Abstract

Perkembangan Hukum Jaminan, juga membawa perkembangan atas lembaga jaminannya, antara lain lembaga jaminan yang merupakan bentuk perkembangan Hukum Jaminan adalah Fidusia. Fidusia sebagai lembaga jaminan yang cukup diminati, pengaturannya juga dikembangkan demi kemudahan dalam keseluruhan prosesnya, antara lain yaitu dengan diadakannya pendaftaran online untuk lembaga jaminan Fidusia. Pendaftaran online yang tentunya memiliki mekanisme yang berbeda dengan pendaftaran biasa, sudah barang tentu memiliki karakter perlindungan yang berbeda untuk kreditornya. Tentunya saat beranjak dari konsep pendaftaran online, kedudukan kreditor bukannya cenderung membaik, namun berpotensi menjadi rawan. Tujuan dari penelitian ini adalah menemukan cara agar kedudukan baik itu kreditor dan debitor dalam pendaftaran online Fidusia itu tidak menjadi rawan dan sama-sama terlindungi oleh hukum yang baik. tidak Penelitian ini merupakan penelitian normatif. Hasil dari penelitian ini adalah adanya rekomendasi bagi pemerintah, untuk membuat suatu aturan lanjutan terkait pendaftaran jaminan Fidusia yang dilakukan secara online, khususnya mengenai pemenuhan asas spesialitas pada Sertifikat Fidusia.The development of the Security Law, also brought the development of its security law institution, among others institution which is the form of the development of the Security Law is Fiduciary. Fiduciary as a security institution is quite attractive, the arrangement is also developed for ease in the whole process, such as online registration. Online registration that certainly has a different mechanism with regular registration, it certainly has a different protection character for its creditors. Surely when starting from the concept of online registration, the position of creditors rather than tend to improve, but potentially become prone. The purpose of this study is to find a way for both creditors and debtors who register the Fiduciary online, not to be vulnerable and equally protected by law. This research is a normative study. The result of this research is a recommendation for the government, to make a follow-up regulation related to registration of Fiduciary done online, especially regarding the fulfillment of speciality principle on Fiduciary Certificate.

Abstract

Penelitian yang berjudul “Kedudukan Tanah Wakaf Yang Dikuasai Ahli Waris” ini bertujuan untuk lebih dalam mengetahui dan memahami serta menganalisis bagaimana kedudukan tanah wakaf yang telah bersertipikat namun masih dalam penguasaan ahli warisnya. Metode penelitian yang digunakan adalah penelitian secara Normatif. Penelitian secara Normatif yaitu penelitian dengan menggunakan pendekatan perundang-undangan dan menarik asas-asas hukum yang berkaitan dengan tanah wakaf, sertipikat wakaf dan ahli waris dari wakif. Berdasarkan hasil penelitian ini dapat disimpulkan bahwa, Pertama, Tanah milik yang telah diwakafkan oleh wakif kepada nazhir harus dilakukan secara tertulis yang mana tertuang dalam Akta Ikrar Wakaf (AIW) yang dibuat oleh PPAIW, yang kemudian harus didaftarkan kepada BPN untuk mendapatkan sertipikat tanah wakaf sebagai tanda bukti wakaf. Kedua, Dengan adanya sertipikat tanah wakaf tersebut, maka kedudukan nazhir terlindungi dan telah memiliki kekuatan hukum sehingga tidak dapat digugat oleh ahli waris. Terlebih lagi dalam Pasal 3 UU No. 41 Tahun 2004 telah ditegaskan bahwa wakaf tidak dapat dibatalkan, sehingga ahli warisnya pun tidak dapat menggugat tanah tersebut.The research entitled The Position of a Waqf Owned by Heirs aims to more deeply know and understand and analyze how the position of the waqf land has been certified but is still under the control of the heirs. The research method used is Normative research. Normative research is research using a statutory approach and attracting legal principles relating to waqf land, waqf certificates and heirs from wakif. Based on the results of this study, it can be concluded that, First, Owned land that has been represented by wakif to nazhir must be done in writing which is contained in the Pledge Act of Endowments (AIW) made by PPAIW, which must then be registered with the BPN to obtain the waqf land certificate as proof of waqf. Second: With the existence of the waqf land certificate, then nazhir’s position is protected and has legal powers so that it cannot be sued by heirs. Moreover, in Article 3 of Law No. 41 of 2004 it has been stated that the waqf cannot be canceled, so that the heirs cannot sue the land.

Abstract

Resi gudang merupakan tanda bukti kepemilikan atas barang yang disimpan di gudang dan diterbitkan oleh Pengelola Gudang. Selain menerbitkan Resi Gudang, Pengelola Gudang memiliki kewajiban sebagaimana tercantum pada Perjanjian Pengelolaan Barang untuk menjaga barang yang dititipkan serta menyerahkan sesuai dengan keterangan yang tertera pada Resi Gudang. Adakalanya Pengelola Gudang melakukan wanpretasi yaitu tidak mampu memenuhi kewajibannya. Sekarang ini muncul Lembaga Pelaksana Penjaminan Sistem Resi Gudang yang selanjutnya disebut Lembaga Pelaksana. Lembaga Pelaksana adalah lembaga yang melaksanakan fungsi, tugas, kewajiban dan wewenang sebagai Lembaga Jaminan. Lembaga Pelaksana akan melindungi Hak Pemegang Resi Gudang dan/atau Penerima Hak Jaminan apabila terjadi kegagalan, ketidakmampuan, dan/atau kebangkrutan Pengelola Gudang dalam memenuhi kewajibannya. Lembaga Pelaksana juga berfungsi memelihara stabilitas dan integritas Sistem Resi Gudang sesuai dengan kewenangannya.Warehouse receipt is the evidence of goods ownership that is stored in a warehouse and issued by the warehouse superintendent. Besides issuing a warehouse receipt, the warehouse superintendent has obligation stated in the letter of goods management to maintain entrusted goods and to give them back based printed on warehouse receipt. There are time when warehouse superintendent is cannot fulfill their obligation. Now there are implementing institution quarantee collateral system of warehouse receipt called the implementing institution. The implementing institutition is institution which doing function, assigment, duty, and authority as a institution of quarantee. The implementing institutition will protect right of stakeholders and/or the guarantee receiver if there is a failure, incapacity and/or bankrupt by of the warehouse superintendent in carrying out their obligation. The implementing institutition also has function to mantain stability and integrity of warehouse receipt according their authority.

Abstract

Perkembangan teknologi informasi telah membawa banyak perubahan tidak hanya berdampak pada perubahan gaya hidup, tetapi juga kemajuan finansial teknologi. Hal ini tidak hanya membawa pengaruh pada laju pertumbuhan jumlah investasi, tetapi juga membawa manfaat bagi perkembangan solusi pembiayaan berbasis teknologi. Salah satu metode pembiayaan yang lahir di era teknologi informasi adalah crowdfunding, yaitu suatu metode gotong royong yang bertujuan untuk menggalang dana. Keunggulan crowdfunding adalah transparansi, efisiensi dan efektifitas. Oleh karena keunggulannya tersebut, crowdfunding semakin diminati oleh banyak orang, sehingga tak heran apabila crowdfunding pun mengalami diversifikasi dan jenisnya semakin banyak. Salah satu jenis crowdfunding yang baru-baru ini disahkan oleh Otoritas Jasa Keuangan (OJK) adalah layanan urun dana melalui penawaran saham berbasis teknologi informasi (equity crowdfunding). Dalam banyak hal equity crowdfunding banyak kemiripan dengan Initial Public Offering (IPO), namun juga ada perbedaannya. Untuk itu, perlu diadakan penelitian tentang equity crowdfunding sebagai alternatif pembiayaan yang dapat menggungguli penawaran umum perdana atas saham perusahaan (IPO).The development of information technology has brought many changes not only impacting lifestyle changes, but also advances in financial technology. This not only has an effect on the rate of growth in the amount of investment, but also brings benefits to the development of technology-based financing solutions. One method of financing born in the information technology era is crowdfunding, a method of mutual cooperation that aims to raise funds. The advantages of crowdfunding are transparency, efficiency and effectiveness. Because of its superiority, crowdfunding as a method to rally fund is increasingly in demand, so it is not surprising if crowdfunding as a method also experiences more diversification and type. One type of crowdfunding that was recently ratified by the Financial Services Authority (OJK) is a fund service through information technology-based stock offerings (equity crowdfunding). In many cases equity crowdfunding has many similarities to Initial Public Offering (IPO), but there are also differences. For this reason, it is necessary to conduct research on crowdfunding equity as an alternative financing that can outperform the initial public offering of the company’s shares (IPO).

Abstract

The existence of the principle as well as the norm that the judge/court must not reject the case (ius curia novit), it turned out to be an interesting discussion in the discourse regarding land procurement/acquisition disputes for public interests, which have been known together that the arrangements regarding the procedure for settlement, land procurement/acquisition disputes for public interests is regulated separately outside the BW and HIR/RIB, namely by law of RI No.2 of 2012. So in a land procurement/acquisition dispute for public interests, in the name of the principle and norm of ius curia novit, is it still possible to file a lawsuit in violation of law through mechanisms and procedures as regulated by BW (material civil) and HIR/RIB (formal civil), and therefore there is no need to submit to the provisions of the Law of RI (UU RI) No. 2 of 2012 or in other wise it means crashing into the norm preference principle namely lex specialis derogat legi generali? Though both of these principles are the same position and degree. To answer that question, each description will be discussed about the concept of the two principles from the viewpoint of legal theory, then later it will be described which concept is more relevant to the benefit and law enforcement based on rational legal arguments, so as to create legal certainty, justice, and legal usefulness in resolving land acquisition disputes in the public interests in Indonesia.

Abstract

Pada zaman yang modern ini selalu dikaitkan dengan perkembangan teknologinya. Segala aspek kegiatan saat ini dipermudah dengan adanya teknologi, tidak terkecuali dalam sektor keuangan. Muncul sebuah inovasi baru demi menunjang perekonomian pribadi ataupun perusahaan. Inovasi tersebut dikenal dengan layanan pinjam meminjam uang berbasis teknologi informasi. Layanan tersebut termasuk dalam layanan finansial teknologi. Layanan pinjam meminjam uang berbasis teknologi ini belum ada peraturan-peraturan secara spesifik yang mengatur layanan ini, meskipun layanan pinjam meminjam uang berbasis teknologi sedang ramai di kalangan masyarakat. Hal tersebut dapat menimbulkan kerugian pada semua pihak karena tidak ada perlindungan hukum yang melekat pada mereka. Layanan pinjam meminjam uang berbasis teknologi informasi meskipun sangat memudahkan masyarakat saat ini, tetapi layanan ini justru sangat berisiko yang disebabkan antara pemberi pinjaman dan penerima pinjaman tidak bertatap muka secara langsung pada saat melaksanakan perjanjian atau transaksi. Oleh karena itu, regulasi dari finansial teknologi ini dinilai sangat mendesak, harus segera dibuat peraturan-peraturan yang mengatur pada layanan pinjam meminjam uang berbasis teknologi informasi ini.In modern times it is always associated with the development of technology. All aspects of current activities are facilitated by technology, not least in the financial sector. Appears a new innovation in order to support the private or corporate economy. Inovaasi is known as borrowing services to borrow money based on information technology. These services are included in technological financial services. This technology-based money-borrowing service does not yet have specific rules governing this service, although technology-based borrowing and borrowing services is busy among the public. It can cause harm to all parties because there is no legal protection attached to them. Borrowing services borrow money based on information technology even though it is very easy for people today, but this service is very risky that caused between the lender and the borrower not face to face directly when executing the agreement or transaction. Therefore, the regulation of financial technology is considered very urgent, should be made regulations that regulate the borrowing services to borrow money based on this information technology.

Abstract

Pre-Project Selling merupakan suatu perikatan yang dilakukan oleh para pihak terhadap jual beli properti sebelum proyek dibangun dan yang dijual baru berupa gambar atau konsep. Alasan pengembang melakukan praktik Pre-Project Selling ini dalah untuk mengetahui respon pasar atas produk properti yang akan dibangun. Sesuai dengan syarat sahnya perjanjian dalam pasal 1320 Burgerlijk Wetboek dinyatakan bahwa salah satu syarat yang harus dipenuhi adalah adanya objek perjanjian yang jelas. Praktik Pre-Project Selling merupakan perjanjian khusus. Hal ini disebabkan karena objek perjanjian merupakan gambar atau konsep dari pengembang. Maraknya Pre-Project Selling ini tentu menghadirkan beberapa problematika. Salah satunya adalah mengenai perlindungan konsumen dari gambar atau konsep yang diajukan oleh Pengembang. Dalam penelitian ini akan membahas Pengendalian Pre-Project Selling Melalui Prinsip Perlindungan Konsumen Berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Jenis penelitian yang digunakan adalah penelitian normatif, yaitu penelitian yang berdasarkan pada kajian yang sesuai dengan teori dan aturan hukum yang telah ditetapkan. Penelitian normatif ini juga berfungsi untuk memberikan argumentasi secara yuridis terhadap terjadinya kekosongan, kekaburan, dan konflik norma. Dengan demikian penelitian ini dirasa sangat penting sebagai bahan masukan kebijakan agar memeberikan nilai keadilan bagi masyarakat.Pre-Project Selling is an agreement made by the parties to the sale and purchase of properti before the project is built and the new one is sold in the form of pictures or concepts. The reason developers develop this Pre-Project Selling practice is to find out the market’s response to the properti product that will be built (test the water). In accordance with the legal conditions of the agreement in article 1320 Burgerlijk Wetboek stated that one of the conditions that must be met is the existence of a clear object of the agreement. The Pre-Project Selling practice is a special agreement. This is because the object of the agreement is an image or concept from the developer. The rise of the Pre-Project Selling certainly presents some problems. One of them is about protecting consumers from images or concepts proposed by Developers. In this study will discuss the Urgency of Consumer Protection against Pre-Project Selling practices that refer to the legal principles in the Consumer Protection Act. This type of research is normative research, which is research based on studies that are in accordance with the theories and legal rules that have been determined. This normative research also functions to provide a juridical argument against the occurrence of emptiness, obscurity, and norm conflicts. Thus this research is considered very important as a policy input material in order to provide the value of justice for the community.
