Abstract

The social phenomenon of young people preferring to hang out in entertainment venue such as cafes, malls, or shopping centers rather than performing congregational prayers at the mosque has become both a religious and social issue that requires serious attention.This study aims to analyze the factors contributing to the low interest of youth in enlivening the mosque, to understand why youth-friendly mosques with modern facilities remain quiet while simple mosques are instead filled with young worshippers, and to formulate appropriate guidance strategies to revive the spirit of congregational prayer among the youth. This study employs a qualitative research method with a phenomenological approach. The type of research applied is a mixed research method, combining library research and field research. The data were collected through literature review, observation, interviews, questionnaires, surveys, and documentation related to youth behavior and the condition of mosques in several locations in the city of Pekanbaru. The findings indicate that peer environment, modern lifestyle, and the lack of family guidance and religious leadership are the main factors behind the declining presence of youth in mosques. However, mosques that succeed in building emotional bonds, providing exemplary religious figures, and strengthening community culture remain vibrant even without complete facilities.. The study concludes that strategies for fostering youth engagement in mosque activities should emphasize the synergy among families, mosque management, and the community through spiritual, educational, and social approaches that can attract young people to consistently perform congregational prayers.

Abstract

This article examines the transformation of marriage guardianship (wali nikah) in Moroccan family law from a family-based authority model toward individual legal autonomy. Focusing on the  transformation of legal authority from classical Mālikī jurisprudence to the 2004 Mudawwanah al-Usrah, the study investigates how the position of the guardian shifted from a mandatory pillar of marriage validity into an optional legal institution within contemporary Moroccan family law. Positioned within the discourse of Islamic legal reform, this research argues that the transformation of guardianship in Morocco reflects not merely a legislative change, but a broader epistemological shift in the structure of legal authority in Islamic family law. Using a qualitative library-based method with historical-normative, normative-analytical, and limited maqāṣid al-sharī‘ah approaches, this study analyzes classical fiqh doctrines, hadith traditions, and statutory provisions related to marriage guardianship. The findings reveal that classical Mālikī law constructed guardianship as a representation of patriarchal family authority and social protection, whereas the Mudawwanah reconstructs legal legitimacy around women’s independent legal capacity. This transformation demonstrates a hybrid model of Islamic legal reform that preserves symbolic continuity with fiqh tradition while simultaneously integrating modern principles of gender equality and individual autonomy

Abstract

Perkembangan persoalan hukum Islam kontemporer (nawāzil) menuntut adanya metodologi istinbath yang adaptif dan tetap berlandaskan prinsip-prinsip syariat. Salah satu metode yang relevan adalah takhrij dalam ushul fiqh, namun kajiannya masih terbatas pada aspek definisional dan aplikatif. Penelitian ini bertujuan menganalisis konsep takhrij, menjelaskan urgensi epistemologisnya, merumuskan kaidah metodologisnya, serta mengaplikasikannya dalam penetapan hukum Islam kontemporer. Penelitian ini menggunakan pendekatan kualitatif dengan metode normatif-doktrinal (library research) melalui analisis deskriptif, konseptual, komparatif, dan aplikatif terhadap literatur klasik dan kontemporer. Hasil penelitian menunjukkan bahwa takhrij merupakan bentuk ijtihad mazhabi terstruktur yang mengintegrasikan teks, kaidah, dan realitas sosial dalam proses penetapan hukum Islam. Validitas takhrij ditentukan oleh kesesuaian dengan nash, kesamaan illat, dan kompetensi ilmiah pelakunya. Penelitian ini menyimpulkan bahwa takhrij memiliki relevansi strategis dalam pengembangan hukum Islam kontemporer karena mampu menjaga keseimbangan antara otentisitas syariat dan adaptabilitas terhadap perubahan zaman.

Abstract

The development of contemporary Islamic legal issues (nawāzil) demands an extraction method (istinbāṭ) capable of maintaining the Continuity of classical fiqh authority while remaining responsive to shifting modern realities. In this context, takhrīj emerges as a pivotal method within the ushul fiqh tradition, particularly following the decline of absolute ijtihad and the rise of madhhab-based orientations. However, studies on takhrīj have thus far focused predominantly on its technical applications, while its epistemological dimension as a form of madhhab-based ijtihad remains relatively under-explored. This research aims to analyze the essence of takhrīj as a method of madhhab-based ijtihad, examine its position between qiyās and taqlīd, and explain its relevance in determining contemporary nawāzil rulings. Using a qualitative approach with a normative-doctrinal method (library research), this study employs descriptive, conceptual, and applied analyses of turāth literature and contemporary studies. The results indicate that takhrīj is not merely a legal derivation technique, but rather an epistemological mechanism that proportionally connects texts, madhhab principles, and social reality. Within the structure of ushul fiqh, takhrīj occupies a position between absolute ijtihad and taqlīd, thus characterizing it as a form of structured madhhab-based ijtihad. Furthermore, this study finds that the methodological flexibility of takhrīj allows Islamic law to remain relevant in addressing contemporary problems, such as smart contracts, digital money, and fiqh al-wāqi‘, without departing from the framework of the madhhab’s ushul. The novelty of this research lies in its effort to reconstruct takhrīj not only as a method of fiqh but also as an epistemological paradigm for the development of contemporary Islamic law
