Abstract

Introduction: Midwife professionalism is the basic social contract between a midwife and society so that professionalism is considered to be very important. There are some cases related to midwife professionalism. Midwife as health practitioner should understand about midwifery practice very well. The midwife should realize that she works based on regulation and law. Material and Method: The study was aimed to find out the professionalism in midwifery practice. Non Doctrinal research was used as the research approach. The sample was taken with non-probability sampling, which is a snowball technique. Findings: 93% of midwifery practices were qualified to administer code of ethics, 86% of midwifery practices were qualified to administer responsibility of midwifery practice, 93% of midwifery practices were qualified to precise collaboration and reference for midwifery practice, all the midwifery practices were qualified to administer continuing education in order to improve midwifery care, 93% of midwifery practices were qualified to competence for midwifery practice, 53% of midwifery practices were qualified to administer advocacy. Conclusion: It can be concluded that the midwifery practice has fulfilled the professionalism indicators such as profession code of ethics, responsibility, precise collaboration and reference, continuing education, and competence. Nevertheless, there were some professionalism indicators which have not been fulfilled. It was giving advocacy. It was due to the lack of knowledge and comprehension about advocacy in midwifery practice.

Abstract

Purpose of the study:This article aims to define Prophetic (Islamic demystification/Islamic scholarship) which is a concept offered by Kuntowijoyo to integrate science and religion. Unlike western epistemology, prophetic includes revelation and the heart as part of the ontology. From the aspect of prophetic epistemology, it is based on synthetic and analytic approaches with transcendental structural methods, while from axiological aspects, justice with prophetic ethical values are humanization, liberation, and transcendence, becomes the goal and values.Methodology: This research was based on a philosophical approach because it was intended to explore the epistemological building of the prophetic paradigm offered by Kuntowijoyo. The main sources of information in the form of Kuntowijoyo's writings and thoughts about the prophetic paradigm  were collected through library studies. The data that have been processed were analyzed using descriptive analysis, interpretation, hermeneutics, and heuristics.Main Findings: Prophetic can be used as one model to integrate science and religion, which is done by connecting the text with the context.Applications of this study: This study can provide keywords that can be used as a guide to understand prophetic such as: (1) qauliyah verses, kauniyah verses, and nafsiyah verses; revelation, reason, heart, and senses, as a keyword in understanding aspects of ontology; (2) synthetic and analytic approaches with transcendental structural methods, as keywords in understanding aspects of epistemology, and; (3) justice which is based on prophetic ethical values encompassing humanization, liberation, and transcendence, as keywords in understanding the axiological aspects.Novelty/Originality of this study: understanding the prophetic paradigm of Kuntowijoyo

Abstract

The research aimed to describe the public legal awareness about meat distribution and legal protection for the beef consumers through law enforcement efforts at Boyolali District based on a qualitative non-doctrinal approach. Therefore, this focused more on primary data collected by interviews and observations and supported by secondary data collected by library research. The data then were processed for further qualitative analysis. Based on the results of the study it was found that legal protection related to the distribution of healthy and safe meat did not run well as this was influenced by the community legal, namely the knowledge and understanding of law, although it had been supported by good legal attitudes and behavioral factors.

Abstract

Tujuan: Penelitian ini bertujuan untuk mengetahui penerapan Peraturan Perundang-undangan di Indonesia dalam kasus penyandang disabilitas korban tindak pidana asusila, kemudian perlindungan hukum terhadap penyandang disabilitas korban tindak pidana asusila, serta peran Sasana Inklusi dan Gerakan Advokasi Difabel dalam proses advokasi terhadap korban difabel.Metodologi: Metode pendekatan yang digunakan adalah pendekatan non-doktrinal kualitatif. Jenis penelitian yang digunakan adalah penelitian deskriptif. Penelitian ini menggunakan sumber data primer dan data sekunder. Metode pengumpulan data yang digunakan adalah studi kepustakaan, dan wawancara.Temuan: Terdapat perbedaan penerapan Peraturan Perundang-undangan terhadap kasus penyandang disabilitas korban tindak pidana asusila (perkosaan dan pencabulan) antara korban dewasa dengan korban anak. Perlindungan hukum terhadap penyandang disabilitas korban tindak pidana asusila dilakukan melalui pemenuhan hak yang berkaitan secara langsung. Peran SIGAB dalam mendampingi korban difabel meliputi proses litigasi dan non litigasi.Kegunaan: Pemerintah perlu segera menyusun dan menerbitkan Peraturan Perundang-undangan yang berkaitan dengan Perlindungan Penyandang Dsabilitas, serta tentang Sistem Peradilan Pidana Penyandang Disabilitas.Kebaruan/Orisinalitas: Penyelenggaraan pendidikan dan pelatihan tentang “Teknis Peradilan Pidana Penyandang Disabilitas Berhadapan Dengan Hukum” bagi Penyidik, Jaksa, dan Hakim dapat menambah pemahaman dan pengetahuan para penegak hukum tersebut dalam proses pemeriksaan di setiap tingkatan terhadap penyandang disabilitas berhadapan dengan hukum.

Abstract

The mosque is not only a place for congregation to pray five times a day. Mosques have social, educational and even economic functions. LP3M IAIN Ponorogo has developed mosque posdaya with the aim of empowering the community on the basis of a mosque. The principle of empowerment used is emancipatory, which is to organize the community by placing the community as the subject (subject) with the empowerment paradigm that rests on the community (community based development). The program called the mosque's Posdaya is centered at the Thoriqul Huda mosque, Dorokenong Hamlet, Tulung Village, Sampung Ponorogo District. The revitalization of the function of the Thoriqul Huda mosque is carried out by empowering the economy of congregations who are economically disadvantaged or called pre-prosperous communities. Economic empowerment activities are manifested through entrepreneurship training activities for plastic bag making and marketing. The activity is aimed at providing life skills for preprosperous families of mosque congregations. In the next stage, improving the life skills of congregations from underprivileged families must be supported by capital and network access. Mosques develop amil zakat institutions and mosque cooperatives by strengthening mosque religious management.

Abstract

Trade is a form of economic activity that has an effect on increasing the economy of a region. The availability of place, time, and goods is not a problem in trade, because the touch of technology is one of the solutions. Technology in buying and selling makes it easier for sellers and buyers to make transactions without meeting and based solely on the principle of good faith. Regarding the problems that occurred in the research process, several respondents admitted that the problems that often arise came from the traders. The use of oral agreements in buying and selling becomes a habit that cannot be abandoned by Klewer Market traders, even though they are aware that their position is weak if there are legal problems in its implementation. The conclusion is that the unwritten agreement entered into by a Trader with a supplier of goods at Klewer Market is still valid and binding on both parties but is weak in terms of proof in case of a civil dispute. On the other hand, we try to review the application of the principles of good faith in oral agreements between traders and suppliers of goods based on local wisdom.

Abstract

Based on the philosophical approach, it is known basic assumptions of rational paradigm as seen in Hans Kelsen's pure theory of law that consists of: human assumptions based on the quasi-transcendental along with its characters and aurea aetas; ontological assumptions based on empirical reality and equating sein reality with sollen, and normativity created as logico transcendental conditions; epistemological assumption that underlying the science of law as cognitive science, creating the rule of law as a whole object, and reconstructing legal norm as the relation between non-causal and non-metaphysical facts; axiological assumption that reconstructs norm as the object of legal science and equating the basic norms with natural laws.Key words: basic assumptions, rational paradigm, the theory pure of law, jurisprudance.

Abstract

The research focuses on a critism study of epistemologycal basis of the relation between law and morality in H.L.A. Hart’s rational paradigm. It is according to prophetic paradigm which is based on philosophical approach. According to the analysis, it is concluded that Hart’s opinion is based on the epistemological basic assumptions including the primary and secondary rules; Value/Ethics including epistemological ethics such as autonomous, individual, procedural, and relative ethics while the prophetic paradigm is based on the epistemological assumptions in which Relative Morailty is the result of creation and will of absolute reality. Meanwhile, Norm of morality means the reality should be created by the competent will through a delegate with epistemological ethics such as the combination between reality of society and apocalyptical values. Keywords: Moral Concepts, Prophetic Paradigm and Rational Paradigm
