Abstract

This study aims to analyze the provisions of Article 16 paragraph (1) of Law Number 2 of 2014 concerning the Position of Notary, specifically regarding the principle of notary independence when practicing as a bank partner. This article regulates the obligation of notaries to act honestly, independently, impartially, and protect the interests of the parties involved in every deed. However, in practice, the involvement of notaries as bank partners has the potential to create a conflict of interest, considering the existence of a commercial cooperative relationship between the notary and the bank. This study is a literature study with a normative legal research method, using a statute approach. The results of the analysis show that the cooperation between Notaries and Banks is contractual, but has the potential to violate the principle of neutrality because it creates a special relationship with one of the parties facing the notary. Provisions on honorariums and other rights often trigger conflicts of interest that are contrary to Article 16 paragraph (1) letter a of the UUJN and Article 3 paragraph (4) of the Notary Code of Ethics. This condition can risk reducing the status of the deed to a private deed or making it null and void by law, so an evaluation is needed to maintain the integrity and public trust in the notary profession.

Abstract

Penelitian ini bertujuan untuk menganalisis peran dan tantangan notaris dalam pembuatan akta pendirian Koperasi Desa/Kelurahan Merah Putih sebagai bagian dari kebijakan nasional dalam memperkuat ekonomi berbasis masyarakat. Latar belakang penelitian ini didasarkan pada adanya percepatan pembentukan koperasi sebagaimana diamanatkan dalam Instruksi Presiden Nomor 9 Tahun 2025 tentang Percepatan Pembentukan Koperasi Desa/Kelurahan Merah Putih yang menuntut adanya kepastian hukum dalam proses pendiriannya. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, yang dianalisis secara kualitatif melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa notaris memiliki peran strategis sebagai pejabat pembuat akta autentik yang tidak hanya berfungsi secara administratif, tetapi juga substantif, edukatif, dan preventif dalam memastikan kesesuaian anggaran dasar koperasi dengan ketentuan hukum dan kebijakan pemerintah, termasuk yang diatur dalam Peraturan Menteri Koperasi Nomor 2 Tahun 2025 tentang Pengembangan Usaha Koperasi Desa/Kelurahan Merah Putih. Di sisi lain, notaris menghadapi berbagai tantangan, antara lain tekanan percepatan pembentukan koperasi, kompleksitas regulasi, keterbatasan pemahaman hukum masyarakat, potensi ketidaksesuaian data, serta tuntutan adaptasi terhadap digitalisasi layanan hukum. Kondisi tersebut menuntut notaris untuk tetap menjunjung tinggi prinsip kehati hatian, profesionalitas, dan integritas dalam menjalankan jabatannya. Penelitian ini menyimpulkan bahwa keberhasilan pembentukan Koperasi Desa/Kelurahan Merah Putih tidak hanya bergantung pada kebijakan pemerintah, tetapi juga pada kualitas peran notaris dalam menjamin legalitas dan keberlanjutan koperasi sebagai instrumen pembangunan ekonomi nasional.

Abstract

The development of personal data protection regulations in Indonesia through Law Number 27 of 2022 concerning Personal Data Protection has legal consequences for various sectors that process personal data, including notarial practices. Notaries, as public officials authorized to make authentic deeds, have a legal obligation to maintain the confidentiality of notarial protocols as regulated in Article 16 paragraph (1) letters b and f of Law Number 2 of 2014 concerning the Position of Notary. On the other hand, Article 8 of the personal data protection law provides a number of rights to data subjects, such as the right to terminate processing, delete, and/or destroy personal data. The meeting between these two legal regulations has the potential to cause disharmony of norms, especially when the fulfillment of the rights of personal data subjects conflicts with the notary's obligation to maintain the confidentiality of notarial documents that are part of the notarial protocol. This study aims to analyze the legal implications of this disharmony of regulations and formulate a construction of harmonization of norms between the obligation to confidentiality of notarial protocols and the fulfillment of the rights of personal data subjects from a positive legal perspective in Indonesia. The research method used is normative legal research with a statutory and conceptual approach. The results of the study indicate that the disharmony between the two regulations creates potential conflicts of obligations for notaries in practice, particularly regarding granting access to or deleting personal data contained in authentic deeds. Harmonization of norms can be achieved through a systematic interpretation of both laws, the application of the principle of proportionality in limiting data subjects' rights, and strengthening standards for personal data management in notarial practice. This approach allows for a balance between protecting individual privacy rights and the legal certainty inherent in notarial documents as authentic evidence.

Abstract

This study aims to analyze the maqāṣid al-sharī'ah and siyāsah māliyah in relation to the Free Nutritious Meals (MBG) Program policy in Indonesia. The research method used is normative legal research employing a legislative approach, a conceptual approach, and a maqāṣid al-sharī'ah approach. Legal materials were obtained through a literature review covering legislation, books, scholarly articles, and other relevant literature. The results indicate that the MBG Program constitutes a dharuriyyat need because it supports the protection of life, intellect, and lineage through the provision of sustainable nutrition. This finding reinforces the development of contemporary maqāṣid asy-syarī’ah literature, which interprets ḥifẓ an-nasl as no longer limited to the protection of lineage but also encompassing children’s quality of life, health, and well-being, and contextualizes it within the MBG policy as an innovative contribution to research. From the perspective of Islamic public economics, the program’s financing reflects the principles of siyāsah māliyah and al-‘Adālah al-Tawzi‘iyyah. However, the implementation of the MBG also has the potential to cause mafsadah if it is not supported by fiscal sustainability, food quality oversight, data integration, and community empowerment, thereby fostering dependence on state assistance. Therefore, the success of the MBG must be directed toward the realization of al-maṣlaḥah al-`āmmah through accountable, sustainable, and equitable governance.
