Abstract

Policy value of basic law of investigation on the handling of an offense by the police investigators is still less than the maximum because public distrust and dissatisfaction factors on the performance of the Police. The purpose of this research isto describe rate policy the basic law, the factors that influence and examine how the investigation should be done on the handling of criminal assault by police investigators in the present and future. The method used in this research is the approach normatife juridical and empirical approaches. Type of research is descriptive. Primary data and secondary data is data used in this study. Methods of data collection in this study using observation, interview and literature study. Analysis of data using qualitative descriptive method. The study states that 1) in order to hold the inquiry and investigation, the Investigation Police Investigation Unit and has implemented procedures in accordance with the prescribed rules legislation; 2) The most dominant factor affect the investigation that is a factor of society 3) The efforts made in overcoming the barriers that exist, such as by holding socialization and explain the importance of the role of investigator in handling criminal offense.Keywords: Basic Law; Investigation; Investigator.

Abstract

The problems of this study are: view of the living norms of public life related to the legalization of abortion under PP No. 61 of 2014 on Reproductive Health in the jurisdiction of Ex Residency of Cirebon, Legal protection of children conceived for Pregnancy Preferred (KTD), form the legal protection of children conceived for Pregnancy Preferred (KTD), particularly rape victims in the future.The method used by researchers is sociological approach juridical law and specification in this study was included descriptive analysis. As for sources and types of data in this study are primary data obtained from interviews with field studies Cirebon MUI, and secondary data obtained from the study of literature. Data were analyzed qualitatively. The problems studied by the theory of effectiveness and progressive law.Based on the results of research that potentially incompatible with Islamic law if it does not pay attention to the provisions of law or the Fatwa of Indonesian Ulama Council, besides that government regulation is taking the authority of the judiciary by the executive branch, because the authority to determine a person can have an abortion only submitted to the doctor and known by the Health Department / districts forwarded to the Provincial Health Office, without having to get a judgment and / or determined by the court, including the MUI Fatwa can ignore. Abortion performed by a rape victim is allowed and does not constitute a crime, but as a special lex and Health Act Government Regulation No. 61 Of 2014 on Reproductive Health has taken over the authority of the judiciary, because abortion is performed by a rape victim does not need to get a determination from the court. Reflected Bill-September 2019-the Penal Code refers to the Law of Health and Government Regulation No. 61 of 2014 on Reproductive Health, so that the provision is contrary to the Constitution of the Republic of Indonesia 1945.Keywords: Provocate Abortion; Child; Rape; Legal Protection.

Abstract

This study aims to explain the factors that cause of cases of violence against children and legal protection of children's data analysis begins with collecting data, reducing the data, presenting data, and the final conclusion. The results showed that the factors that lead to violence against children that occurred in purworejo refer to acts of sexual violence, which resulted in a deep trauma for the victims, as well as their follow-up is handled purworejo police station. Violence against children in purworejo is a case of sexual act that refers to the handling 76E jo Article 82 by Act No. 23 of 2002 on Child Protection. where the victim is a child and the perpetrator comes from within the family and outside the family. Violence against children should look by the community, in education needed either within the family or outside the family, it affects to grow to Consderng children, because every child deserves the affection in the family environment.Keywords: Violence; Children protection; Families.

Abstract

 Family violence or who is often called it with domestic violence is a universal problem faced by a country. This research to know and analys the application of the law and protection to victims of criminal acts of domestic violence, as well as the barriers and solutions in the protection of victims of domestic violenceThis research using empirical juridical approach or commonly referred to as the Juridical Sociological. The research is specified as descriptive analytical research.The results of this study are (1) a form of protection of domestic violence victims temporary and permanent protection of the court less attention. (2) Barriers in Implementing Law Enforcement Protection of Victims of Domestic Violence, namely: a. Domestic violence is often not reported to the police, because the victims felt shame; b. If the case had no complaints are often the victim withdraws the complaint and intends to settle the case in family. The conclution in this research that the legal protection for victims of domestic violence according to Act No. 23 of 2004 on the Elimination of Violence in the household is necessary. Obstacles of domestic violence is often not reported to the police. If the case has a complaint often the victims withdraw their complaint and intend to settle cases in a family manner.Keywords: Legal Protection; Victims of Domestic Violence.

Abstract

ABSTRACT This research entitled Criminal Violence in Teaching and Learning Process Viewed From Criminal Law Perspective Law Number 14 Year 2005 About Teachers and Lecturers. The purpose of this study: 1) To know and analyze the criminal acts in teaching and learning process in the perspective of criminal law and Law no. Law No. 14 Year 2005 on Teachers and Lecturers. 2) To know and analyze the weaknesses of criminal acts in teaching and learning process in the perspective of criminal law and Law no. Law No. 14 Year 2005 on Teachers and Lecturers. 3) To find out the solution of criminal acts in teaching and learning process in the perspective of criminal law and Law no. Law No. 14 Year 2005 on Teachers and Lecturers.Result of the research: 1) Provision of physical sanctions by teachers to learners in the perspective of criminal law is not a criminal offense and can not be accounted for criminal, as such a physical sanction is a means to improve education and discipline of learners. 2) In today's era of many complaints of teacher violence against students, teachers who provide physical sanctions to students in school is not a criminal offense and can not be held criminally liable as a physical sanction just as a means to educate and discipline students and physical sanctions given in the corridor and fairness limits. 3) The solution of crime in teaching and learning process is: a. Apply nonviolent education. b. Encourage or develop humanization of education. c. The punishment provided correlates with the child's actions. d. Equip teachers with knowledge insights. e. Counseling. f. Tujuan Penelitian ini : 1) Untuk mengetahui dan menganalisis tindak pidana dalam proses belajar mengajar dalam perspektif hukum pidana dan Undang-Undang No. 14 Tahun 2005 tentang Guru dan Dosen. 2) Untuk mengetahui dan menganalisis kelemahan-kelemahan tindak pidana dalam proses belajar mengajar dalam perspektif hukum pidana dan Undang-Undang No. 14 Tahun 2005 tentang Guru dan Dosen. 3) Untuk mengetahui solusi tindak pidana dalam proses belajar mengajar dalam perspektif hukum pidana dan Undang-Undang No. 14 Tahun 2005 tentang Guru dan Dosen.Hasil Penelitian : 1) Pemberian sanksi fisik oleh guru kepada peserta didik dalam prespektif hukum pidana bukan merupakan tindak pidana dan tidak dapat dipertanggungjawabkan pidana, semampang sanksi fisik tersebut merupakan sarana untuk meningkatkan edukasi dan kedisiplinan peserta didik. 2) Pada era sekarang ini banyak aduan kekerasan guru terhadap peserta didik, guru yang memberikan sanksi fisik kepada peserta didik di sekolah bukan merupakan tindak pidana dan tidak dapat dimintai pertanggungjawaban pidana semampang sanksi fisik tersebut hanya sebagai sarana untuk mendidik dan mendisiplinkan peserta didik serta sanksi fisik yang diberikan dalam koridor dan batas kewajaran. 3) Solusi tindak pidana dalam proses belajar mengajar adalah : a. Menerapkan pendidikan tanpa kekerasan. b. Mendorong atau mengembangkan humanisasi pendidikan. c. Hukuman yang diberikan berkorelasi dengan tindakan anak. d. Membekali guru dengan wawasan pengetahuan. e. Konseling. f. Segera memberikan pertolongan bagi siapapun yang mengalami tindakan kekerasan.Kata Kunci : Tindak Pidana, Kekerasan, Guru Dan Dosen

Abstract

The issues that will be reviewed by the authors in this paper are: 1) How can the application of Restorative Justice in the criminal investigation police persecution in the Middle Semarang?; 2) What are the obstacles in the implementation of Restorative Justice in the criminal investigation police persecution in the Middle Semarang; 3) What is the solution to implement Restorative Justice in the criminal investigation police persecution in the Middle Semarang? The method research approach used socio-juridical. Specification of the research is descriptive.The the type of data used is primary data, secondary data consisting of secondary legal materials and tertiary legal materials.Based on the results of the study concluded that the application of Restorative Justice in the investigation of criminal mistreatment in police Middle semarang has been able to implement, but still refer to the existing rules that reduce the evidence to the non-fulfillment of the evidence in accordance with Article 184 Criminal Procedure Code so that the case can be implemented degrees termination of an investigation or SP3 , Obstacles in the implementation of Restorative Justice in the criminal investigation police persecution in the Middle Semarang is the existence of internal factors and external factors that should be corrected so that Restorative Justice can be implemented without violating the rules. The barriers related solutions need to do is provide legal counseling, seminars, maximize the role of lower-level government officials related legal awareness in the community and maximize Bhabinkamtibmas role as the executive officer as well as representing the presence of the state in society.Keywords: Restorative justice; Investigation; Crime of Persecution.

Abstract

ABSTRAKIslam memberikan pedoman, acuan terhadap keyakinan terhadap ummatnya dalam membrikan solusi dalam perjalananan hidup agar manusia mampu mengatasi persoalan persoalan hidup di dunia  serta mencapai kebahagiaan yang kekal kelak di akhirat. Wakaf merupakan salah satu ajaran sangat penting dalam menjadi instrument berkait dengan pemberdayaan ummat serta solusi terhadap persoalan ekonomi ummat. Kelahiran UU Nomor 41 Tahun 2004 tentang Wakaf menandai era baru serta keseriusan pemerintah didalam melindungi serta mendukung pengelolaan harta benda wakaf. Dimana Badan Wakaf Indonesia (BWI) berperan sebagai regulator pengelolaan harta benda wakaf secara nasional, diharapkan mampu melaksanakan tugas dan fungsinya secara akuntabel dan profesional.Sangat menarik untuk dikupas tentang bagaimana pelaksanaan Undang-undang Nomor 41 tahun 2004 tentang Wakaf, hambatan-hambatan apa saja yang timbul dalam mengimplementasikan Undang-Undang tersebut, serta bagaimana solusi atas hambatan-hambatan tersebut di lingkungan Kantor Kementerian Agama Kota Salatiga.Pelaksanaan Undang-Undang Nomor 41 tahun 2004 tentang Wakaf ini membutuhkan integrasi serta integritas dari berbagai sektor terkait, ulama, Badan Wakaf Indonesia (BWI), serta Forum Nazhir, wakif, serta dukungan dari seluruh masyarakat. Wakaf is one of the most important teachings in becoming an instrument related to the empowerment of the ummah as well as solutions to the economic problems of the ummah. The birth of Law No. 41 of 2004 on Wakaf marks a new era and the government's seriousness in protecting and supporting the management of wakaf property. Where Wakaf Board of Indonesia (BWI) acts as a regulator of wakaf property management nationally, is expected to perform its duties and functions in an accountable and professional manner.It is interesting to discuss how the implementation of Law No. 41 of 2004 on Waqf, what constraints arise in implementing the Act, and how the solution to these barriers within the Ministry of Religious Affairs Office of Salatiga City.The implementation of Law No. 41 of 2004 on Wakaf requires the integration and integrity of various related sectors, scholars, Wakaf Board of Indonesia (BWI), and Nazhir Forum, wakif, and support from all communities. Abstract

Settling disputes fight by children because of the influence of liquor based on the Law applicable Relative authority possessed by police, then in handling ABH, the police can make or use the authority the discretion of the need to continue the legal process. Restorative Justice approach used in settling disputes fight by children because of the influence of liquor in the best interest of children of law enforcement officers are already implementing Discretion (Police Authority) and Diversion Restorative Justice approach based on each brat who committed the crime. According to Act No. 11 Of 2012 on Child Criminal Justice System, Restorative Justice approach is highly required as for the approach made through Diversion is applied at every stage of the proceedings. With the Discretion (Police Authority) and Diversion at every stage of the proceedings under the Child Criminal Justice System provides a great opportunity to keep the child out of the judicial process that is not needed in order to maintain mental, moral, and future of the child.Obstacles and solutions for settling disputes fight by children because of the influence of liquor through the mechanism of Restorative Justice Approaches Related to the competence of the investigators in the field of legal knowledge, laws and regulations, the criminal justice system and the technical skills and tactical investigation is still not optimal. This happens because not all personnel functions reskrim follow vocational education and skills of detectives technical functions supporting for example the ability to use information technology in the disclosure of a criminal case. Abstract

Police as investigators in settling disputes traffic accidents of children, are required to make efforts diversion on. This research problems using a knife analysis theory and the theory of the workings of the criminal responsibility law. Implementation of diversion on by investigators as a form of settling disputes traffic accidents child is in conformity with the provisions of Act No. 11 of 2012 on the Child Criminal Justice System. Investigators obstacles encountered in the application of investigative procedure as a form of settling disputes traffic accidents are children in Purworejo district police diversion on process does not produce an agreement and the diversion on agreement is not implemented. Another constraint is has not formed some infrastructure to support the implementation of the Act SPPA, including the lack of Correctional Centers (BAPAS), Institute of Child Development While (LPAS) and Special Child Development Institute (LPKA) located in the region of Purworejo. In practice, investigators already holding BAPAS Class II Purwokerto, because long distance, it is feared the diversion on process becomes longer than that prescribed by the Act., To overcome these obstacles investigator to approach the families of the victims, seeking coordination with BAPAS and if there is no agreement versioned then handed over to the Prosecutor's case.Keywords: Investigation, Diversion on, Child.

Abstract

The problem of this research is the criminal law enforcement policies in prevention efforts of information technology crime in the positive law and criminal law enforcement policy in combating criminal acts in the positive law of information technology that will come. The method used is normative juridical approach and specification in this study were included descriptive analysis. And sources and types of data in this research is secondary data obtained from the study of literature relating to the theory of Enforcement and Compliance Laws. Based on the results of the research that the Indonesian government policy with the promulgation of Act No. 11 of 2008 on Information and Electronic Transactions (ITE Act.) is the first legal framework that governs the world of cyber (Cyber Law) because the charge and broad scope in discussing arrangements in cyberspace, such as the expansion of electronic evidence together with the evidence that has been known so far, the recognition of electronic signatures as a means of verification, and authentication of legitimate an electronic document, as well as setting deeds done in cyberspace as a criminal offense. Policy formulation of the crime of information technology should pay attention to the internal harmonization with the criminal justice system or the general sentencing rules that apply today. It can not be said to harmonization / synchronization when the formulation policies are outside the system. Therefore the policy formulation of criminal law the crime of information technology in the future should be in the criminal justice system currently applies.Keywords: Policy, Law Enforcement; Criminal; Information Technology.
