Abstract

Health is one of the human rights guaranteed in Article 28H paragraph (1) of The 1945 Constitution of The Republic of Indonesia that state is responsible to respect, protect, and fulfill its implementation. Health Act is a manifestation of the right to health services to improve public health based on the principles of non-discriminatory, participatory, and sustainable. One of the nurses as health professionals working in remote and difficult to reach in a dilemma in the form of a very limited authority to health personnel, in addition to pharmacy personnel, associated with pharmacy practice set out in Article 108 paragraph (1) of the Health Act and Explanation, while in others there is the threat of the sanction of imprisonment or fines provided for in Article 190 paragraph (1) if the Health Act deliberately did not provide help to patients in emergencies. Abstract

Based on research that aims to describe and mengekspla-nasikan patterns political intervention in the judicial process Komando Jihad, and basing on non-doctrinal approach, it is known that the process of checking and passing judgment in the case Komandi Jihad, can not be separated from the executive power and the intervention or military, conducted through: (a) the use of military kekuatasan, which shall: (1) structural interventions, whether made directly or indirectly, (2) non-structural interventions, (b) through Intelligence Operating System, which is done through the strategy are: stocking, fishing rods and nets as well; glassware and mastered. Key word : Komando jihad, intervention, trial.

Abstract

Professional development of civil servants through performance assessment is a part of management personnel in the evaluation phase. Normatively, work assessment is made in the form of decisions issued by the officials of the state official. The perceived detrimental decisions of civil servants in the performance appraisal of personnel sometimes been disputed that need a fair settlement. Abstract

 The establishment of KPK (Corruption Eradication Commission) as an institution is aimed neither to settle every corruption case nor to monopolize every corruption case settlement on court. KPK was initiated as a trigger mechanism institution in the corruption case settlement to the law enforcer institution. Therefore, the authority and responsibilities of KPK are to coordinate and to supervise. Article 6 point a and b No. 30 year 2002 concerning the coordination and supervising function mentioned above. Both has important role on the corruption cases investigation in the region. Up to now, these functions are not maximally executed by KPK. Year-by-year sub-division of coordination and supervision of KPK has a specific target to be done; nonetheless, there are lot of police and attorney investigators who are assigned to handle the corruption cases in the region state that the execution of these functions are still far from expectation. Key words: coordination, supervision, corruption investigation

Abstract

Kuningan, local government districts declared as a conservation district. Kuningan district government coordination and cooperation with regard to conservation, namely: First, they Policy-makers need to understand how awareness of water conservation can help solve water shortage pro-blems while providing economic and social benefits, making environmental regulations that support conservation; Second, Water managers and the role of experts involved in the planning, develop-ment, and management of the water system, including managers and scientists working for the preservation of the environment is to create a reservoir as well as the urban forest in order to streng-then the conservation and Third ). Mass Media and Educators, their knowledge of the water sector may be little but they are experts in public relations, communications, marketing, and education is to create programs that support conservation programs such as Seruling (Students are concerned about the environment), Apel (Apparatus care environment) Pepeling (Bridal care for the environ-ment) and the Car Free day car-free day program. Kuningan district invites the public to play a role in realizing kuningan participate as a conservation district that is the existence of programs that support the conservation of water resources. Abstract

Appropriate wage Law must base on labour regulation and labour acts, fulfil substantive justice criteria related with continuous work relationship, peaceful and harmony with business owner, and also had rights and proper wage. The idea to formulate regulation in wage sector transparently by wage method, survey mechanism, structured, and scaled as well as surveillance/supervision. Besides that, encourage Labour Organization/Worker Association to implement their obligation to protect and to defence the rights and interest of their members. Result of wage law reformulation hopefully could foster Indonesia’s labour legal system which had equal values universally. Keywords: System, undertaking, worker, substantive justice.

Abstract

Gratification is defined as a gift in broad meaning, which cover money, goods, discount, commision, loan without interest, travel ticket, accomodation facility, tour travelling, free health service, and other facilities. The issue is that many institutions have used definion of gratification provided in Law No.20 of the Year 2001 to regulate ethical code in the institutions. This is interesting because the definition in the Law deal with criminal offence while definition in the ethical code deal with ethical violation. Sincronization is needed to differentiate between gratification in criminal law perspective and ethical perspective.  Key words:  gratification, corruption, KPK

Abstract

The result of this research showed that the spatial arrangement of the function in preserving the environment is experiencing a variety of  problems; First, the conflict between sectors and across regions.  Second, environment degradation due to the spatial deviations among land, sea and air. Thind, support for the development of the region is not optimal, as indicated by the lack of policy support for the development of strategic areas of national and local goverments. Therefore, it needs a commitment from Gorontalo city government to address these problems through or local lawch which regulate the spatial function of Gorontalo City. Keywords : spatial, environment, environmental law

Abstract

Science and Ocean Technology rapid development has great impact upon the exploration and exploi-tation growth. This dynamic development shall be followed by empowerment of International Law, therefore, natural resources as the mankind treasure in the sea bed can be protected and managed wisely. International Law has defined rights and duties of each nation, however those rights and du-ties can't be best enforced without good cooperation involving nations and international organiza-tion. Abstract

Law Number 32 Year 2009 on Environmental Protection and Management ( UUPPLH ) that have entered criminal provisions in Chapter XV , which consists of 23 chapters. Provision of punishment is much more complete and detailed than the Law Number 23 Year 1997 on the old  Environmental Law, but still a lot of things that need to be addressed in the UUPPLH. The results showed that the enforcement of the criminal law to an act of formal law has a special event, because it relates to the principle ultimum, meaning that the effective use of criminal law to an act of formal law enforcement have to wait until the administration declared is no longer effective. To avoid difficulties in the enforcement of environmental law, the legislation specifically about formal law should be drafted clearly, firmly, not interpretations. Authors attempt to compare with Environmental Law in South Korea, in order to find a refinement of Law Number 32 of 2009. Key words: criminal law policy, enforcement of environmental law
