Merariq sebagai tradisi perkawinan adat di masyarakat suku Sasak ternyata menyimpan potensi konflik yang tidak jarang berakhir dengan sengketa, karena diawali dengan peristiwa memaling atau mencuri atas dasar persetujuan si gadis dari kekuasaan orangtuanya, sebagai wujud sikap ksatria sekaligus bentuk keseriusan si laki-laki untuk menikahi si gadis. Namun di tengah kelemahannya ternyata sistem merariq telah menyediakan sarana alternatif penyelesaian berupa pelaksanaan negosiasi antara perwakilan pihak calon mempelai laki-laki dengan keluarga calon mempelai perempuan yang diistilahkan dengan selabar untuk menyepakati pembayaran ajikrame dan pisuke guna menuju perdamaian para pihak.Merariq is a customary law of marriage in Sasak society, this Merariq turned out to potentially create conflict that is commonly ended up with a dispute. The reason is because it begins with the events of rob (steal) on the consent of the girl approval from the power of her parents. The rob (steal) be done as a form of chivalry of the man’s seriousness marrying the girl. But amid that weakness, Merariq has provided an alternative dispute settlement by the process of negotiation between the representatives of the prospective groom to the bride family, which are termed selabar to agree on payment ajikrame and pisuke towards peaceful relationship between the parties.

Perolehan tanah untuk kepentingan umum dapat ditempuh melalui pengadaan tanah. Pengadaan tanah untuk kepentingan umum memerlukan persetujuan dari pihak yang berhak. Oleh karena pihak yang berhak tidak bersedia melepaskan hak atas tanah, maka timbul sengketa antara instansi yang memerlukan tanah dan pihak yang berhak. Sifat sengketa dalam pengadaan tanah adalah sengketa tata usaa negara dan sengketa keperdataan. Penyelesaian sengketa dalam pengadaan tanah untuk kepentingan ditempuh melalui musyawarah antara instansi yang memerlukan tanah dan pihak yang berhak, gugatan, atau keberatan kepada pengadilan.Acquisition of land for public purpose can be reached through land acquisition. Land acquisition for public interest require the approval of the party entiled. There fore, the party entiled to not be willing to give up their land rights, the dispute arises between agencies that require land and beneficiaries. The nature of the dispute in the procurement of land for public purposes is dispute administrative and civil disputes. Settlement of disputes in land acquisition for public purposes pursued through consultation between the agencies that require land and the party entiled to, claim, or objection to the court.

Persetubuhan atau perzinahan baik menurut hukum pidana dan hukum adat Tolaki memiliki pandangan yang sama di mana persetubuhan atau perzinahan merupakan perbuatan melawan hukum dan patut untuk diberikan sanksi pidana atas perbuatan pidana tersebut. Namun demikian, hukum adat Tolaki dalam konsep klasifikasi persetubuhan lebih mengatur secara komprehensif tentang perzinahan, di mana perbuatan zina tidak hanya terbatas pada mereka yang telah terikat dengan perkawinan sebagaimana dimaksud dalam Pasal 27 BW tetapi mengikat pula bagi mereka yang belum terikat perkawinan dengan penerapan sanksi adat Tolaki yang berbeda-beda berdasarkan klasifikasi jenis perzinahannya atau umoapi.Promiscuity or adultery either according to the criminal law and the Tolaki customary law, have the same view where promiscuity or adultery is against the law and so it is worth to be given criminal sanctions upon the criminal act. Nevertheless, Tolaki customary law regulated about promiscuity comprehensively about adultery, where the Act of adultery is not just limited to those who had been marriage as stipulated in article 27 BW but also bind those who are not marriage yet, with the application of Tolaki different customs sanctions based on classification type of the fornication or umoapi.

Pendaftaran tanah diselenggarakan dalam rangka memberi jaminan kepastian hukum. Dalam hal melakukan hukum untuk mengalihkan suatu hak atas tanah haruslah dilakukan di hadapan seorang Notaris atau Pejabat Pembuat Akta Tanah yang bertujuan untuk memperoleh kekuatan pembuktian yang sah dan dibuatkan dengan akta otentik. Khusus untuk tanah-tanah yang bersertipikat dalam proses pengalihan hak ini harus dilakukan di hadapan Pejabat Pembuat Akta Tanah, dalam pelaksanaan peralihan hak atas tanah dengan Perjanjian Hibah/Perikatan Hibah. Dalam pembuatan Perjanjian hibah sering dicantumkan kuasa mutlak yang merupakan perjanjian pendahuluan yang lazim ditemukan dalam praktek Notaris. Kuasa mutlak terdapat pada perjanjan hibah ini sebagai tindak lanjut dari perjanjian pendahuluan dalam peralihan hak atas tanah masih dapat diberlakukan untuk menjaga kepentingan para pihak dapat terpenuhi hingga proses peralihan hak atas tanah tersebut selesai.Registration of land held in order to ensure legal certainty. Pembentukan peraturan perundang-undangan merupakan syarat dalam rangka pembangunan hukum nasional yang hanya dapat terwujud apabila didukung oleh metode yang baik, yang mengikat semua lembaga yang berwenang membuat peraturan perundang-undangan. Indonesia merupakan negara hukum yang mempunyai kewajiban melaksanakan pembangunan hukum nasional yang baik, yang dilakukan secara terencana, terpadu dan berkelanjutan dalam sistem hukum nasional. Konsep pembentukan peraturan perundang-undangan di Indonesia meliputi beberapa konsep yaitu konsep pembentukan peraturan perundang-undangan harus sesuai dengan konsep negara hukum Pancasila. Selain itu, konsep pembentukan peraturan perundang-undangan yang baik harus mengedepankan perlindungan Hak Asasi Manusia. Konsep pembentukan peraturan perundang-undangan yang baik harus mengedepankan asas equality before the law. Konsep pembentukan peraturan perundang-undangan yang baik harus sesuai dengan asas-asas pembentukan peraturan perundang-undangan yang telah ditetapkan sebelumnya oleh undang-undang. Untuk selanjutnya, konsep pembentukan perundang-undangan dibentuk oleh pemegang kekuasaan yang sah, yang dipilih oleh rakyat secara demokrasi.Formation of the legislation is a requirement in the development of national law which can only be achieved if supported by a good method, which is binding on all institutions authorized to make Regulations. Indonesia is a country that has a legal obligation to carry out the development of a good national law, which is done in a planned, sustainable, and integrated into the national legal system. The concept of the establishment of laws and regulations in Indonesia includes several concepts, namely the concept of the establishment of legislation must be in accordance with State law concept of Pancasila. Kecemasan terhadap cyber crime telah menjadi perhatian dunia, namun tidak semua negara di dunia ini memberikan perhatian yang lebih besar terhadap masalah cyber crime dan memiliki peraturannya kecuali negara-negara maju dan beberapa negara berkembang. Tujuan penelitian ini adalah dalam rangka menemukan, mengkaji dan menganalisa upaya pemerintah Indonesia dalam perlindungan terhadap data informasi rahasia negara dan meneliti tentang bentuk-bentuk perlawanan pemerintahan Indonesia terhadap cyber war. Menemukan rekonstruksi pembentukan national cyber defense atau cyber army dalam upaya mempertahankan kedaulatan negara. Dalam UU No. 3 Tahun 2002 tentang Pertahanan Negara, telah ditetapkan bahwa ancaman dalam sistem pertahanan negara terdiri dari ancaman militer dan ancaman non militer, termasuk diantaranya ancaman siber. Salah satu efek samping negatif dari perkembangan dunia siber melalui internet antara lain adalah kejahatan dalam bentuk pelanggaran hukum atau cyber crime, di mana bila eskalasinya lebih meluas dapat mengancam kedaulatan negara, keutuhan wilayah maupun keselamatan bangsa. Sebagai upaya penanggulangan terhadap serangan-serangan di dunia maya ini, diperlukanlah sebuah lembaga yang bertugas menjadi benteng pertahanan dunia siber atau cyber defense.Anxiety against cybercrime has become the world’s attention, but not all countries in the world is giving greater attention to the problem of cybercrime by having the rule and unless the developed countries and some developing countries. The purpose of this research is in order to find, examine and analyze the efforts of the Indonesia Government in the protection of State secrets information and data, also to research the forms of Indonesia Government resistance against cyber war. Find a reconstruction of national cyber defense formation or cyber army in an attempt to defend the sovereignty of the country. In Act No. 3 of 2002 on State Defense, it has been established that the threat in the country’s defense system consists of a military threat and non-military threat, which is including cyber threats. One of the negative effects of the cyber world development via the internet among other things is a crime in violation of the law cybercrime, where when the escalation widely spread, it could have threatened the country’s sovereignty, territorial integrity or the safety of the nation. In an effort to combat against the attacks in this virtual world, will require an agency that is in charge of being the world’s bulwark cyber or cyber defense.
