Abstract

AbstractIndonesia has an advantage in developing sharia tourism considering that the majority of its population is Muslim and there are supporting factors such as the availability of halal products. Indonesia as a cultured Islamic country with a cultural perspective that has run an Islamic community life, so that in most of its territory which is a tourist destination has been friendly to Muslim travelers. Halal products must be recognized as a symbol of cleanliness, security and high quality for Muslim consumers. In Indonesia, it has offered a variety of halal products found in several sectors, such as the business sector, finance, tourism, and food products (halal culinary). The introduction of halal products in the tourism sector can be developed by procuring events or festivals that encourage these products. The festivals that have been proclaimed as government programs will certainly be for the promising tourism sector and certainly interesting for investors to invest in the development of tourism.Tourism development through culinary festivals certainly attracts more interest for Muslim travelers to explore culinary practices that are always innovative and full of creativity. Innovative and halal processed products are certainly one of the icons of an area and must be developed as part of the regional development program. One of the innovative and halal products held at an event, namely the Peyek Ombo culinary festival. Peyek Ombo Culinary Festival is one of the culinary halal festivals initiated by the Banyuwangi government. This is certainly one of the halal tourist destinations that should be appreciated in increasing the potential of halal tourism in Indonesia. This study aims to determine the development of the Islamic tourism sector with a halal culinary appeal with a culinary festival program. This study uses a descriptive approach with methods of observation, interviews and documentation.Tourism development through the Halal Culinary Festival Peyek Ombo is a routine program organized by the Banyuwangi government combined at the Kaliploso Rijig festival. In this case the supporting factors such as the community are predominantly Islamic, the festival activities are carried out within the Muslim community. Making Peyek Ombo culinary is done in accordance with the provisions of halal food products. The organizing of the festival is inseparable from the village government in optimizing the development of the creative economy which is packed with Islamic values and Islamic ethics. For this reason, it is necessary to develop a culinary halal festival strategy by using marketing relationship theory (Relationship marketing), namely: internal marketing, social responsibility marketing (social responsibility), packaging (packaging strategy), strengthening branding of halal certified products from MUI, and integrated marketing (integrated marketing). Produk Halal harus diakui sebagai simbol kebersihan, keamanan, dan kualitas tinggi bagi konsumen Muslim. Di Indonesia telah menawarkan bermacam-macam  Produk halal yang  terdapat dalam beberapa sector, sepeti halnya sector usaha, keuangan, pariwisata, dan produk makanan (halal kuliner). Pengenalan produk halal dalam sector pariwisata bisa dikembangkan dengan pengadaan event-event atau festival yang mendorong produk tersebut. Festival- festival yang telah dicanangkan sebagai progam pemerintah tentunya akan menjadi bagi sector pariwisata yang menjanjikan dan tentunya menarik bagi para investor untuk berinvestasi dalam pengembangan pariwisata tersebut.Pengembangan pariwisata melalui festival kuliner tentunya lebih menyedot ketertarikan bagi bagi para muslim traveler untuk menjajaki kuliner yang memang selalu berinovatif dan penuh kreativitas. Produk olahan inovatif dan halal tentunya menjadi salah satu icon suatu daerah dan harus dikembangkan sebagai bagian dari progam pengembangan daerah. Salah satu produk inovatif dan halal yang diselenggarakan dalam sebuah event yaitu  Festival kuliner Peyek Ombo. Festival Kuliner Peyek Ombo menjadi salah satu  festival halal kuliner yang digagas oleh pemerintah Banyuwangi. Hal ini tentunya menjadi salah destinasi wisata halal yang patut diapresiasi dalam meningkatkan potensi pariwisata halal di Indonesia.Penelitian ini bertujuan untuk mengetahui pengembangan sektor pariwisata syariah berbranding halal kuliner dengan progam festival kuliner.Penelitian ini menggunakan pendekatan deskriptif dengan metode observasi, wawancara dan dokumentasi.Pengembangan pariwisata melalui Festival  Halal Kuliner Peyek Ombo menjadi  progam rutinan yang diselenggarakan oleh pemerintah Banyuwangi dengan digabung pada festival  Kaliploso Rijig. Dalam hal ini factor-faktor pendukung seperti halnya komunitas masyarakat lebih dominan beragama islam, kegiatan festival dilaksanakan terletak di dalam komunitas masyarakat muslim. Pembuatan kuliner Peyek Ombo dilakukan sesuai dengan ketentuan produk makanan yang  halal. Penyelenggaraan festival tersebut tidak lepas dari pemerintah desa dalam mengoptimalkan pengembangan ekonomi kreatif yang dikemas dengan nilai-nilai keislaman dan etika syariah. Untuk itu, diperlukan lah strategi pengembangan festival halal kuliner dengan mengunakan teori hubungan pemasaran (Relationship marketing) yaitu: internal marketing, social  responsibility  marketing (tanggung jawab sosial),packaging (strategi pengemasan), penguatan branding produk bersertifikat halal dari MUI, dan intergratedmarketing (pemasaran terpadu). Kata kunci: Pengembangan, Pariwisata, Festival Halal Kuliner

Abstract

AbstractThe development of halal tourism in Indonesia has become a major topic in various circles of society and is starting to become a special concern for the current government. Seeing the population in Indonesia, which is a large part of the Muslim community, is believed to have local wisdom values that adhere to Islamic values that provide great potential in the development of halâl tourism in Indonesia. Local wisdom carries certain characteristics that are influenced by culture and customs in its management of natural wealth. Through local wisdom that can be used as a tourist attraction, people are expected to be able to develop themselves as an effort to increase the economic values of the local community. As it is today, West Nusa Tenggara has the first halal tourism industry in Indonesia which has the Governor of West Nusa Tenggara Regulation Number 51 of 2015 on Tourism Halâl as a regulation in the development of halal tourism. This can be used as a benchmark for other regions in developing halal tourism in Indonesia. Using qualitative methods through a literature study approach, this study will explain the Implementation of the Values of Archipelago Local Wisdom in the Development of Indonesia Halâl Tourism. By prioritizing the existing local wisdom, halal tourism in Indonesia has more characteristics that continue to emphasize cultural values that adhere to Islamic values. Key Words :Local Wisdom, Islamic Values, Halâl tourism. AbstrakPerkembangan pariwisata halal di Indonesia telah menjadi topik utama di berbagai kalangan masyarakat dan mulai menjadi perhatian khusus bagi pemerintah saat ini.Melihat populasi di Indonesia, yang merupakan bagian besar dari komunitas Muslim, diyakini memiliki nilai-nilai kearifan lokal yang menganut nilai-nilai Islam yang memberikan potensi besar dalam pengembangan pariwisata halal di Indonesia.Kearifan lokal membawa karakteristik tertentu yang dipengaruhi oleh budaya dan adat istiadat dalam pengelolaan kekayaan alamnya.Melalui kearifan lokal yang dapat digunakan sebagai daya tarik wisata, masyarakat diharapkan mampu mengembangkan diri sebagai upaya meningkatkan nilai ekonomi masyarakat setempat. Seperti saat ini, Nusa Tenggara Barat memiliki industri pariwisata halal pertama di Indonesia yang memiliki Peraturan Gubernur Nusa Tenggara Barat Nomor 51 Tahun 2015 tentang Halam Pariwisata sebagai peraturan dalam pengembangan pariwisata halal. Ini bisa dijadikan patokan bagi daerah lain dalam mengembangkan pariwisata halal di Indonesia. Dengan menggunakan metode kualitatif melalui pendekatan studi pustaka, penelitian ini akan menjelaskan Implementasi Nilai-nilai Kearifan Lokal Nusantara dalam Pengembangan Pariwisata Halal Indonesia. Dengan memprioritaskan kearifan lokal yang ada, pariwisata halal di Indonesia memiliki lebih banyak karakteristik yang terus menekankan nilai-nilai budaya yang melekat pada nilai-nilai Islam. Abstract

In Islamic legal thinking when it is associated with social change so it has two theories, they are the theory of immortality and the theory of adabtabilitas. Based on the theory, Islamic legal thinking is developing now more than has tendency to follow the pattern of adaptability theory that is Islamic law as a law created by God for the humanity, and can adapt to the development of the times, so that he can be changed in order to realize in benefit of human being generally (maslahat al-ummah). Among of many mufties who follow the theory of adaptability, is Najamuddin Al-Thufi. The basic framework theory of adaptability is the principle of maslahat, which is a fundamental value for the sustainability of Islamic law in the concept of social change in decision of Islamic law. This written is a criticizes the concept of maslahat at-thufi which applies not only to the issue of law which nash is nothing , but also applies to the context which nash is exist as like in the matter of mu'amalah. When analyzed carefully, this concept can allow for a conflict between nash and maslahat, and the application of this concept afraided will apply to follow the passion and justify the haram tobe halal by on the pretext of maslahat.

Abstract

The development of the times allows for new things that cannot be found at the time of the Prophet Muhammad, such as banking. Islamic banking is present as a polemic solution, because it brings Islamic missions to achieve falah (welfare). The principles used by Islamic banks, such as profit and loss sharing, economic value of time and the goal h goal. It has been clear that the usury law is haram, but if usury is associated with current banking activities, there are those who equate it with bank interest and there are differences. This is caused by the legal excavations that are used, such as those based on the rules of usul and fiqh. Both are as tools and roots in the establishment of laws, especially for today, in practice muamalah continues to experience significant developments and changes. It would be very necessary for the work of qawa 'id al us} uliyah and fiqh in response to the evolving practice of muamalah. Determination of law that starts from the rules of ushul and its jurisprudence will produce clarity in its legal products, as well as being the solution in the practices / cases of the latest muamalah, because in it will be explored in the roots and substance of the current case / practice.

Abstract

AbstractSharia tourism is not only related to religious values such as places of pilgrimage and religion but more towards lifestyle. Sharia tourism includes the availability of supporting facilities, such as restaurants and hotels that provide halal food and prayer rooms. Tourist products and services, as well as tourist destinations in Islamic tourism, are the same as tourism in general as long as they are not in conflict with Islamic values and ethics.Thus, halal tourism is supported by a series of interrelated components: travel, hotel, money market, lifestyle; medicines, cosmetics, and food. Food and cakes are one component that will not be overlooked in halal tourism destinations, even it can be said that there is no tourism without food. There is no halal tourism without halal food.Research on the implementation of halal certification by suppliers of Small and Medium Industries (SMI) in Cirebon Plered Cake Market is a qualitative research that reveals the facts about how the suppliers of SMI around Plered Cirebon whose products are consumed outside the district, between provinces and across islands addressing halal certification. This study also presents the factors of the low interest and intention of the suppliers to process halal certificates on their products and the factors that encourage them to be very enthusiastic to certify the cake or food products.Need breakthroughs and coordination from related parties; Government agencies, institutions, traders, so that the implementation of halal certification can run well so that it can support tourism in each region in Indonesia. Keyword: Syaria Tourism, Halal Sertification, Small Medium Industry  AbstractWisata syariah tidak hanya melulu terkait dengan nilai-nilai agama seperti tempat ziarah dan religi, tetapi lebih mengarah pada lifestyle.Wisata syariah mencakup ketersediaan fasilitas pendukung, seperti restoran dan hotel yang menyediakan makanan halal dan tempat shalat. Produk dan jasa wisata, serta tujuan wisata dalam pariwisata syariah sama seperti wisata pada umumnya selama tidak bertentangan dengan nilai-nilai dan etika syariah.Dengan demikian pariwisata halal ditunjang oleh rangkaian komponen yang saling terkait: travel, hotel, pasar uang, gaya hidup; obat-obatan, kosmetik dan makananan. Makananan maupun kue menjadi salah satu komponen yang tidak akan terlewatkan dalam destinasi pariwisata halal, bahkan dapat dikatakan tidak ada pariwisata tanpa makan. Tidak ada pariwisata halal tanpa makanan halal.Penelitian tentang pelaksanaan sertifikasi halal oleh supplier IKM di Pasar Kue Plered Cirebon, adalah penelitian kualitatif yang membeberkan fakta tentang bagaimana para supplier IKM di sekitar Plered Cirebon yang produknya dikonsumsi diluar kabupaten, antar propinsi dan lintas pulau menyikapi sertifikasi halal. Penelitian ini juga menyajikan factor-faktor rendahnya minat dan niat para supplier untuk memproses sertifikat halal pada produknya dan faktor-faktor yang mendorong mereka sangat antusias untuk mensertifikasi produk kue atau makananya.Perlu terobosan dan koordinasi dari para pihak terkait; Lembaga pemerintah, institusi, para pedagang, agar pelaksanaan sertifikasi halal dapat berjalan dengan baik, menarik sehingga dapat mendukung parawisata di masing-masing daerah di Indonesia. Keyword: Wisata Syariah, Sertifikat Halal, Industry Kecil Menengah

Abstract

AbstractConsumer Protection is now the public's concern. Where the rights and obligations of consumers and business actors become the main things regulated in the Consumer Protection Law Number 8 of 1999. The purpose of the issuance of the law is to get the people to get their rights as consumers well and to increase consumers' awareness and ability to protect themselves before buying and using goods and or services from a business actor. Differences in interests between consumers and businesses often spark disputes. Law enforcement against consumer disputes is carried out by the Consumer Dispute Settlement Agency (BPSK) as an institution that helps consumers and businesses in resolving their disputes. This paper aims to dissect several problems, namely related to the Effectiveness of Law Enforcement of Consumer Disputes in the City of Malang and Constraints of Law enforcement of Consumer Disputes in the context of consumer protection in the City of Malang. The methodology used is sociological law. The results of this paper note that there are three types of solutions at BPSK namely Arbitration, Mediation, and Conciliation. Constraints faced by BPSK in enforcing consumer disputes are caused by problems with facilities, human resources, and also related to the substance, structure and legal culture. Efforts made to overcome these constraints are carried out in accordance with what has been regulated by law, with the aim that the community can better know the duties and functions of BPSK in the settlement of the dispute.Keywords: Protection, Consumers, Business Actors, Disputes, Law EnforcementAbstrakPerlindungan Konsumen sekarang menjadi perhatian publik. Dimana hak dan kewajiban konsumen dan pelaku usahaVolume 5, Nomor 2 2018 |Et-Tijarie 91menjadi hal utama yang diatur dalam Undang-undang Perlindungan Konsumen Nomor 8 Tahun 1999. Tujuan dari dikeluarkannya undang-undang adalah untuk membuat masyarakat mendapatkan haknya sebagai konsumen dengan baik dan untuk meningkatkan konsumen. kesadaran dan kemampuan untuk melindungi diri sebelum membeli dan menggunakan barang dan atau jasa dari seorang pelaku bisnis. Perbedaan kepentingan antara konsumen dan bisnis sering memicu perselisihan. Penegakan hukum terhadap sengketa konsumen dilakukan oleh Badan Penyelesaian Sengketa Konsumen (BPSK) sebagai lembaga yang membantu konsumen dan bisnis dalam menyelesaikan sengketa mereka. Tulisan ini bertujuan untuk membedah beberapa masalah, yaitu terkait Efektivitas Penegakan Hukum Perselisihan Konsumen di Kota Malang dan Kendala Penegakan Hukum Perselisihan Konsumen dalam konteks perlindungan konsumen di Kota Malang. Metodologi yang digunakan adalah hukum sosiologis. Hasil catatan makalah ini bahwa ada tiga jenis solusi di BPSK yaitu Arbitrase, Mediasi, dan Konsiliasi. Kendala yang dihadapi oleh BPSK dalam menegakkan perselisihan konsumen disebabkan oleh masalah dengan fasilitas, sumber daya manusia, dan juga terkait dengan substansi, struktur dan budaya hukum. Upaya yang dilakukan untuk mengatasi kendala tersebut dilakukan sesuai dengan apa yang telah diatur oleh undang-undang, dengan tujuan agar masyarakat dapat lebih mengetahui tugas dan fungsi BPSK dalam penyelesaian sengketa.
