Abstract

Fenomena deep nudification manipulasi foto seseorang, agar terlihat tanpa busana melalui artificial intelligence (AI) memperlihatkan realitas sosial yang berkembang jauh lebih cepat daripada regulasi, dimana korban mengalami kerugian psikologis, seksual, dan reputasional meskipun kontennya bersifat sintetis. Dalam sistem hukum Indonesia belum optimal menyediakan norma eksplisit yang mengatur konten intim sintetis, sehingga penegakan hukum terhadap pelaku menghadapi kekosongan pengaturan dan hambatan pembuktian. Penelitian ini bertujuan mendeskripsikan karakteristik deep nudification sebagai bentuk kejahatan seksual digital, menganalisis relevansi dan keterbatasan regulasi hukum yang ada dan merumuskan konstruksi pertanggungjawaban pidana yang lebih tepat bagi pelakunya. Dengan menggunakan metode penelitian hukum normatif serta pendekatan multidisiplin yang memadukan analisis hukum pidana, hukum siber, viktimologi, dan perlindungan data pribadi, penelitian ini menegaskan bahwa dampak viktimisasi dari konten sintetis identik dengan konten intim asli. Novelty penelitian ini terletak pada argumentasi perlunya pengakuan yuridis terhadap kategori delik baru yang disebut dengan synthetic sexual violence untuk merepresentasikan kekosongan norma dan memberikan perlindungan hukum yang memadai bagi korban. Penelitian ini menunjukkan bahwa pengaturan eksplisit mengenai konten intim sintetis merupakan kebutuhan mendesak untuk menjamin kepastian hukum, efektivitas penegakan hukum, serta pemenuhan hak-hak korban dalam ranah kekerasan seksual digital.

Abstract

Mahkamah Konstitusi Republik Indonesia memegang peranan sentral sebagai guardian of the constitution dan pemegang kewenangan tunggal dalam menafsirkan konstitusi. Salah satu karakteristik fundamental putusan MK adalah sifatnya yang final, mengikat, dan erga omnes. Namun, dalam praktiknya, Putusan Mahkamah Konstitusi Nomor 90/PUU-XXI/2023 telah menimbulkan kontroversi hukum yang serius karena bertolak belakang secara fundamental dengan dua putusan sebelumnya yang memiliki objek pengujian identik, yakni Putusan Nomor 58/PUU-XVII/2019 dan Putusan Nomor 51/PUU-XXI/2023, dan dikeluarkan tanpa mekanisme overruling yang transparan dan terstandarisasi. Penelitian ini bertujuan untuk menganalisis: (1) batas kewenangan hakim konstitusi dalam perspektif prinsip res judicata pada Putusan MK Nomor 90/PUU-XXI/2023; dan (2) akibat hukum putusan tersebut terhadap kepastian hukum di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif yang bersifat deskriptif-analitis dengan tiga pendekatan yang diterapkan secara bersamaan: pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach). Hasil penelitian menunjukkan bahwa Putusan Nomor 90/PUU-XXI/2023 secara yuridis telah melampaui batas kewenangan konstitusional MK karena melanggar prinsip res judicata pro veritate habetur yang dipositivikasikan melalui Pasal 60 UU MK, serta menciptakan norma baru melalui amar putusan yang bertentangan dengan doktrin negative legislature. Putusan tersebut menimbulkan akibat hukum yang bersifat multi-dimensional terhadap kepastian hukum: secara material mengubah syarat usia pencalonan presiden dan wakil presiden; secara formal menciptakan inkonsistensi yurisprudensi yang melemahkan otoritas Pasal 60 UU MK; dan secara legitimatif mengikis kepercayaan publik terhadap MK sebagai lembaga peradilan konstitusi yang berintegritas. Penelitian ini merekomendasikan reformasi hukum acara MK yang komprehensif, meliputi penguatan mekanisme penerapan prinsip res judicata, pembentukan standar overruling yang transparan, dan penguatan sistem pencegahan konflik kepentingan hakim konstitusi.

Abstract

This study examines the functions and authorities of the General Elections Commission (KPU), the Election Supervisory Agency (Bawaslu), and the Election Organizers Ethics Council (DKPP) in achieving democratic elections in Indonesia. KPU serves as the primary election organizer, Bawaslu acts as both supervisor and resolver of administrative disputes, and DKPP functions as an ethical institution that safeguards the integrity of election organizers. These three institutions hold strategic positions within the constitutional system, complementing one another through executive, supervisory, and code of ethics enforcement functions. Through institutional synergy, the principles of democracy, justice, and good and clean governance can be realized at every stage of the election.

Abstract

Elections are a fundamental tool in a democratic system that serve to realize the rights of the people. This paper aims to examine the background and evolution of elections in Indonesia, including the legal basis, electoral system, organizing institutions, and election results over time. The approach used is a normative juridical approach with descriptive analysis of legislation and related scientific literature. The results of the discussion indicate that elections in Indonesia have experienced significant progress, starting from the 1955 election, which was considered the most democratic, then declining during the New Order era to become a tool for legitimizing power, until re-emerging as a competitive multiparty system after the 1998 reforms. Institutionally, the General Elections Commission (KPU), Elections Supervisory Agency (Bawaslu), and Elections Executive Board (DKPP) were designed as independent organizers, but still face integrity and capacity challenges. The implementation of an open proportional system and simultaneous elections brought democratic progress as well as new issues such as increased money politics and high technical burdens for election officials in the field. This paper recommends the need to strengthen election organizing institutions, reform the election system with a humanitarian perspective, and improve public political education to realize more transparent, accountable, and high-quality elections.

Abstract

Keadilan merupakan tujuan hukum dasar dalam mewujudkan ketertiban, perlindungan hak, dan kesejahteraan masyarakat. Konsep keadilan berkembang dalam berbagai perspektif, baik hukum Islam maupun filsafat hukum. Penelitian ini bertujuan menganalisis konsep keadilan menurut Al-Qur’an dan Al-Sunnah, mengkaji teori keadilan tokoh filsafat hukum, serta membandingkan konsep keadilan dalam hukum Islam dan hukum positif. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan konseptual yang bersumber dari Al-Qur’an, hadis, buku, serta jurnal ilmiah relevan. Hasil penelitian menunjukkan keadilan dalam hukum Islam merupakan prinsip fundamental bersumber dari wahyu yang diwujudkan melalui nilai keseimbangan, kemaslahatan, dan persamaan hak. Sementara itu, konsep keadilan dalam filsafat hukum berkembang melalui pemikiran Plato, Aristoteles, Thomas Aquinas, Hans Kelsen, dan John Rawls yang memandang keadilan dari sudut pandang moralitas, proporsionalitas, legalitas, hingga keadilan sosial. Perbandingan keduanya menunjukkan tujuan yang sama, yaitu mewujudkan ketertiban dan kesejahteraan masyarakat, namun berbeda dalam sumber legitimasi dan orientasi penerapan. Hukum Islam menekankan keadilan substantif berorientasi kemaslahatan, sedangkan hukum positif menitikberatkan kepastian hukum melalui aturan formal. Oleh karena itu, diperlukan keseimbangan antara kepastian hukum, kemanfaatan, dan nilai moral guna mewujudkan keadilan ideal dalam kehidupan bermasyarakat dan bernegara.

Abstract

This study begins with the understanding that race is not a biological entity but rather a social construct shaped by history, politics, and power relations. The research method used is qualitative with a historical approach through a literature study of primary and secondary legal sources related to the development of Critical Race Theory (CRT). The results of the study show that the history of CRT has succeeded in exposing the issue of skin color differences that have been used to justify the positions of those in power, who have always been considered to favor white people. Even though society is required to think rationally in relation to organizations and institutions, certain groups are still being discriminated against today. CRT has provided the principle that exploring the structure of liberal principles must be gradual and objective. Based on this principle, CRT can reveal power structures that are often alienated and have a racial character towards American society. Thus, through these principles, CRT has great potential to understand the situation of practices that disadvantage certain groups, such as in education, the legal system, or citizens' rights in accessing life in their country. The implication of applying CRT to race and racism in Indonesia, with its ethnic and cultural diversity, is that injustice is not merely personal, but rather that inequality arises from those who hold power in this regard, such as social, economic, and political structures. Thus, CRT has exposed the structures of inequality and offered a new perspective on racial differences and racism in Indonesia.

Abstract

The Indonesian Constitutional Court Decision Number 135/PUU-XXI/2024 marks a fundamental change in Indonesia's constitutional and electoral law system by annulling the application of the full concurrent elections concept which combines the National General Election (Pemilu) and the Regional Head Election (Pilkada)—as regulated in Law Number 7 of 2017 concerning General Elections. The Court determined that the unification of national and local election schedules contradicts the principle of regional autonomy (otonomi daerah) and blurs the meaning of popular sovereignty at the local level as guaranteed by Article 18 of the 1945 Constitution (UUD 1945). Through this ruling, the Court ordered that Pilkada must be held separately from the national Pemilu, issuing a conditionally constitutional verdict that reinterprets Article 201 of the Election Law to prevent a legal vacuum (rechtsvacuum). This research utilizes a normative juridical approach with descriptive and conceptual analysis methods, through a review of relevant laws and regulations, Constitutional Court decisions, and academic literature. The analysis results indicate that the Court’s considerations encompass three main dimensions: (1) Philosophical, relating to the protection of popular sovereignty in the regions; (2) Sociological, concerning the workload of election organizers and the validity of election results; and (3) Juridical, regarding the balance between efficiency and the principle of substantive democracy. The juridical implications of this decision include a change in the electoral system from full concurrent to separated elections, the need for legal harmonization between the Election Law and its implementing regulations, and the formation of a new political cycle (year “X” for the National Pemilu and “X+2” for the National Simultaneous Pilkada). From the regional autonomy perspective, the separation of election timing positively impacts the strengthening of local political identity, increased space for the articulation of regional aspirations, and the opening of opportunities for regional head candidates from smaller or independent parties. Conversely, new challenges also arise, such as increased political and budgetary costs, the potential for political transactions in the nomination process, and policy fragmentation between the central and regional governments. Overall, Constitutional Court Decision No. 135/PUU-XXI/2024 not only affects the technical aspects of election administration but also reconstructs the relationship between the central and regional governments within the context of Indonesia's constitutional democracy. This decision serves as a crucial momentum for lawmakers to rearrange the concurrent election system to better align with the principles of regional autonomy, electoral justice, and government effectiveness.

Abstract

Restrictions on freedom of religion within Indonesia’s legal system continue to generate normative and practical debates, particularly due to regulatory practices that tend to be repressive and discriminatory toward certain religious groups. This situation reflects an ongoing tension between the protection of fundamental rights and the state’s interest in maintaining social order. This study aims to analyze freedom of religion in Indonesia from a utilitarian perspective, specifically through John Stuart Mill’s harm principle, and to propose a legal reformulation oriented toward justice and the promotion of the common good. The research employs a normative legal method using philosophical and conceptual approaches, drawing on statutory regulations, legal doctrines, and utilitarian legal philosophy. The findings indicate that current restrictions on religious freedom in Indonesia are inconsistent with utilitarian principles, as they often undermine the greatest happiness of those affected without clear evidence of actual harm to society at large. The proposed legal reform includes revising discriminatory regulations, simplifying the licensing procedures for houses of worship in a non-discriminatory manner, and accelerating the establishment of a National Regulatory Body as a mechanism for legal harmonization. The application of the harm principle in public policymaking has significant implications for strengthening the protection of religious freedom, balancing individual liberty with social order, and fostering a more just and welfare-oriented legal system.

Abstract

Hubungan antara hukum dan masyarakat melahirkan berbagai aliran pemikiran dalam filsafat hukum, salah satunya sosiological jurisprudance. Namun, aliran ini sering disamakan dengan sosiologi hukum meskipun keduanya memiliki dasar keilmuan yang berbeda. Penelitian ini bertujuan mengkaji konsep dan perkembangan sosiological jurisprudance serta menganalisis perbedaannya dengan sosiologi hukum. Penelitian menggunakan metode hukum normatif dengan pendekatan konseptual dan historis yang didukung studi kepustakaan terhadap literatur akademik yang relevan. Hasil penelitian menunjukkan bahwa sosiological jurisprudance berkembang sebagai kritik terhadap formalisme hukum yang memandang hukum secara kaku dan terpisah dari realitas sosial. Pemikiran Eugen Ehrlich tentang living law dan gagasan Roscoe Pound mengenai law as a tool of social engineering menjadi landasan utama aliran ini. Penelitian ini menemukan bahwa perbedaan sosiological jurisprudance dan sosiologi hukum tidak hanya terletak pada arah pendekatan metodologis, tetapi juga pada aspek epistemologis dan ontologis. Sosiological jurisprudance tetap berakar pada ilmu hukum normatif dengan menjadikan realitas sosial sebagai dasar evaluasi dan pembentukan hukum yang responsif, sedangkan sosiologi hukum berakar pada ilmu sosial yang memandang hukum sebagai fenomena empiris. Temuan ini menegaskan bahwa garis demarkasi keduanya terletak pada rumah epistemologis masing-masing yang menentukan orientasi kajian, metode analisis, dan legitimasi keilmuan yang berbeda.

Abstract

Sistem hukum Indonesia menyimpan paradoks yang belum terselesaikan konstitusi mengakui pluralisme normatif, namun praktik hukum nasional masih didominasi epistemologi positivistik warisan kolonial Belanda. Tulisan ini mengkaji bagaimana hegemoni positivisme hukum berdampak terhadap eksistensi hukum adat dan kearifan lokal, sekaligus menawarkan konstruksi sistem hukum nasional berbasis ke-Indonesian yang mengakomodasi pluralisme hukum secara substantif dan berkeadilan. Kajian dilakukan secara yuridis normatif melalui studi kepustakaan dengan pendekatan filsafat hukum dan socio-legal, menggunakan bahan hukum primer berupa UUD 1945, Undang-Undang No. 12 Tahun 2011, Undang-Undang No. 48 Tahun 2009, dan putusan pengadilan terkait hak masyarakat adat, serta bahan hukum sekunder dari literatur akademik dan jurnal ilmiah. Hegemoni positivisme terbukti mereduksi hukum adat menjadi sistem subordinat melalui empat dimensi: legislasi, pendidikan hukum, yudikasi, dan birokrasi, sebagaimana tercermin dalam kasus Nenek Minah dan gugatan masyarakat adat Awyu di Papua. Konstruksi ke-Indonesian yang ditawarkan menempatkan hukum negara, hukum adat, dan hukum Islam sebagai tiga pilar setara dengan bertumpu pada Pancasila sebagai rechtsidee, strong legal pluralism Griffiths, fusion of horizons Gadamer, dan hukum responsif Nonet-Selznick. Reformasi mendesak meliputi rekonstruksi Undang-Undang No. 12 Tahun 2011, pengesahan RUU Masyarakat Adat, penguatan yurisprudensi progresif, dan pembaruan kurikulum hukum nasional. ABSTRACT Indonesia's legal system harbors an unresolved paradox: the constitution acknowledges normative pluralism, yet national legal practice remains dominated by positivistic epistemology inherited from Dutch colonialism. This paper examines how the hegemony of legal positivism affects the existence of customary law and local wisdom, while offering a ke-Indonesian-based national legal system construction that substantively accommodates legal pluralism. The study employs a normative juridical method through library research using legal philosophy and socio-legal approaches, drawing on primary legal materials comprising the 1945 Constitution, Law No. 12 of 2011, Law No. 48 of 2009, and court decisions on indigenous rights, alongside secondary sources from academic literature and scientific journals. Legal positivism hegemony demonstrably reduces customary law to a subordinate system across four dimensions: legislation, legal education, adjudication, and bureaucracy, as reflected in the Nenek Minah case and the Awyu indigenous community lawsuit in Papua. The proposed ke-Indonesian construction places state law, customary law, and Islamic law as three equal pillars grounded in Pancasila as rechtsidee, Griffiths' strong legal pluralism, Gadamer's fusion of horizons, and Nonet-Selznick's responsive law theory. Urgent reforms include reconstruction of Law No. 12 of 2011, enactment of the Indigenous Peoples Bill, strengthening of progressive jurisprudence, and national legal education curriculum reform.
