Abstract

Akhir-akhir ini kenakalan anak telah membawa kepada perilaku kejahatan sebagai akibat kasus anak-anak bermasalah dengan hukum. Usaha untuk mengatasi masalah kenakalan anak dilakukan melalui pelanggaran kepolisian maupun tidak. Akan tetapi beberapa pendekatan untuk mencegah dan mengatasi kenakalan anak yang terjadi saat ini memiliki tendensi untuk melakukan pendekatan yang represif. Terlebih lagi memenjarakan anak-anak yang bermasalah dengan hukum masih sangat menonjol. Pendekatan dan metode yang tepat untuk mengatasi masalah kenakalan anak harus dilakukan dan didasarkan pada pemahaman yang komprehensif dari sebab-sebabnya. Jadi artikel ini bertujuan untuk membahas sebab-sebab kenakalan anak baik dari perspektif teori maupun konsepnya dan juga lingkup hukum serta metode untuk mengatasi kenakalan anak di Indonesia.Currently juvenile deliquency has leaded into criminal behaviour as the result the case of children in conflict with the law arises. The efforts to overcome the matters of juvenile deliquency is performed through penal policy and non penal policy. However, such approaches to prevent and to overcome juvenile deliquency that exist today, have a tendency to perform repressive approach. Moreover, imprisonment to children in conflict with the law is still a very prominent way. The appropriate methode and approach to overcome the matters of juvenile deliquency should be performed and based on deep understanding on the causes of juvenile deliquency. Thus, this article aims to discuss the causes of juvenie deliquency both from the perspective of theories and concepts within juvenile deliquency. Besides that it discuss the legal framework and the methode to overcoming the juvenile deliquency in Indonesia.

Abstract

Sistem pemungutan pajak self assessment system memberi kepercayaan kepada wajib pajak untuk menghitung, melaporkan pajak yang terutang dalam Surat Pemberitahuan (SPT), kemudian menyetor kewajiban perpajakannya. Pemberian kepercayaan yang besar kepada wajib pajak sudah sewajarnya diimbangi dengan instrumen pengawasan, untuk keperluan itu fiskus diberi kewenangan untuk melakukan pemeriksaan pajak. Apabila hasil pemeriksaan menunjukkan adanya perbedaan atau selisih, fiskus berwenang mengeluarkan Surat Ketetapan Pajak (SKP) yang berfungsi sebagai surat tagihan. Dalam praktek seringkali terjadi perbedaan perhitungan antara fiskus dengan wajib pajak, inilah salah satu sebab timbulnya sengketa pajak. Dalam hal wajib pajak mengajukan keberatan atas Surat Ketetapan Pajak dan keberatan ditolak, maka wajib pajak dapat mengajukan banding. Sesuai dengan pasal 36 ayat (4) Undang-Undang Pengadilan Pajak, wajib pajak diwajibkan membayar 50% (lima puluh persen) dari utang pajaknya sebelum mengajukan permohonan banding. Persyaratan yang begitu berat dalam pengajuan banding dimaksudkan agar lembaga banding tidak dijadikan sebagai alasan penundaan pembayaran pajak. Akan tetapi apabila dilihat dari kepentingan wajib pajak ketentuan tersebut tentunya sangat memberatkan. Disini wajib pajak diberikan suatu akses untuk mencari keadilan tetapi di sisi lain ada persyaratan yang memberatkan wajib pajak dalam pemenuhan haknya.The self assessment system gives trust to the tax payer to count, report the tax in SPT and pay it in the tax office. It is reasonable giving trust to the tax payer balanced with the controlling instrument. For that reason, fiskus given the authorization to do tax inspection. If the inspection result shows the difference, fiskus should establish Tax Permanent Letter function as the dunning letter. Practically, it often happens the difference between fiskus and tax payer. It is one of the causes of tax dispute. For tax payer can propose the objection of Tax permanent letter and if it is refused, the tax payer can appeal consideration. It is in line with article (36) verse (4) of law constitution, tax payer should pay 50% of tax burden before appealing consideration. The heavy requirement of appealing consideration made in order that institution does not function as excuses of cancelling taxation. Certainly the rule is being a problem for tax payer. That is why tax payer has access to look for justice even though he/she has to fulfill the heavy requirements to fulfill her/his right.

Abstract

Kuatnya arus demokratisasi sangat berpengaruh terhadap tuntutan good governance dalam tata kelola pemerintahan. Salah satu segi positif dari tuntutan tersebut adalah dengan telah diadopsinya prinsip akuntabilitas dalam Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup bagi pejabat atas tindakan mal-administratif dalam penerbitan izin di bidang lingkungan. Atas dasar prinsip ini warga masyarakat yang menjadi korban pencemaran dan/atau perusakan lingkungan dapat mempersoalkan legalitas perizinan dan sekaligus meminta pertanggungjawaban hukum (pidana) kepada pejabat atas kerugian yang dideritanya.The democratic strengthen is very influencing to the demand of good governance in managing the government. One of the positive demand is it has been adopted the principle of accountability of the constitution of protection and management of environment for official functionary on the act of mal administration in establishing permit of environment field, Based on the principle community who become sacrifice of pollution of environment can appeal the legal permit and the responsibility of criminal case towards the official functionary of disadvantages they have got.

Abstract

Esensi dalam penegakan hukum adalah keadilan. Keadilan itu sendiri mempunyai berbagai macam makna, tergantung dari perspektifnya. Di negara mana pun sering timbul berbagai masalah, terkait penegakan keadilan di ranah hukum. Konsep keadilan yang sudah mapan di suatu negara belum tentu baik apabila diterapkan untuk negara lain. Meskipun demikian, dimungkinkan adanya saling pengaruh mempengaruhi atau bersifat integrasi antara pemikiran satu dengan yang lainnya mengenai makna keadilan, terutama yang mempunyai sifat universal. Pada tataran filosofis, tentu masing-masing negara mempunyai akar pemikiran tersendiri, tergantung dari norma dasar negara dan kehidupan sosial-budaya bangsanya. Untuk mengurai lebih lanjut mengenai makna keadilan dari sudut pandang filsafat, sarana yang tepat digunakan adalah hermeneutik. Penelusuran keadilan dalam perspektif hermeneutik dalam rangka penegakan hukum seyogyanya dibingkai juga dengan perspektif ilmu hukum, agar diperoleh titik temu dan lebih mudah dalam pengimplementasiannya.The essence of the rule of law is justice. Justice has many meanings, depending on the perspective. Every country often arise various problems, related to the administration of justice in the realm of law. The concept of justice that have been established in a country is not necessarily better when applied to other countries. However, it is possible to mutual influenced or be integrated between each other thinking about the meaning of justice, particularly those having a universal nature. At the philosophical level, each country has own thoughts of the roots, depending on the basic norms and socio-cultural life of the nation. Thus, about the meaning of justice from the view of philosophy, the proper tools are used is hermeneutic. Search justice in the perspective of hermeneutics in the context of law enforcement should also be framed by the perspective of jurisprudence, in order to obtain the intersection and its implementation easier.

Abstract

Penyelesaian sengketa perdata di pengadilan negeri dengan asas peradilan sederhana, cepat, dan biaya murah, maka diharapkan dapat diselesaikan melalui proses perdamaian dengan menggunakan mediasi agar tidak terjadi penumpukan perkara. Sejak diberlakukannya Peraturan Mahkamah Agung Nomor 1 Tahun 2008 telah diefektikan proses penyelesaian mediasi sebagai alternatif penyelesaian sengketa. Dalam ketentuan PERMA Nomor 1 Tahun 2008, tahap mediasi dalam proses penyelesaian sengketa perdata di pengadilan negeri bersifat hukum memaksa. Proses mediasi ini membutuhkan waktu sehingga kalau tidak berhasil, maka baru dilakukan proses penyelesaian sengketa perdata secara litigasi. Waktu yang dibutuhkan akan mengganggu penerapam asas peradilan sederhana, cepat, dan biaya murah, terlebih lagi jarang terjadi keberhasilan penyelesaian sengketa dengan cara mediasi. Sedangkan menurut HIR, kemungkinan untuk dilakukan penyelesaian sengketa perdata secara perdamaian bisa dilaksanakan sepanjang proses pemeriksaan sengketa perdata.The settlement of law court dispute in district court  simply, rapidly and economically judicature principle hoped be able to settle through the peaceful process with mediation in order that it is not overloaded the case. Since it has been done The rule of High Court of Justice No. 1/2008 it has been effective the process of mediation settlement as an alternative of settlement dispute. In PERMA No. 1/2008 the mediation phase in the process of the settlement of law court dispute in district court is being law of force. The process of the mediation needs much time so if it is not successful , it will be done the process of law court settlement legitimately. The time needed will disturb the implementation of simply, rapidly and economically judicature principle, moreover it has not been successful. While based on HIR, it may be done the settlement of law court dispute peacefully during the law court inspection.

Abstract

Indonesia telah dikenal sebagai negara yang memiliki keragaman budaya, tercermin dari kekayaan budaya yang meliputi kebhinnekaan suku bangsa, agama, bahasa, dan juga keragaman stratifikasi kehidupan sosial masyarakatnya. Motto Bhinneka Tunggal Ika merupakan refleksi empirik dari keragaman kehidupan sosial dan budaya yang membentuk identitas bangsa Indonesia. Hukum adat adalah salah satu dari produk budaya bangsa Indonesia, khususnya kebudayaan idiil, yang membentuk identitas hukum asli masyarakat Indonesia. Dalam kaitan dengan kebijakan pembangunan hukum nasional semestinya hukum adat menjadi referensi yang patut diperhitungkan untuk memperkaya substansi hukum nasional, karena fakta kemajemukan hukum dalam masyarakat adalah keniscayaan yang tidak dapat dipungkiri dalam dalam kehidupan hukum di Indonesia. Artikel ini mencoba untuk memberi pemahaman yang lebih holistik mengenai kedudukan dan kapasitas hukum dalam kebijakan pembangunan hukum nasional dalam negara dan bangsa yang bercorak kemajemukan budaya.Indonesia has been well known as a multicultural country inSoutheast Asiaregion in term of its ethnic, religion, racial and social stratification. It is, therefore, Unity in Diversity is reflected as an official motto of the State in order to describe the empirical social and cultural diversity ofIndonesia. The diversity refers to a cultural configuration which reflect the Nation identity ofIndonesia, forming elements of cultural capital as well as cultural power that generate the life of Nation State of Indonesia. In the effort of National Law development then questioned whether the existence of adat law as living law and product of culture can be accounted as instrument for enriching substance of National Law? The article attempts to offer answer of the above fundamental question by employing legal anthropology approach with the purpose of obtaining a better understanding holistically regarding the development of National law in multicultural country toward a more just and equitable of State law ofIndonesiain particular.
