Abstract

[Unidroited Position As A Source Of Contract Law In The Future Of Indonesian Contract Law Amandement] Business transaction often faced the issue of ensuring that the rights and obligation are fulfilled as the agreement as agreed, especially when facing the difficulties of the rights and obligation of the parties due to different legal system between countries. Thereore, to answer the problems the parties will seek legal sources, namely book III of the Civil Code in addition to studying and understanding the principles of internasional commercial contract law, namely UNIDROIT which contains principles that can be adopted as one of the works that seek Standarization of contract law to encourage the harmonization of commercial law international efforts to bring together different business actors between countries, so that the same legal basis is required in the coming renewal of Indonesia contract law. Abstract

Not to misuse the regulation of the state as the factor that causes defects in the will of the Indonesian Civil Code, should be anticipated for the development of contract occurs so fast in practice. The convergence of an agreement in the form of rapprochement will of the parties, no longer occur in a balanced manner, because there are elements that influence the parties, both economically and psychologically, whereby the economically strong dominate the contract even harm the opposing party, so the contract applies biased, unfair and inappropriate. Therefore, the government needs to intervene to protect the weaker party. It was felt important need for inclusion of the substance abuse situation as a factor that will cause defects arising from Jurisprudence in the Netherlands as the fourth element, in addition to oversight, coercion and deception that has been set out in Article 1321 of the Civil Code. It is therefore necessary to be examined how the relationship between the abuse of state as the factor that causes the will deform against the abuse of contracts and how to position the state as a factor that causes defects will fill the void in the legal system of contract law in Indonesia. The results showed that the state of relationship abuse as factors that led to the agreement will deform, relevant because the agreement occur with the agreement, and to the agreed required the conformity of the will of the parties. For that agreement became the basis for the validity of the contract. But with the misuse of state in the contract raises the contract it becomes irrevocable, because conformity of his will are not met, while the position of the abuse of the state as the factor that causes a defect will in fill the legal vacuum in the system of contract law in Indonesia, it is very important, where in addition there is no setting in Indonesia, also the case in practice. The parties to a contract are often cornered by the interests of one party, so that the opposing party gives consent with full conviction, because it does not have the bargaining power is balanced, often one of the parties has a weak bargaining position, caused by the influence of the economic position and psychiatric one parties, so we need government intervention to oversee the implementation of the freedom of contract in practice, and making rules coercive. Abstract

ABSTRACTMatter of proof in civil cases is important, since the parties have to prove what is being disputed. It is stated in Article 163 HIR that whoever owned the rights to something, he has to prove it. There are some evidences which have the perfect strength of proof, namely, the written evidence, witness, suspicion, recognition, and the oath. But in practice, the problem arises. Letter of Interrogation of the Suspect was used as an evidence by the judge in the decision number 06/Pdt/2001/PN.Ciamis. As analyzed in this paper, the Letter of Interrogation is only preliminary evidence, so other evidences are needed to make it enforceable, as stated in Article 164 HIR, in conjunction with Article 165 HIR.Keywords: strength of proof, evidence. ABSTRAKPembuktian dan bukti dalam kasus perdata sangat penting semenjak para pihak harus membuktikan dari perselisihan yang muncul. Dalam pasal 163 HIR disebutkan bahwa siapun yang memiliki hak atas sesuatu maka dia harus membuktikannya. Ada beberapa macam alat bukti yang akan mengukur kekuatan pembuktiannya misalnya, bukti tertulis, saksi, pengakuan, dan sumpah. Namun dalam prakteknya selalu muncul persoalan. Surat berita acara pemeriksaan tersangka telah digunakan hakim sebagai bukti sebagaimana dalam putusan nomor 06/Pdt/2001/PN.Ciamis. Dalam tulisan ini dianalisa bahwa berita acara pemeriksaab sebagai bukti permulaan, oleh sebab itu dibutuhkan bukti lain yang dapat menyakinkan sebagaimana dinyatakan dalam pasal 164 HIR dan terkiat dengan pasal 165 HIR Kata kunci: kekuatan pembuktian, bukti, dan surat berita acara pemeriksaan

Abstract

Good faith plays an important role in a contract since it holds a dominant position either during pre-contractual phase or when a contract is executed. However, pre-contractual good faith in Indonesian Civil Code is not recognized as such there is no legal assurance. In fact in pre-contractual stage, the parties already put some investment based on trust and hope, however, they faced dead end and they did not reach an agreement. This was tinted with the fading of wall between two major legal systems: Common Law System and Civil Law System as a result of dynamic in business relation involving countries bringing some developments in contract law. The extension in the substance of good faith in Article 1338 verse (3) of the Civil Code should not be implemented so grammartically that good faith does not only appear during the execution of the contract but it should also be interpreted during the whole process of the contract that good faith should lay the foundation of the parties relation both in pre-contractual phase and during the contract such that the good faith in Article 1338 verse (3) of Civil Code functions dynamically. In UPICC, the provision of good faith is stipulated in Article 1, 7 stressing on the importance of good faith and fair dealing. This stressing underlays the process of contract agreement. Good faith should be interpreted and formulated during the whole process of contract. Under the traditional doctrine of Common law, court cannot punish the defendant because Common Law system does not recognize the good faith principle in negotiation process. Nevertheless, modern law contract waives the legal assurance to reach a substantial justice that good faith is not only applied in a contractual relation but also in a pre-contractual. Meaning, good faith does not only bind upon matters explicitly stated in the agreement, but also upon ones that traditionally are required by appropriateness, tradition, or the law as stipulated in Article 1339 of the Civil Code and Article 6:248 of Netherlands NBW. The good faith and fair dealing principles should be the underpinning of contract law. Each party should uphold the principles of good faith and fair dealing in the whole process of the contract starting from negotiation, contract arrangement, the execution of the contract as far as the termination of the contract particularly in the reformation of Indonesian future contract law

Abstract

Arisan (a social gathering) is an activity where several people pool money or goods of equal value and then draw lots among the participants to determine who wins. Arisan is recognized as an agreement, although it is often based on mutual consent of the participants without formal written agreement. Arisan falls into the category of anonymous agreements. Therefore, when conducting an arisan, the requirements stipulated in Article 1320 of the Civil Code must be considered. The method used in this research is descriptive and analytical, addressing the research problem, specifically the legal protection of victims of online auction arisan due to the difficulty of attracting new members from a civil law perspective. The results indicate that the implementation of online auction arisan, which relies on recruiting new members, poses significant legal risks, particularly due to the weak basis of the agreement, which is often verbal and lacks written evidence. Protection for victims of online auction arisan (raising) can be provided, despite the lack of explicit regulations, through general principles of agreements, provisions of the Civil Code, the Electronic Information and Transactions Law (UU ITE), and OJK regulations. Legal actions that victims can take include non-litigation resolutions such as mediation and negotiation, as well as litigation through lawsuit mechanisms.

Abstract

Penelitian ini membahas pembangunan dan perkembangan hukum di Indonesia melalui perspektif teori hukum integratif. Teori ini menekankan pentingnya penggabungan berbagai sumber hukum, yaitu hukum adat, hukum nasional, dan hukum internasional, agar tercipta sistem hukum yang harmonis dan responsif terhadap dinamika sosial budaya masyarakat Indonesia. Fokus kajian diarahkan pada perkembangan hukum sejak era 1970-an hingga periode reformasi dan globalisasi, dengan tujuan menganalisis sejauh mana teori hukum integratif mampu menjelaskan keterkaitan antara hukum formal, nilai sosial, dan budaya masyarakat dalam proses pembangunan hukum nasional. Metode yang digunakan adalah penelitian hukum normatif dengan sifat deskriptif analitis, menggunakan pendekatan yuridis normatif. Teknik pengumpulan data dilakukan melalui studi kepustakaan (library research), sementara analisis data menggunakan metode yuridis kualitatif yang menekankan pada penafsiran hukum dan relevansinya dengan konteks sosial budaya. Hasil kajian menunjukkan bahwa perkembangan hukum Indonesia sejak 1970-an dapat dipahami melalui teori hukum integratif yang menggabungkan aspek hukum formal dengan nilai sosial dan budaya. Meskipun hukum bertujuan untuk mencapai keadilan sosial, masih terdapat permasalahan berupa ketimpangan penegakan hukum, kriminalisasi kebijakan, serta fenomena “no viral, no justice” yang mencerminkan belum optimalnya perlindungan keadilan bagi seluruh warga. Oleh karena itu, diperlukan reformasi struktural, peningkatan kapasitas aparat, dan penerapan prinsip-prinsip hak asasi manusia sebagai fondasi agar pembangunan hukum Indonesia benar-benar mampu mewujudkan keadilan, kepastian, dan kemanfaatan bagi Masyarakat.
