Abstract

AbstractSOA Usage Status Determination Regulation in line with those mandated by Government Regulation Number 27 of 2014 on Management of State and Regional Assets has been regulated in Minister of Finance Regulation Number 246/PMK.06/2014 on Procedures for the Implementation of State Assets Utilization and Minister of Finance Regulation Number 41/PMK.06/2015 on Delegation of Certain Authority and Responsibility From State Assets Manager To State Assets User. The implementation of SOA Usage Status Determination in Regional Office Directorate General of State Assets Lampung Province and Bengkulu Province is not yet optimal because a little number of SOA status been defined. SOA optimization through utilization in order to gain state’s revenue through non-tax revenue is not the main goal, but the optimal use of SOA in order to support the implementation of the tasks and functions of Ministry/Agency. The implementation of State Asset Management Information System application was expected to support SOA management, especially related to supervision and control in the implementation of SOA Usage Status Determination.Keywords: State-Owned Assets, Usage Status Determination, SOA Utilization. Abstrakabstrak Peraturan SOA Status Penggunaan Penentuan sejalan dengan yang diamanatkan oleh Peraturan Pemerintah Nomor 27 2014 tentang Pengelolaan Barang Milik Negara dan Daerah telah diatur dalam Peraturan Menteri Keuangan Nomor 246/PMK.06/2014 tentang Tata Cara Pelaksanaan Penggunaan Barang Milik Negara dan Peraturan Menteri Keuangan Nomor 41/PMK.06/2015 tentang Pendelegasian Kewenangan dan Tanggung Jawab Tertentu dari Pengelola Barang Kkpada Pengguna Barang. Implementasi SOA Status Penggunaan Penentuan di Kanwil DJKN Provinsi Lampung dan Provinsi Bengkulu belum optimal karena sejumlah kecil status SOA telah ditetapkan. SOA optimasi melalui pemanfaatan untuk mendapatkan penerimaan negara melalui penerimaan negara bukan pajak bukanlah tujuan utama, tetapi penggunaan optimal dari SOA dalam rangka mendukung pelaksanaan tugas dan fungsi Kementerian/Lembaga. Penerapan aplikasi Sistem Informasi Negara Asset Management diharapkan untuk mendukung manajemen SOA, terutama terkait dengan pengawasan dan pengendalian dalam pelaksanaan SOA Status Penggunaan Penentuan.Kata Kunci: Aset Milik Negara, Penggunaan Status Penetapan, SOA Pemanfaatan

Abstract

The concept of the relationship of authority between central and local governments within the unitary state of Indonesia in the context of the widest possible autonomy based on the Constitution of 1945. Whereas, the Republic of Indonesia as a state of law is based on constitutional system so that in every action of law concerning the concept of the relationship between central and local authorities should be established through legislation, whereas in juridical manner of authority is a right and legal authority of government. So, in the concept of the legal state (rechtstaat) all of government action that came from their authority should be based on legality principle. Therefore, the authority which is one form of power has legitimacy (validity), which will be the relationship that authority has a legitimate power. In the legislation related of the division of authority between central government and local government that regulated in Law Number 23 of 2014 on local government is clearly not reflect autonomy broad. Keywords:Authority, Local Government, Autonomy

Abstract

The principle of freedom of fishing on the high seas was recognized as one of the principles in customary international law, the Geneva Convention on the High Seas1958, and Part VII of UNCLOS 1982. Regarding to thehigh level of utilization of fish led to the crisis of fishery resources, then the responsible fisheries management becomes a common agenda of the international community. Thisresearch is a normative legal research, data collection was done through studyliterature and documentaries on the primary and secondarylegal materials related to this problem.After conductedthe identification and classification of the data, then data was analysed normatively. There are some international conventions as a basis for maintainingthe conservation of fish on the high seas. UNCLOS 1982, the 1993 FAO Compliance Agreement, the Code of Conduct for Responsible Fisheries (CCRF) in 1995, the IPOA-IUU Fishing, 2001. The result showed thatIndonesia has had several regulations concerning to fisheries, such as Law Number 31 of 2004 concerning to Fisheries and Law Number 45 of 2009 concerning to Fisheries, and the Minister of Marine and Fisheries Regulation Number PER.03/MEN/2009 on Fishing and/or Transporting Fish on the High Seas and the Ministerial Regulation Number Per.12/Men/2012 concerning toEnterprises Capture Fishery on the High Seas. The Government of Indonesia should be able to take advantage of such participation and to improve the exchange of information, data, research fisheries, combating illegal arrests, and other forms of cooperation.Keywords: High Seas, Fish Resources, Indonesia, conservation

Abstract

The formation of The government regulation a substitute for the law of the Republic of Indonesia Number 1 of 2014 on the Election of Governor, Regent, and Mayor? How does the process of formation of the government regulation a substitute for the law of the Republic of Indonesia Number 1 of 2014 on the Election of Governor, Regent, and Mayor studied in the political perspective of the law? A substitute for the law of regulation making process shows again that the law is a product of politics. The fact that a political institutions, that chooses to create the rule of law. Although empirically then the law will be reset the political institutions. A substitute for the law of regulation is a Ius Constitutum as regulations on local elections. However, A substitute for the act of regulation it will not be effective because it is only temporary. Abstract

In Indonesia arrangement on Human Rights has been included in the constitution, starting from Article 28A to 28J, even re-clarified in Article 29 of the Constitution of 1945. Viewing of the formulation of articles in the 1945 Constitution, suggests that there is injury history so deep against human rights enforcement in Indonesia before the reform, thus setting Human Rights was included as detailed in the constitution that should only set the rules subject. Associated with the handling of victims with disabilities before the law, into a constitutional basis that disabled people should be applied equally before the law, even if not physically perfect and different from normal people as usual. Protection against disabilities, actually are not discussed explicitly in the constitution, but the Legal Power is in our constitution has leads to there, so some sectorial laws need to be explain to specifically.Keywords: Legal Protection , Disability , Rape

Abstract

It’s cannot deny that intellectual property right laws, in certain aspects are possible for using to protect traditional knowledge from their utilization. However, in the same time, intelectuual property rezim also become “a tool” to legitimate of biopiracy practices. Due to the massive of international pressure, mostly developing countries, and the awereness that intellectual property regimes doesn’t optimal to protect traditional knowledge, it develops a discourse to develop a sui generis law outside of intellectual property right regimes. By using the normative method and qualitative approach, this research shows that in order to develop the sui generis law in Indonesia, there are several minimum elements that shall be contained in it, inter alia: the purposes of protection; scope of protection; creteria of protection; the beneficiaries of protection: the holder of traditional knowledge; the kind of rights to be granted; how does the rights acquired; how to enforce it; how does the rights lost or expired; and dispute resolution.Keywords: protection, traditional knowledge, sui generis law

Abstract

This study is departed from the idea that the provision of budget for the persons with disabilities is a very important thing. Recalling this problem, a good regulation is required. This study raised a problem of the urgency of budgeting for the persons with disabilities and the funding strategy as well as the juridical strategy in governing the budget for the persons with disabilities. This study employed a juridical analytical method, a research which is conducted to analyze certain provision of law to be used later in answering the society’ problem. From the research, it could be found that the provision of fund to provide the infrastructures for the persons with disabilities is very urgent. Such urgency included the reasons concerning the funding provision for the persons with disabilities and the determination of their needs required the funding provision. The budgeting strategy for the persons with disabilities is highly dependent on who is responsible for the affairs concerning the persons with disabilities. In the context of the relationship division between Central Government and Local Government, it includes those decentralized to local areas. For that reason, the local areas could provide it from Local Original Income (PAD) deriving from Entertainment Tax with earmarking pattern. When it was not sufficient, recalling that the existing local tax potential was inadequate or null, the funding for the persons with disabilities could be provided by Central Government and the other legitimate source of funds. The regulation strategy which should be taken is to amend the Law Number 28 of 2009 and Law Numer 40 of 2007 on Corporate Social Responsibility, to establish the Law of the Persons with Disabilities to govern the funding.Keywords: persons with disabilities, budget, state finance
