Abstract

Badamai at Banjar Adat community is the implementation of Islamic moral value that have always taught the way of peace or islah in resolving a dispute. Badamai in inheritance disputes prevalent in Banjar society islah way. Similarly in the case of dispute resolution such as divorce marital reconciliation, separate beds (barambangan), including the division of joint property badamai finish (treasure continence) during the marriage in the event of divorce or because of divorce life, this is often done by attempting to reconcile through roles (hakamain). The results of this research are: (1) the division of the community estate in Banjar performed usig an agency called islah, which is essentially the institution determines each part of the theirs and other beneficiaries by consensus. In the role of institutions islah master teacher and close relatives are parents is crucial. Therefore there is the role of master teacher, then the provisions of Islamic aw into their benchmark. But under normal circumstances (no inheritance dispute) the division of inheritance is done varies, at least in two ways, Fara’id-Islah ad second Islah way, and (2) how to completion of the distribution of the estate is done in a family that is by agreement of the heirs based on a custom badamai valid for the Banjar, a wise solution to address the differences in economic conditions heirs. Waris Distribution Agreement in principle heir to the principle of division of real kinship is based on the belief of the scholars of fiqh that matter the beneficiary is an individual right which shall have the right to use or not use its right, or use their rights in a particular way while not harming others in accordance with the standard rules apply in ordinary circumstances

Abstract

Sekitar tiga dasawarsa, pertumbuhan ekonomi yang berbasis pada paham pembangunan, sebagian besar tersumbang oleh eksploitasi dan eksplorasi sumber daya agraria/sumber daya alam, dikuasai dengan hak tertentu dan ada pula yang terlantar. Penelantaran tanah juga berdampak pada terhambatnya pencapaian berbagai tujuan program pembangunan, rentannya ketahanan pangan dan ketahanan ekonomi nasional, tertutupnya akses sosial ekonomi masyarakat khususnya petani pada tanah, serta terusiknya rasa keadilan dan harmoni sosial. Menyadari hal tersebut, dilakukanlah program pengaturan, penataan, dan pemanfaatan tanah, sebagai konsekuensinya harus pula dilakukan penataan tertib Hukum Pertanahan dengan menggunakan pendekatan aspek ekonomi, tetapi juga memperhatikan aspek-aspek lain, termasuk aspek pembangunan di bidang hukum, politik, kesejahteraan, pertahanan dan keamanan. Penertiban tersebut berguna untuk mencegah dan menertibkan serta mengurangi atau menghapus dampak negatif penelantaran tanah. Reforma Agraria akan melakukan penataan atas penguasaan, pemilikan, penggunaan, dan pemanfaatan tanah (P4T) atau sumber-sumber agraria menuju suatu struktur P4T yang berkeadilan dengan langsung mengatasi pokok persoalannya atau tanah harus dikerjakan atau diusahakan secara aktif oleh pemiliknya sendiri. Penelitian ini mengetengahkan masalah hakekat reforma agraria dan konsep penertiban dan pendayagunaan dalam hukum pertanahan di Indonesia.

Abstract

Furifikasi sistem presidensial dalam perubahan UUD NRI Tahun 1945 telah memberikan penguatan terhadap kedudukan Presiden. Namun demikian, furifikasi tersebut belum sepenuhnya memberikan penguatan, karena kewenangan presiden yang terlalu besar dalam bidang legislasi, lemahnya kewenangan legislasi DPD dan dianutnya sistem multipartai. Oleh karena itu, dalam rangka penguatan sistem presidensial perlu dilakukan perubahan, yakni penghapusan kewenangan legislasi Presiden, penguatan legislasi DPD, penyederhanaan partai politik dan pemilihan umum serentak

Abstract

Peristiwa kekerasan dalam rumah tangga (KDRT) didominasi oleh istri sebagai korban. Kekerasan dalam rumah tangga berkaitan erat dengan persoalan gender, adanya diskriminasi terhadap perempuan, serta diidentikkan dengan permasalahan pribadi dalam suatu keluarga. Kekerasan yang dilakukan oleh suami terhadap istri bukan hanya kekerasan fisik, tetapi juga kekerasan psikis, ekonomi dan seksual. Dengan berlakunya Undang-Undang Nomor 23 Tahun 2004, maka diharapkan penegakan hukum terhadap kekerasan yang dilakukan oleh suami terhadap istri dapat dilaksanakan secara maksimal. Baik dengan melakukan penanggulangan secara penal maupun non penal. Sehingga hambatan-hambatan dalam penyelesaian kekerasan yang dilakukan oleh suami terhadap istri dapat ditanggulangi. Penulisan bertujuan mengetahui pengaturan hukum kekerasan yang dilakukan oleh suami terhadap istri, serta faktor-faktor penyebab dan upaya penanggulangannya.

Abstract

Observing the development of public acceptance of the substance of the laws that were generated in recent time, the right of judicial review of an option that can not be avoided for the 'correct' errors that might occur in a legal product to guarantee the protection of constitutional rights of citizens. The tendency in this direction can be seen from the desire of some community groups to apply for judicial review and claim that they are legal products containing controversial value both to the Supreme Court nor the Constitutional Court. If prior to the amendment of the 1945 Constitution, laws and regulations that can be petitioned for review of material just under the Act against the Constitution, but after the 1945 amendment, the legislation level as the Act was that the Act and also Perpu material can be petitioned for review to the Constitutional Court.

Abstract

ASEAN formed pursuant to Declaration of Bangkok on 8 August 1967 signed by five figure founder of ASEAN. ASEAN represent intergovernmental international organization with membership of regional for the purpose of and target of international organizational public which have pattern and distinguish area which its activity area very wide and public and also ASEAN have shown its ability as one of international organization which have fulfilled conditions a international organization. ASEAN of Nations the including Indonesia as member of ASEAN have been given on to heavy challenge namely era fight against terrorism. This proven at decade in year 2009 and till now in the year 2011 as does arrest of Dusty Ustad Abu Bakar Ba'Asyir in Central Java, and till now in course of justice is ecsess than era fight against terrorism. ASEAN of nations have taken legal efforts in anticipating extension of terrorism network in Indonesia through international is same activity. Problems which can be lifted on the surface of, where to this moment terrorism problematica still become serious threat to society, governmental and state in the world in general, and also in Indonesia especially namely same activity what have been taken by ASEAN of nations in anticipating extension of terrorism network in Indonesia and how implication of yuridis-sosiologis of execution of same activity between ASEAN of nations in anticipating extension of terrorism network in Indonesia.

Abstract

Di dalam UUD NRI 1945 terdapat frase “perbuatan tercela” sebagai salah satu syarat untuk memberhentikan Presiden dan/atau Wakil Presiden menimbulkan ketidakjelasan norma. Hal lainnya yaitu memasukkan norma agama, norma kesusilaan dan norma adat ke dalamnya sebagai indikator perbuatan tercela. Hal ini membawa konsekuensi terhadap Presiden sebagai kepala eksekutif karena dengan adanya ketidakjelasan norma akan menimbulkan ketidakpastian hukum (muncul berbagai interpretasi). Di dalam mewujudkan indikator perbuatan tercela maka wajib menghilangkan perbuatan yang keberlakuannya dapat dinilai oleh masyarakat luas artinya di dalamnya harus mempersempit apakah yang dimaksud sebenarnya dengan perbuatan tercela.
