Abstract

Local governments, though they may establish international collaboration, they can not be considered as a subject of law in the international law, but rather as an auxiliary instrument of the central government. From the perspective of international law, the responsibilities raised by such international collaboration or international agreement is not in the hand of local government. Another significant point with regards to the said collaboration is that this is also does not contradict with the principle of national unity (NKRI). Because, the local government is merely as an agent of the state which is a subject of international law. In case of any disputes that may the agreements cause shall also be emphasized to be settled within national legal system of Indonesia.Keywords: Authority, Local Government, Collaboration, MoU, Sister City, Foreign Private

In general, the proving of actio pauliana is not simple, and the procces itself is not organized well. Abstract

In the era of independence, Indonesian territory covered all the former Dutch’s colony territory. The new state territory, which was based on historical fact, is known with the uti possidetis principle. In the practical implementation, this concept is not problematic, especially in the border delimitation process. This article attempts to analyze the border demarcation mechanism between Indonesia and Malaysia land border. Further, this article also attempts to discover the border demarcation impact to the state’s sovereignty in general and its impact to the local people mobility. Normatively, an act, in whatever form in may be, shall be based on the orientation for the the people benefit and to ascertainment of the justice for people. The politics of law of presidential election issued by the relevant body is considered to be conservative and tends to be elitical. On theother hand, the success of Indonesia to exit fron the transition of democracy is determined by the lagal policiy of the govenrment. Abstract

Company law will be an important policy for both the Indonesian Government and New Zealand Government in the future. This is because that law has proven to be extremely effective in developing companies’ performance and improving the economic situation in these countries. This paper examines the similarities and differences of company laws in Indonesia and New Zealand. There are two reasons why Indonesia and New Zealand have been chosen for this paper. The first reason is that Indonesia and New Zealand reformed their company laws in the 90s. The second one is due to the similarity of the main source of company law in Indonesian and New Zealand, namely from the common law jurisdiction Finally, this paper suggests that Indonesia should learn from New Zealand’s experience which has a more comprehensive system of company law.

Abstract
