Abstract

Marriage in the Islamic legal study in Indonesia introduces a discussion of mixed marriages. In the understanding of classical fiqh, when dealing with the term of mixed marriage, the paradigm will lead to the understanding of different religion marriage. However, along with the development and the increasingly existing Islamic law in Indonesia based on the theory of legal existence, mixed marriage is not only limited to a marriage due to religious differences, but there is also a marriage due to citizenship differences as defined in the Marriage Law.[Perkawinan dalam kajian studi hukum Islam di Indonesia memperkenalkan pembahasan tentang perkawinan campuran. Dalam pemahaman fikih klasik apabila berhadapan dengan term perkawinan campuran maka paradigmanya akan mengantarkan pada pemahaman perkawinan beda agama. Namun, seiring dengan perkembangan dan semakin eksisnya hukum Islam di Indonesia dengan berdasarkan teori eksistensi hukum, maka perkawinan campuran tidak hanya sebatas pada perkawinan karena perbedaan agama saja, melainkan terdapat pula perkawinan karena perbedaan kewarganegaraan sebagaimana yang dirumuskan dalam Undang-Undang Perkawinan.]

Abstract

Siri marriage (unregistered marriage) is the one that has met the terms and pillars that have been established by the Islamic law and have been strengthened by the opinion of the classical Moslem scholars. Siri marriage is no longer able to achieve the function of the Islamic pillarsand terms of marriage, especially the witnesses of marriage, which aims to announce a marriage as a guarantee of the rights for the bride, the bride's family and the society. The consideration of siri marriage today is the benefits. This article confirms that marriage registration is a large-scale of the witness's position to achieve the objective of the witness to the society. Thus, marriage is no longer only performed as the terms and pillars that are established by the Moslem scholars, but it also involves the state in order to guarantee the rights of the parties concerned in order to achieve the aim of marriage that is sakinah, mawaddah and raḥmah. This article discusses the effort to re-examine the existence of the siri marriage in the perspective of one methodology of the principles of Islamic jurisprudence that is the method of istislahiah reasoning.[Nikah sirri merupakan pernikahan yang telah memenuhi syarat dan rukun yang telah ditetapkan oleh hukum Islam serta dikuatkan oleh pendapat ulama klasik. Nikah sirri tidak lagi mampu untuk mencapai fungsi dari rukun dan syarat perkawinan terutama saksi yang bertujuan untuk mengumumkan perkawinan sebagai penjaminan hak bagi mempelai, keluarga mempelai serta masyarakat. Pertimbangan nikah siri pada masa sekarang adalah kemaslahatan. Artikel ini menegaskan bahwa pencatatan perkawinan merupakan skala besar dari kedudukan saksi untuk mencapai tujuan saksi pada masyarakat. Dengan demikian, pernikahan tidak lagi hanya dilaksanakan sebagaimana syarat dan rukun yang ditetapkan oleh ulama akan tetapi juga melibatkan negara demi menjamin hak-hak pihak yang berkaitan demi mencapat tujuan perkawinan yaitu sakinah, mawaddah dan raḥmah. Artikel ini membahas tentang upaya menelaah kembali eksistensi nikah sirri dalam sudut pandang salah satu metodologi usul fikih yaitu metode penalaran istislahiah.]

Abstract

Testament is a problem that can be found in all societies. The differences are related to what form of sentences of the testament is, when the testament is uttered, how many testaments are, and who gets the testament. In the Western law, someone may give a testament to a person or an institution with the total amount of his inheritance. This can make the family or the heirs do not get the inheritance, so that the family relationship will become unharmonious. In the traditional society in Indonesia, there is no limit of how many testaments are allowed to give. Parents usually divide the inheritance to their children while they are still alive so that there will be no broken relationship within the family. In Islam, a testament is allowed for the family members or others who are not the family members. The maximum limit of testament in general is 1/3 of the inheritance. A testament for others does not absolutely need the heirs’ permission. It will be different if the testament is for the heirs; it is only allowed when the other heirs permit. The hindered heir (if the member of the family is not Moslem) can get a part of the inheritance by the ‘wajibah’ testament. This provision indicates the importance of family relations and the realization of justice, because all can get the inheritance from the testate.[Wasiat merupakan persoalan yang hampir ada pada semua masyarakat. Perbedaan yang ada terkait bentuk kalimat wasiat, waktu pengucapan wasiat, jumlah wasiat, dan siapa yang mendapatkan wasiat. Dalam hukum Barat, terdapat wasiat yang diberikan oleh pewasiat kepada seseorang atau lembaga dengan jumlah keseluruhan harta. Hal ini membuat keluarga atau ahli waris tidak mendapat harta warisan, sehingga hubungan kekeluargaan menjadi tidak harmonis. Dalam masyarakat adat Indonesia, tidak ada batasan berapa jumlah wasiat yang diperbolehkan. Orang tua biasanya membagi harta kepada anak-anaknya ketika masih hidup agar nantinya tidak terjadi perpecahan dalam keluarga. Dalam Islam, wasiat diperbolehkan untuk orang lain atau untuk anggota keluarga. Batasan maksimal wasiat secara umum adalah 1/3 dari harta peninggalan. Wasiat untuk orang lain tidak harus dengan izin ahli waris. Hal ini berbeda dengan wasiat untuk ahli waris, baru diperbolehkan apabila ahli waris lain mengizinkan. Adapun ahli waris yang terhalang, maka bisa mendapatkan bagian dari harta peninggalan dengan cara wasiat wajibah. Ketentuan ini menunjukkan pentingnya hubungan keluarga dan terwujudnya keadilan karena semuanya bisa mendapatkan harta dari peninggalan pewasiat/pewaris.]

Abstract

A concern in the elimination of discrimination against women with special treatment is recognized by the international community. This is manifested in the convention on the elimination of all forms of discrimination against women (CEDAW), which aims at achieving the equality and justice. The elimination of discrimination acts as the mainstreaming of women towards the gender equality. It is even formulated as a basic need for the promotion of the human rights in the millennium development goals. This article discusses maqāṣid asy-syarī'ah with the principle of substantive equality, the principle of non-discrimination in the fulfillment of basic freedoms and human rights, and the principle of state obligation that has the responsibility to ensure the realization of the right equality of men and women using the approach of al-maṣlaḥah.[Perhatian pada penghapusan diskriminasi terhadap perempuan dengan perlakuan khusus diakui oleh dunia Internasional. Hal ini diwujudkan dalam Convention on the Elimination of All Forms of Discrimination Againts Women (CEDAW) yang bertujuan untuk mencapai persamaan dan keadilan. Penghapusan diskriminasi tersebut berperan sebagai pengarusutamaan perempuan menuju kesetaraan gender. Bahkan hal ini dirumuskan sebagai kebutuhan dasar pemajuan hak asasi manusia dalam millenium development goals. Tulisan ini mendiskusikan maqāṣid asy-syarī'ah dengan prinsip kesetaraan substantif, prinsip non-diskriminasi dalam pemenuhan kebebasan-kebebasan dasar dan hak asasi manusia, serta prinsip kewajiban negara yang memiliki tanggungjawab untuk memastikan terwujudnya persamaan hak laki-laki dan perempuan, dengan menggunakan pendekatan al-maṣlaḥah.]

Abstract

The Compilation of Islamic Law (KHI) cannot be separated from the rules of law written in the Qur'an and Hadith. Article 39 paragraph 3 of The Compilation of Islamic Law (KHI) states that there is a prohibition on marriage due to the same breastfeeding mother. Philosophically, Allah's purpose in prescribing the law is to preserve the benefits of human beings, as well as to avoid ‘mafsadat’, both in the world and in the hereafter. In article 39 paragraph 3 KHI, the determination of the law is in order to realize the benefits of human beings. There are five main elements that are protected against the law of prohibition on marriage due to the same breastfeeding mother as mentioned in article 39 paragraph 3 KHI. The five main elements are religion (ḥifẓ ad-dīn), soul (ḥifẓ an-nafs), reason (ḥifẓ al-‘aql), descendants (ḥifẓ an-nasl), and property (ḥifẓ al-māl).[Kompilasi Hukum Islam (KHI) tidak lepas dari kaidah-kaidah hukum yang tertulis dalam al-Qur’an dan Hadis. Pasal 39 ayat 3 Kompilasi Hukum Islam (KHI) menyatakan adanya larangan melangsungkan perkawinan karena sesusuan. Secara filosofis, tujuan Allah mensyariatkan hukumnya adalah untuk memelihara kemaslahatan manusia, sekaligus untuk menghindari mafsadat, baik di dunia maupun di akhirat. Dalam pasal 39 ayat 3 KHI, penetapan hukum tersebut dalam rangka mewujudkan kemaslahatan manusia. Ada lima unsur pokok yang dilindungi terhadap penetapan hukum keharaman menikah karena sesusuan yang tercantum dalam pasal 39 ayat 3 KHI. Kelima unsur pokok tersebut adalah agama (ḥifẓ ad-dīn), jiwa (ḥifẓ an-nafs), akal (ḥifẓ al-‘aql), keturunan (ḥifẓ an-nasl), dan harta (ḥifẓ al-māl).]

Abstract

Article 39 Paragraph 3 of The Compilation of Islamic Law explains the prohibition of marriage due to the same breastfeeding mother. The Article states that a man and a woman are forbidden to marry due to several things. One of them is due to the same breastfeeding mother, but the Article does not explain how much the level of breastfeeding is that makes the marriage between those with the same breastfeeding mother is forbidden. However, viewing the formulation of Islamic Law Compilation sourced from the book of fiqh Syafi'iyah, the content of breastfeeding in the article follows the Syafi'i school, which is five times of suction (susuan). Whereas in the Islamic law,one explains that it can make a mahram no matter how much the content of breastfeeding is,one says that once or twice cannot make a mahram, and the other says that at least five times of suction can make a mahram. [Pasal 39 Ayat 3 Kompilasi Hukum Islam menjelaskan tentang larangan perkawinan karena sesusuan. Dalam Pasal tersebut menyebutkan bahwa seorang laki-laki dan seorang perempuan dilarang melangsungkan perkawinan disebabkan oleh beberapa hal. Salah satunya karena pertalian sesusuan, namun dalam penyebutan Pasal tersebut tidak menjelaskan seberapa kadar susuan yang menyebabkan larangan perkawinan sesusuan. Namun melihat rumusan Kompilasi Hukum Islam yang bersumber pada kitab fiqh Syafi’iyah, kadar susuan yang terkandung dalam Pasal tersebut mengikuti mazhab Syafi’i, yaitu lima kali hisapan (susuan). Sedangkan dalam hukum Islam menjelaskan kadar susuan itu ada yang berpendapat sedikit banyak tetap menjadikan mahram, satu kali dua kali tidak dapat menjadikan mahram, dan ada juga minimal lima kali susuan dapat menjadikan mahram.]

Abstract

In the Islamic law there is a marriage prohibition related to time, which is a prohibition on getting married when a person performs ihram, both the ihram of hajj and ihram of umrah and in the iddah period. The people of Sibiruang Village, Koto Kampar Hulu District, Kampar Regency, Riau Province, besides adhering to Islamic law, are still firmly adhered to the customs that have been passed hereditary to the prohibition of marriage between two praying sermons of Eid al-Fitr and Eid al-Adha or from the 1st Shawwal after the Eid al-Fitr to 10 Zulhijjah before the Eid al-Adha. Sibiruang people believe if someone violates, he will get a negative impact on the life of his family someday. This articlewants to examine the marriage prohibition between two praying sermons of Eid al-Fitr and Eid al-Adha and the traditional custom sanctions for those who break the perspective of Islamic law.[Dalam hukum Islam terdapat larangan perkawinan yang berkaitan dengan waktu, yaitu larangan untuk melakukan perkawinan ketika seseorang melakukan ihram, baik ihram haji maupun ihram umrah, dan pada masa iddah. Masyarakat Desa Sibiruang Kecamatan Koto Kampar Hulu Kabupaten Kampar Propinsi Riau, selain berpegang teguh pada hukum Islam, juga masih perpegang teguh pada adat kebiasaan yang sudah turun-temurun terhadap larangan melakukan perkawinan di antara dua Khotbah Idul Fitri dan Khotbah Idul Adha atau dari mulai tanggal 1 Syawal setelah Khotbah Idul Fitri sampai dengan 10 Zulhijjah sebelum Khotbah Idul Adha. Masyarakat Sibiruang meyakini apabila ada yang melanggar akan mendapatkan dampak negatif terhadap kehidupan keluarganya kelak. Abstract

Having been commonly practiced, in vitro fertilization (fertilization in a tube/baby tube program) is one of the controversial medical practices both for religious reasons and for ethical and moral reasons. From the ethical/moral point of view, the problem lies in the fact that the implication of such a practice may result in the destruction of the remaining unused embryos. In this article, the writer argues from the point of view of maqāṣid asy-syarī‘ah that the practice of in vitro fertilization is much needed by the infertile couples who want to have children. The embryo's moral status starts from the implantation of the blastocyst in the women’s uterine wall, so that the zygote of fertilization in the pre-implantation tubes does not have a moral status yet.[Walaupun telah jamak dilakukan, fertilisasi in vitro (pembuahan dalam tabung/bayi tabung) merupakan salah satu praktis medis yang konroversial baik karena alasan agama maupun karena alasan etika dan moral. Dari segi etika/moral, permasalahannya adalah implikasi dari praktik itu yang berakibat pada pemusnahan sisa embrio yang tidak digunakan. Dalam tulisan ini penulis berargumerntasi dari sudut pandang maqāṣid asy-syarī‘ah bahwa praktik fertilisasi dalam tabung sangat dibutuhkan oleh pasangan tidak subur yang mendambakan keturunan. Status moral embrio dimulai sejak implantasi sehingga zigot hasil fertilisasi dalam tabung praimplantasi belum memiliki status moral].
