Abstract

The problems in this research are: first, how is grandchildren’s inheritance right in the jurisdiction of Islamic Supreme Court in Selangor, Malaysia and Supreme Court in Indonesia? Second, how is the comparison of grandchildren’s inheritance right in those two jurisdictions; and how is the pattern of the distribution of inheritance to grandchildren? This research used comparative approach. The discussion was presented in descriptive analysis. The data analysis was qualitative and normative-juridical. The findings show that: first, grandshildren’s right mentioned in the old fiqh mujtahid is revised in fiqh of consitutions in Selangor and in Indonesia. Grandchildren’s inheritance right, based on the jurisdiction in Selangor, is called as wajibah, and in Indonesia it is called as heir substitute (ahli waris pengganti). Second, there are both similarities and differences between those two jurisdictions. The one in Selangor is a result of ijtihad tatbiqi which is in line with Islamic law principles. Grandchildren from the male side whose parents pass away first will receive inheritance right. Grandchildren from female side do not receive any right. The portions that grandchildren receive can be governed in inheritance status or last will which maintains justice. The jurisdiction of grandchildren’s inheritance right in Indonesia is resulted from customary law which is adopted from Netherland’s civil law. It is a part of culture which is not based on religious principle (syahadat), is against justice principle, ijbari principles, is not in line with inheritance elements, and is against the priority principle and hijab.

Abstract

The direct residential as well as provincial election may pave the way for the enhancement of the quality of democracy. It is unfortunate however, that among those elections have raised the conflict and social unrest, which led to the lack of recognition of the elected candidates, and finally the cases then are brought to the court.  Legal provisions pertaining to the way these disputes shall be settled are also have not yet been synchronized. This brings about that General Election Commission (KPU) as well as Local Election Commission (KPUD) and the Supreme Court (MA) hold their own legal  interpretations which differs each from others.

Abstract

This research focuses on problems as follows: First, position and role of Bank Indonesia as a state body in Indonesia; Second, independency of central bank in performing its monetary function. This research is a juridical normative research using primary legal source which is legislation concerning central bank. Data is collected through document study and literary study. This research concludes that position of Bank Indonesia as a legal entity should have been included in the explanation of constitution system. Legislation should emphasize that Bank Indonesia is a central bank not a state body. Central Bank should have independency to avoid conflict of interest.Key words : Central bank, governance , independency

Abstract

The impacts of new criminal acts containing pornography such as the criminal act of live-sex business are very dangerous in the life of a nation and country in general, as well as the young generation in particular. In relation to that, the problem in this research is about the criminal policies as an effort to tackle the criminal act of live-sex business in the present and in the future. This was a legal normative (doctrinal) research. The finding concludes that the criminal policies related to the criminal act of live-sex business are not explicitly governed by Pornography Law. However, there are several articles which are very close to such thing: Article 34 for the subjects and actors of live sex, and Article 35 for the viewers of live sex. The RUU KUHP (the draft of criminal law) accommodates the sanctions of the criminal act of live-sex business, but it does not govern it explicitly. Such thing can be seen in Article 469, Article 473, and Article 475 for the subjects; Article 472 and Article 474 for the viewers of live-sex scenes. In addition, non-penal policies, such as socialization and a good approach, are also necessary in order to make the efforts successful.

Abstract

This research discusses two issues which are: First, (1) comparison of similarities and differences of the essence of Constitution and the amendment agreement of Constitution; Second, (2) consequence of those differences towards the current development of Constitution. Normative legal research and post-colonial theory methods are used to analyze the issues. Data are collected from legal materials through literary study and documentary study. With those methods, this research found that the difference between 1950 and 1999 agreement shows inconsistency and divergence in viewing Constitution. Besides that, the agreement on essence of Constitution is performed based on decolonialization paradigm, while the consent of People’s Consultative Assembly in 1999 was mostly based on democractization paradigm.

Abstract

The research will examine the discourse of Pancasila-based constitutional state and the relevance in Indonesia’s life after the amendments to the 1945 Constitution of Indonesia. The research uses a normative legal approach combined with a material-based analysis. The result shows that the founding fathers accepted the concept of Rechtsstaat, but they changed the basis of social-economy from liberal economic system into planned economic system. The change was made by expediting the process of social-economy decolonization and tradition reconstruction; as a result, the constitutional state of Indonesia exists on the basis of welfare state and Indonesian legal traditions. The aims are not only to ensure legal certainty for economic business but also to provide justice and welfare for all citizens. Although it was unclearly stated that the amendments to the 1945 Constitution of Indonesia rejected the free trade economic system, it has eliminated GBHN as the instrument to implement the planned economic system as regulated in Article 33 Verse (1) of the 1945 Constitution of Indonesia. Consequently, the economic system tends to move towards the free trade system, which is parallel to the concept of liberal-constitutional state and principally against the values of Pancasila that aim to grant social justice for all Indonesian citizens.

Abstract

In the era of independence, Indonesian territory covered all the former Dutch’s colony territory. The new state territory, which was based on historical fact, is known with the uti possidetis principle. In the practical implementation, this concept is not problematic, especially in the border delimitation process. This article attempts to analyze the border demarcation mechanism between Indonesia and Malaysia land border. Further, this article also attempts to discover the border demarcation impact to the state’s sovereignty in general and its impact to the local people mobility. The last, this article also attempts to know the border dispute settlement chosen by both Indonesia and Malaysia.Keywords: Border Sign, Souvereignity, The Border Region, Border Dispute, And Border Convention

Abstract

After the reform, the amendment of 1945 Constitution of Republic Indonesia, in fact, keeps taking place. The material of 1945 Constitution of Republic Indonesia was amended not only through the formal mechanism of People’s Consultative Assembly conventions, but also through informal mechanism or the mechanism outside the formal context, in this case, through the interpretation of the judges of Constitutional Court. This research studied the problems about: first, did the Act of Constitutonal Court Number 92/PUU-X/2012 amend 1945 Constitution of Republic Indonesia? Second, what were the juridical implications of the Acts of Constitution Assembly? The research method used was normative juridical using case study. The result of the research concluded that first, there was an amendment of 1945 Constitution of Republic Indonesia through the Act of Constitutional Court of Republic Indonesia Case Number 92/PUU-X/2012 regarding the process of the formulation and discussion of draft law on Regional Representative Council (DPD) authority. Second, the Act of Constitutional Court had an implication on the position of DPD which is now equal to House of Representatives and President in suggesting draft law and in formulating Prolegnas, DPD must be involved.

Abstract

The changes of UUD 1945 has an implication on the establishment of Constitution Justice. One of the authorities of the institution whose authority is in the same line with Supreme Court is the dispute settlement of General Election results. The role played by Constitution Justice, once it solved the dispute of the result of general election in 2004, proved that the principals of court justice have been implemented in order to keep the democracy and to establish the constitution.
