Jurnal Cita Hukum
Jurnal Cita Hukum is an international journal published by the Faculty of Sharia and Law, Universitas Islam Negeri Syarif Hidayatullah Jakarta, Indonesia. The focus is to provide readers with a better understanding of legal studies and present developments through the publication of articles, research reports, and book reviews. Jurnal Cita Hukum specializes in legal studies, and is intended to communicate original researches and current issues on the subject. This journal warmly welcomes contributions from scholars of related disciplines. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws and legal system. Published exclusively in English, the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. The Review, hence, welcomes contributions from international legal scholars and professionals as well as from representatives of courts, executive authorities, and agencies of development cooperation. The review basically contains any topics concerning Indonesian laws and legal system. Novelty and recency of issues, however, is a priority in publishing. The range of contents covered by the Review spans from established legal scholarships and fields of law such as private laws and public laws which include constitutional and administrative law as well as criminal law, international laws concerning Indonesia, to various approaches to legal studies such as comparative law, law and economics, sociology of law and legal anthropology, and many others. Specialized legal studies concerning various aspects of life such as commercial and business laws, technology law, natural resources law and the like are also welcomed.

Eradicating Criminal Acts of Terrorism in Indonesia: Legal Theory Perspective. The terrorist attacks on September 11th 2001 has fundamentally changed the United States and the world's understanding towards the dangers posed by terrorism. As a result, the Act (Act) Anti-Terrorism Law No. 15 and 16 of 2003 was regulated and legalized by the House of Representatives (DPR). Anti-Terrorism Act is expected to provide support functions as a component of the rule of law and a fair legal basis, and effectively prevent the occurrence of acts of terrorism. The Effect of Gender Discourse in the Development Family Law in Indonesia. One of the social movements that emerged and gained its strength in the second half of the 20th century is feminism movement that encourages a structural change in the patriarchal structure society and equality between men and women. The movement also includes Muslim countries. The struggle of feminism or gender equality gained its momentum when the practice of discrimination towards women prevail in the Muslim community that is supported by treasury classical Islamic law (fiqh). It is on that particular context, the process of family law reform in Muslim countries at the end of the century-20s became an important arena of women's advocacy groups of their rights, as well as incorporate aspects of family law reform. Corruption as a Corporate Crime. In an effort to eradicate corruption in Indonesia has been conducted in various ways, however, the result is not satisfying because corruption is part of corporate crime which can be proven by the involvement of elite politician whether individually or in groups. Nullity Polygamy in the Religious Court. According to the positive law in Indonesia, Muslim husband may practice polygamy, and the polygamy can be recorded at the Office of Religious Affairs (KUA) if he got permission from the Religious Court. If permission is not obtained from the Religious Court, then according to the provisions of article 44 of Government Regulation No. 9 of 1975 the marriage can not be authorized. Combating Human Trafficking Through Criminal Law. In modern day slavery does not exist anymore. However, the practice of slavery in modern times transforms into human trafficking. Trafficking in persons in general can be defined as a condition where people, especially women and children, are for sale to work and they are forced to be involve in prostitution. Then the question is, how is it necessary to criminalize human trafficking? This article concludes that the actions to criminalize human trafficking is right based on the theory of crime. Beberapa Tuntutan Terhadap Pemberlakuan Hukum PerbankanSyariah. Hukum dibentuk untuk melayani masyarakat. Dengan demikian, hukum tunduk kepada masyarakat. Berbeda halnya dengan hukum agama (Islam), masyarakat wajib tunduk kepada hukum agama (Islam). Hukum yang dapat dipatuhi dan diterima oleh masyarakat adalah hukum yang didesain sesuai dengan ideologi dan kepercayaan masyarakat itu sendiri. Masyarakat Indonesia mayoritas memeluk agama Islam. Perjanjian Berbahasa Asing yang Dibuat Notaris Berdasarkan Undang-Undang Nomor 30 Tahun 2004. Posisi notaris sebagai fungsionaris dalam masyarakat dianggap sebagai tempat resmi yang dapat memperoleh saran. Segala sesuatu yang ditulis dan ditetapkan sudah benar dan pejabat produsen resmi dalam dokumen kekuatan hukum, khususnya dokumen yang berkaitan dengan kontrak yang terjadi di masyarakat. Concept of Criminal Liability in the Future of National Criminal Law. Separating criminal offense and libility would create a more comprehensive and systematic order towards penal code. This dualistic view implied that the formulation of criminal law only contain actus reus as an objective elements, while mens rea becomes the elements of criminal offense. Status and Binding Power of the Denhaag Convention 1954. Armed conflict between the United States and Iraq indicates that the two parties neglect cultural objects. The disobedient towards the provisions of international law, particularly the 1954 Hague Convention and its additional protocols, regarded as one of the conspicuous reasons for the fatal damage of cultural objects. The only justification to avoid from the obligation od protecting cultural objects is that one of the party does not bind to the instrument of international law. Human Rights in Indonesian Constitutional Amendments. Indonesian constitutional amendments incorporated human rights principles into the Constitution of the Republic of Indonesia 1945 (UUD NRI), especially in the second amendment in 2000. Under that amendment, the UUD NRI currently stipulates human rights principles as provided for in the Universal Declaration of Human Rights (UDHR). However, there are some important notes, which at its core is a lack of emphasis on the vision and mission of the State in implementing human rights in Indonesia, as well as the existence of gaps between the norms of the Constitution and the Universal Declaration of Human Rights.
