Abstrak Penelitian ini mengkaji perlindungan hukum bagi pemilik hak cipta terhadap peredaran buku bajakan di marketplace Shopee ditinjau dari hukum positif Indonesia dan hukum Islam. Perkembangan marketplace digital berbasis user generated content telah mempermudah praktik penggandaan dan distribusi buku tanpa izin, sehingga menimbulkan persoalan hukum dalam penegakan hak cipta. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual melalui analisis terhadap peraturan perundang-undangan, doktrin hukum, serta prinsip-prinsip hukum Islam. Hasil penelitian menunjukkan bahwa praktik penjualan buku bajakan merupakan pelanggaran terhadap hak ekonomi dan hak moral pencipta. Meskipun Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta telah memberikan perlindungan normatif, efektivitasnya dalam konteks marketplace digital masih terbatas akibat sifat delik aduan, kendala penegakan hukum siber, serta belum optimalnya pengaturan tanggung jawab preventif penyelenggara platform. Dalam perspektif hukum Islam, pembajakan buku bertentangan dengan prinsip haq al-ibtikar dan tujuan maqashid al-shari’ah, khususnya perlindungan harta (hifz al-mal). Oleh karena itu, diperlukan penguatan tanggung jawab hukum marketplace dan harmonisasi antara hukum positif dan nilai-nilai hukum Islam guna mewujudkan perlindungan hak cipta yang adil dan efektif di era digital Kata Kunci: Hukum Islam, Pembajakan Buku, Perlindungan Hak Cipta, Shopee Abstract This study examines legal protection for copyright holders against the circulation of pirated books on the Shopee marketplace from the perspectives of Indonesian positive law and Islamic law. The development of user-generated content-based digital marketplaces has facilitated the unauthorized reproduction and distribution of books, thereby raising legal issues regarding copyright enforcement. This study employs a normative legal research method using a legislative and conceptual approach through an analysis of legislation, legal doctrine, and principles of Islamic law. The results of the study indicate that the practice of selling pirated books constitutes a violation of the creator’s economic and moral rights. Although Law No. 28 of 2014 on Copyright provides normative protection, its effectiveness in the context of digital marketplaces remains limited due to the complaint-based nature of the offense, challenges in enforcing cyber law, and the lack of optimal regulations regarding the preventive liability of platform operators. From an Islamic legal perspective, book piracy contradicts the principle of haq al-ibtikar and the objectives of maqashid al-shari’ah, particularly the protection of property (hifz al-mal). Therefore, it is necessary to strengthen the legal liability of marketplaces and harmonize positive law with Islamic legal values to achieve fair and effective copyright protection in the digital age.
