Abstract

The primary problem in this study is how to law enforcement and the protection of consumer's rights against the certification and labeling of halal products according to UUJPH. The second problem to consider is the factors that causing young enterpreneurs to delay certification and halal product labeling on their products. This is a normative juridical research with a complementary juridical empirical data. The study points out that: first, until now there has been no law enforcement and no collective protection of consumer rights on the certification and labeling of halal products. To complicate matters, there is lack of coordination between ministries and agencies by MORA RI. Second, some of the factors that cause the enterpreneurs to delay halal certification on their products are the facts  that: i) UUJPH cannot be implemented operationally because the Government Regulation (PP) has not been issued; ii) BPJPH which is the mandate of UUJPH has not been established; iii) Business actors find it difficult to certify some kinds of their products, such as pharmaceutical products  since  the raw materials are  imported from abroad; iv) There is a reatively poor public awareness of  consumers of halal products  since they do not prioritize halal factor in selecting and purchasing a product.

Abstract

Patent protection in Indonesia still leaves various problems, both in terms of practical level (implementation) and conceptual level (public acceptance). This study aims to investigate the problematic patent protection from the point of governing law, in this case it is due to the reasons underlying its formation. This is a normative research with a political approach. The legal materials used in the form of the treatise of the trial establishment of patent law, Law No. 6 In 1989, Law No. 13 of 1997 and Law No. 14 of 2001 on Patents. Secondary legal materials in the form of articles that accompany or responded to the formation of the law, and the materials that explain the situation when the law was formed. It comes up with a conclusion that the establishment of the Patent Act is originally intended to encourage industrialization in the country, but in fact is more highly affected by the desire to keep abreast of political and international trade, especially that of developed countries, more adjusted to the substance of the Act by the International Agreement (TRIPs), and create better (foreign) investment climate. The assimilation of domestic-foreign interest more or less would affect the acceptance and implementation of patent protection leading to stumbling blocks as seen today.

Abstract

The primary problem in this study is how the decision-making authority for border cooperation with the District Government of Nunukan should get prior approval of the Central Government? Second, what kind of border cooperation that have been undertaken by the Indonesia-Malaysia of North Kalimantan Nunukan Regency to Tawau City of Sabah State? This study uses a normative approach. The results of this study concluded that first, the decision to border cooperation is still dependent on the approval of the Central Government since Regional Authority of Nunukan Regency is very limited. Second, the border cooperation that have been undertaken by the Indonesia-Malaysia of North Borneo Nunukan to Tawau City State of Sabah is the cooperation of the Socio-Economic of Malindo families. However, it does not create an interface connection with the regional development programs and regional economic cooperation such as BIMP-EAGA, which is actually very relevant to be integratively and complementatively developed with the Socio-Economic of Malindo families.

Abstract

Despite the fact that reformation has been running for 16 years, the idea of strengthening the Presidential System remains a discourse and even worse, it is getting weaker and causing anomalies or irregularities here and there. The first research problem is what is the cause of the anomaly in government presidential system after the amendment of Law of 1945? Second, how to establish an effective government presidential system for the benefit of government in Indonesia? This is a normative research with legal and conceptual approaches. The study discovers that the first anomaly presidential system following the amendment of the 1945 Constitution is influenced by three reasons: (i) a blend of a multiparty system with a presidential system, (ii) the occurrence of a coalition in a presidential system, and (iii) the reduction of presidential powers after the amendment. Second, it requires several steps to establish a presidential system: (i) simplification of political parties; (ii) strengthening the functions and performance of the political parties; (iii) forming a permanent coalition of political parties; (iv) revoking legislative authority of the president; (v) authorizing the presidential veto in the passage of legislation; (vi) depending on leadership style of the president; vii) implementing a district election system.

Abstract

The first and foremost problem in this study is testing the urgency of the legislation that is integrated in the Constitutional Court. Secondly, it deals with the relevance of the integration testing of the legislation to the development of law in Indonesia. This is a juridical normative research whose legal materials were analyzed descriptively and qualitatively. The study reveals that first, the idea of unification of judicial review of legislation in the Constitutional Court is very essential to do, in order to harmonize the legislation, to maximize the protection of constitutional rights of citizens, and to realize the supremacy of the constitution. Second, the unification of legislation testing can fix elements of the legal system that is particularly an instrument or substance of the law, which highly affect law-making and institutional capacity building, namely the Supreme Court, the Constitutional Court and the executive in Indonesia.

Abstract

The first and foremost issue in this study is how is the licensing regulations of housing and transportation policies in the city? Second is how is the relationship between generation and attraction of Sidoarum Housing crossing Godean street? Third is how the prospect of housing permits settings integrated with the analysis of the impact of traffic? This is an empirically normative research. It leads to a conclusion that first, the laws and regulations related to housing both in the provincial and district levels are still partial, sectoral, and not synchronized with the plan of spatial and territories. So far there is no regulation which relates housing with traffic density at the local level. Second, the level of housing density in Godean street and the current traffic density has increased from year to year thronging the open roads connecting Godean (as the densely populated residential areas) towards the city as an economic, offices, and educational center and causing high degree of saturation, comprising of 7749 and 9141 generation of traction. Thus, the density of housing in an area highly affects traffic density. Third, it is recommended that housing licensing regulations be regulated in an integrated manner with the housing permit obligations of Traffic Impact Analysis (Andalalin) for housing with certain capacity in a regional regulation.

Abstract

The first and foremost issue in this study is the general principles and legal arrangements of tapping into national and international human rights law. Second, as lex specially can tappin be prosecuted to national or international law? Third, why is the wiretapping of Australia against Indonesia not considered as a crime but a violation of the diplomatic code of conduct. This is a normative research. The study reveals that first: legally tapping is prohibited by law and international human rights based on the Universal Declaration of Human Rights (UDHR) in 1948, the International Covenant on Civil and Political Rights (ICCPR) in 1966, the European Convention for the Protection of Human Rights and Fundamental Freedoms (1958) and the 1961 Vienna Convention. While in the national law, the prohibition of tapping is provided in Article 28G paragraph (1) of the 1945 Constitution, Article 32 of law No. 39 of 1999, Article 40 of Law No. 36 of 1999, Article 31 paragraph (1) of Law No. 11 of 2008, and Article 31 paragraph (2) of Law No. 11 Year 2008. Tapping is allowed when the order and security of the country is being threatened as stipulated in the Law on Combating Criminal Acts of Terrorism, Narcotics Law, the Law on the Corruption Eradication Commission, and the Law on State Intelligence. Second, the ban on wiretapping in international criminal law can be excluded for particular crimes as stipulated by Rome Statute of 1998, and Transnational Organized Crime. Thirdly, in the context of the behavior relations between countries, Australia tapping against Indonesia has shifted meaning from a crime  into a violation of the diplomatic code of conduct. Indonesia acted diplomatically towards Australia’s violation by forgiveness.

Abstract

The first and foremost problem in this study is the setting of Whistle Blower and Justice Collaborator in Indonesia. The second is the urgency and the existence of Whistle Blowers and Justice Collaborator in the Criminal Justice System. To analyze those problems the researcher used a normative juridical research. On the basis of the study it is revealed that, first, there are some rules governing the Whistle Blower and Justice Collaborator in the Criminal Justice System, but there is no room for its setting in the Criminal Code (KUHAP). Second, the urgency and the existence of Whistle Blowers and Justice Collaborator can be found through the workings of both the Criminal Justice System in the Investigation, Prosecution, Trial and in the implementation of decisions
