverment Regency Kuantan Singingi so diligently provide socialization law, so that more people understand and accept written rules made by the competent authorities in order that the higher legal awareness.
