Undang-Undang Resi Gudang telah menciptakan lembaga jaminan baru, yaitu Hak Jaminan atas Resi Gudang. Hak Jaminan atas Resi Gudang belum menampakkan karakter dari lembaga jaminan kebendaan yang utuh sebagaimana lembaga jaminan kebendaan, karena tidak adanya asas droit de suite dan penentuan lahirnya hak kebendaan, sehingga ditafsirkan bahwa lahirnya hak kebendaan, yaitu pada saat kreditor memberitahukan kepada Pusat Registrasi dan pengelola gudang. Lahirnya hak kebendaan pada jaminan kebendaan merupakan hal yang sangat penting karena untuk menjamin kepastian hukum atas kedudukan kreditor sebagai kreditor preferen.The Warehouse Receipt Act has created a new guarantee institution, namely The Rights Guarantee of Receipt Warehouse. The Rights Guarantee of Receipt Warehouse has not yet revealed the character of property security institution fully as property security institution, because the absence of droit de suite principle and the determination of the property right, so that it is interpreted that the outward of the property right, is when the creditor notified The Registration Center and warehouse manager. The outward of property right in the property guarantee is a very important thing to ensure legal certainty over the position of creditor as prefered creditor.

ASEAN didirikan berdasarkan Deklarasi Bangkok pada tanggal 8 Agustus 1967, dengan beranggotakan sepuluh negara di kawasan Asia Tenggara yang masih tetap berpegang teguh pada prinsip non intervensi yang telah diatur dalam Treaty of Amity and Cooperation in Southeast Asia 1976 (TAC) dan Piagam ASEAN. ASEAN berkembang menjadi suatu organisasi internasional besar dan mulai diperhitungkan dalam dunia internasional, prinsip non intervensi masih menjadi suatu permasalahan yang masih melingkar dalam tubuh ASEAN dan sudah seharusnya para pemimpin ASEAN untuk memikirkan suatu fleksibelitas dari suatu prinsip ini, hal ini bertujuan untuk membantu suatu negara anggota yang tengah dihadapi permasalahan khususnya tentang kemanusiaan.ASEAN was established by the Bangkok Declaration on August 8, 1967, with the region of ten countries in Southeast Asia that still remains on the principle of non-intervention which has been arranged in the Treaty of Amity and Cooperation in Southeast Asia in 1976 (TAC) and the ASEAN Charter. ASEAN grown into a large international organization and gained recognition in the international world, the principle of non-intervention is still a problem that still coiled in the body of ASEAN and the ASEAN leaders ought to think about the flexibility of this principle, it aims to help a country members who were in face particular problems of humanity.

Penyelesaian sengketa perpajakan di Pengadilan Pajak pada umumnya berawal dari adanya penerbitan suatu keputusan yang dilakukan oleh pihak Direktorat Jenderal Pajak. Upaya penyelesaian sengketa ini dibedakan menjadi dua upaya yaitu banding yang dilakukan atas Surat Keputusan Keberatan dan gugatan yang diajukan atas keputusan lain selain keputusan keberatan dan keputusan terkait dengan upaya penagihan pajak. Hak dan kewajiban Wajib Pajak dalam upaya banding dan gugatan ini dalam beberapa hal menjadi tidak terlindungi. Adanya pembatasan kompetensi absolut mengakibatkan permohonan Wajib Pajak yang tidak dapat dipertimbangkan atau tidak dapat diproses lebih lanjut. Hukum acara yang berbeda (dibandingkan dengan Hukum Acara Peradilan Tata Usaha Negara) menimbulkan kerancuan dan ketidakpastian dan terkesan bahwa upaya penyelesaian sengketa di Pengadilan Pajak sangat ekslusif dari Peradilan Tata Usaha Negara. Selain itu, upaya hukum lebih lanjut berupa kasasi juga tertutup karena atas putusan Pengadilan Pajak tidak dapat diajukan banding ataupun kasasi sehingga upaya lebih lanjut atas Putusan Pengadilan Pajak hanyalah Peninjauan Kembali di Mahkamah Agung.The tax dispute resolution at the Tax Court generally begins with the issuance of Directorate General of Taxes Decision. Dispute resolution efforts comprise of two different arenas: appeal agains the Objection decision and lawsuit against Decisions related to the tax collection and Decisions other than objection decision. To some extend, it is clear that the rights and obligations of the Taxpayer are not protected. The limitation on the absolute competence may result in the Decision of Tax Court which stated that the application cannot be considered or processed further. Different Laws on the procedures (compared to the Procedures in Administrative Court) may result in the legal uncertainty and give an impression that the dispute resolution effort at the Tax Court is separate and exclusive from the Administrative Court. Furthermore, further legal effort, i.e appeal to the Supreme Court is also impossible because the only legal effort available after the tax Court Decision is only Reconsideration at the Supreme Court.

Prinsip kebebasan berkontrak membawa para pihak dalam suatu kontrak untuk menandatangani suatu persetujuan, termasuk diantaranya adalah kontrak baku. Kontrak baku dibuat oleh satu pihak, biasanya oleh suatu perusahaan dengan tujuan adanya efisiensi. Kontrak tersebut bagaimanapun berpotensi adanya penyalahgunaan kedudukan yang lebih mendominasi dalam penerapannya, kontrak seperti ini dikenal dengan nama kontrak adhesi. Dalam kaitannya dengan kontrak adhesi terdapat batasan dan/atau pengalihan tanggung jawab dari resiko bisnis kepada mitra berkontraknya (adhered party). Maka dari itu prinsip itikad baik tentu memainkan peranan yang cukup penting untuk mengevaluasi implementasi dari kontrak adhesi. Penulisan ini membahas kontrak adhesi dalam kaitannya dengan prinsip dasar hukum kontrak dan juga menganalisa payung hukum untuk mitra berkontraknya (adhered party) dalam pencarian hak-hak kontraktualnya terkait implementasi dari kontrak adhesi. Dalam tulisan ini juga akan dibandingkan implementasi dari kontrak adhesi dalam prakteknya baik di Indonesia dan di luar Indonesia dengan cara menganalisa hukum nasional dan aturan yang berlaku secara internasional seperti Prinsip-prinsip Kontrak Perdagangan Internasional (The Principles of International Comercil Contracts-PICC).Freedom of contract principle brings the contracting parties to sign into an agreement in such forms, including a standard contract. The standard contracts are made by one party, usually by business entities in the aim of doing efficiency. The contracts, however, potentially contains abuse of power in its application, known as adhesion contract. In term of adhesion contract, it contains prompt restrictions and/or transfer of responsibilities of the business risks to the adhered party. Therefore, good faith principle plays an important role to evaluate the implementation of the adhesion contract. This article discusses the adhesion contract in the light of the basic principles in contract law and explores the legal frameworks for adhered party to seek their contractual rights in conjunction with the implementation of the adhesion contract. We also compare the implementation of the adhesion contract, practically, both in Indonesia and international practices by examining the national laws and the model law e.g. Principles of International Commercial Contracts (PICC).

Perkawinan sebagai konsep tentang persatuan antara laki-laki dan perempuan, sehingga menciptakan harta yang berhubungan dengan perkawinan tersebut. Dalam perkawinan terdapat dua harta yaitu harta bawaan dan harta bersama. Harta bersama merupakan harta benda yang didapat selama perkawinan berlangsung. Ada tiga konsep yang mengulas mengenai harta bersama dari perspektif Hukum Islam, Kitab Undang-Undang Hukum Perdata, dan Hukum Adat. Ketika terjadi perceraian Kompilasi Hukum Islam dan Kitab Undang-Undang Hukum Perdata mengatur bahwa harta bersama akan dibagi dua setengah untuk suami dan setengah untuk istri, sedangkan menurut Hukum Adat pembagian harta bersama diatur secara berbeda dari satu wilayah dengan wilayah lainnya.Marriage which known as the concept of unity between a man and a woman, and therefore creates a property that associated with the marriage. Along the marriage, there are known two types of property, private property and property in marriage. Property in marriage is property that is generated during the marriage. There are three concepts to review property in marriage rules, based on Islamic law, civil law, and customary law. When a marriage ended with divorce, the property in marriage shall be devided. Based on Indonesian Islamic Law and Indonesia civil law, the property in marriage shall be devided half and half for the husband and wife, but according to the community law, the property in marriage shall be devided differently from Indonesian Islamic Law and Indonesian Civil Law, the distribution of the property in marriage according to community law is set differently from one region to another region.

Mahkamah Konstitusi merupakan institusi peradilan yang dipercaya oleh konstitusi (UUD 1945) untuk mengimplementasikan sistem peradilan impeachment. Peradilan impeachment dimulai dengan permintaan fatwa oleh Dewan Perwakilan Rakyat kepada Mahkamah Konstitusi. Kedudukan Dewan Perwakilan Rakyat dalam persidangan Mahkamah Konstitusi atau dalam sistem peradilan impeachment adalah sebagai pihak pemohon. Permohonan diajukan ke Mahkamah Konstitusi setelah Dewan Perwakilan Rakyat berpendapat bahwa Presiden dan/atau Wakil Presiden telah melakukan pelanggaran yang disebutkan dalam Pasal 7A UUD 1945. Sedangkan putusan yang diberikan oleh Mahkamah Konstitusi menjadi bukti, bahwa Indonesia benar-benar sebagai negara yang berbentuk negara hukum. Kewenangan Mahkamah Konstitusi dalam sistem peradilan impeachment baru bisa dijalankan, bilamana Dewan Perwakilan Rakyat mengajukan permohonan padanya. Kalau Dewan Perwakilan Rakyat tidak mengajukannya, maka sistem peradilan impeachment tidak akan terwujud.The Constitutional Court is a judicial institution that is trusted by the constitution (UUD 1945) to implement the impeachment court sistem. Justice impeachment begins with a request fatwa by the House of Representatives to the Constitutional Court. Position of the House of Representatives at the hearing of the Constitutional Court or the judicial sistem of impeachment is the applicant. Application is submitted to the Constitutional Court after the House of Representatives argued that the President and/or Vice-President has committed an offense referred to in Article 7A of the 1945 Constitution. While the verdict given by the Constitutional Court is proof that Indonesia is really a form of state law countries. Authority of the Constitutional Court in the impeachment court sistem can only be executed, if the House of Representatives to apply to him. If Parliament does not propose, then the justice sistem impeachment will not be realized.

KEDUDUKAN ANAK LUAR KAWIN DALAM PEWARISAN DITINJAU DARI SISTEM HUKUM KEKERABATAN ADAT Ellyne Dwi Poespasari

Kedudukan anak luar kawin dapat didasarkan pada ketiga sistem kekerabatan yang ada, yaitu pada sistem kekerabatan patrilineal, kekerabatan matrilineal dan sistem kekerabatan parental. Kedudukan anak luar kawin dalam hukum adat bukan sebagai ahli waris dan bukan sebagai penerus keturunan dari bapaknya secara biologis. Anak luar kawin hanya mempunyai hubungan dengan ibunya dan kerabat ibunya. Namun terkait dengan Yurisprudensi Mahkamah Agung dan Putusan MK Nomor 46/PUU-VIII/2010, maka telah membuka peluang bagi anak luar kawin untuk mendapatkan harta warisan dan perlindungan hukum dengan orang yang diduga sebagai bapaknya biologis dari anak luar kawin tersebut.The position of children born out of wedlock can be based on the three kinship systems which are patrilineal kinship system (based on kinship with the father or the male line), matrilineal kinship system and parental kinship system. The position of children born out of wedlock in customary law is not as the beneficiary of their parents or is not the descendant of their fathers, biologically. Children born out of wedlock are only has relationship with the mothers or mothers’ relatives. Therefore, by the Jurisprudence of Supreme Court and Constitutional Court Number 46/PUU-VIII/2010, there will be chances for children born out of wedlock to get law protection and inherit from a person who is assumed as the father of the children.
