Abstract

Abuse of narcotics in Indonesia tends to increase. Its effects, not only harm themselves but also the perpetrators of the surrounding environment. On the one hand, drug abusers are the ones who need to be helped to all treatment, but on the other hand, the public and law enforcement thought early abusers are criminals who should be punished. As a legal basis in the eradication of narcotics, Act No. 35 of 2009, there are still concerns about the notion of juridical criminal narcotics, which are related to the sanctions that can be imposed by the judge, especially for sanctions in the form of rehabilitation measures.Keywords: Criminal Sanctions; Abusers; Narcotics.

Abstract

ABSTRAKSIKepolisian Negara Republik Indonesia atau biasa secara singkat Polri adalah instrumen negara yangberperan dalam menjaga keamanan dan ketertiban masyarakat, menegakkan hukum, dan memberikan perlindungan, perlindungan dan pelayanan kepada masyarakat dalam rangka menjaga keamanan dalam negeri. Unit lalu lintas itu sendiri merupakan bagian dari Polri yang merupakan unsur pelaksana utama di bawah Kapolri. Abstract

Settings on the Crime of corruption in the procurement of goods and services defined in the Criminal Code as well as in Act Corruption today. However, there are still weaknesses contained in the Anti-Corruption Act today, one about the formulation of minimum criminal sanctions, which do not formulate sentencing guidelines to implement this minimum criminal threats.Corruption that has grown and occurs systemically and widespread must be done explicitly countermeasures to combat it. Corruption need severe sanctions (the imposition of the death penalty if necessary) in addition to confiscation of the wealth gained from corruption. Cooperation of various parties must be improved so that the law enforcement process runs with orderly and appropriate procedures, so that the perpetrators of criminal sanctions in kind (so that these sanctions have a deterrent effect) and eventually become a member of the public good and useful.Some issues regarding the criminal system that it is still in need of repair in the future is to be considered in order to create legislation that is even better. In 2018 the concept of the Criminal Code has been no formulation of the articles related to the criminal system that specifically regulates the crime of corruption by local officials, only qualifying offense of corruption that meet the elements of the subject that is a local official.Keywords: Legal Policy; Corruption.

Abstract

AbstractCriminal justice system as a tool of law enforcemen didn’t work optimally, in fact criminal justice system in Indonesia be acquainted whith principle of function difference impact on law enforcemennt performance so it will be difficult to achieve its function, as a crime prevention effort. This research purpose to set system concept and ideal approaches the organization of a unified criminal justice system so as to achieve an optimal performance of the criminal justice system (CJS) in criminal law enforcement, by approachng the system and re-structural, substantial and cultural reorientation of the criminal justice system.the main object of research is againt criminal law enforcement policy, the approach used is a normative juridical and sosiological approach complemented by a historical aproach/contextual and global/comparative, by prioritizing secondary data whit qualitative analysis. The result of the research show the sub system in the criminal justice system (such as investigation, prosecution, adjudicate and execution) funcionally and institutionally has not yet shown the existence of an integrated criminal justice system when viewed partially, the components of the support component seem to separate from one another, and tend to be centric institutions. Understanding of the integrated criminal justice system is inseparable from an understanding that includes substantial meaning, but also a philosophical aspect about the meaning justice and be nefit integrated. Therefore the legal culture is an integral part.     Keyword: implementation of the criminal justice system, functional differentiation, integrated approach.Abstrak Sistem peradilan pidana sebagai sistem penegakan hukum dengan menggunakan hukum pidana, tidak berjalan secara optimal bahkan sistem peradilan pidana di indonesia dikenal asas “differensiasi fiungsional” berdampak pada kinerja penegakkan hukum sehingga akan sulit untuk mencapai fungsinya, sebagai upaya penanggulangan kejahatan. Penelitian ini bertujuan untuk menemukan konsep sistem dan pendekatan yang ideal penyelenggaraan sistem peradilan pidana yang integral sehingga terwujud suatu kinerja Sistem peradilan pidana (SPP) yang optimal dalam penegakan hukum pidana, dengan melakukan pendekatan sistem dan reorientasi struktural, substansial dan kultural terhadap sistem peradilan pidana. Objek utama penelitian ialah terhadap kebijakan penegakan hukum pidana, pendekatan yang digunakan adalah pendekatan analisis yuridis normatif dan sosiologis dilengkapi dengan pendekatan historis/kontekstual dan global/komparatif, dengan mengutamakan data sekunder dengan analisis kualitatif. Hasil penelitian menunjukkan sub-sistem dalam sistem peradilan pidana (sub-sistem penyidikan, penuntutan, mengadili dan pelakasana pidana) secara fungsional dan kelembagaan belum menujukkan adanya perihal sistem peradilan pidana terpadu (SPPT) apabila dilihat secara parsial, komponen-komponen pendukung terkesan terpisah antara satu dengan yang lainnya, serta cenderung bersifat “instansi sentris”. Pemahaman mengenai sistem perdilan pidana terpadu tidak terlepas dari pemahaman yang mencakup makna substansial, tapi juga menyentuh aspek filosofis mengenai makna keadilan dan kemanfaatan secara terintegrasi. Abstract

The problems that arise in connection with the use of foreign labor in Indonesia, is a violation of residence permit and work permit. In the passport and foreign workers have written that the Indonesian government granted permission by the immigration authorities is to work as migrant workers in Indonesia with a position and a certain time even just as a tourist. Not infrequently the user companies often hide these illegal foreign workers. Indonesia is a country of law where any problems exist in the country has been governed settlement conditions in the form of the rule of law. In matters of illegal foreign workers in Indonesia the rules governing such example Act No. 13 of 2003 on employment has made a policy both administrative and criminal policy. Criminal in the world of employment can not be denied as a punishment to provide a deterrent effect, especially entrepreneurs form of a corporation in the use of illegal foreign labor. Labor gives a great influence in the development of national economy and the arrival of foreign workers into Indonesia when no restrictions are adjusted will cause social unrest, economic, and human resources are poor in Indonesia. Abstract

With the Perma No. 2 of 2012 then the misdemeanor case will be examined by a quick inspection event. The formulation of the problem and the purpose of this thesis is to describe and analyze the position of Supreme Court Regulation No. 2 of 2012 in the settlement of a misdemeanor, and to describe and analyze the implications of enforceability Perma No. 2 of 2012 against the authority of the investigators and prosecutors in cases of detention and the case investigation in court. This research method using normative legal research methods dengn type of research is descriptive analytical. Based on the analysis Perma No. 2 of 2012 to put forward the following results, that the legal position Perma No. 2 of 2012 is in substance related to the adjustment of the limits misdemeanor and fines in Perma No. 2 of 2012 which was ordered by higher laws or formed under the authority, in this case based on Article 79 of Act No. 5 of 2004 jo. Act No. 3 of 2009. The publication of Perma No. 2 of 2012 had an enormous impact on the implementation of the provisions of the detention authority possessed by the law enforcement agencies in the criminal justice process, especially in the judiciary under the authority of the Supreme Court. Abstract

This study, entitled "Implementation of Criminal Sanctions Against Crime Mining Potential Effects Without Permission For Deterrent Effect (Study In Region Central Java Regional Police)". Based on the description in this thesis, that will be examined are: 1). How does the application of criminal sanctions against the crime of mining without a license in the jurisdiction of the Central Java Regional Police? 2). Is it true that criminal sanctions against mining without permission a criminal offense can be a deterrent effect? 3). How the barriers and solutions so the application of criminal sanctions against the crime of mining can be a deterrent effect?The study concluded that: 1). Penal provisions against the crimes mining unlicensed / illegal mining regulated in Act Number 4 of 2009 on Mineral and Coal, under Article 158, Article 160 Paragraph (1) and Paragraph (2), Article 161, Article 163 Paragraph ( 1) and Paragraph (2), and Article 164. 2). Act Mineral and Coal just set the maximum threat. This is impacting on the demands of the Public Prosecutor and the decision to be handed down by the judge. In the absence of a minimum penalty, the prosecutors and the judge may impose demands and the decision to a penalty is low, so it is feared not give deterrent effect to the perpetrators of illegal mining. 3). Mining Law there are four (4) weakness which some contradictory to each other, namely: a). In Article 169 (a) regarding the validity of the Contract of Work. b). Act Number 4 Of 2009 on Mineral and Coal Mining (Mining Law) are not set on the Mining Authority (KP). c). Mining Law regulates the obligation of business entities and IUPK IUP holders whose shares are owned by foreign investors to divest shares. d). Mining Law makes the shifting patterns of relationship between the government and mining entrepreneurs. Abstract

Legal aid is a legal service which aims to provide a defense against human rights. The method used in this study is juridical empirical sociological law research that examines the applicable law and what happens in reality in society. In this study, the law conceived as an empirical phenomenon that can be observed in real life. The theory used in this research is the theory of the rule of law, theory principle of legal certainty, fairness and legal benefit.The study concluded that: 1) The role and responsibilities of legal aid refers to Article 1, Section 7, Article 8, Article 9, Article 10, Article 11, Article 13, Article 15, Article 20, Article 21 of Act Number 16 2011. 2) the obstacles faced by Legal aid Society in carrying out their roles and responsibilities are: a) the lack of continued patently victims and perpetrators of crime, b) lack of communication between legal aid providers with the investigator, c) attitude of investigators who sometimes covered with their view that a legal aid provider will impede the process of investigation, d) existence of different legal interpretations between Advocacy Legal aid to investigators about the conclusions and investigations. 3) Solutions related constraints faced by Legal Aid Society in carrying out their roles and responsibilities are: a) Government should give special warning to do the legal laid as Act Number 16 of 2011, b) Improve coordination between Police and Legal Laid Board connected with the Legal Laid, c) Followed investigator in socialization on law about legal laid.Keywords: Legal Aid; Legal Aid Board; Crime.

Abstract

Concomitant with the increasing number of criminal cases concerning criminal law talks even more into the spotlight. One criminal case whose numbers have increased is the narcotic crime. The doers are not limited to age, gender or social strata. Increasing this narcotic crime was accompanied by the use of increasingly sophisticated modus operandi so, make the legislators felt the need to establish a new law governing narcotics. Judge in deciding should consider the value of certainty, justice and the role of the judge is kemafaatan for law enforcement and justice. Abstract

The purpose of this study is to know, shortly describe, analyze and assess the implementation, barriers, and the remedies to overcome obstacles in the legal protection for victims of traffic abuses resulting in death by Police Traffic of Rembang. The method used in this study, using a kind of sociological juridical research, analytical, descriptive, with data used are primary data and secondary data, and analyzed Qualitative. The results of this study are: (1) legal protection for victims of traffic abuses resulting in death by Police Traffic of Rembang preferably through peace settlement with restitution, (2) barriers in the legal protection for victims of terms: (a) the substance of the law: Act No.22 of 2009 and the Criminal Procedure Code has not been providing legal protection for victims and their families; (B) the legal structure: lack of personnel and infrastructure; and (c) the legal culture: the lack of public awareness; (3) the remedies to overcome these obstacles, in terms of: (a) the substantive law: consideration of material and immaterial damages the victim or the victim's family, (b) the legal structure: additional personnel and high-tech infrastructure, human resource development; and (c) legal cultures: socialization and education traffic rules, and concept of restorative justice.
