Abstract

Abstrak: Manakala membicarakan tentang proses islamisasi di Indonesia, para ahli akan fokus pada pembahasan tentang Aceh. Pada hal di Sumatera Utara, khususnya di sekitar kota Medan dan Barus banyak  dijumpai situs makam kuno yang membuktikan agama Islam sudah lama bertapak di daerah ini. Dengan menganalisis tipologi dan kronologi nisan Aceh dan inskripsi yang terdapat pada batu nisan di Kota Rantang dan Barus, Sumatera Utara diketahui bahwa proses islamisasi di Sumatera Utara sudah terjadi sejak abad ke-13 M. Proses islamisasi itu akhirnya membentuk sebuah komunitas politik bercorak Islam pada abad ke-13 M yakni munculnya Kerajaan Haru di Kota Rantang, Hamparan Perak.Abstract: Islamization in North Sumatra: A Study of Gravestone in Rantang and Barus Cities. When talking about the process of islamization in Indonesia, many an expert will focus on discussing Aceh. Where as in North Sumatra, especially around the city of Medan and Barus many ancient gravestones found that proves the Islamic religion has long foothold in this area. By analyzing the typology and chronology of Aceh tombstones and inscriptions found in gravestones in the cities of Rantang and Barus, North Sumatra Province is known that the process of islamization in North Sumatra have occurred since the 13th century AD. The process of islamization was eventually formed a political community of Islam in the design of the 13th century AD ie the emergence of the Kingdom of Haru in the Kota Rantang, Hamparan Perak.Kata Kunci: Islamisasi, tipologi, batu nisan, Kota Rantang, Barus, Kerajaan Aru

Abstract

Abstrak: Musyârakah merupakan salah satu model profit and lost-sharing (PLS) yang kehadirannya dalam bank syari‘ah paralel dengan Islam. Musyârakah dalam praktik perbankan syariah tidak dikonstruk melalui fikih an sich, tetapi telah diadaptasikan dengan situasi dan kondisi riil yang didasarkan pada fikih lokal kekinian, KHI atau fatwa MUI. Dalam fikih klasik, ulama sepakat bahwa jaminan, misalnya, tidak perlu mewujud dalam kontrak musyârakah, karena mitra adalah orang yang dipercaya, dan atas dasar “kepercayaan” ini, maka mitra yang satu tidak dapat menuntut jaminan dari mitra yang lain. Namun fikih lokal memberikan kelonggaran kepada bank syariah mensyaratkan mitranya untuk memberikan jaminan guna mereduksi risiko dalam pembiayaan musyârakah.Abstract: Musyârakah: Between fiqh and Syariah banking. Musyârakah is one of the profit and lost-sharing (PLS) models which is parallel with Islamic bank concept. At the practical level of syariah banking, musyârakah is not purely legal construction but it is a social adaptation to the real circumstances which are based on contemporary local fiqh (Islamic law). Classical fiqh does not require the guarantee to be embodied in a musyârakah contract, because the partner is a trustworthy person. Moreover, on the basis of trust, one partner cannot require a guarantee from the other party. Otherwise, local fiqh gives concessions to Islamic bank, i.e., it requires partners to provide assurance in order to reduce risk in the musyârakah financing.Kata Kunci: musyârakah, bagi hasil, fikih muamalah, bank syari‘ah

Abstract

Abstrak: Tujuan penelitian ini adalah untuk mengetahui peranan ulama dalam pembinaan masyarakat Banjar di Kalimantan Selatan. Peneliti menyimpulkan bahwa ulama memainkan peranan tradisional, meskipun mereka hidup di era Modern. Tanpa memandang tipologinya, ulama telah membawa masyarakat Banjar dalam kesatuan. Ulama memainkan peran besar dalam membina keseimbangan, keharmonisan dan ketunggal-ikaan dari berbagai pandangan, kepentingan dan kelompok masyarakat Banjar. Penelitian juga menemukan bahwa faktor demografi dan sosial budaya tidak memiliki kaitan erat dengan peranan ulama, kecuali faktor religiositas. Dalam masyarakat Banjar, ulama menempati kedudukan yang tinggi karena keilmuan, keterpujian akhlak, kesalehan dan peranan konkret yang mereka lakukan dalam membina masyarakat. Lebih dari itu, karena religiositasnya, pendapat ulama terhadap perubahan sosial, modernisasi, dan pembangunan di Kalimantan Selatan direspons secara positif oleh masyarakat.Abstract: The Role of Ulama in Developing Banjarese Society of South Kalimantan. This research aims at comprehending the role of ulama in developing Banjar society of South Kalimantan. The author concludes that ulama plays traditional role, provided that they live in modern era. Without considering the typology, ulama has brought the Banjarese society into unity. They have also taken important role in keeping up stability, harmony and diversity from various perspectives, interest, and social groups of Banjarese. It is also revealed that demographic and socio-cultural factors are not closely related with the role of ulama, except that of religiosity. In Banjarese society, ulama is regarded as having high esteem position, due to their knowledge, good character, piety, and their concrete role in social development. In addition, due to their religiosity, their opinions on such fields as social transformation, modernization and development in South Kalimantan are positively responded.Kata Kunci: ulama, masyarakat Banjar, Kalimantan Selatan

Abstract

Abstrak: Al-Qur’an yang bersifat universal diperuntukkan bagi semua manusia, tidak terkecuali bangsa Indonesia. Penafsiran terhadap al-Qur’an tentu tidak dilepaskan dari konteks sosial masyarakat yang bersangkutan. Karena itu, penafsiran al-Qur’an yang bercorak keindonesiaan merupakan sebuah keniscayaan. Dalam artikel ini, penulis memperlihatkan urgensi penafsiran al-Qur’an yang bercorak keindonesiaan, mengingat penafsiran yang ada seperti yang diwakili oleh Mahmud Yunus, T.M. Hasbi As-Shiddieqy, HAMKA dan M. Quraish Shihab, masih lebih banyak corak kearabannya. Setidaknya, hal ini menjadi simbol kontinuitas dari upaya kajian fikih yang sudah lebih menunjukkan corak keindonesiaan.Abstract: The Importance of Qur’anic Interpretation in Indonesian Form. Al-Qur’an with its universal character is provided for all human kind, and Indonesian people are not an exception. The interpretation of the Qur’an cannot be separated from its respective social context, and as such Qur’anic interpretation in the Indonesian form is a necessity. In this article, the author attempts to explain the need of interpreting the Qur’an in line with the Indonesian context, considering such interpretations available thus far as those of Mahmud Yunus, T.M. Hasbi As- Shiddieqy, HAMKA and M. Quraish Shihab are greatly featured in Arabic circumstances. Nontheles, these works have become a symbol of continuity of Islamic legal studies effort that have demonstrated Indonesianized characteristic of Islam.Kata Kunci: penafsiran, corak, Indonesia

Abstract

Abstrak: Islam meletakkan keadilan sebagai elemen terpenting dalam kehidupan masyarakat dan kesempurnaan keislaman seseorang terkait erat dengan komitmennya dalam menegakkan keadilan dalam kehidupan. Agar keadilan dapat ditegakkan diperlukan penguasa dan penegak hukum yang bertugas menjamin terlaksananya keadilan secara seimbang dalam masyarakat. Dalam tataran praktikal, penguasa seringkali terkendala oleh sistem pembuktian yang dianut, yakni asas praduga tak bersalah. Akibatnya, kebenaran dan keadilan sulit ditegakkan. Penulis artikel ini berargumen bahwa Islam tidak terlalu terpaku pada sistem atau asas yang digunakan penegak hukum. Sekalipun Islam mengajarkan asas praduga tak bersalah, namun juga membenarkan diterapkannya asas pembuktian terbalik. Penulis menyimpulkan bahwa teks-teks ajaran Islam dan kaedah fiqhiyah memberi peluang kepada umat Islam untuk melakukan upaya pembuktian terbalik demi tegaknya keadilan, sesuatu yang dibenarkan, bahkan ada kalanya harus dilakukan.Abstract: The Exigency of the Application of Reversal Burden of Proof Principle in Islamic Law Procedure. Islam places justice as an important element in social life, and the perfection of ones’ islamicity is closely related to his or her commitment in doing justice into practice. In order to preserve justice government and legal authorities are needed guaranteeing that justice is kept upright in society. At the practical level, the authority has always faced with the system of proof being presumed, that is the principle of reversal burden of proof, and thus justice is difficult to be fulfilled. The author argues that Islam has not been confined into system and principle used by legal authorities. Although Islam introduces the principle of innocence, it also acknowledges the application of reversal burden of proof principle. The author concludes that the texts of Islamic teachings and Islamic legal maxim provide room for the Muslim community to exercise reversal burden of proof to maintain justice, something that is permissible if not a necessity to be applied.Kata Kunci: keadilan, hukum Islam, pembuktian terbalik, hukum acara

Abstract

Abstrak: Beberapa ahli memperkirakan ada sekitar 1,6 miliar orang Muslim di dunia, di mana 62.1 % dari mereka hidup di kawasan Asia. Hanya 15 % adalah Muslim Arab, sedangkan hampir sepertiga hidup di Asia Tenggara. Islam di Asia Tenggara relatif lebih moderat dibandingkan Islam di Timur Tengah. Sifat moderasi ini merupakan bagian yang tidak terpisah dari perkembangan Islam di Asia Tenggara. Islam sampai ke Asia Tenggara melalui jalur perdagangan dan tidak melalui penaklukan militer seperti yang banyak terjadi di dunia Arab, Asia Selatan dan Timur Tengah. Islam juga diwarnai pada paham animisme, Hindu, dan tradisi Buddha di Indonesia, yang memberikan ciri sinkritisme. Islam baru tersebar di Asia Tenggara pada akhir abad ke-17. Kebangkitan Islam telah mengubah wajah politik  Islam di Asia Tenggara. Memang benar bahwa Islam Asia Tenggara termasuk di antara Islam yang sangat minimal corak kearabannya yang diakibatkan oleh proses islamisasi yang pada umumnya berlangsung damai.Abctract: The Contribution of Islam towards Southeast Asian Future Civilization. By some estimates there are approximately 1.6 billion Muslims in the world, of which 62.1% live in Asia. Only 15% of Muslims are Arab, while almost one third live in Southeast Asia. Islam in Southeast Asia is relatively more moderate in character than in much of the Middle East. This moderation stems in part from the way Islam evolved in Southeast Asia. Islam came to Southeast Asia with traders rather than through military conquest as it did in much of South Asia and the Arab Middle East. Islam also was overlaid on animist, Hindu, and Buddhist traditions in Indonesia, which are said to give it a more syncretic aspect. Islam spread throughout much of Southeast Asia by the end of the seventeenth century. The Islamic revival is changing the face of political Islam in Southeast Asia. It is true that Southeast Asian Islam is among the least Arabicized forms of Islam, largely as a result of a process of Islamization that was generally peaceful.Kata Kunci: Islam, Asia Tenggara, peradaban

Abstract

Abstrak: Artikel ini mencoba mengkaji metode penafsiran al-Qur’an yang digunakan oleh Wahbah al-Zuhaylî, seorang pakar hukum Islam, namun ia juga telah menghasilkan sebuah karya monumental dalam bidang tafsir yang berjudul al-Tafsîr al-Munîr fî al-‘Aqîdah wa al-Syarî‘ah wa al-Manhaj. Dalam penyusunan karya ini, al-Zuhaylî mengkolaborasi beberapa metode. Dilihat dari sumber penafsiran, ia menggabungkan metode Klasik, yaitu tafsîr bi al-ma’tsûr (riwayat) dan bi al-ra’y (ijtihad). Jika ditinjau dari cara penyajian tafsir, ia menggabungkan metode modern, yang merupakan perpaduan antara tahlîlî (analitik), dalam menguraikan aspek bahasa dan sastra, dan metode maudhû’i (tematik), dalam menjelaskan tema-tema tertentu. Corak yang ditawarkan dalam tafsir ini bernuansa fikih, sebagai bias dari latar belakang keilmuan mufasirnya. Namun di sisi lain, nuansa al-âdab al-ijtimâ‘i juga tampak begitu kental sebagai upaya untuk menjawab persoalan umat.Abstract: The Method of Wahbah al-Zuhaylî’s Qur’anic Commentary: A Study of al-Tafsîr al-Munîr. This article attemps to study the method of commentary of the Qur’an employed by Wahbah al-Zuhaylî, an expert in Islamic law yet has produced a monumental work on the Qur’anic commentary, entitled al-Tafsîr al-Munîr fî al-‘Aqîdah wa al-Syarî‘ah wa al-Manhaj. In his discussion, al-Zuhaylî collaborates several methods. From the source perspective, the author combines classical methods, namely Tafsîr bi al-ma’tsûr (riwayah) and bi al-ra’y (ijtihad), while in the way of presenting his commentary he employes the modern methods, which constitutes the combination of tahlîlî (analysis), in discussing language and  literary aspects, and maudhû‘i (theme), in elaborating certain themes. The pattern applied in this work seems to be colored by author’s intellectual background, which is Islamic law. Yet, the social aspects (al-âdab al-ijtim‘i) are also to have their parts in the discourse in the context of responding to social needs.Kata Kunci: metode, Wahbah al-Zuhaylî, al-Tafsîr al-Munîr

Abstract

Abstrak: Artikel ini berbicara tentang penyelesaian sengketa wakaf dalam sejarah hukum Islam. Permasalahan wakaf telah muncul di awal sejarah Islam. Sehubungan dengan sengketa tentang status harta sebagai wakaf telah muncul pada masa lalu  disebabkan oleh perubahan sosial; pergeseran nilai dan tatanan masyarakat, dan ditambah lagi dengan masalah bahwa tidak adanya bukti tertulis yang menyatakan bahwa status suatu harta sebagai objek wakaf. Pada tulisan ini dikemukakan kasus-kasus permasalahan sengketa wakaf yang terjadi pada awal periode Islam dan kasus-kasus kontemporer tentang sengketa perwakafan serta penyelesaiannya, yang terjadi di Indonesia pada beberapa dasawarsa yang lalu.Abstract: The Settlement of Religious endowment (waqf) Dispute: A Socio-Historical Approach of Islamic law. This paper concentrates on the settlement of religious endowment (waqf) dispute in the perspective of Islamic law history. The disputes relating to waqf  has emerged since the early development of Islamic history. In regard with the conflict of the status of waqf property, the disputes have originated from the social change, the shift of values in the society, and the absence of written evidence of waqf property. This article will elaborate the cases of waqf disputes which occured in the early periods of Islam and the contemporery cases along with the settlement of the disputes taking place in Indonesia in the last few decades.Kata Kunci: Hukum Islam, Hukum Perwakafan, Sejarah Sosial Hukum Islam

Abstract

Abstrak: Sejak Indonesia merdeka hingga masa Reformasi, Aceh senantiasa mengalami pasang surut. Sepanjang sejarah tersebut, konflik, baik secara vertikal masyarakat dengan Pemerintah RI, maupun secara horizontal sesama masyarakatnya, selalu saja terjadi. Terjadinya bencana tsunami 2004 menambah penderitaan rakyat Aceh, namun sekaligus memberi hikmah tentang pentingnya membangun Aceh kembali dalam bingkai wawasan keislaman dan keindonesiaan. Pasca tsunami, pembangunan kembali Aceh menjadi topik yang banyak dibicarakan. Dalam konteks itu, penulis memaparkan strategi rekonstruksi Aceh yang bertumpu pada pertama, membuat buku panduan pengamalan Syariat Islam untuk mayarakat dalam kehidupan sehari-hari. Kedua, membuat perencanaan pembangunan dengan menggunakan prinsip-prinsip pembangunan Islam. Ketiga, mewujudkan pemerintahan yang bersih dan berwibawa.Abstract: Islamic Development Strategy in Post-Tsunami Aceh towards Establishing Religious Society. Since Indonesian independence to the reformation era the development in Aceh has undergone changable rise and fall. In such history long-lasting conflict, be it vertically between the people and the government of the Republic of Indonesia or horizontally amongst the society had repeatedly happened. The tsunami of 2004 put the burden of Acehnese people even heavier, but at the same time it throw light into the importance of reconstructing Aceh in the framework of Islamic and Indonesian ways of life. In the post tsunami, the reconstruction of Aceh has become the most discussed topic. In this context, this essay extensively discusses the strategy of reconstruction in Aceh which mainly focus on: First, writing the blueprint of the Islamic teaching experience that should become as a guideline for peoples’ daily lives. Abstract

Abstrak: Tulisan ini mengkaji pengaruh neosufisme terhadap kontinuitas doktrin tasawuf dan tarekat-tarekat baru yang timbul sejak dua abad terakhir periode pertengahan Islam. Kemunculan neosufisme abad ke-14 M berpengaruh besar terhadap corak tasawuf dan tarekat baru abad-abad tersebut. Selain mendorong “purifikasi” doktrin agar tidak dimasuki unsur-unsur non Islam, neosufisme juga memberi arah baru agar tasawuf dan tarekat senantiasa berada dalam bimbingan syariat. Orientasi ini tidak saja memperlemah doktrin emanasi Tuhan atas makhluk- Nya berganti dengan doktrin transendensi, tetapi juga menjadikan tasawuf berada dalam kerangka ortodoks, tarekat juga demikian. Pengembalian ajaran ke sumber asli al-Qur’an dan Sunnah membuat tarekat-tarekat baru yang muncul bebas dari sifat yang tidak islami. Neosufisme berhasil mengubah orientasi tasawuf dan tarekat baru, yang lebih aktif-responsif terhadap urusan duniawi.Abstract: The Influence of Neosufism towards the Development of Tasawuf and New Tarekat. This essay studies the influence of neosufism on the continuity of tasawuf doctrine and new tarekats emerged during the last two centuries of medieval Islamic period. The raise of the fourteeth century neosufism movement had greatly influenced the nature and the characteristics of the new tasawuf and tarekats of the succeeding era. In addition to giving impetus in ‘purification’ of the doctrines to avoid the tasawuf and tarekat from intrusion of un-Islamic elements, the neosufisme has provided with guidance so that they should be kept under the syariat control. This new tendency has forced the tasawuf and tarekats to weaken their support to the doctrin of immanation of God toward His creatures, and replaces it with the transcendent doctrine. The return to the original stipulations of the Qur’an and the Sunna liberated the tasawuf and tarekats from their un islamic characters. The Neosufism movement had succeeded in changing the orientation of the new tasawuf and tarekas to be more responsive to the worldly interest.Kata Kunci: neosufisme, purifikasi, ortodoksi, aktivisme
