Abstract

AbstractConsumer Protection is now the public's concern. Where the rights and obligations of consumers and business actors become the main things regulated in the Consumer Protection Law Number 8 of 1999. The purpose of the issuance of the law is to get the people to get their rights as consumers well and to increase consumers' awareness and ability to protect themselves before buying and using goods and or services from a business actor. Differences in interests between consumers and businesses often spark disputes. Law enforcement against consumer disputes is carried out by the Consumer Dispute Settlement Agency (BPSK) as an institution that helps consumers and businesses in resolving their disputes. This paper aims to dissect several problems, namely related to the Effectiveness of Law Enforcement of Consumer Disputes in the City of Malang and Constraints of Law enforcement of Consumer Disputes in the context of consumer protection in the City of Malang. The methodology used is sociological law. The results of this paper note that there are three types of solutions at BPSK namely Arbitration, Mediation, and Conciliation. Constraints faced by BPSK in enforcing consumer disputes are caused by problems with facilities, human resources, and also related to the substance, structure and legal culture. Efforts made to overcome these constraints are carried out in accordance with what has been regulated by law, with the aim that the community can better know the duties and functions of BPSK in the settlement of the dispute.Keywords: Protection, Consumers, Business Actors, Disputes, Law EnforcementAbstrakPerlindungan Konsumen sekarang menjadi perhatian publik. Tujuan dari dikeluarkannya undang-undang adalah untuk membuat masyarakat mendapatkan haknya sebagai konsumen dengan baik dan untuk meningkatkan konsumen. kesadaran dan kemampuan untuk melindungi diri sebelum membeli dan menggunakan barang dan atau jasa dari seorang pelaku bisnis. Perbedaan kepentingan antara konsumen dan bisnis sering memicu perselisihan. Penegakan hukum terhadap sengketa konsumen dilakukan oleh Badan Penyelesaian Sengketa Konsumen (BPSK) sebagai lembaga yang membantu konsumen dan bisnis dalam menyelesaikan sengketa mereka. Tulisan ini bertujuan untuk membedah beberapa masalah, yaitu terkait Efektivitas Penegakan Hukum Perselisihan Konsumen di Kota Malang dan Kendala Penegakan Hukum Perselisihan Konsumen dalam konteks perlindungan konsumen di Kota Malang. Metodologi yang digunakan adalah hukum sosiologis. Hasil catatan makalah ini bahwa ada tiga jenis solusi di BPSK yaitu Arbitrase, Mediasi, dan Konsiliasi. Kendala yang dihadapi oleh BPSK dalam menegakkan perselisihan konsumen disebabkan oleh masalah dengan fasilitas, sumber daya manusia, dan juga terkait dengan substansi, struktur dan budaya hukum. Upaya yang dilakukan untuk mengatasi kendala tersebut dilakukan sesuai dengan apa yang telah diatur oleh undang-undang, dengan tujuan agar masyarakat dapat lebih mengetahui tugas dan fungsi BPSK dalam penyelesaian sengketa. Abstract

The goal of an election is to choose the best leader with great integrity and responsibility. In achieving the goal, the election must be supported by all components involved in it; the administrators, participants, and integrated process. One of the process of the election is campaign. This process is used as the best way to attract people’s interest. Therefore, people will vote a particular candidate in the election day. The candidates of board members will compete to get the highest voter.The one who get the highest vote will be the board member. The rules of the campaign are clearly stated in the regulation. However, there are many violations happened. The votes are meaningless because the process is full of violations, not a fair and democratic process as people desire.

Abstract

The Covid 19 pandemic that has hit Indonesia since the beginning of 2020 has not only affected people's freedom to gather, but also affected the people's economic life. Many community members lost their jobs so that the community's economic level declined, this also happened in Tamanharjo Village, Singosari, Malang Regency. The problems faced by the community in Tamanharjo Village, Singosari, Malang Regency as partners of this service program are the desire to develop the creativity of mothers in making jumputans, but they are not supported by capital and there is no adequate knowledge and expertise about making jumputans. Partners need knowledge, techniques and skills to make jumputans based on cloth, which will be very helpful in efforts to produce quality jumputan fabric products, so that they will improve the welfare of the local community. To be able to realize the things mentioned above, assistance and training are needed in making jumputans from cloth. The method that will be used in its implementation is by conducting training on the basics of making jumputan fabrics, introducing equipment and also the practice of making jumputans. The implementation of the jumputan skill making program was carried out well with the results in accordance with the output target of this service, namely partners were able to make and produce jumputan batik fabrics with various patterns and colors, so this can be used as capital to develop jumputan businesses. Abstract

The Industrial Revolution Concept 4.0 agree that personal data is economic value data. Personal data can be used for commercial purposes, so clear and specific arrangements need to be made. In Indonesia, the meaning of this type of personal data has not yet reached the highest level of Laws up to Government Regulations. This study aims to analyze the regulations on private data or data that are personal in Indonesia and make comparisons with several countries in Europe that implement personal data protection agreements. In this series of studies, the method used is a normative juridical method which consists of three types relating to statutory regulations, conceptual approaches, and comparative approaches. Based on the results of the study, a common thread related to the regulation of data privacy protection legislation No. 19 of 2016 concerning ITE up to the latest namely Permenkominfo No. 20 of 2016. However, at the technical level, regulations and regulations regarding the use of personal data in Indonesia are still at the point of legal vacuum. This can be seen in several sectors when considering the provisions in force in the European Union (GDPR) such as the meaning and type of Personal Data, standardization of Company Regulations, and provisions related to notifications that have supported personal data. The conclusion that can be drawn is that the substance of norms in GDPR is a norm that is more accommodating to the needs of people in Indonesia, because it is a guarantee of the availability of much better personal data. In addition, the deletion of personal data on request is also done more effectively and efficiently. Keywords: Regulation, Protection, Deletion, Personal Data.
