Abstract

Abstract                                                                                                   In Indonesia, bitcoin is a form of digital currency (e-money) and means of payment transactions that have been used by some communities. It is necessary to get attention, especially from Bank Indonesia. Other than that, the supervision that was once fully done by the central bank of Bank Indonesia, is now taken over by OJK (Otoritas Jasa Keuangan). Thus, Bank Indonesia only has the authority to regulate and control the circulation of currency only. Since some of the tasks and authorities of Bank Indonesia were taken over by OJK (Otoritas Jasa Keuangan), many things have not been covered, such as the new phenomenon in the field of finance in terms of capital, investment, currency circulation, and others. In addition there is no legal umbrella against bitcoin, which is increasingly widespread transaction using bitcoin done in e-commerce transactions. So in terms of security also need to be questioned, therefore there needs to be regulation and supervision specifically against bitcoin, and society will not feel harmed. When viewed in the perspective of Islamic law, that relating to the issuance of money as a means of transactions in a country, is a matter protected by general rules in Islamic law. Therefore, the issuance of money and the determination of the amount is matters relating to the benefit of the people. Another aspect to consider in the use of bitcoin is whether from the side of madharat is greater or benefits taken if used as currency and tool transactions, even as a commodity though. So the focus in this research is the use of bitcoin as currency and transaction tool by using approach and study of Islamic law.

Abstract

ملخص يقوم هذا البحث على إظهار تأسيس مقاصد الشريعة التقدمية لرد الفكر الإرهابي والتطرفي, فإنه لا يكفى الرد له بمجرد مقاصد الشريعة القدامى, لأنها من قبيل الشريعة بالمعنى الضيق وهونطاق الفقه, الذي يمكن أن يفتح التطرف  والتشدد, ولذا تتطلب لرده المقاصد الشاملة, التي تقوم على ثلاث دعامات, أولا: حفظ التسامح الذي بدوره احتفظت وحدة الأمم, وثانيا: نطاق دراستها التي لا تحتوي على الفقه فحسب, بل على العقيدة والتصوف حسب الشريعة بالمعنى الواسع, وثالثا: تقديم الأدلة الكلية على الأدلة الجزئية  لأن الكلية أقرب الى القطعيات,  وبصيغ هذه المقاصد تقوم عليها الحياة الإنسانية في المجتمع التعددي بحيث إذا اختلت واحدة منها, أتاحت إمكانية الفكر الإرهابي والتطرفي.

Abstract

ملخصإن لدراسة القواعد الفقهية أهمية كثيرة. وقال الزركشي مؤكدا لأهمية القواعد الفقهية: "وهذه قواعد تضبط للفقيه أصول المذهب وتطلعه من مآخذ الفقه على نهاية المطلب وتنظم عقده المنثور في سلك وتستخرج له ما يدخل تحت سلك". (الزركشي. 1985: ج 1 ص 65). .يقول السيوطي  بعد أن بين أهمية الفقه موضحا أهمية القواعد الفقهية: "...ولقد نوعوا هذا الفقه فنونا وأنواعا وتطاولوا في استنباطه يدا وباعا وكان من أجل أنواعه : معرفة نظائر الفروع وأشباهها، وضم المفردات إلى أخواتها وإشكالها...". (السيوطي. 1990: 4). بهذا يتبين أن للقواعد أهمية كثيرة في تيسير الفقه الإسلامي حيث تجمع الفروع الكثيرة وتجمع شتاتها في سلك واحد تحت قاعدة واحدة. وفي فهم القواعد الفقهية تيسير على المفتين والفقهاء وطلاب العلم ضبط الفقه بأحكامه، لأن حفظ جزيئات وفروع أمر في غاية الصعوبة، أما حفظ القواعد ففيه يسر. وكذلك دراسة القواعد الفقهية تكون لدى الباحث والطالب ملكة فقهية تجعله قادرا على التخريج لمعرفة الأحكام الشرعية، وذلك لان القواعد الفقهية وسيلة لاستحضار الأحكام. ومن هنا تكمن أهمية البحث حول القواعد الفقهية. كما أن هذا البحث يتناول القواعد الفقهية التي استخدمها مؤلف كتاب إعانة الطالبين في باب العبادات: الصلاة والصيام والزكاة والحج. فالكتاب مهم في المذهب الشافعي، كما أن الكتاب منتشر بشكل واسع وقاموا بتدريسه في المعاهد الإسلامية في إندونيسيا. فالقواعد الفقهية الخمسة تعتبر من القواعد الفقهية في غاية الأهمية لما تشمل في كثير من أبواب الفقه بل وفي كلها. وهذه القواعد الفقهية الخمسة قيل عنها: إن الفقه كله مبني عليها، وهي: الأمور بمقاصدها، اليقين لا يزول بالشك، المشقة تجلب التيسير، الضرر يزال، وقاعدة العادة محكمة.

Abstract

Islamic education for the nation of Indonesia becomes very important because it is known as a diverse nation in various aspects, such as religion, ethnic groups, languages, traditions and even colors. Once differences is not supported by human maturity, it easily leads to conflict of life. Maturity becomes the main factor to set it in order, safe, comfortable and peaceful atmosphere among humans. Maturity is also one indicator of educational success. It is characterized by three things: independence, stability and responsibility. These three are able to realize personal quality and also produce the social quality for humans. Based on Law number 20 year 2003 about National Education System, the position of Islamic education is very strategic because its essence contained also functioned as barometer in arranging the Indonesia national education system. They are found out as the unity of the nation, among others, spiritual power, the ability of self-control, personality, intelligence, noble morals and various life skills that are useful for individual, society and country.

Abstract

To realize the learning, it takes teaching supervision activities. The target of supervision is the teaching staff. The  purpose  of  this  paper  is  to  find  out  (1)  how  the teaching  supervision  activities  in  madrasah  is  (2)  how the techniques and approaches of supervision is (3) how the supervision of teaching in the madrasah is based on pesantren culture. The research method is library research with the technique of collecting the source of supervision theory of teaching through literature study and analysis technique   with   deductive-inductive    thinking   pattern. The results showed that (1) supervision of teaching in madarash is a function of leadership communication with pesantren  culture  so  the  relationship  between  teachers with the headmaster  or between  teachers  and students is to follow the pattern of relationship between kyai and santri (2) supervision approaches with a limited personal relationship approach and in an informal setting are much more effective because supervisory activities between teacher and headmaster are not open (3) teaching supervision  uses cultural  organization  group of religion technique (4) teaching supervision uses situational integrated approach.

Abstract

The Crusades had a tremendous impact particularly on the Western Europe; these wars led to the development of the European civilization. The Crusades necessarily include both destructive and constructive elements. It expanded the trade, exploration, and scientific inventions much significantly for the Europe. Similarly, but not as deep and wide as on the Western Europe, the Crusades impact could be seen on some socio-religious elements of the Muslim world. Further, the bitter legacy of these wars widened the hostility, hatred, and dissent between the West and the Muslim world that still is perceived in one way or the other. The present paper attempts to revisit the impact of the Crusades into a broader social, economic, political, and religious context. It will first investigate the Crusades’ impact on the Muslim world and, then accordingly and importantly on the Western Europe vis-a-vis trade, economy, religion, knowledge, scientific inventions, literature to name a few prominent areas. The Crusade imagery, ideology and symbolism are so much powerful and immense so that it has subsided and undermined the constructive/positive impact the Western Europe achieved by confronting with the Orient/Muslim world. The paper concludes that the Crusades’ positive impact and interaction if broadly highlighted and explored, and if given considerable space in public and academic discourses then the possibilities of the East-West tension and hostility could be alleviated to a considerable extent.

Abstract

Section-1 of this paper provides an understanding and comparison of the fundamental concepts of Modern Human Resource Management (MHRM) and Islamic Human Resource Management (IHRM). Section-2 identifies the implications of MHRM and IHRM from modern/secular and Islamic/religious perspective on HRM and the metamorphosis between their concepts. Section-3 claims that MHRM and IHRM do not produce similar results. The application of MHRM results can only be achieved in the life of this World, but the results of the IHRM can be achieved in the life of this World, and also in the life of World-Hereafter. Section-4 presents a survey based research, comprised of quantitative data showing the perception of employees about IHRM and its resultant impact on Organizational Commitment.  A questionnaire for data collection and survey approach has been used to study the perception of IHRM on employee-commitment. The research suggests the importance of adopting IHRM based strategies to increase organizational commitment among employees.

Abstract

AbstracThis paper describes the development of Sufism in South Sulawesi. As in the archipelago such as Aceh, Minangkabau, Palembang, Banten, Demak, Banjar and Ternate, Gowa and Bone as the epicenter of the development of Islam in South Sulawesi is also influenced by Islamic teachings of tasawuf. The preachers who brought Islam to the archipelago were Sufis who taught Sufism. During this happening contestation and clash between the philosophical color of Ibn Arabi and tasawuf al-Gazali, then Sufism's style that developed in South Sulawesi society successfully reconciled these two domains which then called Neosufisme. The main figure of Sufism in this period is Sheikh Yusuf al-Makassari who developed Tarekat khalwatiyah Yusufiyah and Sheikh Abdul Munir Syamsul Arifin developed Khalwatiyah Sammaniyah. This tarekat then gives influence to the people of South Sulawesi, especially in the Kingdom of Gowa for ethnic Makassar and the Kingdom of Bone for ethnic Bugis. The influence of Sufism is still being felt in various aspects
