Abstract

This study aims to: (1) examine the factors that cause sentencing disparities in narcotics crime cases at the Denpasar High Court, and (2) identify and analyze the efforts made by law enforcement officials to prevent sentencing disparities. This research uses an empirical legal research method with a descriptive research. The study was conducted at the Denpasar High Court. Data were collected through document study and interviews with judges who handled Case Number 63/Pid.Sus/2024/PT Dps and Case Number 2/Pid.Sus/2024/PT Dps. The sampling technique applied was non-probability sampling with a purposive sampling type. The results of this research show that: (1) sentencing disparity occur due to the absence of binding sentencing guidelines, the discretionary power of judges, subjective factors and individual character of the judges, and the different circumstances of defendants in each case. (2) Efforts made by law enforcement authorities to prevent sentencing disparity include providing rational and transparent legal considerations, strengthening judicial ethics and professionalism, and encouraging academic and public discourse as a form of social contro

Abstract

This study aims to comprehensively describe how the role of information technology can improve the quality, effectiveness, and efficiency of legal aid provision by advocates to clients in civil cases. The advancement of digital technology has had a major impact on various sectors of life, including the legal field. In the civil context, advocates are not only required to understand the substantive legal aspects, but must also be able to utilize information technology to answer the complexity of resolving cases quickly and accurately. This study uses a juridical-empirical approach with a qualitative descriptive nature. Data were collected through literature studies, observations, and interviews with advocates and other stakeholders.The results of the study show that the use of information technology, such as the e-Court system, online legal databases, case management software, and digital communication media, has made it easier for advocates to carry out their professional duties, from drafting lawsuits, legal consultations, to conducting online trials. This technology has been proven to save time, costs, and expand the reach of legal services, especially for clients who are far from legal centers or who have limited mobility. However, the use of technology in legal practice also faces a number of challenges, such as the digital divide, limited infrastructure, low technological literacy among regional advocates, and concerns about data security and the confidentiality of legal information. Therefore, support is needed from the government, professional organizations, and legal education institutions in the form of training, adaptive regulations, and the provision of equitable access to technology. With these efforts, it is hoped that the use of information technology in legal aid practices can be a means to strengthen access to justice in a more inclusive and sustainable manner.

Abstract

This study aims to (1) examine and analyze the form of legal protection provided by the Indonesian Government to non-procedural Indonesian Migrant Workers (TKI) working abroad, and to what extent the mechanism is able to guarantee the fulfillment of their basic rights even though their departure is not through official or legal channels and (2) to examine and analyze the obstacles faced by the Indonesian Government in providing legal protection to non-procedural TKI abroad, both those originating from national and international legal aspects, diplomatic limitations, and socio-political conditions in the country of placement. This study uses a normative legal approach with a conceptual method and a statutory regulatory approach. The data sources used include primary, secondary, and tertiary legal materials, obtained through literature studies. The results of this study indicate that legal protection for non-procedural Indonesian Migrant Workers (TKI) abroad has not been running optimally. Non-procedural TKI who depart without going through official channels do not receive adequate protection because they are not registered in the formal employment system. Existing laws and regulations, such as Law Number 18 of 2017, do not explicitly regulate the protection mechanism for them, so the state tends to take reactive steps when problems arise in the field. The protection provided is generally limited to repatriation assistance or handling emergency cases. On the other hand, various obstacles hinder the effectiveness of protection, including the absence of legal norms, limited diplomatic relations with the destination country, and an unfavorable socio-political situation. These conditions make non-procedural TKI very vulnerable to exploitation, violence, and human rights violations. A more inclusive policy is needed so that all Indonesian migrant workers, including non-procedural ones, continue to receive adequate legal protection.

Abstract

The purpose of this study was to determine (1) the Implementation of Legal Protection for Victims of Criminal Acts of Migrant Worker Fraud Abroad by Placing Agents in Buleleng Regency and (2) the Role of Related Agencies in Buleleng Regency in Assisting in Prosecuting Migrant Worker Fraud Cases. The research method used is empirical law. Data were obtained through document studies, observations, and interviews with related parties. The results of the study are (1) Although several steps have been taken to protect victims of migrant worker fraud in Buleleng Regency, these steps have not yet been implemented optimally. This is caused by the continued occurrence of unofficial departures, the lack of public knowledge about legal procedures, and the absence of supervision of the actions of unofficial placement agents. (2) The role of related agencies in taking action, namely; the Buleleng Manpower and Transmigration Office plays a role in data collection, mediation, and verification of official agents through the Siap Kerja application; the Singaraja Immigration Office supervises documents and issuance of passports; The Buleleng Police handle law enforcement based on Article 378 of the Criminal Code and Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers, despite being hampered by cross-border jurisdiction.

Abstract

The purpose of the research is to find out and analyze (1) Forms of abuse experienced by Indonesian Workers in Taiwan and the factors that contributing to their continued occurrence, and then (2) The role of the government in providing legal protection for Indonesian Workers in Taiwan through the Indonesian Economic and Trade Office. The type of research used is normative legal research using a statute approach, case study approach, and a conceptual approach. The legal materials used are primary, secondary, and tertiary legal materials. The technique of collecting legal materials used literature study technique and analyzed by descriptive technique. The results of the research show that (1) Indonesian Workers in Taiwan are vulnerable to abuse. The driving factor for the continued violation of Indonesian Workers Rights of the impact of the One China Policy which results in the absence of formal diplomatic relations and weakens their legal protection (2) The role of the Government in legal protection efforts for Indonesian Workers through IETO is to carry out consular functions properly. Actively provide assistance to Indonesian Workers who have problems, provide complaint services, providing legal aid and humanitarian assistance, administrative services such as document legalization, passport and visa extension. Although IETO is not a formal representative IETO always strives to protect the interests of all Indonesian citizens in Taiwan as best as possible.

Abstract

This study aims to determine the legal protection for children who use paracetamol syrup and legal liability for losses experienced by consumers related to cases of using contaminated paracetamol syrup and causing Atypical Acute Progressive Kidney Disorders (AKIRD). The research method used is a normative-empirical approach, with primary, secondary and tertiary data sources in the form of cases of atypical acute progressive kidney disorders, the existing data is analyzed using the deductive method. The results of the analysis state that legal protection that can be obtained by consumers can be in the form of criminal lawsuits, civil lawsuits, administrative lawsuits, assistance from consumer institutions and dispute resolution at BPSK. Legal liability due to the occurrence of Atypical Acute Progressive Kidney Disorders (AKIRD) due to consuming contaminated paracetamol syrup, consumers can request such responsibility to business actors as drug manufacturers in accordance with Article 19 paragraphs 1 and 2 of Law No. 8 of 1999 concerning Consumer Protection, in the form of compensation or compensation. In this case, consumers can also demand accountability from BPOM in accordance with Law No. 36 of 2009 Article 14 concerning health, the claim is based on BPOM negligence, the claim that can be made can use a personal claim or a class action lawsuit. As a form of BPOM responsibility in the form of revoking the distribution permit and carrying out stricter supervision. To prevent similar cases from recurring, stricter supervision is needed on the production and distribution of drugs increasing the standards of good drug manufacturing practices (CPOB) and improving the mechanism for investigation and withdrawal of products from circulation.

Abstract

This study examines the dualism of village governance in Bali, reflected in the coexistence of Desa Dinas (administrative villages) and Desa Adat (customary villages), and its implications for the administration of cultural tourism. This dualism is a historical and juridical consequence of two systems of authority operating simultaneously within the same social space: the administrative governmental system and the customary legal system. In practice, the overlap of authority and territorial boundaries between these two village institutions often leads to disharmony, particularly in the management of tourist attractions and the imposition of tourism levies. This study employs a normative legal research method using statutory and conceptual approaches through an examination of relevant legislation and conceptual frameworks governing tourism administration at the village level. The findings reveal that the ideal administration of Bali’s cultural tourism requires institutional synergy between Desa Dinas, Desa Adat, and the Regional Government, especially in the determination and collection of tourism levies, which legally may only be established through regional regulations. Harmonizing authorities, strengthening technical regulatory frameworks, and developing operational cooperation mechanisms are urgent necessities to prevent authority conflicts and to ensure accountable, sustainable, and community-oriented tourism governance. This study underscores that cultural tourism management can only operate optimally when village dualism is placed within a coordinated and integrated framework aligned with the regional governance system.

Abstract

This paper examines the relationship between legal positivism and moral philosophy, emphasizing the role of ethics in the legal context. Legal positivism is understood as a school of thought that asserts that law should be viewed as a set of rules established by a legitimate authority, independent of underlying moral considerations or ethical values. In contrast, moral philosophy focuses on the study of the concepts of right and wrong, good and bad, and the ethical principles that govern human action. In the legal realm, fundamental questions arise regarding the extent to which moral and ethical values can, or should, influence the formation, interpretation, and application of law. This paper explores various perspectives within this debate, including the positivist perspective that positions positive law as the sole source of legal obligations, as well as the alternative view that emphasizes the importance of ethics in ensuring legal justice. Through a critical analysis of the arguments of both camps, the author seeks to find common ground between legal positivism and moral philosophy. The discussion covers the concept of universal moral principles as the normative basis of law, as well as the role of moral values in maintaining justice and the sustainability of the legal system. Furthermore, this paper highlights various challenges and dilemmas in integrating ethics into the legal positivism framework, particularly regarding the balance between individual freedom, societal interests, and legal certainty. Thus, this paper is expected to enrich legal studies through a more holistic and reflective approach.

Abstract

The phenomenon of overtourism in Bali Province has emerged as a critical challenge in the sustainable governance of the tourism sector. The continuously increasing number of tourists, without effective control measures, has caused numerous negative impacts on the environment, local culture, and community life. This research aims to analyze the legal authority and responsibilities of local governments in addressing over-tourism in Bali within the framework of national law, and this study also aims to evaluate how far the principles of good governance have been implemented in regional tourism policies. The researcher adopts a normative legal research method using statutory approaches, conceptual, and document-based approaches. The findings indicate that local governments possess legal legitimacy to formulate and implement policies rooted in local wisdom to mitigate over-tourism, as mandated by Law Number 23 of 2014 on Regional Government and other tourism-related regulations. The successful implementation of transparency, accountability, public participation, and law enforcement principles is essential to achieving sustainable tourism governance. However, several challenges remain, including weak coordination between central and local governments, lack of oversight, and short-term economic interests. Therefore, more responsive, collaborative, and datadriven legal policies are needed to address overtourism fairly and sustainably in Bali.

Abstract

This research aims to examine the influence of Absorptive Capacity on Innovation Performance in Class IIA Bengkulu Correctional Institutions. Using quantitative research methods, data was collected from 117 Class IIA Bengkulu prison employees through questionnaires. Data analysis was carried out using a simple linear regression test using SmartPLS 4.0, which showed a positive and significant influence between Absorptive Capacity and Innovation Performance. The research question focuses on whether there is an influence of Absorptive Capacity on Innovation Performance in Class IIA Bengkulu Correctional Institutions. The aim of the research is to understand and assess these influences. The practical benefits of research involve the Technical Implementation Unit, researchers and other parties, by providing related input.
