Abstract

The hydrometeorological disaster that struck Sumatra in November to December 2025 claiming 1,072 lives and causing material losses of Rp68.67 trillion cannot be viewed merely as a natural phenomenon. This article analyzes the catastrophe as an ecological disaster rooted in the failure of both the state and corporations to uphold environmental sustainability. Using a normative legal research method, the study examines the state’s responsibility in issuing business permits in disaster-prone areas based on principles of good environmental governance, and evaluates the effectiveness of legal remedies through Citizen Lawsuits and Class Actions. The findings reveal systemic violations, including the neglect of Strategic Environmental Assessments (KLHS), spatial planning breaches, and weak oversight of corporate activities in upstream watershed areas, all of which have exceeded ecological carrying and assimilative capacities. In this context, the state may be held accountable for violating citizens’ constitutional rights, while corporations are subject to strict liability and the polluter pays principle. The article recommends strengthening environmental law enforcement through strategic litigation as a pathway to ecological justice and sustainable natural resource governance in Indonesia.

Abstract

This study aims to analyze the protection of industrial design and trademarks in the phenomenon of rework fashion involving the modification of secondhand international branded clothing, as well as the limits of the exhaustion of rights doctrine. The research employs a normative juridical method with statutory and conceptual approaches, using secondary data collected through library research. The analysis is conducted qualitatively using a descriptive analytical method to interpret legal norms and examine their application to rework fashion practices. The results show that the exhaustion of rights doctrine does not apply absolutely when substantial modification occurs, as trademark and industrial design rights remain attached and may be infringed. The legality of rework fashion depends on the extent to which modifications eliminate the original identity of the product and do not create consumer confusion. This study identifies a legal transformation threshold that determines the shift from secondhand goods to new products, as well as the importance of identity severance to avoid infringement. Therefore, rework fashion operates within a legally vulnerable area and requires clearer boundaries between creativity and intellectual property protection..

Abstract

The annulment of State Administrative Decisions (KTUN) by the State Administrative Court (PTUN) is a form of judicial oversight of government actions to ensure they remain within the legal corridor. This study aims to analyze the legal reasons used by judges in annulling KTUN. The research method used is normative legal research with a legal approach and a conceptual approach. The results of the study indicate that PTUN judges in annulling KTUN generally base their decisions on violations of applicable laws and regulations, general principles of good governance (AUPB), and defects in authority, procedures, and substance in the issuance of KTUN. Thus, the annulment of KTUN is an effort to guarantee legal protection for the public from arbitrary administrative actions..
