Abstract

Construction projects inherently involve the public sphere because their outcomes directly impact community safety, welfare, and access to public facilities. Consequently, the fulfillment of constitutional rights—particularly the principles of equality before the law under Article 27(1) of the 1945 Constitution and legal certainty under Article 28D(1)—is essential to ensure that development is carried out fairly. This article examines how these rights are realized or potentially violated through two key regulatory instruments: construction contracts and building permit processes. Using a normative juridical method supported by statutory analysis, doctrinal review, and comparative reference to FIDIC Red Book 2017, the study identifies common sources of constitutional risk such as ambiguous technical specifications, unclear brand corridors, incomplete designs, and procedurally defective permits. The article concludes that strengthening contract documents, enhancing transparency of permitting procedures, and ensuring accountable public oversight are crucial for safeguarding constitutional rights in equitable development.

Abstract

The inconsistency between the selection of construction contract types and the completeness of planning products as tender documents has become a persistent problem in Indonesian government procurement, frequently leading to variation orders, cost overruns, risk misallocation, and audit findings. This research aims to analyse the legal relationship between the completeness of planning products and the selection of construction implementation contract types, as well as to identify the legal implications of such mismatches under Indonesia's goods and services procurement law. This study employs a normative legal research method using a conceptual approach and case studies of sports stadium renovation projects. The analysis is carried out through Lawrence M. Friedman's Legal Systems Theory, which encompasses three components: the substance of the law, legal structure, and legal culture. The results of the study show that the lack of synchronisation between contract types and the readiness of tender documents constitutes a systemic failure. The substance of the law has not provided operational parameters; the institutional structure does not perform a control function from the planning stage; and the prevailing legal culture remains oriented toward the transfer of risk and the shifting of responsibility rather than sound technical planning. The study recommends establishing minimum standards of planning completeness as a prerequisite for the qualification of tender documents for lump sum contract types, strengthening the role of Construction Management (Manajemen Konstruksi) from the initial planning stage, and shifting the paradigm toward technical data-based risk management.

Abstract

Perubahan iklim telah mendorong berbagai negara, termasuk Indonesia, untuk mengembangkan instrumen ekonomi yang mendukung upaya penurunan emisi gas rumah kaca. Salah satu instrumen yang berkembang adalah Nilai Ekonomi Karbon (NEK), yang diatur melalui Peraturan Presiden Nomor 98 Tahun 2021. Di sisi lain, implementasi mekanisme karbon juga memunculkan kekhawatiran terhadap praktik greenwashing, yaitu penyampaian klaim lingkungan yang tidak sejalan dengan kinerja lingkungan yang sesungguhnya. Penelitian ini bertujuan untuk menganalisis pengaturan hukum terkait AMDAL, persetujuan lingkungan, dan penyelenggaraan NEK di Indonesia, mengidentifikasi potensi risiko greenwashing dalam implementasi NEK, serta mengkaji peran AMDAL dan persetujuan lingkungan sebagai instrumen hukum preventif dalam memitigasi risiko tersebut. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Data yang digunakan berupa bahan hukum primer, sekunder, dan tersier yang dikumpulkan melalui studi kepustakaan dan dianalisis secara kualitatif dengan metode deskriptif-preskriptif. Hasil penelitian menunjukkan bahwa AMDAL dan persetujuan lingkungan memiliki fungsi strategis dalam memastikan integritas lingkungan pada kegiatan yang berkaitan dengan NEK. Namun demikian, masih terdapat tantangan berupa fragmentasi regulasi, keterbatasan mekanisme pengawasan, serta belum adanya pengaturan yang secara eksplisit mengaitkan greenwashing dengan penyelenggaraan NEK. Oleh karena itu, diperlukan penguatan regulasi dan koordinasi antarsektor untuk meningkatkan efektivitas instrumen hukum preventif dalam mendukung transisi menuju ekonomi rendah karbon yang berintegritas.
