Abstract

Negara hadir untuk memberikan kepastian hak-hak konstitutional warga Negara, tanpa terkecuali hak mendapatkan pendidikan sebagai hak fundamental warga Negara, adapun Indonesia merupakan archipelagic state yang tidak mudah untuk menjangkau antar wilayah, maka pemerintah dan pemerintah Daerah seyogianya memberikan perhatian khusus untuk mewujudkan pemerataan hak warga Negara. Dalam kajian ini penulis menyajikan tulisan deskriptif prespektif pendekatan yuridis normatif peraturan perundang-undangan sebagai konsep untuk memberikan nilai-nilai mengangkat hak konstitusional warga Negara tanpa terkecuali yang tinggal diwilayah perbatasan Negara bahwa warga Negara yang ditegaskan dalam Undang-Undang yang mengatur perihal Hak Asasi Manusia.

Abstract

The decision of the Constitutional Court, which is final and binding, has the meaning that it has been closed to all possibilities for legal remedies thereafter. Consequently, the decision of the Constitutional Court should not be annulled and even ignored. The formulation of the problem raised in this study is, first, What is the meaning of the Constitutional Court's decision which is final and binding? Second, What are the factors that cause problems that occur in the decision of the Constitutional Court which is final and binding? This research is a type of normative legal research, which is an approach carried out based on the main legal material by examining legal theories and laws and regulations related to this research. The results of this study concluded first, the decision of the Constitutional Court is the first and last attempt that has the consequence that no further legal remedies can be taken against the decision, therefore it directly has permanent and binding legal force to be implemented. Second, there are several factors that cause problems that occur in the final decision and bind the Constitutional Court consequently (i) the position of the Constitutional Court only as a negative legislature, (ii) the absence of consequences for the disregard for the decision of the Constitutional Court, (iii) the Constitutional Court does not have an executor unit in charge of guaranteeing the application of the final decision (special enforcement agencies).

Abstract

The State of Indonesia is one of the legal countries where this makes all aspects of life, whether it's actions, behavior, even daily behavior is always related to the law in the eyes of the law, all are proper and equal, there is nothing special, whether it is ordinary people or officials, all are the same in the eyes of the law. which legal eye in making Indonesia need an institution that can enforce law and justice in Indonesia and that institution is the PTUN or what we call the state administrative court, PTUN is one of the judicial institutions under the auspices of the supreme court, as one of the One of the institutions that are trusted by the state to enforce law and justice, the Administrative Court is an institution that has the right to exercise judicial power in the state of Indonesia considering that Indonesia is a state of law as described in the 1945 Constitution, therefore this paper aims to find out the role and function of the Administrative Court as one of the Enforcement agency law and justice in Indonesia.

Abstract

Indonesia is a legal state based on Pancasila with the aim of realizing a safe, prosperous and orderly life order for the nation and state as the legal position of citizens in society is guaranteed. The state is a power organization (political organization) led by a centralized government whose task is to defend the state, maintain public order and prosper all citizens. In its implementation, there are often disputes and disputes between the State Administration Agency and Officials and the citizens of the community. The dispute is resolved through the State Administrative Court. This paper discusses about the proving procedure in state administrative disputes. Because, as it is known that a very important problem in the law of proof is the problem of the burden of proof. The distribution of the burden of proof must be carried out fairly and impartially, because a one-sided distribution of the burden of proof means that a priori the party who accepts the burden that is too heavy falls into the abyss of defeat. Meanwhile, proving or providing evidence is by using certain evidence to provide a level of certainty that is in accordance with reasoning about the existence of the facts (laws) in dispute. It is stipulated in article 100 paragraph (1) of Law N0. 5 of 1986 concerning the State Administrative Court in the form of letters or writings, expert statements, witness statements, confessions of the parties and knowledge of judges.

Abstract

One of the most important agendas of demands for reform and democracy is the establishment of an Indonesian constitutional system based on the notion of people's sovereignty and a rule of law (rechstaat). Therefore, in the context of strengthening the legal system which is expected to be able to bring the Indonesian people to achieve their aspired statehood goals, the amendment to the 1945 Constitution is a strategic step that must be carried out carefully by the Indonesian nation. Talking about the legal system is of course inseparable from the issue of legal politics, because it is legal politics that determines the legal system as desired. Changes in the constitutional system that occurred resulted in changes in the political, cultural and legal systems in Indonesia. Therefore, the younger generation must become agents of change in the life of the state constitutionally by taking part in the dynamics of the constitutionality of the nation and state. To foster a culture of constitutional awareness, it is necessary to understand the basic values and norms which are the material content of the constitution. Thus, the idea of establishing a Constitutional Court is an effort aimed at the correct administration of power and state administration in accordance with the basic law or constitution. The Constitutional Court is one of the state institutions that has the authority to exercise independent judicial power to administer justice, is responsible for managing its own organization, personnel, administration, finances, and can further regulate matters necessary for the smooth implementation of its duties and authorities.

Abstract

The constitutional court is one of the judicial power institutions that has the authority to try cases and also resolve cases from the first level to the last level, in exercising judicial power a decision if it has been issued by the constitutional court then the decision is final and also binding in the sense of the word if a the decision has been issued by the constitutional court, the decision is no longer legal, that's why the law gives four powers to the constitutional court to become one of the institutions that can uphold the law and also justice in Indonesia and the four authorities are: 1) examine the 1945 Constitution 2) decide on a dispute over authority between state institutions whose authority has been granted by the state based on the 1945 Constitution 3) decide on the dissolution of political parties 4) decide on disputes over election results.

Abstract

Permasalahan Pelaksanaan Putusan PTUN Sebagai negara demokrasi, sistem ketatanegaraan Indonesia membagi lembaga legislatif, eksekutif, dan yudikatif menjadi tiga cabang untuk melaksanakan prinsip checks and balances. Peradilan dikendalikan oleh lembaga peradilan yang mempunyai kekuasaan memberikan perlindungan dan kepastian hukum. Hukum administrasi negara sebagai lembaga antara lembaga di bidang administrasi dan anggota masyarakat. Penelitian ini menggunakan penelitian hukum normatif, metode analisis deskriptif dan metode kualitatif. Berkaitan dengan pelaksanaan putusan pengadilan, terdapat permasalahan sistemik dalam pelaksanaan hukum acara. Putusan hakim PTUN melayangkan mosi membatalkan pelaksanaan Tata Usaha Negara (KTUN), menyelesaikan perkara dengan denda, mengeluarkan sanksi administratif dan memutuskan memasang pemberitahuan di jejaring sosial. . Masih terdapat berbagai kendala pelaksanaan putusan hakim PTUN, karena pelaksanaan putusan diserahkan kepada pejabat TUN. Beberapa isu yang diangkat tidak diatur secara jelas dan tidak ada batasan hukum yang jelas

Abstract

Penyelenggaraan Pemerintahan Republik Indonesia harus berdasarkan asas penentuan nasib sendiri oleh masyarakat dan asas negara hukum berdasarkan asas tersebut, sehingga segala keputusan dan tindakan pejabat administrasi harus menghormati dan menghormati kedaulatan warga negara. Pengaturan mandiri keputusan pemerintah adalah ujian apakah setiap individu yang terkena dampak diperlakukan ramah silikon dengan bantuan aturan dan regulasi. Negara dan pembangunan harus didasarkan pada produk hukum, produk standar ini berupa hukum administrasi negara, hukum perjanjian administrasi negara berarti unsur penting berasal dari negara dengan budaya hukum yang sangat maju, terutama ketika keputusan negara dibuat oleh negara. penguasa atau pejabat dapat di hadapan pengadilan tata usaha negara yang dikendalikan. Artinya, nilai-nilai ideal asal negara, aturan kekuasaan negara harus selalu berpihak pada warganya, bukan pada warga negara. dan sebaliknya.

Abstract

The objective to be achieved in this study is to Review, know andanalyze the logical ratio of Article 21 paragraph (1) of Law No. 30 of 2014 on Government Administration, which authorizes the State Administrative judiciary to test the elements of abuse of authority and implications of ptun authority in testing abuse of authority against the enforcement of corruption crimes. The method used in this study is Normative legal research with legal material tracing techniques conducted with Pustaka studies. The results of the research with the above method show that the logical ratio of Article 21of Law No. 30 of 2014 on Government Administration is Supervision by the State Administrative Court as a means of preventing abuse of authority in decisions and /or actions (discretion) by government administration officials carrying out service duties and legal implications that can arise from the authority of the State Administrative Court to test whether or not abuse of authority related to corruption crimes is that the Authority of state administrative judiciary carries implications in the enforcement process of corruption crimes.
