Abstract

This research focused on the aspects of inequality and legal uncertainty due to the double taxation (double taxation) on the same object. As a result, the tax burden felt by the public will feel heavy. The research also examines the Constitutional Court ruling on the petition for the perceived tax law has imposed double taxation on an object the same tax. Analysis of the research done by looking at the tax benefit that should be used for national interests rather than the interests that are regional (sectoral) because of the potential tax on an area. Moreover, coordination among government agencies that are not effectively be an additional analysis to be more comprehensive in its discussion.

Abstract

The research will examine the discourse of Pancasila-based constitutional state and the relevance in Indonesia’s life after the amendments to the 1945 Constitution of Indonesia. The research uses a normative legal approach combined with a material-based analysis. The result shows that the founding fathers accepted the concept of Rechtsstaat, but they changed the basis of social-economy from liberal economic system into planned economic system. The change was made by expediting the process of social-economy decolonization and tradition reconstruction; as a result, the constitutional state of Indonesia exists on the basis of welfare state and Indonesian legal traditions. The aims are not only to ensure legal certainty for economic business but also to provide justice and welfare for all citizens. Although it was unclearly stated that the amendments to the 1945 Constitution of Indonesia rejected the free trade economic system, it has eliminated GBHN as the instrument to implement the planned economic system as regulated in Article 33 Verse (1) of the 1945 Constitution of Indonesia. Consequently, the economic system tends to move towards the free trade system, which is parallel to the concept of liberal-constitutional state and principally against the values of Pancasila that aim to grant social justice for all Indonesian citizens.

Abstract

The research is aimed at finding out which institution, the Corruption Eradication Commission (KPK) or the Indonesian National Police (POLRI), actually has the authority to conduct investigations in the driving simulator case because both institutions stated that they had the authority. This research uses a normative approach supported by legal approach and case study. The type of data is secondary data. The data sources include primary legal materials, secondary legal materials, and tertiary legal materials. The research finding is that according to Law No.30 Year 2002 on Corruption Eradication Commission, Article 50, the Corruption Eradication Commission has the authority to conduct investigations. This authority is also strengthened by the statement of President Susilo Bambang Yudhoyono. To settle the dispute between KPK and POLRI, the President stated in his speech on 8 October 2012 that the driving simulator case involving Inspector General Djoko Susilo should be handled by KPK. Moreover, considering the Memorandum of Understanding among Corruption Eradication Commission, Indonesian National Police, and Attorney General, the authority should be given to KPK.

Abstract

The research aims to study the dialectics between law and moral in the perspective of legal philosophy and examine the function of moral for law and law for moral. This study is a doctrinal-legal research that uses primary legal materials and a conceptual-juridical approach. The result indicates that the relationship between law and moral bears a reciprocal functional relation in law making and law enforcement. For law, moral functions as the source of ethics (values) in positive law making, source of rules in positive law, evaluative instrument for legal rule substances, and justification reference for settlement of legal cases that have unclear laws. Meanwhile, for moral, law functions as a medium that transforms individual moral rules into social legal rules with certain sanctions, strengthens moral values, principles, and rules, establishes new morality in the society, and enforce moral values, principles, and rules in social order.

Abstract

The research is aimed at finding out whether the exemption for agricultural industries in the competition laws in Unites States of America and European Union is fully or partially granted. In addition, the study examines whether the competition law in Indonesia also regulates exemption for agricultural industries. The research method is normative juridical with a legal comparison approach. The result shows that the exemption for agricultural industries in the United States of America mentioned in the antitrust law was regulated by the Congress through Clayton Act 1916 and confirmed in Capper-Volstead Act 1922. In European Union, the exemption is regulated in the Treaty Establishing the European Community. The regulations in the United States and European Union are the same, in which farmers are allowed to establish agricultural cooperatives that aim to meet the needs of its members, such as collective processing, preparation for markets, merchants, and marketing. Although Indonesia does not have a specific law for exemption, several stipulations in Article 50 and 51 of Law No. 5 Year 1999 can be interpreted as exemption for agricultural industries in the competition law.

Abstract

This research analyzes whether the sole proprietorship policy can support national banking monitoring andhow this policy is implemented in the banking globalization, legal protection for national banking and concept of national banking development in globalization era in relation to the objectives of welfare state. The research uses normative juridical method with descriptive analysis. The findings are: first, the sole proprietorship policy does not apply to under 25% shareholding of a bank or share acquisitions in several banks. Second, the nature of sole proprietorship policy is futuristic, so it can reduce the discretion for national banking shareholding by foreign/global investors. Third, legal protections for national banking towards domination of national banking shareholding have been ineffective because the sole proprietorship policy only incorporates the same proprietorship of several banks. Fourth, in globalization era, the concept of national banking regulation independency for capital is adjusted to the business segment of each bank. In addition, an integrative monitoring should be applied to national banking activities, particularly to foreign parties who hold shares in several national banks without highly influenced by global banking regulation recommendation.

Abstract

This research was conducted to find out the sociological juridical reasons on the increase of crimes using firearm. This is a socio legal research. The research result showed that sociologically the increase of firearm ownership in the society has resulted in the increasing number of crimes using firearm in the society. One of the reasons is that the law permits firearm ownership through two gates, by the Minister or by the Police.

Abstract

The presence of Sharia banks offers customers with various banking products. It is just different from conventional banks in terms of pricing, both the selling price and the buying price. As for the types of products offered by Sharia banks are: Al-wadi’ah (savings), Financing with profit sharing, Bai’al- Murabahah, Bai’as-salam, Bai’Al-istihna, Al-Ijarah (Leasing), Al-Wakalah (Mandate), Al-Kafalah (warranty), Al-Hawalah, Ar-Rahn. The aim of this paper is: to find out the position of Sharia Banks in the Indonesian banking system, and to determine the role of Sharia Banks in the provision of banking services. The research method in this research is normative juridical approach. Based on the results and discussion of Sharia Bank position in the Indonesian banking system, the targets of Sharia banking development are: enhancing the benefits of Sharia banking for the public welfare; realizing a healthy, competitive, and efficient Sharia banking; assuring the compliance of Sharia principles consistently based on mudaraba (partnership); and assuring the precautionary principles. Furthermore, the role of Sharia Banks in the provision of banking services, which is based The Bank of Indonesia Regulation 6/ 17/PBI/2004 on Rural Banks based on Sharia principles and The Bank of Indonesia Regulation 6/24/PBI/2004 on Commercial Banks Conducting Business Based on Sharia Principles: Sharia Monitoring and Reporting Procedures for Monitoring Results to Sharia Supervisory Board.
