Abstract

Pembangunan nasional Indonesia yang pesat berpengaruh pula terhadap pertumbuhan ekonomi yang semakin baik. Hal ini tentu tidak terlepas dari keberadaan korporasi sebagai pelaku bisnis dan usaha yang turut menyumbangkan pendapatan bagi negara baik secara langsung maupun tidak langsung, misalnya melalui penyediaan lapangan pekerjaan atau pembayaran pajak. Kehadiran korporasi yang terus berkembang baik dari segi jumlah maupun jenis dan lingkup usaha dan bisnisnya tentu menimbulkan persaingan yang semakin ketat. Dalam keadaan ini, timbul kesadaran bahwa ada kemungkinan praktek bisnis korporasi dilakukan dengan melakukan pelanggaran hukum, termasuk hukum pidana. Oleh sebab itu, hukum dan peraturan perundang-undangan juga dituntut untuk berkembang untuk menghindari kemungkinan tersebut, salah satunya dengan melihat korporasi sebagai suatu subyek hukum yang dapat dimintai pertanggungjawaban, termasuk pertanggungjawaban pidana.

Abstract

AbstractEnvironmental law related to natural resource management in Indonesia should have to achieve national food and energy security. Juggling and smuggling in the natural resource law may injure community justice (equity) and national economic (economy). Law enforcement in the name of ecology has the potential to criminalize people and cause social problems. The aim of this  paper is to explain the existence of environmental law and the legal system for managing natural resources in meeting national food and energy needs. To respond the problem(s) arised, therefore the study is conducted through a qualitative research by examining various laws and regulations, relevant theories and concepts, and several court decisions between the period of 2016-2019. In conclusion: the system space of law for managing natural resources has not prioritized the function of law as a protector and driver of a prosperous society. It needs a systemic relaxation of legal system (legal substance, legal structure, and legal culture) towards advancing food and energy sovereignty. Such relaxation should proceed, not only at the legislative drafting stage, but also at  judicative stage in order to accelerate the people-awareness stage heading to the ius constituendum.Keywords: advancing food and energy sovereignty, natural resource management,  systemic relaxation AbstrakHukum lingkungan hidup terkait pengelolaan sumber daya alam di Indonesia semestinya berupaya mencapai ketahananpangan dan energi nasional. Jumpalitan dan penyelundupan hukum sumber daya alam dapat mencederai keadilan masyarakat (equity) dan kepentingan ekonomi nasional (economy).  Penegakan hukum yang mengatasnamakan pelestarian (ecology) berpotensi menyebabkan kriminalisasiterhadap masyarakat dan menimbulkan permasalahan sosial. Paper ini bertujuan untuk menjelaskan bagaimana eksistensi hukum lingkungan hidup dan sistem hukum pengelolaan sumber daya alam dalam memenuhi kebutuhan pangan dan energi nasional. Untuk menjawabnya, telah dilakukanpenelitian yuridis normatif yang bersifat kualitatif dengan mengkaji berbagai ketentuan, teori dan konsep yang relevan, serta beberapa putusan pengadilan antara tahun 2016-2019. Kesimpulannya: ruang gerak sistem hukum pengelolaan sumber daya alam belum memprioritaskan fungsi hukum sebagai pelindung dan pendorong kesejahteraan. Perlurelaksasi sistemik terhadap sistem hukum (substansi hukum, struktur hukum, dan budaya hukum) demi kedaulatan pangan dan energi yang berkemajuan.  Relaksasi sistemikbukan hanya pada tahap perancangan legislasi tetapi juga pada tahap yudikatif demi meningkatkan kesadaranmasyarakat menuju hukum yang dicita-citakan pada masa yang akan datang.Kata kunci: kedaulatan pangan dan energi yang berkemajuan, pengelolaan sumber daya alam, relaksasisistemik

Abstract

AbstractAs an institution authorized to deal with legal complaints concerning improper health services, Indonesian Medical Disciplinary Honorary Assembly (MKDKI) has the task of determining whether there are malpractices made by doctors or dentists in the application of medical disciplines in terms of medical professional standards. This authority is stipulated in Article 66 (1) Law Number 29 of 2004 concerning Medical Practice. However, disharmony which occurs between such article and article 66 (3) as well as several health related law in Indonesia seems like negating MKDKI role in determining the element of negligence at the time of an alleged violation such as medical malpractice. Based on this condiion, the study was conducted to examine the impact of such legal disharmony in the practices and services of  Indonesian health sector. Keywords: Medical Law, Patient’s Right, Existence of MKDKI AbstrakSebagai lembaga yang memiliki kewenangan dalam menangani pengaduan atas pelayanan kesehatan, Majelis Kehormatan Disiplin Kedokteran Indonesia (MKDKI) memiliki tugas untuk menentukan ada tidaknya kesalahan yang dilakukan oleh dokter atau dokter gigi dalam penerapan disiplin ilmu kedokteran dan kedokteran gigi yang tidak sesuai dengan standar profesi medik. Kewenangan ini tercantum dalam ketentuan Pasal 66 Ayat (1) Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran. Akan tetapi, disharmoni antara ketentuan Pasal 66 Ayat (1) dengan Ayat (3) dan beberapa regulasi yang terkait dengan bidang kesehatan seakan menegaskan peranan MKDKI dalam menentukan unsur kelalaian pada saat suatu dugaan pelanggaran seperti malpraktik medik. Penelitian ini dilakukan untuk mengkaji tentang akibat hukum dari disharmoni peraturan perundang-undangan di bidang kesehatan itu serta dampaknya terhadap praktik kedokteran Indonesia. Melalui tulisan ini diharapkan dapat diperoleh kesimpulan dan saran-saran yang relevan yang dapat diterapkan untuk mewujukan pembangunan kesehatan yang berkualitas untuk masyarakat. Kata Kunci: Hukum Kesehatan, Hak Pasien, Eksistensi MKDKI

Abstract

The ease of conducting a banking transactions makes it vulnerable to become a vehicle for money laundering. The purpose of this article is to understand the existence and procedure of Customer Due Diligence (CDD) principles in banking to prevend money laundering that is based on the Financial Services Authority Regulation Number 12/POJK.01/2017. The research method used is normative juridical legal research using a statute approach. The result of the study show that the Bank as a Financial Services Provider is required to implement a Customer Due Diligence (CDD) principle to ensure that every banking transactions are in accordance with the profile, characteristics and/or transaction patterns of prospective customers, customers or walk in customers (WIC). Banks are required to report suspicious banking transactions to Financial Transaction Reports and Analysis Center (PPATK).

Abstract

Land is a symbol of prosperity for an agrarian country. Having land rights that have been regulated by law, for example is absentee land which is ownership of a number of land outside of the place where he is domiciled. Civil servants or military officials are given specificity to occupy official houses provided by the state to ensure the effectiveness of time in carrying out their work. Specificity for military officials (TNI) to own land because military officials often have difficulty in determining the domicile caused by their official duties. And there are exceptions to land ownership for retired military officials.
