Abstract

Penelitian ini merupakan penelitian lapangan yang bersifat deskriptif, analisis, komparatif dengan menggunakan pola pendekatan sosiologis dan normatif. Penelitian ini menggunakan dua teori yaitu teori jaminan fidusia secara umum dan jaminan menurut Hukum Ekonomi Syariah (HES). Selain itu, peneliti menggunakan dua teori ini untuk menganalisis praktek, konsep, dan mekanisme jaminan fidusia secara umum dan jaminan di dalam HES secara keseluruhan pada perusahaan pembiayaan kendaraan bermotor. Penelitian ini beragumentasi bahwa bentuk dan isi perjanjian pembiayan konsumen dengan jaminan fidusia pada perusahaan pembiayaan umum yang ada di Pontianak Barat merupakan perjanjian standar. Perjanjian pembiayaan tersebut dibuat oleh perusahaan secara tertulis dan disertai materai. Pelaksanaan perjanjian ini berdasarkan hukum perdata terdiri atas dua sumber yaitu asas kebebasan berkontrak dan perundang-undangan di bidang hukum perdata. Peneliti menemukan hambatan-hambatan yang muncul dalam pelaksanaan perjanjian yakni terjadinya penunggakan sehingga mengarah pada terjadinya wanprestasi. Pengalihan kendaraan atau over credit pada pihak lain. Diharapkan nanti, proses pelaksanaan perjanjian antara kreditur dan debitur dapat melakukan perjanjian dan pelaksanaan jaminan fidusia sesuai standar yang terdapat dalam UU No.42 Tahun 1999 dan dalam konsep hukum perjanjian, al-rahn dapat dianalogikan sebagai perjanjian ’accesoir’ atau perjanjian ikutan (tambahan). Sebagai konsep hukum jaminan, al-rahn dapat dianalogikan sebagai lembaga jaminan sebagaimana lembaga jaminan konvensional lain yang juga merupakan perjanjian ’accesoir’, yaitu hak tanggungan, fidusia dan gadai. Konsep tolong menolong tersebut terimplementasi dalam bentuk pinjam meminjam, tolong menolong inilah yang merupakan ciri khas dari konsep al-rahn atau jaminan syariah. Abstract

The main point of this research is that the cost of buying and selling photocopies in the city of Sintang, West Kalimantan.. In this context, "cheap" means "affordable cost", "easy access", "useful", and "alternative options for people to meet needs". This study is a type of legal research that takes a qualitative approach and uses descriptive analysis. At the same time, the data collection procedure uses primary data (field research), such as observations, interviews, and documentation, so that researchers can process them. Books related to research topics and research results in the form of theses, theses, journals, and articles are examples of secondary data (library research). The analysis technique that the researchers use is the editing, classification, verification, and concluding stages. While in the data validity test stage, researchers use triangulation and member-check. The results show that; 1) This book sale and purchase transaction was motivated by a low price and market demand and availability of the photocopied book; 2) There is a form of difficulty in the process of finding original books and is also motivated by the limited economic conditions of consumers/buyers; 3) In the practice of buying and selling this book, there is a change of applicable law. The practice was originally considered haram but is now acceptable for individuals who have difficulty finding the original book; 4) In this study, two laws apply under two conditions, namely, buying photocopies for customers with sufficient and unimpeded funds is haram, while buying photocopies for consumers who have difficulty getting original books and with limited funds is legal. Abstract

This study aims to determine the experience of small traders in Sungai Malaya Village in practicing buying and selling with prize coupons and the responses of religious leaders regarding the law related to the practice. This study uses a qualitative method with empirical legal research as the object of the practice of prize coupons in Sungai Malaya Village, Sungai Malaya District, Kubu Raya Regency. Sources of data used primary data in the form of interviews with informants while secondary data in the form of books, journals, theses, and related articles discussing the sale and purchase of prize coupons. While the data collection technique is a field technique. According to the results of the researcher's analysis, it can be concluded that: 1) The practice of gift coupons packaged in the form of rectangular coupons in the Sungai Malaya Village community, Sungai Ambawang District, Kubu Raya Regency is carried out by withdrawing the available coupons and the seller offering attractive prizes. 2) Religious leaders in Sungai Malaya Village, Sungai Ambawang District, Kubu Raya Regency, regarding the prize coupons did not allow this practice because it favored one party, and there was an element of maisir or gambling. 3) Opinions of religious leaders are based on textual concepts (referring to the Qur'an and hadith) and contextual concepts (chance and pure luck).

Abstract

This research is motivated by the existence of various additional fees in Shopee Pinjam (SPinjam), but with regard to the meaning of this additional fee, several scholars do not agree on the exact meaning of this additional fee. Therefore, the researcher wants to examine the meaning of additional fees in Shopee Pinjam from the perspective of the fatwa of the National Sharia Council-Majelis Ulama Indonesia whether it is contradictory or not. This research employs normative and empirical research methods. The results of this study indicate that: 1) SPinjamm users know the amount of additional fees from the beginning. The additional fees in SPinjam are a 5% installment fee, a 1% disbursement fee, a 0.3% SPinjam protection fee, and a 5% late fee. These additional fees are not a burden to users. The additional fees charged in SPinjam can relieve the lender party and can provide prudence to the borrowers so that they are disciplined and not negligent in paying loans. 2) The additional fees in SPinjam are not among the additional fees prohibited in the fatwa of DSN-MUI because these additional fees are part of the improvement and maintenance of the company's systems and facilities. Moreover, this additional fee in SPinjam is in accordance with the general provisions of Fatwa DSN-MUI No. 117/DSN-MUI/2018 in point 5 of the general provisions and Fatwa DSN-MUI No. 19/DSN-MUI/IV/2001 in point 3 of the general provisions.

Abstract

The purpose of this research is to determine the buying and selling transactions, especially regarding mobile phones, carried out by sellers and buyers on Facebook Pontianak Informasi, considering the discovery of fraud issues therein. This study uses a qualitative method with a normative legal research type. The main data sources include interviews with the admin of Pontianak Informasi, sellers, and buyers. Meanwhile, secondary data used include primary legal materials such as the Fatwa of DSN-MUI No: 75/DSN MUI/VII/2009 and other materials such as books, journals, theses, and articles. The data collection techniques employed are interviews and documentation. Data analysis used a descriptive-qualitative approach through a series of activities including data collection, data reduction, data presentation, and conclusion drawing. The research findings indicate the following: 1) Buying and selling on Facebook Pontianak Informasi serves as a means for the Pontianak community and the surrounding area to carry out transactions with ease and competitive prices compared to other marketplaces. 2) Pontianak Informasi has a buying and selling mechanism through online advertisements and searching for information related to the transaction process. 3) The DSN-MUI Fatwa cannot be used absolutely to judge all transactions that take place on Facebook Pontianak Informasi because not all sellers violate this fatwa.

Abstract

This study aims to determine the factors that cause cancellation of orders between drivers and consumers on the Go-Jek application. Knowing the KHES view on canceling orders between drivers and consumers on the Go-Jek application. The research uses qualitative research methods with the type of field research and normative sociological approach. Data collection techniques used by researchers are observation methods, interviews with sources and documentation. Data analysis researchers do data reduction, data display, and conclusion drawing. Then the data is checked for validity by tringulation of sources. The argument of this research is that the implementation of order cancellation both by consumers and drivers is influenced by legal awareness that is paragmatic, but accommodates the wishes of the parties. This research provides an understanding of several factors that cause the cancellation of orders between drivers and consumers in the Go-Jek application including: 1. From the consumer's point of view: long pick-up time due to weather or vehicle problems, Driver's identity does not match the application, the vehicle number does not match the Driver's account. 2. From the Driver's point of view: the order is too far above 4 km so the cost of gasoline is high, there is a problem with the vehicle. According to KHES, the relationship between consumers and Gojek drivers can be seen as an Ijarah contract. However, KHES prohibits unilateral cancellation unless there are legally justified reasons.

Abstract

This research aims to find out the factors that encourage the Higgs Domino Island (HDI) game to be popular among IAIN students and to find out the views of Islamic Law related to chip buying and selling transactions. This research uses qualitative research methods with the type of field research and normative sociological approach. The data source uses primary data obtained from interviews with IAIN Pontianak students, while secondary data is obtained from various sources, namely book journals and the internet that are relevant to the focus of the research. Data collection techniques were obtained by conducting observations, interviews, and documentation. Data analysis was conducted through data reduction, data display, and conclusion drawing. Then the data is checked for validity by triangulating sources, triangulating data. This research shows that the practice of buying and selling Higgs Domino Island game chips starts from various social media such as Facebook, WA, and various other applications but buyers and sellers can also trade their chips in a direct way such as fellow friends, buyers easily buy their chips. Buying and selling in the online game Higgs Domino Island is the object that is traded which is not materially handed over in the hand, but the object can be utilized and also transferred. The transaction of buying and selling HDI online game chips Ijab and Qabul is clear. Because it is clear that the seller sells something with awareness, and the buyer also buys something that is sold. However, from the point of view of the terms and conditions, the sale and purchase of chips in HDI online games contains elements of maysir, so it is not in accordance with Islamic Law.

Abstract

This study aims to determine the implementation of the musaqah contract in the KHES review of cooperation for the production sharing of rubber plantation maintenance in Galing Village. This research uses qualitative research methods with a type of field research and a normative sociological paradigm approach. The data source uses primary data obtained from interviews with the owners and managers in Galing Village. The people of Galing Village rely heavily on the agricultural sector for economic growth. The agricultural sector is one of the sectors that greatly contributes to the economy in Galing Village. Plantation crops, namely rubber plantations, are one of the agricultural subsectors that can help meet the economic needs of the people of Galing Village. The owner and manager of the rubber plantation in Galing Village collaborate on the production sharing of rubber plantations with an oral agreement and use a musaqah contract. The pattern of profit sharing is based on the initial agreement, namely, using a profit-sharing system based on production results, with as much as 1/3 of the harvest. In the implementation of this profit sharing, there is a default committed by the owner against the manager by reducing the profit sharing for the manager. However, the implementation of this agreement violates the law of musaqah. This is because there is a reduction in profit sharing that is detrimental to the manager. According to Musaqah in the Compilation of Sharia Economic Law regarding the division of plantation yields, there is a violation of Musaqah law.

Abstract

Oil palm plantations represent a strategic sector in Indonesia’s economy and play a vital role in enhancing rural communities’ income. This study aims to examine the legal basis, cooperation model, and terms stipulated in the partnership agreement between PT Papa Agrotama Sawit and Koperasi Unit Desa (Village Unit Cooperative) Mufakat Jaya Mandiri, as well as to analyze its compliance with the principles of Sharia economic law outlined in the Compilation of Sharia Economic Law (KHES). The research employs a descriptive qualitative method with a field-based approach. Data were collected through observation, interviews, and documentation. Primary data were obtained from the cooperative’s treasurer, the company’s plantation manager, and cooperative members, while secondary data were drawn from the partnership agreement and the Compilation of Sharia Economic Law (KHES). Data analysis followed an interactive model involving data reduction, data presentation, and conclusion drawing. Data validity was ensured through source and method triangulation. The findings indicate that the partnership was initiated by the local community’s desire to productively manage customary land. The cooperation model adopted is the nucleus–plasma system, with profit sharing allocated at 63.6% for the company and 36.4% for the cooperative. The agreement’s content aligns with the principles of muzara’ah, musaqah, and mukhabarah contracts as stipulated in the KHES. However, a notable weakness remains regarding the cooperative’s legal status, as it has not yet obtained formal legal entity recognition. Therefore, institutional strengthening of the cooperative is essential to ensure the partnership agreement is valid both under Sharia law and positive (national) law.
