Abstract

The village as the smallest governmental entity, plays a crucial role in regional autonomy, with the readiness of thevillage in establishing its governance system impacting the development anda welfare of its community. Themanagement of village finances, especially the Village Revenue and Expenditure Budget (APBDes), is crucial insupporting village development. This research aims to understand how the implementation of Pamijen VillageRegulation Number 03 of 2023 concerning the Amendment of the Pamijen Village Revenue and Expenditure Budgetfor the Fiscal Year 2023 in Sokaraja Subdistrict, Banyumas District, and to identify the challenges faced in theimplementation of Pamijen Village Regulation Number 03 of 2023 concerning the Amendment of the PamijenVillage Revenue and Expenditure Budget for the Fiscal Year 2023 in sokaraja Subdistict, Banyumas District. Themethodological approach used is normative juridical with descriptive analysis. Date were obtained from fieldstudies at the Pamijen Village Office and trough interviews with villagr officials. The research findings indicate thatthe implementation of APBDes in Pamijen Village complies with applicable regulations. However, there aretechnical constraints and budget changes that affect activity realization. It is recommended that the villagegovernment continue to evaluate and minimize constraints in the implementation of APBDes. Abstract

Since the enactment of Law Number 11 of 2020 concerning Job Creation which has now been replaced by LawNumber 6 of 2023 concerning the Stipulation of Government Regulation in lieu of Law Number 2 of 2022 concerningJob Creation to Become a Law, the government removed the term Building Permit (IMB) was replaced with aBuilding Approval (PBG) as one of the conditions for constructing a building. PBG is a permit granted to buildingowners to build new, change, expand, reduce, and/ or maintain buildings in accordance with building technicalstandards (Article 1 Number 17 Government Regulation Number 16 of 2021 concerning Implementing Regulationsof Law Number 28 2002 concerning Building Buildings). This study aims to analyze the implementation of theBuilding Approval (PBG) policy based on the Regional Regulation of Purbalingga Regency Number 3 of 2022concerning Retribution for Building Approvals and the obstacles in granting PBG by the Public Works and SpatialPlanning Office in Purbalingga Regency. The research method uses a normative juridical approach and data analysisin this study uses qualitative analysis. Data collection techniques were carried out by reviewing laws and regulationsrelated to buildings and conducting interviews as supporting or additional data. The results of this study indicatethat in the provision of PBG by the DPU-PR Purbalingga there are still obstacles that affect the course of the policy,including the lack of public awareness of the importance of obtaining PBG, a lack of understanding of PBGprocedures and requirements through SIMBG, and a lack of professional planners at the DPU-PR of the RegencyPurbalingga.

Abstract

One of the goals of the Indonesian state is to educate the nation’s life, to the end; the government makespolicies in the field of education, one of which is the school zoning system. However, there still issues withthe implementation process, so the purpose of this research is to determine how the zoning system policyis implemented and the obstacles encountered at the Regional Coordinator of the Sumbang Sub-DistrictEducation Office. A normative/juridical approach method was used in the research to find the law inabstracto in cases in concreto. Secondary data obtained by studying documents is used as the main data,and primary data obtained by conducting interviews is used as supporting data. The qualitative analysismethod is used to conduct the analysis, and deductive reasoning is used to think. Based on the author’sreview of the literature and research, it is possible to conclude that the implementation of zoning systempolicy in the Regional Coordinator of the Sumbang Sub-District Education Office (Based on BanyumasRegent Regulation Number 28 of 2021 concerning Admission of New Students in Early ChildhoodEducation, Elementary Schools, and Junior High Schools for the 2021/2022 Academic Year) has been goingquite well, if not optimaly. The implementation process is hampered by a lack of information and facilities.

Abstract

Abstrak . Banyumas Regency is one of the regencies that received the highest ranking for corruption prevention. According to the Corruption Eradication Commission's Monitoring Center for Prevention (MCP) corruption prevention instrument, Banyumas Regency is ranked sixth at the national level with an index of 95.79. This research was conducted to find out the strategies of the Banyumas Regency Regional Government in preventing corruption of the Regional Budget (APBD) in Banyumas Regency and the obstacles of the Banyumas Regency Regional Government in implementing strategies to prevent corruption of the Regional Budget (APBD) in Banyumas Regency. The research method used is normative juridical using secondary data sources and primary data sources in the form of data from interviews with the Banyumas Regency local government consisting of the Regional Secretariat of the Legal Section and the Banyumas Regency Regional Inspectorate. Based on the results of the study, that the strategies and effective efforts of the Banyumas Regency local government in preventing corruption of the Regional Budget (APBD) in Banyumas Regency can be done through the establishment of regulations, handling conflicts of interest, fostering the State Civil Apparatus (ASN), using the Monitoring Center for Prevention (MCP), using the Whistleblowing System (WBS), using complaint stalls, conducting investigative audits, implementing the Government Internal Control System (SPIP), and carry out the duties and functions of local government on the regional revenue and expenditure budget (APBD). The obstacles of The Banyumas Regency Regional Government in preventing Corruption in the Regional Budget (APBD) in Banyumas Regency include delays in the implementation of activity schedules, the effectiveness of regulations, and the incompatibility of public complaints. Abstract

The aim of this research is to determine the process of applying military law to military members who commit the crime of desertion based on the military criminal code and to find out the obstacles to military law against military members who commit the crime of desertion based on the military criminal code. The type of research in writing this thesis is normative juridical research, and the approach method used is law, analytical and case approaches with clinical legal research writing of a perspective nature. The data collection technique was a literature study. The results show that the application of military criminal law to members of the Indonesian National Army who are proven to have committed a criminal act of desertion is the authority of the military court to try them, then the stages are in the form of investigations carried out by the Military Police on the orders of a superior who has the right to punish (Ankum). Then the investigation file is given to the military prosecutor to be studied, then the military prosecutor makes the indictment to be submitted to the military court, after the court feels that the files from the military prosecutor are sufficient, the military court will try military personnel accused of desertion. Furthermore, the constraints in law enforcement related to the crime of desertion are viewed from 4 interrelated aspects, namely concerning the substance of the law, the legal structure itself, facilities or infrastructure, and society. Settlement of cases in military justice is currently well regulated, however, it is hoped that all those who play a role in the military case settlement process carry out all these stages based on Justice and Positive Law. Abstract

This study aims to find out how the implementation of population administrationservices for making birth certificates at the Department of Population and CivilRegistration of Banyumas Regency and to find out how the obstacles or obstaclesfaced and the efforts made by the Office of Population and Civil Registration ofBanyumas Regency, it can be concluded that the implementation of servicespopulation administration making birth certificates at the Department ofPopulation and Civil Registration of Banyumas Regency in accordance withRegional Regulation Number 18 of 2015 concerning Population Administrationin Banyumas Regency where the service has fulfilled the quality of service well allaspects in the service are based on applicable regulations and have standardprocedures in carrying out properly according to applicable regulations.However, the implementation of the service has not been optimal, there are stillobstacles in its implementation, there are several obstacles and problems thatmust be improved, such as the ability of employees to update the system andHuman Resources for the Department of Population and Civil Registration ofBanyumas Regency.

Abstract

This research aims to determine the visiting hours service for inmates atthe Class IIB Nusakambangan Open Penitentiary and to find out theobstacles faced in the visiting hours service for Inmates at the Class IIBNusakambangan Open Penitentiary. The approach method used in thisresearch is a normative juridical research method and the analysis in thisresearch uses a qualitative analysis method. The results of the research atthe Class IIB Nusakambangan Open Penitentiary, namely that visitinghours services for inmates at the Class IIB Nusakambangan OpenPenitentiary were carried out in accordance with the rules stipulated inthe Operational Standards, Service Standards and GovernmentRegulation No. 99 of 2012 concerning Requirements and Procedures forthe Implementation of the Rights of Inmates in Prisons with theimplementation of visiting schedules, guarantees provided and servicesfrom other visiting hours and obstacles faced in serving visiting hours forinmates at the Class IIB Nusakambangan Open Penitentiary, namelylimited crossings for to the Nusakambangan Open Prison location in thespecial Nusakambangan Island Correctional Area and strict procedures,namely administration regarding the Village Head's certificate. However,despite the obstacles, the Class IIB Nusakambangan Open Penitentiary isworking as a solution, namely providing relief for the Village Head'scertificate to be followed up on the next visit provided that the visitor stillhas one Family Card and continues to provide the best service byproviding video call services so that the WBP can still communicate withtheir families.

Abstract

Pembaharuan   hukum   pidana      (Penal Reform) terus  diupayakan  oleh   pemerintah untuk    mewujudkan   bangunan   negara Indonesia    sebagai   negara   hukum   yang berdasarkan    Pancasila   dan   UUD   1945. Berbagai upaya telah dilakukan baik dengan pembentukan undang-undang hukum pidana yang  sesuai  dengan  kebutuhan  waktu  dan jaman     hingga   sekedar     meng-insert (menyisipkan)  pasal  tertentu  dalam produk perundangan yang sudah ada.  Namun semua usaha tersebut belum menjadi sebuah kerjua besar   bagi  kegiatan  pembaharuan  hukum pidana di Indonesia. Sebuah kerja besar yang banyak dinanti adalah terwujudnya kodifikasi hukum pidana Indonesia yang baru yaitu Kitab Undang-undang   Hukum   Pidana   (KUHP) sebagai  ganti  atas   Kitab   Undang-undang Hukum    Pidana    (KUHP)    positif    yang merupakan  terjemahan  dari   Wetboek  van Strafrechtvoor Netherlands Indie (WVSNI).Kodifikasi dan unifikasi  hukum merupakan kebutuhan  dalam upaya membangun sistem  hukum nasional.  KUHP adalah produk perundangan yang diharapkan dapat meujudkan cita-cita suatu kodifikasi dan unifikasi    hukum   pidana    di   Indonesia Rancangan  Kitab  Undang-Undang  Hukum Pidana (RKUHP) memiliki karakteristik yang unik karena merupakan basil dari rekodifikasibukum   pidana     nasional      Indonesia. Karakteristik ini berbeda dengan Rancangan Undang-Undang   (RUU)   lainnya.    Dengan adanya rekodifikasi hukum pidana nasional ke dalam  RKUHP  ini,    maka  segala  macarn ketentuan    perundang-undangan   pidana menjadi     tersatukan    (terunifikasikan) (Moeljatno,2008: 18)  secara sistematis dalam satu buku khusus.

Abstract

Sejatinya setiap negara selalu berusaha meningkatkan pembangunan, kesejahteraan dan kemakmuran rakyatnya. Usaha kearah tersebut dilakukan dengan berbagai cara yang berbeda antara negara satu dengan negara lainnya. Salah satu usaha yang selalu dilakukan oleh negara adalah menarik sebanyak mungkin investasi asing masuk ke negaranya tidak terkecuali Indonesia. Upaya yang dilakukan pemerintah dalam menarik minat investor adalah dengan dibentuknya Badan Bank tanah, sebuah lembaga khusus negara atau sui generi Indonesia yang dibentuk oleh pemerintah pusat yang diberi kewenangan khusus untuk mengelola tanah, lembaga ini lahir dari terbitnya Peraturan Pemerintah Nomor 64 Tahun 2021 Tentang Badan Bank Tanah. Namun, pembentukan lembaga baru ini dinilai sebuah upaya kontra produktif yang justru dampak buruk dari lahirnya lembaga baru ini mengancam ekonomi masyarakat kelas bawah khususnya petani, dan lembaga baru ini juga dikhawatirkan akan mengaktifkan kembali asas domein verklaring yang dapat menghambat upaya reforma agraria di Indonesia.
