Abstract

Reklamasi merupakan bentuk campur tangan (intervensi) manusia terhadap keseimbangan lingkungan alamiah yang selalu dalam keadaan seimbang dinamis. Perubahan ini akan melahirkan perubahan ekosistem seperti perubahan pola arus, erosi dan sedimentasi pantai, berpotensi meningkatkan bahaya banjir. Kajian cermat dan komprehensif tentu bisa menghasilkan area reklamasi yang aman terhadap lingkungan di sekitarnya. Otonomi daerah sebagaimana yang tertuang dalam ketentuan undang-undang merupakan landasan yang kuat bagi Pemerintah Daerah untuk mengimplementasikan pembangunan wilayah laut mulai dari aspek perizinan, perencanaan, pemanfaatan, pengawasan dan pengendalian.Reclamation is a form of human intervention to the balance of the natural environment which are always in a dynamic state of balance. This change will resulting changes in ecosystems such as changes in current patterns, coastal erosion and sedimentation, and potentially increasing the danger of flooding. Careful and comprehensive assessment can certainly produce a reclaimed area that is safe for the surrounding environment. Regional autonomy as set forth in the legislation is a strong foundation for the local governments to implement the construction of the marine areas development from aspects of permitting, planning, utilization, monitoring and control.

Abstract

Berdasarkan Stufentheorie, pengaturan perencanaan pembangunan daerah semestinya tidak boleh bertentangan dengan pengaturan perencanaan pembangunan nasional. Namun, dengan melihat sistem perundang-undangan yang dibangun itu haruslah koresponden, maka harmonisasi (keselarasan, kecocokan, keserasian) pengaturan perencanaan pembangunan nasional dan daerah tidak harus terjadi, terlebih karena adanya pelaksanaan asas desentralisasi dalam wujud otonomi daerah. Penggunaan asas hukum lex superiori derogat legi inferiori yang diterapkan secara kaku dalam hubungan antara pengaturan perencanaan pembangunan nasional (lex superior) dan pengaturan perencanaan pembanguan daerah (lex inferior), tentu saja akan mengedepankan kepastian hukum, sehingga akan dapat menggeser kepentingan yang lebih luas. Apabila kepastian hukum diikuti secara mutlak, maka hukum hanya akan berguna bagi hukum itu sendiri, tetapi tidak untuk masyarakat.Based on Stufentheorie, regional development plan arrangements should not be contrary to the national development plan arrangements. However, regarding that system of laws must be correspondently built, then harmonization (alignment, compatibility, congeniality) regional and national developmet plan arrangements does not have to be happened, especially since the implementation of the decentralization principle in the form of regional autonomy. The use of lex superioriy derogat legi inferiori that rigidly applied in connection of the national development plan arrangements (lex superior) and the regional development plan arrangements (lex inferior), will definetely indicates that legal certainty is a virtue, means that it will be able to shift the wider interests. When the legal certainty of the law is absolutely applied, then the law will only be useful for the law itself, but not for the community.

Abstract

Secara psikologis, anak bukanlan miniatur orang dewasa, namun anak adalah suatu subyek yang masih dalam tahap perkembangan dengan kapasitas yang rawan, yang mana berkaitan dengan hubungan sebab akibat antara pemenuhan dan perlindungan akan hak hidup, hak bertahan hidup, hak tumbuh dan berkembang anak, yang mana juga termasuk hak untuk mendapatkan perlindungan dari kekerasan dan diskriminasi. Perlu ditekankan bahwa hak untuk hidup tidak bisa dilepaskan dengan hak atas kelangsungan hidup, dan hak untuk tumbuh dan berkembang. Terutama bagi anak-anak yang masih dalam masa pertumbuhan dan perkembangan, dimana setiap luka, kerusakan, atau mengurangi hak anak untuk kelangsungan hidup akan mengakibatkan suatu akibat yang serius dan fatal terhadap kondisi anak. Kecenderungan untuk membawa anak ke peradilan anak, mengakibatkan anak akan selalu menjadi target kriminalisasi. Jadi tidak boleh dibawa ke pengadilan jika tidak perlu. Hal ini tentu saja tidak hanya mempengaruhi anak secara fisik, tetapi juga psikologis. Sistem pemidanaan edukatif yang berlaku di Indonesia saat ini belum seperti yang diharapkan. Perlindungan anak yang dikualifikasikan sebagai seorang kriminal benar-benar harus mendapatkan perhatian serius dari pemerintah. Anak yang berkonflik dengan hukum dalam posisi anak sebagai seorang kriminal yang membutuhkan perlindungan dan keamanan membutuhkan perlindungan khusus yang menjamin kepentingan anak.Psychologically, child instead of  a miniature adult but child is a subject that is still in the developmental stage capacity-prone (evolving capacities), which is closely related to the causality between the fulfillment and protection of the right to life and the right to survival, the right to grow and develop the child as well as the right to be protected from violence and discrimination. It should be emphasized that the right to life can not be released to the right to survival, and the right to grow and develop. Especially for children who are still in a period of growth and development, where each wound, destruction, or reducing the child’s right to survival will resulting in serious and fatal child’s condition. The tendency to bring the child to the juvenile justice machine, then the children will always be the target of criminalization. So it should not be taken to court if it does not need. This is of course not only affects the child physically, but also psychologically. Educative criminal system prevailing in Indonesia at this time has not been as expected. Protection of children whom qualified as criminals really have to get serious attention from the government. Children in conflict with the law in the position of children as criminals in need of protection and security in addition to self-regulation also requires a special protection that ensures the interests of the child.

Abstract

Euthanasia merupakan upaya untuk mengakhiri hidup seseorang ketika mengalami sakit yang tidak dapat disembuhkan, guna mengakhiri penderitaannya. Di Indonesia, euthanasia tidak dapat dilakukan dan merupakan perbuatan yang ilegal. Baik dalam hukum positif maupun dalam kode etik kedokteran diatur bahwa melakukan euthanasia tidaklah diperbolehkan. Bila dikaji dalam perspektif Hukum Islam, diatur bahwa euthanasia aktif adalah perbuatan yang diharamkan dan diancam oleh Allah SWT dengan hukuman neraka bagi yang melakukannya.Euthanasia is an attempt to end someone life when he/she has an uncurable illness, euthanasia will be done  in order to release his/her from suffering his/her illness. In Indonesia, euthanasia can not be done and it is classified as an illegal act. Both in the positive law and the ethics code regulate that performing an euthanasia is not allowed. Regarded to the perspective of Islamic law, also regulated that an active euthanasia is an act that is forbidden and punishable by God with a punishment of hell for those who did.

Abstract

Pelaksanaan pidana penjara yang merupakan bagian dari sistem peradilan pidana perlu segera dilakukan reorientasi mengingat sebagian besar sanksi pidana yang sekarang ada baik itu dalam Kitab Undang-Undang Hukum Pidana (KUHP) maupun dalam konsep Kitab Undang-Undang Hukum Acara Pidana Baru masih menggunakan bentuk sanksi berupa pidana penjara. Tujuan dijatuhkannya pidana penjara adalah untuk melindungi masyarakat maupun untuk memperbaiki hidup pelaku. Perkembangan lebih lanjut pidana penjara dijatuhkan agar si pelakunya dirasakan sebagai pembalasan. Pelaksanaan pidana penjara dengan sistem pemasyarakatan tidak hanya ditujukan untuk mengayomi masyarakat dari bahaya kejahatan melainkan juga untuk mengayomi dan memberi bekal hidup orang-orang yang tersesat karena melakukan tindak pidana. Namun kenyataannya tidak mudah mewujudkan tujuan mulia tersebut sebab praktek di lapangan masih banyak ditemui kendala dan hambatan diantaranya masih ditemukan berbagai bentuk kekerasan dan diskriminasi di Lembaga Pemasyarakatan.Execution of imprisonement which are the part of criminal justice system needs to be reoriented considering that most criminal pinalties that now exists whether regulated inside the book of criminal law (KUHP) or inside the concept draft of the new criminal procedure law (RUU KUHAP) still using a form of sanctioned imprisonement. The imposition of imprisonment purpose is to protect the public as well as to improve the live of the offender. Further, the imposition of imprisonment purposed to give a pshycological effects of retaliation to the offender. Implementation imprisonment with correctional system, are not only intended to protect the public from the dangers of crime, but also giving enlightenment to other people so they can stay away from criminal act. But the fact is that it was not easy to achieve such lofty goal, because in practice there are so many obstacles and barriers encountered. There were still definetely various forms of violence and discriminantion in prison.

Abstract

Salah satu kegiatan dalam hal pendaftaran tanah adalah diterbitkannya sertipikat hak atas tanah sebagai tanda bukti hak oleh Kantor Pertanahan. Dengan diterbitkan sertipikat ini, nantinya akan dengan mudah dapat dibuktikan siapa pemegang haknya. Dengan diterbitkan sertipikat, akan terwujud jaminan kepastian hukum dan perlindungan hukum bagi pemegang haknya. Pada kenyataan dalam praktiknya, terjadi tindakan penyimpangan dalam penerbitan sertipikat, yang mana hal ini terjadi dalam beberapa bentuk, yaitu diterbitkannya sertipikat palsu, sertipikat asli namun ternyata palsu, sertipikat ganda, sertipikat tumpang tindih, dan juga sertipikat fiktif.One thing that is required in land registration activity is the issuance of the certificate of land rights by the land office, which is used commonly as an evidence. By the issuance of this certificate, it will ease the process of proofing the ownership of the related land. The issuance of this certificate will definetely realize the legal certainty and legal protection to the owner. In fact, there was an act of irregularities in the issuance of certificates, which occured in several forms, such as the issuance of fake certificates, original certificates but apparently false, multiple certificates, certificates of overlap, as well as fictitious certificates.

Abstract

Negara mempunyai kekuasaan untuk mengelola sumber daya alam demi mewujudkan keadilan sosial, kesejahteraan umum dan untuk kemakmuran rakyat. Instrumen hukum kontrak menjadi payung hukum sebagai upaya perlindungan hukum terhadap aset negara yang berupa minyak dan gas bumi. Kontrak Bagi Hasil menjadi pilar dasar dalam upaya pengelolaan dan pemanfaatan kegiatan usaha minyak dan gas bumi. Kontrak Bagi Hasil merupakan kontrak publik yang tidak sepenuhnya tunduk pada hukum privat. Dalam melakukan hubungan kontraktualnya, negara tidak boleh dirugikan (imunitas negara) dan harus memperhatikan klausula-klausula yang menitikberatkan pada perlindungan aset negara.State has the power to manage natural resources for the sake of social justice, the general welfare and are used as much as possible the greatest benefit for the greatest welfare of people. Contract law is the main instrument used to protect the state assets including oil and gas. Production Sharing Contract as a legal safeguard for oil and gas, is a fundamental pillar in the effort and utilization management activities of oil and gas. In this Production Sharing Contract, which the contracts also involve the government and called government contract, has a unique characteristic which is not entirely subject to private law. In principle, the state should not be harmed, called as state immunity. This principle also applies universally in the interest of protecting the state assets.
