Abstract

Procurement is one of the important functions of government organizations, one of which is channeling and distributing the state budget through the procurement of government goods/services. Procurement of government goods/services is a fundamental component of good governance. Government procurement of goods/services has the aim of, among other things, obtaining goods/services at prices that can be accounted for with appropriate quantity and quality and timely implementation. The implementation of procurement of goods and services in Indonesia until 2008 still used a conventional procurement system. In carrying out this tender, the interaction between the procurement committee and service providers is carried out directly so that there are many irregularities in the process of procuring goods and services. This type of research uses descriptive qualitative with analytical methods. The causes of irregularities in the procurement of goods and services in Indonesia include: a dominating bureaucratic leadership structure, lack of strong regulations on government procurement of goods/services, the system of government procurement of goods/services not working properly, employee salaries/incentives that are still low, the mental and moral of employees the low, the lack transparency, expensive political campaigns, the existence of political dynasties, big projects, crony interests, weakness order and law enforcement, weak legal profession.

Abstract

Mahkamah Konstitusi berperan sebagai penjaga demokrasi dengan memastikan terlaksananya asas-asas dan norma-norma yang termuat dalam UUD melalui putusan-putusan penting yang dikenal sebagai landmark decision. Salah satu putusan yang menjadi fokus analisis adalah Putusan Mahkamah Konstitusi No. 112/PUU-XX/2022. Putusan ini menimbulkan pro dan kontra yang signifikan di masyarakat dan menjadi sorotan dalam berbagai artikel dan berita. Penelitian ini bertujuan untuk mengevaluasi apakah Putusan No. 112/PUU-XX/2022 layak disebut sebagai landmark decision berdasarkan lima kriteria yang telah ditetapkan. Metode yang digunakan dalam penelitian ini adalah metode kualitatif dengan fokus pada analisis teks dari sumber hukum. Data yang digunakan terdiri dari bahan hukum primer, sekunder, dan tersier. Metode pengumpulan data dilakukan melalui studi kepustakaan (library research), kemudian dianalisis dalam tabel untuk mengidentifikasi apakah putusan tersebut memenuhi kelima kriteria landmark decision. Hasil penelitian menunjukkan bahwa Putusan No. 112/PUU-XX/2022 belum dapat dikategorikan sebagai landmark decision karena hanya memenuhi empat dari lima kriteria. Kriteria ketiga, yang mensyaratkan pembatalan keseluruhan undang-undang, tidak terpenuhi. Dalam amar putusannya, hakim hanya membatalkan pasal yang dimohonkan oleh pemohon, yaitu Pasal 29 huruf (e) dan Pasal 34 Undang-Undang KPK. Hal ini menunjukkan bahwa putusan tersebut tidak memiliki dampak yang cukup luas untuk membatalkan seluruh undang-undang yang bersangkutan, yang merupakan salah satu syarat utama dari landmark decision. Lebih jauh, analisis ini juga mencerminkan pentingnya peran Mahkamah Konstitusi dalam menavigasi isu-isu hukum yang kompleks dan kontroversial. Oleh karena itu, penilaian terhadap sebuah putusan yang dianggap sebagai landmark decision dapat juga dikatakan sebagai bentuk eksaminasi putusan yang merupakan upaya akademik dalam memperkaya keilmuan hukum ketatanegaraan.

Abstract

Emerging concerns in the legal domain are a direct result of the digital age's advancements in the economic sphere. Binary options' rise to prominence is a topic worthy of discussion, particularly with regard to the breadth of asset returns in such instances. Binary option victims are questioning the fairness of the state's claim to assets in light of the recent court ruling in the Indra Kenz and Doni Salmanan case. This research aims to help victims of binary options get their money back through restitution by analyzing the problem and offering remedies. The victims of binary option crimes will have their rights protected; that much is certain. Solutions to the problem of investor asset return can be found by using normative methodologies in the examination of statutes, case studies, and concepts. This study finds that victims of illegal activities can regain their possessions through restitution, which also provides a sense of justice and guarantees legal protection for their rights. People can suffer materially, emotionally, and psychologically as a result of committing a criminal offense. Based on the priorities of legal protection and justice, this research is anticipated to provide a solution for law enforcement in the return of assets for binary option criminal offenses.

Abstract

Mahkamah Konstitusi berdiri untuk membatasi kekuasaan pemerintah dan memberikan akses peradilan tingkat pertama dan akhir kepada masyarakat jika pemerintah dalam mengambil keputusan pembuatan UU bertentangan dengan konstitusi dan norma negara yang sudah berlaku hingga saat ini agar penyelenggaran negara tidak sewenang-wenangnya. Selain itu, berdasarkan putusan No. 48/PUU-IX/2011, Mahkamah Konstitusi diberi wewenang untuk membuat norma dalam UU dari negative legislator menjadi postive legislator. Salah satu putusan yang penting untuk di analisis adalah putusan No. 90/PUU-XXI/2023. Hal tersebut menjadi polemik pro dan kontra dimasyarakat setelah dikeluarkan putusan tersebut sehingga menjadi topik pembahasan utama dalam berbagai jurnal dan berita. Tujuan penelitian ini adalah sebagai bentuk eksaminasi untuk mengetahui apakah putusan No. 90/PUU-XXI/2023 dapat dikatakan sebagai Landmark Decision. Penelitian ini menggunakan metode yuridis normatif. Sumber data diambil dari mengumpulkan dokumen hukum yang digunakan dalam penelitian ini dengan teknik desk study, berupa buku-buku, jurnal, artikel dan peraturan. Metode Pengumpulan data melalui studi kepustakaan dan dianalisis untuk mengetahui lima kriteria landmark decision. Hasil dari penelitian ini menunjukan bahwa putusan No. 90/PUU-XXI/2023 tidak dapat dikatakan sebagai landmark decision karena hanya memenuhi empat kriteria. Pada kriteria ketiga yaitu membatalkan seluruh UU tidak terpenuhi karena dalam putusan pemohon meminta untuk mengubah pasal 169 huruf q No. 7 Tahun 2017

Abstract

The division among the lawyer organizations has led them to claim themselves as the leaders of the organization. This division also affects who has the right to appoint and swear in lawyers. The letter from the Chief Justice of the Supreme Court Number 73/KMA/HK.01/IX/2015 has provided a new direction in the management of the advocate organization in Indonesia. This letter reaffirms the principle of non-intervention by the Supreme Court in internal disputes of the law organization while also strengthening the principle of independence in the legal profession. However, the impact has given rise to various interpretations regarding the structure and regulation of the ideal lawyer organization. This research aims to analyze the impact of the letter on the dynamics of the lawyer organization, both from legal, institutional, and professional aspects. Through a juridical-normative approach and analysis of secondary data, this research identifies the challenges and opportunities faced by advocacy organizations following the issuance of the letter. The research findings indicate that this letter encourages lawyer organizations to be more independent in resolving internal conflicts, but on the other hand, it creates doubts about the mechanisms of oversight and professional accountability. Therefore, it is necessary to strengthen regulations that can bridge the interests of the parties to maintain the integrity of the legal profession in Indonesia.

Abstract

This study analyzes the decision of the Constitutional Court Number 116/PUU-XXI/2023 regarding the parliamentary threshold as landmark decisions. This decision is evaluated whether it meets the criteria as landmark decisions. The purpose of this study is as a form of examination to find out whether the Constitutional Court decision No. 116/PUU-XXI/2023 can be said to be a landmark decision. This research uses a normative juridical method. The legal tools and materials used in this study include official documents related to the Constitutional Court decision Number 116/PUU-XXI/2023, including the text of the Constitutional Court's decision and legal arguments submitted by the parties involved in the dispute. In addition, this research will also refer to laws, constitutions, and other legal documents that are relevant in the context of constitutional law and politics in Indonesia. The data collection method used in this study is a literature study. The results of this study show that the Constitutional Court's decision Number 116/PUU-XXI/2023 cannot be said to be a landmark decision because it only meets three criteria. The first criterion does not contain new legal principles, namely in the judge's ruling stating that article 414 paragraph 1 of the conditional constitution, that the 4% parliamentary threshold remains in effect in the 2024-2029 elections, this means that there is no new legal principle. The new legal principle will apply in the 2029 House of Representatives elections and subsequent elections, as long as changes have been made. In the third criterion, the decision does not invalidate the entire law because in this case the election law is still valid, but the judge declared article 414 paragraph 1 of the constitution conditional.

Abstract

Traditional health services in Indonesia play an important role in maintaining public health, but the increasing cases of malpractice in this practice can endanger patient safety. The main challenges are the lack of supervision and the lack of legality that exacerbate the potential for malpractice. Therefore, strict legal protection is needed to ensure that traditional medicine is safe, effective, and meets standards, as well as to protect patients and traditional health workers. This study uses a normative legal method with a legislative, conceptual, and case study approach. Data were collected through literature studies and analyzed descriptively to understand the legal protection for patients of traditional health services. This study proposes strengthening supervision of traditional health practices through the establishment of a Traditional Health Worker Supervisory Board and non-litigation dispute resolution mechanisms such as mediation or arbitration. In addition, strict law enforcement against malpractice through administrative, civil, and criminal law will increase the accountability of traditional health workers, improve the quality of services, and provide a sense of justice for patients. Thus, it is hoped that a balance will be created between preserving tradition and effective legal protection to create a safe and fair health system in Indonesia.

Abstract

The limitation of regional heads' terms in Indonesia is basically related to two things, the first is to avoid abuse of authority, and the second is to regenerate leadership in the regions, therefore the limitation of the regional heads' terms is very important. This research is normative legal research with a statute approach and a case approach, by analyzing the decisions of the Constitutional Court such as Decision Number 22/PUU-VII/2009, Number 67/PUU-XVIII/2020, and Number 2/PUU-XXI/2023. This study examines how the Constitutional Court interprets the term limits of regional heads, including the calculation of the term of office for regional heads who do not complete their term of office. The results of this study show that the Constitutional Court emphasizes that a term of office that is served for half of the term or more is counted as one full term, both for definitive officials and temporary officials. This interpretation aims to ensure legal certainty and prevent abuse of power, by providing protection for the constitutional rights of citizens who wish to run for re-election. The Constitutional Court's decision also confirms that the norm of term limits for regional heads is in line with the principles of justice, proportionality, and legal certainty guaranteed in the 1945 Constitution. Thus, this term limit is not only served to prevent the dominance of power, but also to encourage the regeneration of healthy leadership in the Indonesian democratic system. The implications of this Constitutional Court decision are very important for the implementation of the 2024 Simultaneous Regional Head Elections, where the KPU and Bawaslu must ensure the consistent implementation of this norm, to ensure the creation of fair, transparent, and quality elections.

Koalisi partai politik dalam sistem presidensial Indonesia berperan penting dalam stabilitas politik dan pembentukan pemerintahan yang efektif. Namun, koalisi yang terbentuk sering kali berlandaskan pragmatisme kekuasaan, bukan kesamaan visi jangka panjang, yang dapat mengancam demokrasi dan melemahkan fungsi oposisi. Penelitian ini bertujuan untuk menelaah implikasi koalisi partai politik terhadap good government dan clean government. Dalam konteks ini, koalisi yang ideal harus didasarkan pada transparansi, akuntabilitas, dan integritas, serta mengutamakan kepentingan rakyat daripada kepentingan elit partai. Penataan koalisi yang tepat dapat menciptakan pemerintahan yang lebih efisien, bersih, dan berfokus pada pelayanan publik. Penelitian ini menggunakan metode hukum normatif dengan analisis kualitatif berdasarkan data sekunder dari bahan hukum, teori, dan pendapat ahli. Hasil penelitian menunjukkan bahwa pembentukan oposisi yang kuat dan transparansi dalam kebijakan koalisi menjadi kunci untuk menjaga demokrasi dan mencegah oligarki politik. Selain itu, perlu dibentuk lembaga independen untuk memantau dan mengevaluasi kebijakan koalisi serta menciptakan dana khusus untuk mendukung program-program koalisi yang berdampak langsung pada rakyat. Penelitian ini menyarankan pembentukan undang-undang khusus yang mengatur mekanisme koalisi untuk memastikan koalisi yang stabil dan bertanggung jawab. Dengan koalisi yang berkomitmen pada prinsip-prinsip good government dan clean government, Indonesia dapat memperkuat demokrasi, meningkatkan kesejahteraan rakyat, dan menciptakan pemerintahan yang adil dan transparan.
